How long will you be at the postion in Poland.

Option1. Postpond the interview up to a year....no GC, so he would need a visa to visit the US.

Option2.. Continue with the interview, have him POE in the US and stay with family and friends until he receives his GC. Not sure how he will be able to enter Poland.

Option3..Hubby goes to Poland, and if you and hubby have establish residence 6 months later, than have the interview in Poland by having he case transferred to the Poland consular.

If this is the case are you trying to attend a funeral. You can try to get a emergency visitor visa for that purpose.

The staes of MARYLAND, VIRGINIA and the District of Columbia has laws that policies will not be written with pre-existing clause.

BCBS has 26 Plans, and many of these Plans do write policies without pre-existing clauses. Atena, and Kaiser also write without pre-existing clauses.

If you have diabetes it is almost impossible to get individual insurance, if he can get it will exclude the preexisting condition and be very expensive. Remember, the immigrant will not have previous US coverage and therefore everything is a preexisting condition. It isn't as though he is just switching from one policy to another while in the US already.



That statement is completely un-true, Blue Cross and Blue Shield have many policies that have no-pre-existing clauses. The policy can be underwritten without a pre-existing clause. Some states doesn't even allow Insurance companies to write policies with a pre-existing clause.


Most people on this board makes statemets based on the states that they live in, there are 52 states many terrioties that have different states laws regarding how a Insurance policy can be admistered.

Well, that is what the AOS is for right? I have a joint sponsor for him in this case. I would assume the sponsor (me) and the joint sponsor should be the ones that support my husband in all things that he might need, right? To my knowledge, there is no requirement for health insurance in the case that the spouse doesn't have any (as I don't).

AOS is adjusting his status for a GC within living in the US, your husband will be given a GC ability as soon as he enters the US.

There is a condition to quarantee that your husband will not become a public charge. The state of Mass. requires thaat all of its residence haave health Insurance.

I probably would agree, but isn't that what the sponsor and joint or co-sponsor are for, to help so the person doesn't go on government aid? And, this kind of insurance doesn't cover anything pre-existing, so it won't help with his diabetes needs. It will just help for emergency situations or accidents, etc. So it will hopefully be a good net, but it is a shame that they can't just ask us to find a plan to enroll him in once we set foot in the US.



There are many policies that covers pre-existing conditions. You can elect to have a basic policy that covers medical conditions, with a 5,000 per deductible per family. It does not have to be the top of the line policy. You are confusing your responsiblities as co-sponsor, yes the government can sue you after the fact, but the government is asking for this as a pre-condition to allowing your husband to enter the country.

It seems as if they were trying to AOS within the US, but husband had to leave before it was completed. therefore the AOS was denied correctly. The 130 was approved, and is still approved. what the OP needs to do is to have the 130 sent to NVC, once all of the fees at the NVC stage has been paid, they will then send it on to the correct consular for an interview.

Start taking picture now, but pictres are not the only evidence they will look at. Hint: pictures can be photoshop, so they are not the final evidence.

Now, if your husband has been coming to JA since 2009, you'll should have hotel receipts, emails, maybe some mail receipt through the postal service, letters from friends who can atest to the relationship. His passport should show all of his entry stamps to JA.

If you make the age difference a concern then the CO will pick up on that concern.

There is no need for the wavier unless the embassy requests it. I haven't seen a request for a wavier when there have not been any charges aginst the appliciant.

I wasn't sure if it was the approved I-130 that would expire or this was in regards to the Visa itself. I was hoping for the best - pee and wait for the re-interview. Kim, your approved I-130 do not expire, that is why I stated in one year just request another interview date. Those who file for a K1, will have to re-file all over agin, because their I-129 will expire.

Since the petition filed was a130, a year from the denial date you can ask for another interview date, the embassy has asked for interval drug screening test to show evidence that he has not continue to particapte in this illegal activity.

So, wait a year, pee into a cup for testing every 3 months, hope for a negative result, and be-re-interviewed.

Before some ask the question check do have to be from the petitioner, no as long as it is drawn on a US bank check. Therefore anyone in the US who has a US bank checking account can assist you in this matter.

It will not matter if it is DCF or not, all petitions are sent to a US P.O box address.

Note, check must be cashable, and written to be drawn on a US bank.

Some countries have US banks such as TD bank, Citicorp, Bank of America.

Do some research within your country of stay to see if there is a US base bank there.

I would say yes since it was a criminal offense. He will probably have to submit the papers as well showing his charges and the outcome of them.
Do DUI charges affect a petition? Could it be denied if the petitioner has 3 DUI's?
Is he now a felon?
A 3rd DUI is a felony in most states. He is now not eligible to visit most countries.




A USC with a felony can petition a spouse, as long as the charges doesn't fall within the Adam Walsh act, and if it does they can submit a waiver. maybe you were think about the Beneficiary, they must be squeaky clean.

I know all comments are made from frustration, but how do you know that USCIS don't hire top graduates, were you denied a job with them, .... because you graduated at the top of your class.
