You are already at a 2 month window if you are at NVC now, I don't see much time being shaved off from the NVC to embassy interview, but if a couple of weeks makes a difference then nothing will be lost if you don't try.

Again, you will be dealing with the Jamaican embassy. So good luck.

Why do a USC need a VISA? The USC must prove proof of domicile, not the immigrate in doing DCF.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 Form

Line 21 does not specify address in U.S., I used my wife's address in China on my I-130, technically you have lived together ( at your parents home) the line does not ask whether you own the residence or not, they are asking at what address you lived together at. When he visits, you and him live together at your parent's address. If you need evidence have your parent's prepare an affidavit stating he stays there when he visits.

The correct answer is none, b/c you stayed in the same building during a visit doesn't consitute as living together. Please read the document and interrupt it correctly.

I was addressing the OP regarding her situation, I did not say that the question asked her if she ever lived in the US. I was giving the OP an example for her situation.

I did say which question I am answering but to be more specific its question 21 from section c.

The correct answer is "none". If you have never lived in the US, then it's none. N/A would mean the question didn't apply to you, but the question does apply.

I totally disagree with all, since she has not stated what question she is trying to answer, n/a or none could be interchangable. What question on the i-130 are you trying to answer? BTW the example form under the GUIDE tab gives great instructions and examples.

'Hey Guys,
Quick Question- im trying to fill out my I-130 form as you can see i haven't reached anywhere.

if hubby and i haven't lived together what should i put n/a or none.

we just got married and he went back to work. i live in ja and he lives state side. What should i put?

If the question is "if hubby and I haven't lived together what should I put" I don't see a question that ask this on the 130 form, so i am confuse.

If you can't afford your existing household bills, how does adding another person to support help explain financial hardship. Your wife could be without a job for a year or more in this encomony, you yourself just gave support to the fact the the job market in your area was in a decline with your own job hours being cut.

In saying this "nothing beats a failure if you don't try"

That is all's well. but sometimes GOD ask us to do some of the work ourselves. If there was an issue with the DOB in the orginal passport, why didn't you correct it then. Mistakes left unattended, tends to follow us for life. God can't un-do the past.

Good luck, I hope it's only a small issue and they will issue you a visa.

ohhh !!! sorry i mean: her dad's insurance not her mom's one
so, does she can use her dad's one untill she finish her school this year and start to work ?
or she can't use it for the fact we got married ? even though i live in in Quatar right now for work far than her... what can she do ?
thanks guys

It's not my place to tell her or her Dad to lie about her marital status. If he lies and his insurance policy company finds out, he will have to deal with the consequencies.

She would only be covered under her Mom's insurance if she was single and up to the age of 26. Why did you'll get married if you'll wasn't ready to accept grown-up responsibilities.

To answer the other part of your question, married is married regardless where you were married at. All of this should have been discussed before the I do's.

IR-1 / CR-1 Spouse Visa Process & Proceduresmarriage license or marriage certificate?

The United States Embassy in Kingston or immigration will need the marriage certificate on security paper issued by the Registrar General's Department. The document given to you by the minister is not a certificate but a copy of the marriage register. Apply to the Registrar General's Department for the marriage certificate

I think I said this in my post, the Poster is married therefore she/he will need the cert copy at the NVC stage, way before anything gets to the Kingston Embassy. USCIS will/has accepted copies of the marriage cert that is given by the minister after marriage.

I want to know the difference between marriage certificate and certified marriage certificate. What is certified marriage certificate for? I submitted a copy of my marriage certificat with the I-130 form yesterday.
Do I need to submit certified marriage certificate later at some point? Thanks!

Easily defined, the certified one has a saeal on it. Most marriage cert's that are obtained on the day of the wedding, do not have the seal. The cert marriage certifiations are obtained a couple of days after the marriage from the apprioprate govt agency after the marriaged has been registered with the approved govt. agency.

It needs to be a copy of the marriage CERTIFICATE that has the official seal on it.

You can file with USCIS using the long form marriage cert that the minister gave to you, when your case is at NVC, you can then send in the certified marriage cert then.

IR-1 / CR-1 Spouse Visa Process & ProceduresUse wife's email account to send email for DS-3032

Hi guys,

I have a question about sending email for DS-3032:

My wife want me to use her email account to send email for DS-3032, i.e. "choice of agent". If I do that then I have to log in from USA and send that email to NVC. My question: is it ok or legal to do that? has anyone did that? Does NVC care about that even though my wife give me full permission to use her email account.
Please help. Thanks.

NVC doesn't care, use the wife's email account.

Because i have not registered for classes in the soring. Yes we are here to seek treatment but instead of getting better she is worse. She is on a special formula that is not found here, her reflux medicine is not found here. We had to change her whole treatment and she lost already 3 lb in two weeks because she refuses to eat, breaks put in rashes. I dont think i need to justify why i tried a different treatment for my daughter. It did not work. Period. I feel like you are trying to attack me and i dont owe you any explanation.

Thank you for your help. I guess uscis was able to help me when i called this morning and if the letters i have from drs they said i should be able to expedite.

You don't owe me or anyone an explanation, but you do owe us the truth when you are asking for advise, so we can give you the best answers possible.

I am new here and need some help.
I have been living in the US since september 2005 when i went as an au pair did that for two years got into college and was with an F-1 visa until I married my husband in may 2011. I had complications with my pregnancy and our baby was born july 2011 with some health issues and a lot of hospital stays so I did not send my papers in.

Now december my daughter was addmited again and my mother was really sick so i had to leave the US with my daughter in the hopes of getting a second opinion and help with her issue.

IR-1 / CR-1 Spouse Visa Process & ProceduresMarried in the USA,had baby and had to leave before applying to GC

assumption - I-130 not submitted yet.

ON THE TOP OF THE I-130 pile, you put in a letter, requesting the expedite. Use 2 or 3 paperclips to keep it at the top of the pile. Then, on the outside of the mailing packet - write it big red letters -

EXPEDITE I-130, USCitizen daughter is ill.

---
IMO/E, this is the fastest way to get the expedite done. Don't wait to ask for it after the I-130 is filed, as there's a different queue altogether.

Good Luck !

Will need supporting evidence, again Darrell is making a big assumption.

You made a rash decision without thinking about all of the issues involved and ran back to Brazil. Now that you have had time to calm down, you what to rush back to the US. Again, you haven't thought out this process. You keep leaving out the main fiqure out of the onversation, the USC.

Yes

Since this is the end of the fall semster, the Univ, probably have sent in their information on non-register students. You had 30 days to leave or change status if you are not registered for classes. Your OOS(out of status) status would have started the 1st of Nov.

Your USC husband needs to get started on the 130 petition. BTW, there seems to be more to this story, but un-neessary for what you needs to do. A petition needs to be filed for a spouse visa.

Good luck.

First, let get the time table straight, the complete process can take up to 9 months, the 5 months is only the time frame for the petition to be approves. The entire process from beginning to end can take from 9 to 12 months.

IR-1 / CR-1 Spouse Visa Process & ProceduresMarried in the USA,had baby and had to leave before applying to GC
You and your USC husband should hav contacted an immigration lawyer. It seems as if the USC is missing out of this picture, you keep addressing conerns around your mother. Your child is a USC and should have a US passsport, your child can return to the US at any time if she/he needs medical care. There is nothing in stopping the USC parent from having the child in his care to assist with providing medical care.

Again, the USC seems to be missing from your conversation/post. It was up to the USC and you to find out how your non-immigratiion status would be affected if you left. The USC drop the ball on this, not the phone rep at USIC.

You knew how to obtain an aun pair and a student visa, so there was some kind of understaning about immigration visas on your part.

Once you get that chip off of your shoulder, you can call/email the embassy once you have one interview date and ask that the other petition interview date be set at the same time. It is a simple request.

There is nothing unique about your situation, a polite request will settle it.

Good luck
