Have your husband to follow-up on this. Most states require you to send updated paper work in every 6 months. Check with the caseworker on this. If her policy is cancel, you'll will have to re-apply and it will take time to have it re-install. That will mean she will not have this extra coverage for a period of time.

Some people here are heartless and cruel. Yes i have explained why she cannot be in the us alone and i bet those giving advices for me to let my baby go are people that do not have a child. I am all for those people that have serious reasons for expedite go ahead and file. It is not my fault that others have to wait. I wish this was easier on everyone. I have been thru hell and back and i am not going to let anyone tell me i dont have valid reasons. Why dont you ship you baby to the us alone for months and have a nanny care for her ? I really don't think most people care about your expedite, what they do care about is if things don't work out the way you'll wants it to, don't blame the US government for the welfare of your child.

You have chooses.

No one wants to see a mother seperated from their child, but understand that it's you'll the parents who are making the decisions concerning this child lack of better meducal care, not USCVIS, NVC or the US government.

Are the people suggesting that she sends her six month old baby to the US without her parents?? As a mother (and yes I do have a sick child myself) I would be beside myself if I was seperated from my young baby indefinitely and even more so if she was sick and possibly having to under go medical proceedures! I'm not dismissing all the advice etc but I think it is cruel to tell a mother of young baby to suck it up and send your kid off by herself! The child is not in immediate danger in her country but would benefit from the better care in the US. I wouldn't part with my infant either. Have a heart people

This baby is voimting blood, so I don't know what you consider immediate care. The father is in the US, and he isn't by -side of the baby in Brazil. Either way this child right now is only residing with one parent.

To answer the question about the health insurance coverge overseas. There maybe benefits for coverage overseas, but the member must pay up front to the hospital then submitt the bills to the Health Insurance company to be reimburse. If they have a straight HMo policy, then their benefits would probably be very limited as to what is covered out of network. The only coverage out of network might be medical emergency only. The husband NEEDS to call his health Insurance company to inquire about what benefits the family has.
Just my comment on how Insurance works.

Can you expedite if your spouse is in danger?

It isn't gang related and how will it follow him to the US if this person probably has no way of going to the US himself? And we have gone to the police and they said that they can't prove anything so they can't do anything about it. And I am doing something I'm asking for advice on here what else can I do, go and make the dude write and sign a paper that he's threatening my husband?

Okay, then how can you expect the US government to expidite your case base on your statements alone? They will need documentation.......

Can't offer anything else, if it not documented, then nothing can be done.

I'm in Brasil where the cops dont do S#!t...because that guy that killed my father in law is still walking around la di da he's not hiding and no one is after him....this isn't the US I have realized things are different here. And the threats aren't written they are said so I don't even know what to do

(If) these threat are real, what makes you'll think these same threat won't reach him here in the US. If this is some sort of gang related issue, this won't go-away one he reaches US soil. Have a polie report been filed in Brazil? If not, why haven't your husband filed one, it doesn't matter if you'll feel the authorities won't do anything. It sounds as if you'll are not doing anything about it too. The US govt will be looking for some type of action on your husband part on trying to protet himself.

Go file a Police report.

aaron, I have seen people obtain work visas, H2b'as well H1b visas while they are waiting on their 130 to be completed. Since I don't know exactly where in the que the 130 is, no one can say it impossible. They can only try.

Problem with paying fee

If the bank acct is still open, then the check are good. Print your name on the top of the checks yourself. All that is required is that the checks are drawn on a US bank. Nothing is said about how pretty or profesional the checks should look like.

Expidite on the phone

my mother in law in usa called USCIS and she request for expidite after 5.5 months from NOA1
they gave her reciepet number start in TIF
but it couldent found on their website

First, the MIL can't request an expidite unless it's her case. Now, did the MIL give false information to the USCIS operator. Who's case is the MIL calling on, is it her daughter case? Is the daughter the petitioner?

All of above is correct, but what they really wants is proof that will show that your husband was invovled with his daughter durning her childhood years. They will be requesting the DNA in addition to all of this.

Head of household, sounds fine, but it is me (the non USC) who claimed them on our Euro taxes. Would that make a difference?

And who is that qualifying person they're talking about?

You- non USC
Partner of children -USC
Children- USC

Partner Cannot claim married because you'll are not married
Partner can file single or head of household
Does the Partner have income?
If claiming the children then the children are the qualifting persons

Please help I read somewhere on the websites that u can have a maximum of two co sponsor for one applicant so if I had two co sponsors that made 20,000 each both with one child will I be ok

How Long To Wait To Cancel an I-130

An approved 130 never has an expired date, so why cancel. Just don't finish up the NVC portion until you are ready. There is nothing for you'll to do at this time unless there is false information on the 130 that you'll do not wish for USCIS to use for an approval.

Leave that to the US to decide...We both know it was real and she isn't all gaga about it,unfortunately it did not work out as planned(I am not first victim in this case and won't be the last we could have patched and manage the marriage to my 10yrs if we wanted it fraudulent)....She went off track and left me stranded(apologized though hurt considering we both have put some much in this.) and I found someone who picked me up.We get the divorce we remain friends and I get married to my new found love...Don't mind how long the process is going to take and can't be bothered as long as am with the woman I'm happy and in love with.How does that sound in your ears?

BTW, getting the visa is not the finally call, If you obtain a divorce before it is time to ROC, you must ROC immediately after the divorce.
