Okay, you are the Beneficiary (hint Benef means one who benefit from)

Yes, you told your wife before filling the I130, SO WHAT WAS THE GAME PLAN ON THIS INFORMATION?

Where you just held or were you arrested, since this was in your country, most on VJ will not be able to answer unless you tell us.

The correction is Medicaid. If your daughter is not presently in the US, this policy maybe come obseloute soon.

cancel soon.

Have your husband to follow-up on this. Most states require you to send updated paper work in every 6 months. Check with the caseworker on this. If her policy is cancel, you'll will have to re-apply and it will take time to have it re-install. That will mean she will not have this extra coverage for a period of time.

Some people here are heartless and cruel. Yes i have explained why she cannot be in the us alone and i bet those giving advices for me to let my baby go are people that do not have a child. I am all for those people that have serious reasons for expedite go ahead and file. It is not my fault that others have to wait. I wish this was easier on everyone. I have been thru hell and back and i am not going to let anyone tell me i dont have valid reasons. Why dont you ship you baby to the us alone for months and have a nanny care for her ? Lets see how you feel.
ALSO I AM GOING TO REPEAT AGAIN I DID NOT ASK WHAT PEOPLe THINK ABOUT MY EXPEDITE

I really don't think most people care about your expedite, what they do care about is if things don't work out the way you'll wants it to, don't blame the US government for the welfare of your child.

You have chooses.

No one wants to see a mother seperated from their child, but understand that it's you'll the parents who are making the decisions concerning this child lack of better meducal care, not USCVIS, NVC or the US government.

Are the people suggesting that she sends her six month old baby to the US without her parents?? As a mother (and yes I do have a sick child myself) I would be beside myself if I was seperated from my young baby indefinitely and even more so if she was sick and possibly having to under go medical proceedures! I'm not dismissing all the advice etc but I think it is cruel to tell a mother of young baby to suck it up and send your kid off by herself! The child is not in immediate danger in her country but would benefit from the better care in the US. I wouldn't part with my infant either. Have a heart people

This baby is voimting blood, so I don't know what you consider immediate care. The father is in the US, and he isn't by -side of the baby in Brazil. Either way this child right now is only residing with one parent.

Yeah i cant tell you how our insurance is. Lol but i know that even some tests she had done where not covered 100%.

Your husband needs to talk to his Insurance company about his baby condition, and seek their assistance in this tomorrow.

To answer the question about the health insurance coverge overseas. There maybe benefits for coverage overseas, but the member must pay up front to the hospital then submitt the bills to the Health Insurance company to be reimburse. If they have a straight HMo policy, then their benefits would probably be very limited as to what is covered out of network. The only coverage out of network might be medical emergency only. The husband NEEDS to call his health Insurance company to inquire about what benefits the family has.
Just my comment on how Insurance works.

IR-1 / CR-1 Spouse Visa Process & ProceduresCan you expedite if your spouse is in danger?

It isn't gang related and how will it follow him to the US if this person probably has no way of going to the US himself? And we have gone to the police and they said that they can't prove anything so they can't do anything about it. And I am doing something I'm asking for advice on here what else can I do, go and make the dude write and sign a paper that he's threatening my husband?

Okay, then how can you expect the US government to expidite your case base on your statements alone? They will need documentation.......

Can't offer anything else, if it not documented, then nothing can be done.

IR-1 / CR-1 Spouse Visa Process & ProceduresCan you expedite if your spouse is in danger?

I'm in Brasil where the cops dont do S#!t...because that guy that killed my father in law is still walking around la di da he's not hiding and no one is after him....this isn't the US I have realized things are different here. And the threats aren't written they are said so I don't even know what to do :crying:

(If) these threat are real, what makes you'll think these same threat won't reach him here in the US. If this is some sort of gang related issue, this won't go-away one he reaches US soil. Have a polie report been filed in Brazil? If not, why haven't your husband filed one, it doesn't matter if you'll feel the authorities won't do anything. It sounds as if you'll are not doing anything about it too. The US govt will be looking for some type of action on your husband part on trying to protet himself.

Go file a Police report.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 sent, can apllicant also apply for work visa?

It will be impossible for her to get a work visa to come to the US and wait out her CR-1 visa.

It takes months to obtain a work visa. Also, an employer will need to sponsor her for a job. The employer has to show no US resident is qualified or available for the job by obtaining a Depr. of Labor certification. The US does not simply allow foreign workers into the US to take jobs that can go to an unemployed US resident.

It will be extremely improbable that your wife can obtain a work visa before the CR-1 visa interview.

If the bank acct is still open, then the check are good. Print your name on the top of the checks yourself. All that is required is that the checks are drawn on a US bank. Nothing is said about how pretty or profesional the checks should look like.

First, the MIL can't request an expidite unless it's her case. Now, did the MIL give false information to the USCIS operator. Who's case is the MIL calling on, is it her daughter case? Is the daughter the petitioner?

IR-1 / CR-1 Spouse Visa Process & Proceduresquestion
You are correct, the new wavier program has not been activated yet.

I-601 Provisional Waiver Is Not in Effect http://www.uscis.gov...000082ca60aRCRD

USCIS is considering changes that would allow certain immediate relatives (the spouse, children or parents of a U.S. citizen) who can demonstrate extreme hardship to a U.S. citizen spouse or parent to receive a provisional waiver of the unlawful presence bars before leaving the United States.

These procedures are not in effect and will not be available to potential applicants until USCIS publishes a final rule in the Federal Register specifying the effective date. USCIS plans to publish a notice of proposed rulemaking in the coming months and will consider all comments received as part of that process before publishing a final rule.
Do not send an application requesting a provisional waiver at this time. USCIS will reject any application requesting this new process and we will return the application package and any related fees to the applicant. USCIS cannot accept applications until a final rule is issued and the process change becomes effective.
Be aware that some unauthorized practitioners of immigration law may wrongly claim they can currently file a provisional waiver application (Form I-601) for you. These same individuals may ask you to pay them to file such forms although the process is not yet in place. Please avoid such scams. USCIS wants you to learn the facts about protecting yourself and your family against scammers by visiting uscis.gov/avoidscams.

If you already have an immigrant visa interview with the U.S. Department of State, we strongly encourage you to attend. The Department of State may cancel your immigrant visa registration if you fail to appear at this interview.

The truth, your non-contact since 1996 and then only to be united in February 2011 then married June 2011, will not be enough to prove that your marriage was not entered into for immigration purpose.

Leave that to the US to decide...We both know it was real and she isn't all gaga about it,unfortunately it did not work out as planned(I am not first victim in this case and won't be the last we could have patched and manage the marriage to my 10yrs if we wanted it fraudulent)....She went off track and left me stranded(apologized though hurt considering we both have put some much in this.) and I found someone who picked me up.We get the divorce we remain friends and I get married to my new found love...Don't mind how long the process is going to take and can't be bothered as long as am with the woman I'm happy and in love with. How does that sound in your ears?

You proceed with a petition to uunite a family, when you knew going to the interview that the family had already started the process of dissolving. Your wife has asked you for a DIVORCE. BTW, getting the visa is not the finally call, If you obtain a divorce before it is time to ROC, you must ROC immediately after the divorce.

SO, do you think the US would believe that your marriage was a legit marriage if you are divorce as sooon as you land upon US soil.

It's not illegal for a non U.S. citizen or resident to travel to Cuba, so it won't pose a problem for him now. You can get a license to travel to Cuba as a U.S. citizen or resident, if you travel with an authorized operator. It's not technically illegal to travel to Cuba without one, but it is illegal to spend any money there (which makes it practically illegal).

Cuba doesn't stamp passports of U.S. citizen visitors, they only issue tourist cards.

IT is only illegal to spend US dollars, she can convert her money to pesos or any other forgein curreny and spend it there.
