PhilippinesPhilippine passport - change of name

Hi everyone! I need your opinion. I will be visiting the Philippines by October to attend my brother's wedding. I entered US with a K1 visa. However, I have not made a change of name in my Philippine passport so it is still under my maiden name. All of my legal ID's and documents here in the US are under my married name though.

Question #1:
If I book a ticket, should I use my maiden name since my passport is still unchanged?

Question #2:
They say I will just need to bring my marriage certificate so that when I come back, the US immigration can verify along with my green card and passport. Will it cause delay or problem at the airport coming back?

Question #3:
I am in the process of renewing my Removal of Conditions since I entered US with a K1. I have received a letter of extension valid for one year until May 2013. Will this cause delay or problem too?

Anyway, anyone of you who have similar experiences please share it here. At least I can make decisions and won't waste time, money, and effort. Thank you!

Re garding yr queries, yr flight ticket must match yr passport or y will be refused when going through immigration. Carry yr marriage cert and y shld be fine to re- enter the usa. Immigration officers might question you but u can explain yr situation. Iam afraid that i cannot reply question3.

I got my Naturalization cert last week . The cert has listed me divorced at my Interview and on my n400 I listed my husband as spouse and that I am married .I sent the form to them the n-565 but did not enclose a check any advice appreciatted :-) I am also petitioning for my spouse sent the I-130 in April when I was a LPR and sent them a copy of my Naturalization ceretificate .

Can I just ask you a quick question about your Packet 3. Do you have to fill out the Financial Affadavit of Support or not? I know that people say that you do not for Casablanca, but some people do anyways...I am leaving the country for 2 months and so I want to get all the necessary forms filled out before I go, but also, I don't want to do that complicated finance form if it really isn't necessary.

Any help with this would be great!

Hi,

We are really praying for all of you to get quick NOA2s...I have a quick concern maybe someone can help me with. We were approved on 7/21 and I know for sure our case was at the NVC by 7/25 because I called and they confirmed. As of 7/29 we got another notice saying it was still there....and I just called again and our case is still at the NVC, it has been two weeks now! I am really worried, even though the lady said there was explicitly no problem, she said we should call back at the end of the month!

That seems unreasonable! I am really depressed about this, because even though we got our NOA2, our case is nothing until it is at the Consulate! Can anyone tell me why this might be? Why is it being held up?

Yay! Congrats! So....just for those of us monitoring, that's seven weeks between when the case was received by the embassy and your interview date...that seems about average for Casa. And it's 9 weeks between the NOA2 and Casa interview....good to know, hopefully our NOA2 will come quickly and easily!

Hey all! I have a weird question -- I want to see if this has happened to any of you

I just got a call on my cell phone (my permanent number) from a 301 area code, saying it was the Casablanca consulate, (maybe it was, it just wasn't a Moroccan number, of course I am sure the Embassy can arrange that sort of thing) and the woman said that my fiancé's visa had been approved! I was obviously so excited. They said that he would be getting a call from them in the next day or two!! That is super fast! I was just wondering if this had happened to any of you, especially those who had to go through AP, (his interview was yesterday!) because I was a tiny bit suspicious that this was actually part of the AP process....but I called Simo up instantly anyways, and told him the good news!


I mean, nothings certain till the visa is in the passport and the passport is in hand, but this is good news nonetheless!

Has this happened to any of you?

Hi everyone,
I couldn't bear to read about everyone's interviews and fiance/es finally coming because we were stalled waiting for the interview (6 weeks wait time)...so I just avoided the whole site! But...I'm back because things are finally rolling again...

Simo had his interview today (finally!!!) I figured out that the Casablanca consulate pretty much closed down for all of Ramadan (the whole month of September) and so even though I am soooo frustrated that we had to wait an extra month to get to this point, I know that it is all worth it, and we have been so strong supporting each other. He said it went really well, things out of Casablanca have not been good recently, so many reports of rude COs and rejections for no reason, but Simo says his interview went really smoothly -- the lady said no need for evidence or financial support or anything, just wanted to know where Simo had traveled, how we met, where I lived in Morocco, what I was doing now. That's it!

She said it "wouldn't be long" which is great! Of course being Moroccan, we have to go through mandatory AP -- but it seems like the good kind, where all is asked is just a little time. Let's hope its really a little time, not a lot!

So, we are thinking, the next week or two he should get the visa, and a week or two after that, boarding the plane! I am so excited, and adjusting well, I'm in my first year of PhD program, so balancing the multiple stresses is hard...but luckily I have a whole week off for Thanskgiving, so we are thinking that is when we will do the quick courthouse wedding/honeymoon and just get Simo settled in.

I can't wait. I know we have been so lucky, as I was living in Morocco for so long that it really hasn't been THAT long since we've seen each other, but this whole process just seems to drag on and on...boo!

Ok, just wanted to let you all know that things are going well for us! And I can't wait to go through the whole EAD/AOS process with you all! You have been so supportive!

I just came back from Cuba. When I go I fly to Miami and use Marazul for my charter. They can provide you with everything you need. There is a woman there named Yanni who is absolutely fantastic.

The other charter flight given in a previous post I have heard of and seen when checking in at the airport but never used. The lines for the company however are smaller but I do not know of costs.

Marazul costs are around 400- 450 round trip. I do not know if you can book a 90 day stay but you can change your flight for only 25 us dollars.

Try calling around.

Best of luck I know the consulate in DC was closed while I was in Cuba but heard they are now open again until Feb 17th 2014. I guess I need to get my visa in order for my next trip before they close. ;-0

Do you know if this document cost money? Also if he needs to request his birth certificate do you know how long that takes? Sorry for the questions. I speak to my finance only once every two weeks due to costs on both our ends and computers are limited in cuba.

What is the document that needs his original signature?

There is also a form that needs to be filled out online by him and a photo uploaded. Im concerned about this and not sure he will be able to upload a photo of himself on a computer.

All these stupid documents needed are driving me nuts. It would be simple if Cubans could actually just come to america and stay like most other countries..

my luck to to love someone from a country with restrictions to it.

Hello! My fiancé is in Cuba and he JUST went to the embassy last week to pick up packet 3. They instructed him to fill out the DS-160 which is an online form. Someone in Havana with a computer and internet helped him fill it out. Where he lives he doesn't have access to either of these. Then he got a paper with a list of all the things he needs to take with him to the interview:

DS-160
Affidavit of support
Copy of his passport page that has his picture (front and back)
2 Visa style photographs
2 passport style photographs
Birth certificate
Certificate of marriage status (certifies that he is single)
Criminal record
Medical exam results
A fee of $240 CUC to cover the visa
Evidence of our genuine relationship

Also, the medical exam is $405

I called the embassy about 2 days ago and they told me that they hadn't received some documents yet for him, so I should call back to schedule the interview in about a week.

I'd love to know when you called for the interview and when it was given to you. I don't know anyone that has ever done this with Cuba before so any info anyone can give me helps. I appreciate it!

When you say certificate of marriage.. what if the cuban is not nor has never been married? What is an acceptable document for that?

Also since you recently went through this did you have to fill out only one DS-160 or did you have to fill out all the others that I have seen posted not only here but other sites as well.. exampe ds-156, ds-157 and so no so forth...

Who has told you it is pointless to marry in Cuba unless you plan to live there? I have never heard of this from my friends or other people on here. I know someone who married his girlfriend who is Cuban and he lives here.. he has applied for the spouse visa to bring her here. He said it was a pretty simple process for him.

As for your fiancee returning to Cuba each time because he doesn't want to lose his status.. What if he stayed here in the states for the year and one day and then received his greencard and become a perm resid.. Are you saying he is not allowed to go back to Cuba ever if he did do that?

zetete is correct- to get married in cuba cost an arm and you are looking at at least $1000.00 just for the paper work and the marriage. This does not include your trip or the filing for the visa.. you have two things to consider here though.. do you want him here faster or do you want to be sure he gets here?

K-1 visa for fiancee they seem to be rejecting people in cuba lately

the CR- visa you are already married less paper work maybe more time apart but more of a chance for him to get here.

K-1 could be denied then you would have to turn around and start the process all over again (after getting married).

its your call.

 

I keep hearing on here the K-3 Visa is non existant.. for those that can answer this please explain to me why it is still on the USCIS site???

It states you can apply for the K-3 while you are waiting for the CR-130 to be processed for you to have your spouse with you while you wait.

Sara is correct- I just read this online that the consular service in DC is renewing passports but you have to be traveling back to cuba in order for them to do it.

I guess if you go through marazul you can book a flight for July have them renew the passport and once it is renewed cancel the flight if you are actually not going back to Cuba at that time.

You would lose out on your deposit but you would have an updated passport.. Not positive though they might hold off on giving you a new passport until you actually fly out..

But hey its something to look into.. Hopefully they will find a bank soon and resume services in DC for all of us that need their services. I know I do..

Maybe you can try calling the interest section in Havana? Or even Canada see if they can renew it even if it is for someone in the US. I know my friend who resides here had a 3 year visa to return back home to Cuba but has since expired and is now stuck here until they open back up.. He can't even go through another country back to Cuba.. Not sure why but the laws for Cuba alone confuse me..

Maybe there is a way to mail it to Cuba by DHL?

I wonder the same thing.. lol How does one answer why you chose to marry in US vs. Cuba? My reality is.. because it is cheaper and a shorter process. I guess that's simple enough and hope it works for an answer.

 

Second though why live in US vs Cuba.. well ###### I dont know maybe because life is better in the US with more opportunities.

 

I don't think it will offend anyone since it is the US Consulate and not the Cuba consulate. But then again who knows.

oh this frightens me. I am waiting till after my fiancee's tourist interview this month on the 20th to see if he is approved to visit here before I file for a visa. We might end up getting married while he is here visiting and then I would apply for the spouse visa vs. the fiancee visa..

We do not talk but maybe 2-3 times a month and emails are few and far between due to the lack of internet in Cuba..

We also have a laguage barrier when apart. When together we understand one another lol but over the phone ha not a chance.

Im fearing we will get denied due to all this but I have everything needed photos, phone records, emails, boarding passes, passport stamps, his family and friends.

I hope that everything works out for you and they get back to you soon with an approval!! Keep us posted and GOOD LUCK

If they are not working on the case why would it update? How do you know for sure they are going to let the case expire? Is this happened to you or do you know of other stories like this that you can link?

So does that mean if they give someone their passport back after the interview and tell them it needs to be processed further (AP) that it is actually a denial?

AP is an extended review of a petition.. Additional Processing I wouls assume not sure the correct lingo..

Meaning they are taking a deeper look at your petition.

But there are alot of people who are put into AP status after the interview and there is nothing you can do but wait..

Sometimes it takes days, weeks, months and I have even read on here up to a year.. I wish you luck and hope you can reach someone who can help you figure out what is going on with your case.

When filling out these type of forms for Visa's and such do we need to include the person we are sponsering in the household size? They are not living with me yet so I would think, not to include them. Is this correct?? I mean why include them if they are not yet here and also it would make the income requirements go up for a larger household size?? I wouldn't fill out another form. If you are making more this year then just have the woman write a new letter stating last year you worked such and such amount of hours and was paid XYZ and this year she has you working more hours (amount of hours) which will continue and you are now making more money. I don't see it being a problem if someone is making more than what they claimed for last year taxes. People get raises all the time or pick up more hours.

 

But as the other person stated if the employment job description doesn't match that might raise a flag and you would be better off just filling out a new form. I'm not an expert but I'd rather have all my ducks in a row not to get another RFE. Good lukc

K-3 Spouse Visa Process & Proceduresk-3 visa

Would a K3 visa be faster than a K1 Visa to be processed and approved? I haven't filed for the K1 yet and just found this site. I see the k1 for the most part takes anywhere from 8 months to a year. Very few cases were shorter but I have not seen the time frame for a k3 process.

Also which would be easier (less paper work and hassle).

I am really confused by people posting on this site the K3 is no longer used.

When you go to the USCIS website it clearly states this is still a valid VISA process however it is not to petition a spouse to be approved to live here but for use of requesting your spouse to be in the US while you wait for your CR1 to be processed and approved.

Is this not correct?
