I've had a talk with my lady and although we don't like it we are going to wait. I wanted to be able to bring her here but that seems like hitting ur head on a rock. So I guess instead of making two trips I'll have to make three. I say three coz I'm thinking I'll have to be at the interview for the CR-1. If I'm wrong plz somebody let me know.



First, lets take one step at a time, make the first trip and then move on from there. The consular no longer allows the USC to be in on the interview unless they have requested their present, it could turn into a 4 trip relationship.

On a side note, getting married doesn't guarantee that a visa will be issued, if the consular DONOT belive that the marriage is a true marriage. It is not us here on VJ that you will have to convince it will be the JA consular.

Getting married on a 1st visit, will send up a red flag for the consular in JA.

That is not what they are saying i will quote the letter,
Dear,
we regret to inform you that we are unable to process your application for an immigrant or fiance visa. section 221g of the immigration and nationlity act prohibits a cousular officer from issuing a visa to an alien if the cousular officer has reason to believe that the alian is ineligible.
based on a review of your case at the embassy, new evidence provided, not previously available to USCIS, requires uscis to review. therefore, we are returning your petition to the bureau of citizenship and immigration services cis of the department of homeland security dhs for review and possible revocation. That is what the letter said. On top of that the childrens name were incorrectly spelt and my sons last name is missing. The address my daughter as Mr and the letter is as flat as I restate it.

They are not saying wait until I ROC they are saying that when I took them to there interview I presented evidence to them that USCIS did not have.

These are the questions that was ask;



What does my husband do for a living. I told her.
How did I entered the US, To which I respond "work" because I came here for my then company.
Do I have 2010 W2 to which I thought I did but realize that i left it up here. I told her that I did and she said send it back with the kids passport.
She said do I have my drivers lincense and i told her that it expiers and that a new one was on its way to me. I ask her why is she asking for those things, and ahe said she is verifing relationship and address to which I respond to her, my husband and I have a child together and that I recently relocated to Fl for him to join us.

This is also my concern our daughter is not on the affidavit of support only his oldest child and she has a baby that he claim too, Does anyone know if that is the problem?
Right now i am just speculating so I will just wait to see if anyone has ever been through this can shed some light on the situation.






Based on your prior post, you have stated that you and your husband are not living in the same state, you just had your own AOS done recently within the last 8-9 months. You and your husband did not file your recent taxes jointly, all of these events leads USCIS to believe that your marriage maybe for immigration fraud. Having a baby together does not prove that a marriage is true. You have too many red flags, there are others that you have posted but I do not want to post them on a public board.

If you'll didn't have these issues right after you AOS, you probably would not have ran into this problem of trying to bring your kids over. Everything I have posted have come from your prior posts.

No, there are missing pieces to the conversation, they are telling her that they will not approval her children's visa until she ROC. There are some under-lying reasons that are not printed in the thread.

That sounds about right, you'll know you will have to file taxes together sometimes between now and then. Your husband will have to clear up some of his personal issues, so you'll can do that.

Well we contacted a lawyer who thought the same thing, she is going to try and stop the case from returning by presenting our relationship evidence, plus we have a 9 month old daughter and he is the one who is paying all the bills here and a whole lot of other stuff.

The fact that only came here the end of last year and all my business that I do is in GA and all my bills that i owe are there. and we have a lot of bills together I have life insurance and health insurance, he is thr gaurantor on my student loan and it goes on and on.



When did you adjust your status in the states, also I would be concern that they are not trying to revok your GC aswell.
The children in Jamaica are only yours correct, your husband is not the father of them.

What is registered on the children's BC, do you have their legal father listed?

The poster have written her post as if there is a sense of urgency happening but doesn't give any indication of the urgency. Boiler was trying to get more information from the poster to help/aid in that sense of urgency, by asking leading questions.

I know most people that post on these board wants everyone to give them the soft kid glove approach by giving them step by step directions, but how can you anyone give the best answer if there are open answered question left by the poster.

If he has it on hand they will accept it. For the CR1, the Jamaican consular like to see a continuous pattern of income met or above the income level. I am surprise banju went back with the same problems she had when she petition her husband. They told her she needed a co-sponsor at the consular review with her husband, so they would also apply the same guidelines to her step daughter petition.

From my last topic about a friend got blue slipped because her 2008 return wasn't over the poverty line

Well both of my 2009, 2008 are under the poverty line except for my 2010 my recent year..I currently make over the poverty line but I am self employed so I do not have check stubs, but employer did write me up a job letter stating my current year salary there.

I am still waiting to get my husband medical and interview date..well actually the ds230 is still processing.. My husband im filing for is in Jamaica the embassy in JAmaica.. While we are waiting

You will need a co-sponsor when your husband is interviewed at the JA embassy. Have the co-sponsor to complete the 864 forms and have everything ready to be presented at the interview.

Your husband, (not You) needs to talk to his commanding officer at the military base where he is stationed to start the process. You will need to gather the required documents that your husband will need from you, copies of passport, marriage license, your birth papers.

Again your new husband will have to start the process here in the US at his military base.

Please explain why your USC petitioner isn't on this site asking these questions since most of these forms were completed by the petitioner and the terms and acronym that you are asking about does makes sense to her. If she was as concern as you seem to be, it would make sense that the petitioner would be the one trying to sort out what happen and what her next step should be. The next step will really depend on the petitioner, if the petitioner doesn't act on it, then this petition is as good as being dead.

Ok, I went thru this and married in Morocco. It takes a month to do paperwork if you are lucky. You need any information on previous marriage, criminal investigation report on you, passport with all stamps of visits, birth certificate (and they kept mine), separated Photos ID like state or federal, medical exam there, income papers like tax returns for last year certified, employment records, school and college records (is asked for not necessary in some places)

If you trust him send these ahead of your visit

so he can get them translated into 6 copies and certified and that will save time. but i would email request to have his case reviewed by CO before all comes back here and if you can, ask to fly over and talk to CO.
I have been married now 15 months and we finally have our interview next month.

You are already at a 2 month window if you are at NVC now, I don't see much time being shaved off from the NVC to embassy interview, but if a couple of weeks makes a difference then nothing will be lost if you don't try.
