K-1 Fiance(e) Visa Process & Proceduresmisdemeanor -129F

I think you also need to make sure when you get a copy from the courthouse their stamp is on it. I have a DUI conviction and what I have is a copy of the arrest record notes from the police officer, I also have the court outcome with all the fee's that were applied and showing paid. I think that also needs to be provided but double check that part. I also sent in a letter explaing the conviction and the outcome- fee's what I was charged with my probation and all that good stuff.

Shouldn't be a problem if you tell the truth and provide all the documents for the charges.

Once you go through the application it will ask you to upload the photo.. Here is a site that will help you with getting the right photo and size on your computer once you save it and it asks for you to upload the photo you use the photo you saved from this program.. It was pretty simple and it worked for me..

K-1 Fiance(e) Visa Process & ProceduresDivorce Paper - Do they need to be notarized/translated?

thanks Liz :goofy:

sucks because I don't have his originals and that means I will have to go back to cuba to get them since there is no way to mail things.. ughh this whole process is tiresome and I haven't even started. I get stressed out listening to everyone elses stories.

I should have just taken all his documents when I was there he already had 2 of everything. bummer

K-1 Fiance(e) Visa Process & ProceduresDivorce Paper - Do they need to be notarized/translated?

I have a question in connection to the thread.. What if my fiancee was divorced and I only have a copy of his divorce papers? It is a photo copy he made for me to bring back to the states for when I file. Do I need his original copy?

I understand that it will need to be translated into english and notarized when done. Would this be enough or again do I need his original copies?

I also thought that you are not suppose to send in anything original?? Only take them to the interview?? The only original thing that should be send it are papers he would need to sign like the biometrics and any letters he has hand written?

K-1 Fiance(e) Visa Process & ProceduresI-129F Children of my Fiance

what if she doesn't list them?

I have the same issue and since they are not going to come then why list them? Who would ever know?

I read a post on here from another person who had a Cuban fiancee. They listed his child on the form and it caused a huge delay, extra documents and headache. It delayed the process and I can't remember the end result but I do remember reading it and thinking to myself.. uh oh I don't want to put his kid on the form.

K-1 Fiance(e) Visa Process & Proceduresreally important advice needed....

You can search public records to find the case and status of it. If they threw your fingerprints away whatever that means then I'd say it is not on your record nor will it show up. If you were under 18 it is probably cleared from your record so you would answer no.

I would try to call the county where it happened and ask them to search their database see what they come up with and if you are not in their system you would have nothing to worry about. If you are in the system then you were arrested and would need to be honest at the interview.

If you are in their system you would have gone to court and been found guilty or not guilty. If not guilty then your record would be clean and you would answer no when asked if you have a criminal record.

IR-1 / CR-1 Spouse Visa Process & ProceduresUS citizen to marry a UK citizen in UK but now what? Please help

Either the story is false or there is more to it. US Law does NOT require a special visa to get married. Hundreds to thousands of destination marriages are performed in the USA every day.

So, let's DROP this story.

LOL thanks for clearing that up.

IR-1 / CR-1 Spouse Visa Process & ProceduresNever required to file Federal Taxes
Ok so I went to the law office and they filed my taxes for me. They filed me jointly with my wife. I explained my situation to them, that she has a job and goes to university in her country. They asked me if my wife lives here I said no; they asked me if she has any US income I said no. The 1040EZ has her as my spouse, but it has her occupation as a House Wife. Just want to know if this is any issue since in her G-325A form I have her as employed?

As for Bona fide marital relationship my evidence:
1. Bank Statement from our bank back home
2. DD form 1172-2 Application card/DEERs Enrollment. (Naming her as my spouse/dependent) health insurance
3. AF form 899 Request and Authorization for Permanent Change of Station - Military (aka PCS Orders) naming her my spouse/dependent
4. Affidavit from my Step-father(School teacher) and Best friend(Engineer)
5. Photos displaying over our 2 year relationship. inclusive of family and friends. last year we took a trip to a Caribbean island, have photos from that, with a copy of the passport stamps.
6. she is on my life insurance as the sole benefactor

this should be enough to show that our relationship is bona fide right?

Is that possible?... I've only been living in he US 9 months. Can i file taxes even though i was not here for 3 years ? Back home i was a full time student, never worked. I was wondering if i wrote a letter stating my circumstances. Is tax used as proof of income? Can my LES be used as proof of my income and future income? what are the ways to prove income. i have so many questions

IR-1 / CR-1 Spouse Visa Process & ProceduresNever required to file Federal Taxes
I've recently moved to the US (June 23 2012). I worked 2 part time jobs in New York for 2 months. Went back home for a month in October to marry my sweetheart. I entered the air force 4th Dec. 2012, Currently in Tech school and should be headed to Andrews AFB MD. My situation is when it comes time for the affidavit of support I have no tax or very little to show. Visited my law office and they said that i will get back the tax from the 2 jobs cuz i didnt make the minimum required amount. what can i use to so USCIS that i now make enough money to sponsor my wife? I researched and found that active duty member are only require to make 100% of the poverty line which (if i'm correct) is $15,130 for 2 member household - My pay gross (base pay + BAH + BAS)will be over that at around $36000/yr. What can i use to prove my income? would i need an official letter stating what i make a year? Should i use a joint sponsor to be safe (My step-dad is willing to help me)
thank you very much
I love my wife with all my being and I am a bit paranoid that something can go wrong with immigration.

K-1 Fiance(e) Visa Case Filing and Progress ReportsNOA 2 in just 37 days!! go VSC! =)

This gives me hope that not every employee in VSC has turned into a zombie during the apocalypse in Vermont.

Congratulations :)

I wonder if they misplaced all of November. One NOA2 in early-Nov among k-1 VJ members. Two NOA2 for mid-Dec among K-1 VJ members. Maybe there is a huge snow drift that is preventing them from accessing any Nov/early-Dec applications. I am about to look at the status of all of the first K-1 Visa's received each day from about mid-Oct to mid-Nov. I'll let everyone know the percentage I find among those. Maybe the Mid-Dec ones were from a new hire who grabbed the wrong box. They've been a couple days away from working on mine since before Christmas according to VJ's timeline.

BTW- congrats to everyone who has recently received an NOA2.

K-1 Fiance(e) Visa Case Filing and Progress ReportsWhat can we do while waiting for the NOA2?

I heard 3-4 months. I work for a 3 letter acronym but we don't have a hand in foreign policy:) I was hoping that maybe USCIS would just take a look at the investigation that was done through OPM and call it a day..but I'm thinking that was wishful thinking! omg, I pray I don't have to wait for one agency to contact another and wait for a reply:( Maybe this would be a little easier if he could get a visa to visit the US..instead of me having to make the trip each time. Ok enough of the pity party:) Good luck with the process:)

Thanks, and good luck to you. Hopefully I will know soon whether or not it's true. I'll let you know if it takes longer or not.

K-1 Fiance(e) Visa Case Filing and Progress ReportsWhat can we do while waiting for the NOA2?

Hi, i see you are a federal employee too. I have heard that the investigation will take longer d/t this status. what have you heard?

I haven't heard anything like that, but I haven't heard much of anything. How much longer have you heard it takes?

It would make sense for those that work with Department of State, DHS, or other 3 letter acronyms, especially those that create foreign policy. It wouldn't look proper for those people to have a spouse with close ties to a foreign Gov. So they may need to make sure that the spouse does not have a relationship with anyone who works for a foreign Gov. But that decision should be the responsibility of the agency that employs them. So the extra time may be to allow the employer to be notified and provide a response.

K-1 Fiance(e) Visa Case Filing and Progress ReportsWhat can we do while waiting for the NOA2?

the I-134 will take some time (well sometimes) so get that started. You'll need a letter from your employer, letters from your bank(s), tax statements etc. Getting that stuff mailed can take a little time, better than waiting.

Hope that helps :)

What do these letters from the bank/employer need to include? As a Federal Employee, I receive SF-50s when there is an action to my file. Currently I have 18 SF-50s over the past 3 years. It includes my SSN, DOB, location of where I work, pay, job title, service date, and it's electronically signed by HR at OPM. Has anyone used an SF-50 for the I134?

K-1 Fiance(e) Visa Case Filing and Progress Reports3 approvals this past week

I agree, I have to believe that VisaJourney represents only a portion of the total filings. I would like to know what that percentage is.

I think that on average the VSC receives about 100 I-129F's per day. On VJ there are about 3-5 I-129Fs per day. So i think it's safe to say VJ represents 3-5% of USCIS wrt I-129Fs. However, I see no reason why CSC touches more VJ member cases than VSC. VSC on average approves more I-129Fs per month than CSC.
T and JMaleThailand2010-02-15 00:21:00
K-1 Fiance(e) Visa Case Filing and Progress Reportsk-1 VISA, went to found out if any changes on our petition

The light should start getting bigger and brighter somewhere near the end of March, so you're almost there. :star:

Current average is in the 120-days range (source) . Create a VJ timeline to get a better estimate and so it is easier to help if needed.

The VJ timeline is very slippery. For the past 2 months, every week it keeps on slipping a week for me.
20% of the cases from Oct 15 are still in initial Review.
68% of the cases from Oct 27 are still in Initial review.
74% of the cases from Nov 3 are still in Initial review.
90% of the cases from Nov 13 are still in Initial Review.

So be prepared to wait a couple more months, it's likely going to be awhile.

K-1 Fiance(e) Visa Case Filing and Progress ReportsVSC Processing as of 12/31/09

:star: For several months now, the USCIS website has been saying that the normal processing time for I-129F is five months. Yet, if you take a look at specific cases, you'd surely notice that some get approved in 48 days or 89 days either in VSC or CSC.

Just keep your fingers crossed that your approval soon comes.

The way that the USCIS determines the processing time is rather stupid and it does not tell you anything. Here's how they do it. They look at the current pending applications and then they begin to subtract the amount that they have received, month by month starting at the current month. If they get to 0 within 5 months, then they say the processing time is 5 months. If they have to go beyond 5 months then they say that they have a backlog. It has nothing to do with a waiting time. It's just a ratio between pending cases and received cases. Basically take the pending cases and divide by the average number they receive per month. That number is what they determine is the processing time. It really does not tell you anything about how long it takes the average person to wait. Just ignore that 5 months that USCIS says. It means absolutely nothing.

Congratulations, good luck with the interview.

I guess I better start printing out emails, chat log sessions and preparing my I-134. I am not expecting it to be as quick as yours was processed.

The Thai embassy is super fast right now. My fiancee mailed packet 3 on the 23rd of March and her interview is on the 29th of March. We are rushing to get a few things done right now. She still has MSN chat logs to print out, and her medical is on Friday. Other than that everything else is complete.

PS- She still has yet to receive Packet 3 in the mail.

Thanks for the info T, but the problem is, I'm not employed yet lol. I know I can drive it with my international driving license, but just for 3 month from my arrival to the US. It's just that I can't put it in my name until I get my US license ...

You can register it in your name without a South Carolina drivers license. I looked at the form to register a vehicle in SC and the form says, "If
the primary owner has not obtained a South Carolina customer number or driver’s license number, enter the primary owner’s
social security number." Basically if someone moves to America alone, they need to purchase a car to use to take the drivers test to get their drivers license.

You don't need a US Drivers license to drive in America. In most states you can drive using your French drivers license for up to 1 year. South Carolina allows 5 years...

"(6) A citizen of a foreign jurisdiction whose licensing procedure is at least as strict as South Carolina's, as determined by the Department of Motor Vehicles, who is at least eighteen years of age, who is employed in South Carolina, and who has a valid driver's license issued by that jurisdiction may drive in this State for five years if the foreign jurisdiction provides a reciprocal arrangement for South Carolina residents. The provisions of this item also shall apply to the dependents of foreign nationals who qualify under this section."

So go ahead and have fun driving your car around.

agree... what I didn't know before I moved here is that Washington is almost as humid in the summer as FL. Have to find a good beach this wknd.

It has been extremely hot here. Possibly the hottest June ever since they started keeping records, but most of the time I have to live without AC. Jum turns purple when I have the AC on. The only nice beaches around here are in Maryland, New Jersey, and Long Island, NY. All are between 3-6 hours away.

Buying clothes for a female - unsupervised? Mr T - you are one hell of a brave man. It is a road most men fear to tread. The risks involved are immense, and include getting an earbashing for:-

a) getting the size too big "so, you think I'm fat?"
b) getting the size too small "are you trying to tell me I need to lose weight?"
c) buying an expensive item "you could have got that half price in the sale, that's a total waste of money"
d) buying a bargain "is that all I'm worth, a cheap, nasty sale item?"
e) getting the style wrong "do you want me to dress like your mother/prostitute?"

The item is then kept in a bag at the back of wardrobe only to be brought out when wife's female friends visit where they cackle like witches and there are screams of "OMG! - he bought you that?" "what was he thinking?" "he can never be trusted again".

Hope none of the above happens on this occasion!

I'm not afraid. She loves my sense of style. Here is what I bought...
Attached File  Jum shirt.jpg   79.43KB   5 downloads
Attached File  Jum dress.jpg   46.86KB   5 downloads

Anyways, if she ever said anything like that to me, there would be a huge argument. Here is what I would say...
a) No, I don't 'think' you are.
b) If I wasn't then, I am now.
c) You think $5 is expensive?
d) With that attitude, yes!
e) It's better than how you have been dressing yourself lately.

:D

PS - In the past I have bought bra's for her as well. So I have no fear.

PPS - Jum also works for a fashion company. They always compliment her there when she wears the close I buy for her. My sense of style in impeccable.

I had a question about the I-134 Q7.Since John is still unemployed he has left Q7 blank. Is leaving something blank fine?
And regarding Q11,my fiance has ticked on 'I do intend' and our co-sponsor on 'I do not intend'.Will the separate answers be an issue?
Am I getting worked up over nothing major?

Do not leave a question blank. Put some answer. If it's none, but none. If it's 0 put 0. If it not applicable, put N/A. Always answer every single question, otherwise it will cause problems.

For Q11 I did not check any box and I put N/A and explained it is a K-1 visa and she intends to live here as an immigrant. I forget the exact wording I used.

Grrr! I hope everything shapes up fine on his end and you get that ol' P4 very soon (this week, darnit!!)

They were pretty guarded about telling him when, I guess (as is to be expected) but he seems confident that he'll get it by the weekend, for reasons that aren't entirely clear to me (we could only talk for a few moments after the interview, since he doesn't have his phone card and we had to cell it up for $1.59/min). I suggested we wait before he buys the ticket, though, just to play it safe. We haven't hit any huge bumps yet (knock on wood!) and I don't want this to be the thing that causes one...

Congratulations. I wonder why all if these Consulates are sooooo different. In Bangkok they gave Jum a date and time to pick up her visa as soon as her interview was complete. They were like, congratulation you gave been approved. Be here 2 days later at 3PM to pick up your visa.

Actually it's more than just a stamp. At least in Bangkok, they add a page that looks like the picture page of your passport. The visa has your picture, name, DOB, validity, etc.

I'm starting to get irrationally nervous about Ewan's interview... I know in my rational brain that it's going to be fine and easy, but my female brain is all worried and going crazy. It's causing me to do things like lock my keys in the lab and burn my dinner. This nonsense needs to be over with so I can be sane again!

It's not your female brain that is the problem. I had the same problem, it is the brain of the sponsor. The hardest part is waiting on the day of the interview. Did you try cleaning? That seemed to help me pass the time. There wasn't a piece of furniture that wasn't moved. That and also Bejeweled Blitz.

Well I just bought Jum's wedding ring. My day is slowly getting closer. 40 more days alone and then I will be with Jum for the rest of our lives. Unfortunately the wedding itself got postponed 1 month until July so that her sister could be here for it.

This question is for those who are considering buying tickets in the very near future.
I read somewhere on vj that it is 'less' expensive to buy round trip tickets than one-way tickets,I mean,is that true?

And if at all that is,will that be a problem at the POE if they see somehow see that you have a return ticket?

I think this is not a problem, just wanted to know y'all's opinions.

Anwesha

Jum's one way ticket is cheaper than a roundtrip, but not by much. It's $1400 for roundtrip and $1200 for 1 way.

Will anyone at the POE know you have a roundtrip ticket?

Hey guys! Just got in, but wanted to let you all know as soon as possible: I AM IN THE US!!!!!!! Puppy was a hero and survived the cargohold!

POE was a breeze - when I got in, there were hundreds of people in the foreign citizens line, so I asked a guy in uniform if I could go with the US citizens. I gave him a very sad look and told him about my puppy in cargo and he let me :)

There were no question whatsoever, just about the dogfood I had on me - because of that I had a twenty minute wait in secondary customs. Otherwise, really no problem at all.

Now I am just waiting for my baby to come home on Sunday and we'll be reunited :) :) I am ridiculously (however you spell that) happy!!!!!!!

I called DoS today. The only thing they have is that French consulate sent me the P3 on March 12.
Then, she said that they are waiting for the Affedative of Support. I was like :"huh? on the P3 it said I have to show it at the interview". So she said, :"oh ok". o.O
So they have no sign bout me returning the P3, and no interview date for me for me.

Oh well, I guess VSC has a french cousin, the stupid french consulate >.<

This is what sucks about every embassy having different rules. The embassy in Thailand is very well organized will a very well written P3 (the I134 was an original document that needed to be returned with the P3). I wish everyone could have had the same experience I did. Well I am bored. I have nothing to do anymore, so I will start getting ready to give knuckle sandwiches to the Embassies in Paris, London, Mumbai, New Zealand, and other places that I seem to have forgotten. However, I think that might cause a delay in their processing, but it will be a fun time had by all.
Anyways it looks like a June wedding for me. I was hoping to get married on 8/9/10, but I want to get Jum on my Medical Insurance. So I will marry Jum in June.

Good luck to everyone who is still waiting.

i just sent my embassy an email yesterday is they have my package from nvc yet.havent got my p3 at all .still waiting for it

The day that Jum was approved for her visa is the day that her P3 arrived in the mail. So there is a chance that the embassy will tell you that they mailed your P3 last week.
