Penny, is seems as if you have a lawyer, maybe you should be following his direction, but one of the things that we here in the JA forum do is try to give those who goinfgthru the process the correct information. I trust your lawyer, just had an interview at the Kingston embassy to make such a statement. MrsTee, gave you the latest information on how to obtain this form in a previous post, andf only those who have gone thru the Jamaican embassy can answer if it is need or not.

While I thought long and hard about searching the embassies reviews to prove to you that the information that fellow JA poster had given you were correct, I proceed to do just that. I will post their review and you can decide how you wish to proceed with this factual information.

Review Topic: K1 Visa

Arrival
We arrived to the Embassy around 8:15 am for our 8:30 appointment. We approached a long line at the front of the embassy and was greeted by a consulate officer. She checked our paperwork and highlighted the areas where corrections needed to be made. She then asked us to go to the front of the line and show the security officer our paperwork. We then entered the building and had to go through the medal detectors. They do not allow cell phones, so the only items we had with us were keys and paperwork. I would also suggest that you bring a pen because we had to borrow one on several occassions.


Entering the Main Building
After we made it through the medal detectors we had to stand in line for the main entrance. There were applicants for visitor and other types of visas sitting on both sides. They were allowing about 5 people into the building at a time. We had to step out of the line to make the corrections to our paperwork, however, we were allowed to get back in place after this was complete. After we entered the building, we stood in a line to give the consulate officers our DS forms and in return we received a number. We were then asked to enter the building and sit on the right side.

Part 1
After about 20 minutes our number appeared and we approached the window. We were asked for his birth certificate, non-impediment, police certificate, and his paasport. The Jamaican officer was very rude and it was very difficult to understand what she was saying. She was asking for my 2008 paperwork, but I wasn't sure exactly what she wanted. I had bank statements, employment letter, etc. so I wasn't quite sure what she wanted. She got so frustrated that we didn't understand her that she made us stand to the side for over 10 minutes while she helped someone else. As we were standing to the side, my fiance eventually translated what she was asking for. We stood patiently and she eventually called us back to the window. I then provided her with the I-134 form, employment letter and 2008 W-2s and tax returns. She then asked us to go to Window 17 for fingerprinting.

Part 2
After fingerprinting, we returned back to the right side to wait to be called back for the interview. During our wait, we saw over 5 people receive blue slips. We could not totally understand everything, but most of the blue slips were for family-related visas and they seeemed to be due to a lack of paperwork. After our friends, Eric and Jew made it through their interview with an approval, we felt a little more optimistic. We were eventually called to the window by the blonde officer. She looked through our paperwork and asked the following questions:
1.) When did we meet?
2.) How did we meet?
3.) How many times had I visited?
4.) When did I know I wanted to marry him?
5.) Have I met his family?
6.) Has he met my family?
7.) What was my occupation?

She never divided us up and all of the questions were asked as we both stood at the window. She then looked through our pictures that were provided in original application and asked if they were all from the same visit. We told her no and indicated that they were from my visits in June and August. She then handed my pictures to me because she said that we may not see them again. She then told us that he was approved and told us to go to the DHL window. She also told us that we had 90 days to get married upon his arrival to the US. We thanked her and he went to the DHL counter to setup shipping arrangements.

just to add.. i came here on a i-94 visa. and i did file complaints as well as a restraining order on my soon to be ex husband. but this was back on 04-05. dont know if that helps anything.

my brother and sister got their green card 4-5 years ago through marriage (after the 2001 date) without having to leave. and my parents got theirs about a year or 2 ago. i tried to get mine when i married a citizen 6-7 years ago but he would not file my papers due to the fact he thought i would leave him once he did. but he used to abuse me physically and mentally which is why i ended up leaving. just this divorce has been years in the making and will soon be finalized. from the information searching ive done, everyone has told me that i need to wait till i was divorced before i could file for anything.



If you had filed while you were married, then you would have been able to adjust your status on the bases that you were married to a USC. Now, you have no bases to AOS your status against, unless it is against your parents or siblings. To AOS against parents or sibling you will have to interview in your home country. If you leave you will receive a 10 year ban.

Again, who is the everyone that you obtained advice from? Maybe they have some more information to give this type of advice against, that you have not posted here on VJ. So, I can not say if their advice was false or not. But based on what you have given here, you only have the 2 options available to you.

Mikey78, you can file separate if you are being filed as a dependent on someone else's taxes. So if you have been filed as a dependent on someone else taxes, then you could show the tax transcript for that individual who filed for you as a dependent.



Correction, You can file seperate, but you will not be entitled to the dependent deduction, so you would be like you are just doing paper-work.

What if the uncle is filing with his dad as a dependent? If you are being declared as dependent on someone else's tax return does that mean that you don't have to file for the year when you are being dependent? And in case USCIS asks for tax returns for that year, would you have to show tax return where you were claimed as dependent?

Good to hear that the lawyer was still alive and able to assist. But please remember what "Richa" stated, having a GC doesn't automatically enable your MOM to be eligible to become a citizen. This mishap may alter her plans, so Good luck to you MOM going forward. :innocent:

You mean under the LIFE act of 2001 right? There was no act after 9/11. In fact the only push was for all undocumented from certain countries to come forward and be registered.

No, I would NOT leave it blank, or indicate n/a, b/c n/a is the wrong answer. If she doesn't know the exact day, but month and year, I would atleast put that. If they want more than she will get a RFE for it. That will then take you back to the lawyer. Why not start out with contacting the lawyer, unless he isn deceased :crying: :crying:

First, do you really mean Citizenship or is she filing to Adjust Status to Legal Permanent Resident? She can't go for Citizenship without first being a Legal Permanent Resident.

Second, if she entered illegally then she can't adjust status except for a few scenarios such as Asylum or VAWA. In fact entering with false documents or someone else's documents is immigration fraud which can result in here being deported and banned from re-entry.



The mother probably cleared her illegal status after 9/11, when there was that big push and forgiveness for all illegal immigrates to come forward and become legal.

She did complete an adjustment of status and didnt hide the fact that she eneterd the country illegally. She does have a green card and she is a lawful permanent resident.



Did a lawyer help her? he would have copies of her case file.

When your mom obtained her GC, wasn't all of this documented? Is this paper work still available? It seems that if this information was disclosed on the GC application, she would have gone through a more detailed/extensive process for her GC, so there should be documents somewhere that she could obtain this correct information.

i.e lawyer, she would have been required to file a waiver.

This is an improper use of the DV visa. If the family has no intend to migrate, they should release their acceptance of the DV so it can be given to the next available qualify person.

Its better to apply for Re-Entry permit, Form I-131. Usually, your GC is safe if you return within 1 year, but having the re-entry permit allows you upto 2 years to return. Also it ensures that you did not intend to abandon your permanent residency status.



But they cannot apply for re-entry permit if they are all ready outside of the US.

You an establish that with the parents naturalization cert an applying for a US passport for the children. The children must be listed as part of the parent citizenship appliation.
