K-1 Fiance(e) Visa Process & ProceduresNo Proof of Citizenship! Help!

I only know my certificate number. I'm sure they have all on file from when i was certified at the location where i was certified. I don't think they would have given me a receipt for the new Certificate if they came to the conclusion that the certificate number is fake or that I'm not a US Citizen.

The receipt is only evidence that you have requested something, until they have actual verfied the information and submitted you a copy of the certification, they do not knows if the information is true or not.

If i try to get a statement executed by a US consular officer certifying that i'm a US Citizen, could that maybe help? Or maybe if i get a G845 filled out by a consular officer? Would that help the situation?

What do you have as proof that you are a USC, so how can any US consular vefiry this. You seems to be going in a circle.

oh i wasn't there the whole time i was pregnant, and i stayed for less than 4 months. anyway, it's just that from what i know, they don't like it when noncitizens give birth there. and that it's going to be a point against me when they interview me.

Ok. never heard this, but your son should be okay with his US passport.

Thanks so much! :)

Thanks! :) But nope, I didn't overstay my visa.

If you didn't over-stay your visa, why do you think the US would give you a hard time, that you felt the need to ask questions about it. What is your real concern? Most visa stays are only for 6 months max, and a pregnancy generally last nine months, unless it is a premature birth. Just thinking out loud.

What was your legally status 9 years ago when you gave birth to your son, and did you accept an means benefits towards your son's birth. If the answer to these questions are that you were legally in the states, and you did not accept any means benefits toward the birth of your son, then you should have minimum problems with the questions surrounding your son being born in the US.

NVC will send the approved applications to the nearest consular. Note, every country doesn't have a US consular within it, many applicants are being interviewed at other consulars. Don't panic until it's your time to interview by then all may have been settled in Egypt. This isn't the first time the US have dealt with situations such as this.

If you are filing the 129, you will have to mail the application back to the US anyway, so why can't you ask someone in the US to just purchase the money order and drop the entire package in the mailbox for you. Simple as that.... You will have a 5 to 6 month wait anyways before the petition is approved.

Why can't she just finish school then obtain a job and file for you then. Why the need to stop her education.

I once married an aussie Here in the USA from Melbourne Vic. The approval process took so long and Sept 11th happened durring the process. Eventualy she had an affair and filed for divorce. That took a year, as well. It takes a full year of being seperated to get divorced in Australia.

This doesn't make any sense, why didn't you just get marry in Austrilia. As for your statement above, if you lived in the US, then you could have gotten your divorce in the US, but I am assumming that you were living in Australia.

Again, family members adopt each other in the Philippines. She told me it's not too uncommon. We were NOT trying to bypass any laws. My fiancee has raised her since their mother died. USCIS says a beneficiary can bring adopted children on a K-2. I told her to go ahead and make it official and just adopt her since you're already raising her. Seemed simple enough... Now today I am reading that just because it is legal there, it doesn't mean it would be legal here. SO I REALIZE MY MISTAKE NOW, THAT IS WHY I'M HERE ASKING HOW TO RESOLVE IT. We already spoke tonight, and she's going to be asking relatives starting this weekend if anyone can take her sister in when she leaves. We've already resigned to not bringing her sister, just since I realized my mistake - I called her right away (few hours ago). I wasn't even hiding that they were sisters on the application - they have the same middle and last names. I was oblivious to this rule...

My application hasn't had any activity yet, so I hope I can get this corrected before I get in that kind of trouble. So you say call USCIS, will they be able to transfer me to wherever my case so they can correct it for me? Who should I try to contact in the U.S. Federal Government to explain my mistake? Like what department or person? Thanks.

First thing first, don't listen to any of us regarding this.

Go speak with an immigration lawyer, you only need a consultation with them. You will want to discuss the situation with them.

Now regarding adopting her sister, US immigration will recognize the adoption that occurs in Philippines so long as the adoption process took place over there and was completely legal. There may be some back and forth paperwork involved as them being siblings will raise flags, but I believe if you can show it was a legal adoption it will be allowed in the end.

The adoption has not taken place yet so how can the petitioner claim the child as his SO adopted daughter on a petition that has already been filed. Read the post carefully before you advise the OP.

K-1 Fiance(e) Visa Process & ProceduresFRUSTRATION and some questions

okay im visiting him... and im a US citizen and as far as i know its okay to visit without a visa as long as it is less then 90 days which is what im going for...

as far as the package goes.. im going to wait a couple more days and if I still dont get it im just going to send him another... cant believe how insane the post office service is.. i will definitely let my fiance know that he should go through fred ex or dhl... though it is only some paperwork. Not really a big package but still... just seems rediculous, if its much longer we will both need to take new passport pictures..

Any thing you send thru FedEx or dhl to or from Jamaica is going to cost you 50 dollars or more. Now to simplify this process, mail coming from Jamaica to the US can take anywhere from 2 to 4 weeks. There is no getting around it, everything gets held up in custom in Miami, and get scanned for drugs. If you are waiting on the passport pictures, have him to scan them and send them via email, take a copy download via CD to Walgreen, CVS, Walmart and have them to print them out passport size.

Not sure what you are sending in the package, but all of the documents can be sent via email, he can download them and send them back to you.

You've misread my answer. In post #9, you wrote "The sex question is only asked of maerried [sic] couples." No, it is not. Later, in the post that I quoted, you wrote "a K1 will not have a Stokes interview." Both of these statements are patently incorrect. Several VJ couples (K-1 and CR-1) were given Stokes interviews and questioned at length about their sex lives in Ecuador in 2008 and 2009. They most likely represent only a fraction of the total number who were asked. One's bottom dollar can be staked that the sex questions were asked at other consulates worldwide, and that K-1 couples worldwide have been given Stokes interviews. Read the various embassy/consulate reviews and the regional subfora, and if you come back with data to prove me wrong, I'll apologize. Meanwhile, stop making sweeping assertions that fly in the face of what real VJ members have actually experienced.

To define it as a Stokes interview, just because a couple is questioned at the Consular level with certain questions, do not constitute it as a Stokes interview. That has been my statement, again a consular cannot make the assumption that because you are engaged that you have participated in sexual activities. So, I still stand by my answer.

I agree with you. i'm from Haiti too. They wanted me to be there for a dual interview and they ask me all those kind of question. All you need to do is be honest with them.

Please explain, what question did they ask regarding your sex activities? After they asked if you'll were sexually activity, where did it lead to? HAITAI has a Hugh Catholic population, so if you had stated that you had abstained until marriage . Do you think they would not have believed you?

Educate yourself so that you don't make sweeping and false statements that can mislead others, please. This has happened and does happen. Furthermore, the COs have asked about sex.

You need to educate yourself, if a K1 never had sex, then the answer would have been no sex, and the consular would have stop the questioning. Nothing says b/c you are engaged that you should have had sex. So educate yourself, if there was no sex, than how can the conversation continue. how can a consular prove that you have had sex, if you are engaged. if you are stupid enough to answer the question if it goes beyond proper questioning than that is your fault. The consular can only assume that a CR1 has consummated their marriage.

They can ask about any damn thing, but only you can give them answers to continue the questioning. If no sex, what can they say?

You'll are scaring people when there is nothing to scare petitioners about, the consulars are not asking about their sex lives in detail. Show me where a Consular has gone into detail questioning of a petitioner about their sex activities.

A stokes interview is more time consuming and labour intensive than the usual consular process, though, so it's not a common practice. Come prepared with other good evidence and they won't have a reason to spend extra time on your case.

First, a K1 will not have a stokes interview, yes a CR1 might. So if you are a k1, just be prepare with the normal questions.

well my fiance is in haiti and sure he wants to leave, but its not a fraudulent relationship. Regardless of whether they met online, this couple had a year long relationship.. I met my fiance thirty days before I proposed. I've been back three times to see him in the past six months.

But what you are saying, is what i fear: that they will treat ALL relationships as fraudulent. in particular, requiring me to show up at the consulate at considerable time and expense to myself to ask me questions about my sex life. :bonk:

They met one time for one week, in a year long relationship. The consular knows that the cost to come to the DR, is not as costly or timely as a trip to Vietnam. The petitioner could have traveled to the DR more often if needed. There are many aspects of this relationship that led to the consular putting them thru this process.

My interview will be in Haiti in hopefully a few weeks. I've heard of folks being asked for photos of themselves kissing (which i do have) but if they can't produce those to come back with their fiance for a second interview. Also a case in the Dominican Republic, also higher fraud like Haiti, where they were asked in interrogation when was the first time they had sex, and also the last time they had sex.. for a fiance visa.

My other issue barring lack of evidence is the travel issue: I'm willing to travel to Haiti, despite the inconvenience and expense if i have to, but even the DOS has a travel warning so I don't understand how they can ask the USC to arrive to a nation that has a travel warning.

Is your interview in Haiti or the DR? No one has been asked for pictures of thwm having sex, that is just hear say. The sex question is only asked of maerried couples, so they should be able to answer that question hostely.

K-1 Fiance(e) Visa Process & ProceduresEmergency Interview

So we are waiting for our NOA2 still and have about a month to wait at least. Then we have to add a few weeks for NVC and then some more time for Embassy to process. Then the Jamaican timeline for an interview is between 60 to 90 days. But we are pregnant and the baby is due in August. I cant stand the idea of having the baby without him, it is the first for both of us. Does anyone know if we would qualify for an Emergency Interview in order to try and insure his arrival before the baby's? This is what the US Emabassy in Jamaica's website says about emergency interview

The Embassy’s guidelines are very specific regarding what constitutes an emergency. These reasons are:
Serious illness or death of an immediate family member (immediate family members are the applicant’s mother, father, brother, sister, husband, wife, son, and/or daughter).
Emergency medical treatment. We will consider emergency requests for the patient and/or the immediate family member who is required to travel for support.
Short-notice business travel: Please provide a detailed description of the nature of your business in the United States, why it is necessary that you make the trip on an urgent timeframe, and an explanation of why you were unable to anticipate the travel and schedule a timely appointment.

Does being present at the birth of the baby qualify as immediate family member who is required to travel for support?

Feels that way to me!!! Anybody know anything about this?

Sorry to say that having a baby or wanting to have the father present at birth is not an emergency compelling reason to have the process expedited.
After your petition has been sent to Kingston, you can send them an email to see if they have any earlier dates available for the interview, but that will not be a guarantee. Also note, that there are many pieces to the interview process you still have to get through, police report, and medical can always cause a delay.

You have confused everyone, so it's the US citizen who is HIV postive. On what basis do you the SO need to have the visa process expedited? Again, is the OP illness at the stage that he needs to be in a Hospice facility?
LIFE'SJOURNEYFemaleJamaica2011-04-04 13:57:00
K-1 Fiance(e) Visa Process & ProceduresEXPEDITE FOR MEDICAL CONDITION

No as they don't test for HIV any more or not that I am aware of.

What would be the expedited reason?

Do you need medical treatment that is not offered in your country?

If your condition is severe are you physically able to travel?
Will your SO have sufficient Insurance coverage to cover your condition, which wouldn't leave you in the position that you would have to rely on the US for medical care.

Someone who is in a severe stage of HIV needs alot of medical care, so USCIS would have to take all of this into
consideration.

K-1 Fiance(e) Visa Process & Procedureswaiting for nvc

Hello VJ.... I wish I would have known about this site a long time ago, I have gotten so much information in the short time I have been on here... I'm from California and filing for my Jamaican fiance, we are waiting on the NVC to send a notice that they have received our information... It has only been about a week so far and I have kinda gotten used to the waiting! They said it could take 4 to 6 weeks. I sent my i129f to The CSC on Oct 1st and received my NOA1 Oct 12th, I received my NOA2 ROE March 17th, and got my NOA3 Approved March 28th... So now were waiting on NVC and hoping this will go quickly from here on out. I met My fiance in 2002 at a graduation; a mutual friend introduced us, I was there for school at the time. I filed for him in 2003 but because of lack of info I got discouraged we were together until 2004, We have remained friends since then and although we have dated other people we had never found love like we had for each other so when he asked me to return to Jamaica in March 2010 I didn't hesitate to go... We rekindled old flames and in June 2010 on my a second visit he proposed to me I was very surprised and had no idea he was going to do so. In July 2010 He applied for the F1 (student visa) he was approved, they later contacted him for a second interview he was denied and told to tell me to file the i129f O_o. So now we are on our journey... I hope to get lots more advice and meet new friends. If you would like to ask questions... ask away.

Welome and what happen to the 2003 petition that you filed, this may cause you some trouble if you didn't close it. How far in the process did the 2003 petition get?

Ugh, thanks, but not what I was hoping to hear. It baffles me how they expect someone to a) sit around for three months twiddling their thumbs while waiting, and b) SURVIVE for that period with no legal way of obtaining income. Since the foreign fiancee is not allowed to leave the country after the marriage until the AOS and everything goes through, this means that even if my fiancee flew over to marry me without quitting his current job in the UK, he wouldn't be able to fly back and continue working in the UK while we wait for the EAD and AOS to go through. This sounds impossibly stupid! This is FORCED UNEMPLOYMENT and is sure to cause stress among couples both financially and mentally while one person is made to go 3 months without work. How does this help anyone??? Is there really no way for him to do this without being out of the job for 25% of the year? :(

The US government expects the spouse to do better financial planning and to financially support their new spouse, since getting married is not an urgent or emergency event.
