I am in the process of sending out my documents. When I realized that my marriage certificate has all my middle names and I only carry one on all my documents (ssn, passport, etc). Should I include my other names on the I-130 that reflects on my marriage certificate?

Another thing is my step mother filed for me decades ago to migrate to the US, my mothers name was in the SSA system as my mother but somewhere along the line it changed to my step mothers name, but I am putting my birth mother on all the documents to send in. Will this pose a problem?

These two things stopped me in my tracks this morning from mailing my package out. HELPPP!!!!1

1. when you'll get your interview date, you can try to request an earlier date, but since you are the one pregnant(USC) they probably won't honor your request.

2. Interview dates are usually 2 months after approval at NVC.

3. babies comes when they are ready, saying that if he has an mid sept date for Interview, he could be in the states by the end of Sept.

My husband was brought to the United States from Mexico when he was 2 years old. When he was 19 he got into a fight and ended up being charged
with assault with a deadly weapon other then a firearm and burglary. He served a year in county jail and was deported to Mexico in August 2008. We got married before he was deported and I filed an I-130. In July 2008 we got the approval notice. After that nothing was done since the whole deportation happened. I have spoken to a few attorneys and we have to file waivers for the 2 felonies on his record. We have a 3 year old daughter and we are all living in Mexico to keep our family together. I'm wondering if continuing the process is even worth the money or if he will just be rejected. Does anyone have any experience with this or any advice for us? Thank you.

Before you proceed with this , please speak to a lawyer, there have been cases as recently that an IVF/ART baby has had an problem in getting a passport to be able to enter the US.

The question I have is what will be her chances of getting the next green card, the permanent green card.. if we do get divorce, it is true I do not want a divorce and want to work everything out with her,, I ask my question just in case we do get a divorce. Now, you could have divorced then he would have to prove he entered the marriage in good faith. But since you'll are still living as man and wife, he doesn't have to prove much, much less that he is in love with his wife. It sucks, but that is the way of the land.

Again, what I mean, sometimes it takes more than one year for USCIS to approve/deny the case. I'm talking about difficult situation when not GK but extention letter expired already.



Again, GC expired, extension letter expired, you would go into the immigration office and get an extension in your passport. But, you don't have a passport that is valid so they have nothing to stamp. Where do you want them to stamp it, on your extension letter. That will not be possible, either you will have to apply for a new passport or hope for the best that you will not have the need for immediate evidence that you are legally in the US.

A wise man would chose that path that would give him the best and safest result. It's up to you. Pay a dollar now, or holler later.

I am sorry, I didn't make it clear - I don't care about travelling abroad at the moment (have no money and have lots of problems to take care of). My passport expired and I am not going to renew it for a time being. All all need is the proof that I'm legal in USA if I have no valid passport and my extension letter expired. I've heard in this case they can give you paper with your picture and the stamp. I know that I gonna stay legal in they still process my case, but I need a proof of that so i don't have problems with jobs / travelling within the USA.



Your expired Green Card along with your extension letter is all the proof you need to show that you are legally here in the US.

Your GC has your photo on it. Your passport no longer have a valid visa that would show that you are here legally, so it would not be of much use to you.

BTW, all govt agencies have PC's on their desk, so to get a handwritten note would make this request out of the norm.

Why can't the father sign the form, he is a LPR. Maybe the father and son need to go in for counseling, should the son be given the right to continue his residence as a LPR.

You are laready on the hook for the 864, from the 2year conditional GC. So the only way you will be off of the hook for the 864, would be that the son leaves the US or loses his GC status.

The ROC NOA arrives about 2 weeks after receipt of ROC application, the biometric is about a week later. The bio-metric date maybe a problem,but if your center allows walk-in then you should attempt to proceed to do an early walk-in. Do not leave or try to enter the country without the NOA and a completed biometric if the GC has expired.

I'm a bit confused as to why she would need a court order to change her name back. Her former name will always be legal so she can always use it. If she chooses to use her husband's name that is also legal. Also not understanding why some people are taking this personally. There are tons of people who don't adopt the husband's last name for any number of reasons. We're not back in the last century you know.



Kirk, she can go around and call herself whatever name she chooses, but for a name change on a legal government document, she will need to have a court document showing that she has reverted back to legally being called Mrs.XYZ.

This is correct last name doesn't matter to USCIS, the OP will needs to understand that her hubsand wanted to do things the American way, because he felt it would make their life easier. She can call herself whatever she wish to be called. But making changes to US documents will now be a little harder to do.

Once you changed your last name it is now harder to change it back. To make this change in the US, you will now have to go thru the courts, by filing a legal document to make a request to have your maiden name back.

There is no law in the US that states once you are married that you are required to use your husband last name. But once you make that change on official government documents, you will be required to have an official document to make the change back on some. The problems you may encounter is some may make the change without legal documents showing you are now Mrs.Maiden name,while others may not. You do not want to be carrying documents around in two different last name. This will make cause for concern.

generally the NOA is received within 2 weeks, then about 2 weeks later you receives the bio letter. The issue maybe when your appt date is for the bio. Some centers allow walkin, other states you must apppear on the appt date.

You are incorrect, if the bio is not done they will cancel the NOA1 extension. You should check your facts before you continue to always wanting to judge my comments. Now if the OP wants to follow your directions that is on them, but if they are stuck outside of the US because they didn't do their bio, I hope they have your phone number to call to tell the POE why they didn't do it.

You should be ok to travel with your expired green card and NOA extension letter. Do not leave before you have extension letter in hand! Must bring the original, not copy.
