hello.
i am looking for a bit of advise as to what to do next.
i understand everyones experiences are different and it is confusing me a little trying to get the advise i need, without posting and asking! so...here goes

i am a UK citizen, living in the UK, my husband is USC living in USA. we married in the USA and after 18 month or so i had to return to the UK for a family crisis, i lost my dad.
i have been here in the UK since june 2009 and am trying to return to the USA to be with my new family there, but neither of us know how to go about this the right way. i sent a letter to the US embassy in london and they replied saying we need to file in the USA by sending in the I-130, G-325 and supporting evidence...so this is what we are doing.
i left the USA without permission, just got on a plane, and prior to filing for AOS.
i have a SSI number, but no green card.
we have all the supporting documents, as in, marriage certificate, birth certificates, husbands tax information, passport photos, other photos and the required completed I-130 and G-325.
on the USCIS website it says we send to chicago lock box.

i am wondering how long all this will take and approx how much it will cost.

we went through the K1 visa process in 2007-08 and i received my visa in january 08, from jan 08 to june 09 i was in the USA.
my husband has visited me here for a week in january (2010) but returned to the USA.

since june i have had to find somewhere to live and work which i have both, but the place is killing me with rent as it is private landlord and i cannot afford to go through all this process again and

it seems wrong that we are kept apart because of procedure

THE ONLY WAY FOR YOU TO ENTER BACK INTO THE USA, WILL BE FOR YOU'LL TO GO BACK THRU THIS LONG AND TEDIOUS PROCESS BY APPLYING FOR A CR1. Please refer to the VJ guide section above for a more detail explanation, and what this process will require of you and your husband.

There is no quick fix to your problem, lets clear up all non truth information:
1. A lawyer will not make your application process go any quicker.
2. A Congressman/Senator will not make the process go any quicker.
3. You haven't stated any reason as to why a hardship wavier would be a consideration in your case. Note: finance doesn't quality, nor does missing ones husband/wife.

Patients will help you to get to the end of this journey alot quicker. Good luck the end will come.

He went to court and they can't find what?

Did you'll state anything about it on any of the forms that were filled out for the visa application. I think this question is asked again on the d230 or 184 form. If he paid a fine there is the possibility that it will be on his record, also if he is asked at his medical and he mis state aboutany use of drugs and this shows up on his record the consquenses could be hugh.

Or it could just be all in the wash and it slides pass, but I will tell you that it seems that the Jamaican embassy does refuse more visa for drug use, than any other country I had read about here on VJ. WHY????? we don't even have to point out the obvious. Is it fair, no one says life must be fair.

I would get the PC, before I contuine with anymore steps of this process, then from there I would plan my next steps.

First let me start by congratulating you on your marriage... (L)

The entire CR1 process will take you an average of 7 to 9 months, so to start stressing out about the NOA1, will not help you. I would suggest you take this time to understand this entire process, by reading the guides and others experiences in this journey.

I would also, recommend that you and your husband, really talk and get to know everything there is to know about each other aswell. This is not journey you would want to get surprised by an "inaccuracy" when you are close to the end of this journey. It has happen to the best of them.

I dont think you understand what I"m asking here guys, I ALREADY filled out all this information for the beneficiary. Things have went awry, and now I want to pull the aff. of support . Since I never made that type of money b/c I am a full time student, and I didn't have a co sponser for the immigrant, It was never plausible to begin with, right?
So Is it deemed void?

Ok, sorry if this is not done correctly but I am new at posting a NEW TOPIC....

In Jamaica there are 2 types of Birth Certificates...the new one and the old one (simple enough right?) well, according to all reports you must have a NEW one to submit with your paperwork...so I ordered one...2 MONTHS AGO...then my husband went into the office and ordered it again....still nothing... Do you think if I sent all the paperwork in with a copy of the old BC and proof of payment for the new one will they allow it???




Jama, did you'll use the short bc to obtain the Marriage lic? He has a Passport already correct? Have they told him what's the hold up on his BC request? Does he have sibling, have they been able to obtain a copy of their BC? I am just trying to see if there is some type of pattern and if you maybe able to identify what could be the hold up.

But, the answer to your question is he will need the new version of the BC. :crying:

Hello. I'm sorry if I'm posting repeats of previous posts, but just wanted to ask a few questions. My bf is in the Philippines. I'm a US citizen. We've been a couple since July 2008. I had previously planned to bring him over with a fiancee visa because I had read that that's the fastest way. Then I heard on Citizen Pinoy that it's really only a few months faster, but with a spouse visa you don't have to file for adjustment of status. (I think that's what it was.) Anyways, so now I'm looking at the spouse visa options, K3 or CR-1. I've read that CR-1 is the way to go, that K3 is obsolete. Is that correct? I know processing times vary, but for those that have filed CR-1s, how long did it take from the time you filed to the time your spouse had his/her interview? Thank you so much for any help!! :)



The time frame is based on an average of 7 to 9 months. The 9 months time frame seems to be what most are experiencing.

Bajankutie, I am saying this with a smile on my face, I have never seen anyone such as you who has made this visa process like having all of your teeth pulled in one day. :rofl:

Now, on to your question, he is not going to be able to get a copy of his phone records, because he is on a pay as you go system. If you are saying that he pays 20 US dollars for 16 hous of US calls. The only thing you'll can do is get your phone records to show the calls on the received end. This is why we would tell the USOP on VJ to get an account with Rebtel, or Ringyard, since they will register all out going calls to an international phone.

Now, when I went thru the process last year they did ask us for phone records, and I was able to show my Rebtel acct. log. But,If you don't have phone records because you'll are using phone cards, then you'll can explain it to them. Your passport entries would be enough to show that you are and had been maintaining a marriage. Everyone that goes this this process doesn't have all of the evidence that someone else may have been able to introduce to the CO regarding the maintaince of their relationship. What I am saying is not having phone records will not be a killer in your process.

You are planning on attending, so that in itself will be an added bonus to the interview. You need to CALM down or you will wear yourself out before you get to the interview. The interview itself is the easy part of this journey. It's all that comes after that will make you want to jump thru the window. Save all of that engery for that part of the journey, because as they say, it ain't over until the fat lady sings.

It's like the 3 month rule in a relationship...if you knows what I mean.

As was stated in previously post, you need to tell them the truth if asked. The POE will follow the directions that are being given to them.

Due to the recent activities that have been happening in the US, I expect the SO will get grilled very carefully, as to why is it that he is entering the US without the petitioner being physically present in the USA. I would suggest that you don't take your entrance into the USA on a marriage sponosored visa without your sponosor being physically present in the US as a piece of cake (meainig no problem). I believe you will be questioned extensively upon entering and if you should leave directly after entering, upon re-entering it will trigger a flag on your next entrance if there is a substantial amount of time before you re-enter again.

I am sure the POE's will handle your situation in the manner inwhich they have been given directions.

You are missing the point, the fraud didn't happen at the interview, it's something that myabe in someone background or history. You and hubby needs to sit and have a heart to heart talk. Maybe he does know or maybe it a mistake, but they saw a RED flag.

You said your husband had previous been in the US, something maybe flagged from there, we don't know, but you'll needs to look under every rock. Has someone flied for your husband before, and he just didn't mentioned it to you? These are the questions you needs to be asking?

Question, if you are a USC, why isn't your daughter a USC? Were you a USC when your daughter was born? Did you have the right to USC at the time of your daughters birth?

Why are you filing a I-130, for a visa petition for your biological child if you were a USC at the time of your daughters birth?

I fill IT OUT WITH THE OPTION TO RECEIVED ALL CORRESPONDENCE FROM NVC registered mail on 06/12/2010.

On June 13,2010 my wife received the AOS bill from NVC we paid it online June 14,2010.

I also state that I intended to adjust status with immgration services on the choice of agent form. ?????????

Hello everyone and thank you SO much for taking the time to read my question. My partner and I plan to get married. We met with an immigration lawyer about the long process of paperwork, interviews etc. We're second guessing our desire to go through that whole process and are considering waiting things out for immigration law to change and a "pathway to citizenship" where he can become a citizen without leaving the country. My partner entered the USA without inspection over 4 years ago.

My questions are:

1 - After we get married, how soon are we required to submit the I 130 form? Is there a deadline? If not, what happens if we let the deadline pass? Why is there a deadline if there is one?

2- I learned that with a Tax ID number, when we get married he can use it to pay taxes and put him on my health insurance and investments; which is great. SO with this is mind, what risks may we be taking by deciding to "wait it out" and not go through the process? The pros are we can stay together and will not have to go back to his country (yet or ever). But what are we really risking here? So many undocumented workers live in USA for their entire lives without a problem. The TAX ID will solve our issue of his health insurance and retirement benefits. What real risks are there? If deportation in a risk, if it happens, we'll have a longer history of relationship and evidence to fight deportation etc.

Why shouldn't we wait it out?

Just when you think you've heard it all....

My case had been reviewed and I got a RFE because I forgot to send a copy of my husband's passport...According to NVC that was the ONLY thing that was wrong. So, I sent it and they put it on the bottom of the pile of cases to review so at 7 weeks they send me another RFE!!!! This time, it is because of the new ruling requiring a new police record if the previous record was dated prior to June 14th. YES, I was aware we were gonna need to get a new record and provide it at the interview but didn't realize that we would need to have it prior to getting an interview. REALLY????

I don't think that is fair. They already told me the file was good with the one exception....I think they should have advised me that at the interview I will be required to have a new police record but not hold up the process of getting an interview.

My question is....what keeps this from happening again....how many RFE's can one person get??? Is there an expedite I can request due to the length of time and the unfairness of the situation??? Anyone with this or a similar situation??? Multiple RFE's???

HELP!!!




Nothing can stop NVC from requesting documents that they feel they need to adjudicate your case. All you can do is send the requested information and hope for the best. Good luck on moving forward.

I have been going nuts for the past couple of days ever since i was told by my husband that we are gonna need a co sponsor.so I am here by seeking some information about the co-sponsor for CR1 visa.I have been told by my husband that in order for us to file for a CR1 visa we are gonna need a co-sponsor...but i would like to know the requirements that a co-sponsor should posses to be qualify for the case?i would like to know if the co-sponsor has to be a family member ?i also need to know if the co-sponsor has to own a home? or any other assets or valuable possession.i am just seeking sufficient information has to what a person need to have or fulfilled in order to be a co-sponsor?cause so far it is very hard to get someone to be our co-sponsor.one more thing i need to know...me and my husband would like to know what else we can do in the case if we can't get someone to be our co-sponsor....we need to know what will happen if we don't find a co-sponsor? I was wondering if the embassy will deny my visa.... but, then what? Do we start the process over? or pay more money to have it re-open. Do we have to wait until next year so that my my husband taxes will look better?

Does your husband present income meets the income requirement for the number of depends that he will be supporting? The income requirement is set by the proverty level income.
