If you have some type of legal document that says you have sole custody you do not need the dads approval even if he is on the birth certificate. At least that is how it is in some places. I suggest you look into it




Where is that? Sole custody does not eliminate the non-custodional parent right in any state within the USA.

If that was the case then the information would have been constructed , not insulting. The one thing life has taught most adults, insulting someone else doesn't make you look smarter it only show the true you. Sorry to be the voice of reasoning, but the OP did post this thru the Jamaican forum. But that is not the issue here, NO one should be insulting anyone on this board. All are adults, (I hope so) some may not act like it, but none of us are mothers or fathers of the OP who can justify posting comments as if they are disiplining children.

Post your statement to aid in the problem and move on, whether the OP likes it or not is up to them.

Before ALL get their panties in a tangle, if he had been charged it would have been listed on his Police Cert. If there had been an open charge, the Police would have sent his PC to the embassy, he would not have been allowed to hand carry it. There are pices missing from this OP post.

First course of action is to provide the US Embassy in the foreign country all the supporting evidence and make sure they receive it. Have you done that yet?

Your fiance was put on administrative processing review. This means the embassy is waiting for you and your fiancee to send them additional proof of your relationship.

You need to send them
-Photos of you two together and with family members
-Airplane tickets to visit him (vice versa)
-Skype chat logs
-Email logs



I would HIGHLY recommend you send the requested information to them soon, because the embassy will not provide an update or answer until they receive that information. Also, it does no good contact Vermont Service Center, it's beyond their control once it reaches the embassy level. You will need to contact the US State Department and they can provide you updates on the case. You need to give them the Case Number, Name of Beneficiary .

Hi VJ members,

Just want to decrease my anxiety level by relating to someone who's had a similar experience as us. My k1 petition has actually been processed without any impediments untill the actual interview done in December 2011. My fiance was not granted a visa on spot, but was told that they will be in contact with me because they needed more "evidence to substantiate our relationship." In other words they have reason to believe that our relationship might be FAKE. This was a big blow to myself and my fiance, because we thought all was well and we had already started planning our wedding.I was devastated when I got the terrible news from my fiance. I have e-mailed the consulate on several occasion but to no avail, I have yet to hear of a visa approval. Last time I checked the Vermont Service Center, they did not receive the petition from the Jamaican Embassy. :( :(

I make $11 an hour 40 hours a week, last year from August to December I made $9200. Would it be ok if I use my co-sponsor's tax return from 2010 ?


I am not going to do the math for you, but I will give you the rules, nothing from last year will be used for consideration. So, for 3 people you need to make at least $23,162. You need to show recent paystubs to prove that you currently have income that will equal to or greater than $23,162 at the end of a 12 month calendar year period.

If you are not presently making the required income you will need a co-sponsor.

I have read the document but I am not sure about it. I Want some help here because of the long list of law it is easy to get lost. I petitioned for her mother and her August 2010 and she turned 21 in January which was the 5 month mark of our papers. Just before my wife's interview.

CSPA does not apply to your case, see aaron pot above;

How did you "file" for your step-daughter when she was 20? You can only file an I-130 for her if you married her mother before your step-daughter's 18th birthday. Did her LPR mother file for her? It makes a huge difference if you or her mother filed for her.

If you filed a K-1 for your wife, your stepdaughter could have received a K-2 because she was under 21. However, the K-2 route is now closed to her since it has been more than a year since the K-1 was issued and your stepdaughter is no longer under 21.

CSPA is complex. It's applied differently based on 1) whether the petitioner is a US citizen or an LPR, 2) the child's age when a valid petition was filed, 3) how long it takes USCIS to approve the I-130, and 4) how long it takes for a visa number to become available. Additionally, it does not apply in K-1 cases.

I have a similar question about my step daughter who is now 22 I filed for her when she was 20 with her mom. Now married to her mom and she has green card. I have a document about children that was signed in 2002 which reads the following:

On August 6, 2002, the President signed into law the Child Stutus Protection Act (CSPA), Public Law 107-208,116 Stat. 927 which amends the Immigration and Nationality Act (Act) by permitting an applicant for certain benefits to retain classification as a "child" under the Act, even if he or she has reached the age of 21.

I was told by USCIS that the wait for Russia was 9 years for her mom to petition but after I called and asked my wife had friend do some digging and found this information and she has been told that I had the daughter on my original petition and I am still able to get her here.
Does anyone know the details if this is TRUE or UN-TRUE

Why don't you read up on why the law was put in place and then come back and tell us if it applies to your situation;

The Child Status Protection Act (CSPA), Pub. L. 107-208 (Aug. 6, 2002), was enacted to provide relief to children who “age-out” as a result of delays by the Citizenship and Immigration Services (CIS) in processing visa petitions and asylum and refugee applications. The Immigration and Nationality Act (INA) defines a “child” as an unmarried individual under 21 years of age. 8 U.S.C. § 1101(b)(1). The CSPA does not change this definition, but instead changes the point at which the child’s age is calculated.
Prior to the CSPA, an application for permanent residency as a direct or derivative beneficiary child would be approved only if adjudicated prior to the child turning 21.3 Upon turning 21, a child would “age out” and lose the preferential status of a child. As the result of agency backlogs and delays, many children aged out before their cases were complete. For cases to which it pertains, the CSPA now locks in the age of the child at an earlier date in the process, and in this way will preserve the status of “child” for many individuals who otherwise would age out.

My dad said something similar to that when he took the family dog for a final "ride" in the country. Always wonder what happened to that dog? :blink: Somehow I would like to think the dog found a new family, or emigrated to another country on a student visa.

well guys frustration got the better of me last night to tell the truth i would be to frightened to commit the crime even if someone came up with a good plan i was just venting . but to answer a question of someone back there

i was reading the us embassy site and came across what they had to say about allowing a over the age limit person to study in the usa when there family has just recently immigrated to the usa not allowed . and it was my last legal idea to get her here no doubt she will have to stay or i will have to move there its just very sad that they wont make exceptions to the rules



The daughter will be okay, it will be just like she is away at college. The mother will have to visit her daughter more than once a year maybe until the daughter gets use to being away from her mother. But, are saying your wife has no other immediate reletives still in the Phil?

Many a people have built new families out of strangers and have live productive life. The daughter might be looking foward to being on her own, this will be a new beginning for her. If she was raised well, then she will be okay. The aprons strings will have to be cut sometime, why not now.

Let the daughter find her own husband, don't get invovle with the daghter love life.

I know of a very same scenario like this...and it happens to be my bro-in-law. he , his parents and his 2 brothers were petitioned since 1991 but it took about 19 years before they got approval. my bro-in-law reached 21 when the approval came so he got left behind here in the philippines. now that his father is an LPR, he filed for him last 2006. he got interviewed in 2010 but got denied. and they are trying to appeal for his case. but we've heard nothing ever since. his parents keep telling him not to get married if he wants it to more possible for him to go to the US. im also wondering what other solutions can we do for them? im concerned too.



Why was he denied a visa? So shouldn't that be the most critcal concern rather than having him arrive under illegal status. Geezz.

In the excitement of it all, I guess you guys did not look very carefully when the visa were issued. If it was caught at the embassy or as soon as they arrived ( don't know exactly how it works in the Phils) this could have been avoided. But it is definitely wrong. Visas are good for 90 days so they should expire sometime around the 5-6 of May. Please contact the embassy ASAP and get this corrected. They know they screwed up. Sorry about that.



Look at the OP time line for their medical, visa is expiring 6 months after intial medical date.

This check is done on anyone does not have to USC or no USC. Anyone can be flight risk somehow she has managed to get into the Database which shows ppl who should not be leaving the country.

No, we are saying that your financee needs to clear up her court issues before you'll start talking about a life together. P.S., they are not going to clear up her court issues with her being absent, so one way or another she will have to go back to the US and face the judge.

Then after that you'll can discuss what visa route would be best for you'll. Not knowing the country you are from, can't give much more on what to expect.

No, fill out the 134 or 864 form with the required supporting documents. i.e BC or documents showing they have USC, IRS transcript or w2 forms. If the co-sponsor is a LPR, then they need a copy of their GC.

She is from the US-Virgin Island and the process is so slow we don't think she will get it before the interview?



Oh well, you will need to look for another co-sponsor. You'll had atleast 6 months to work this out from the inital time of filing. The interview could be postpond until you receive the correct documents.
