K-1 Fiance(e) Visa Process & ProceduresLifetime Ban From Entering the U.S.?
Admitting to using drugs is not a life time ban. Being convicted of drug usage, sale etc beyond 30 grams is a life time ban. Being convicted twice of using drugs can lead to a life time ban.

BTW, I am sure being convicted of MURDER will get you a life time ban.

Correct, you will not be approved for a visa if the income level is not met, by the petitioner or a co-sponsor.

I agree, thank you guys

Well, I asked and he said he gets food stamps and mainecare health insurance through the government.

what do you guys think?

Neither of these benefits will increase, because your status when you have AOS will be that of a LPR. A LPR doesn't quality for these benefits until after 5 years of being as LPR, unless there is a Medical emergency reason.

:ot:
You should be concern because your finance is having financal issues, and you will not be able to even work, until 4 to 6 months after you have arrived if you'll have the funds to AOS.

K-1 Fiance(e) Visa Process & ProceduresK1 VISA DENIED AT US CONSUL IN DOMINICAN REPUBLICK NEED HELP!!

Just for the record....I applied for the K3. They were going to process it as a CR1 but the K3 was going faster so they went that route. All together this will have taken me about 5 months in total. The only difference between K3 and CR1 is - with K3 you need to married 2 years and then the spouse can apply for an adjustment of status, which will cost $1000, and then they are a permanent resident.

With the CR1, you wait longer and you pay $500 in the beginning instead of 2 years after.

Either way you'd have to be married so I'd say just get married and decide which visa is better for your situation.

The above information is so wrong.

Lexi, this is how it goes, if he doesn't know how to get a PC in Jamaica, then he should be asking around in the yard, down the street on the corner, or the taxi driver. Every Youth or General in Jamaicaa KNOWS where and how to attain a PC, if they don't they know whom to ask in the community.

I disagree with putting off school, especially undergrad. Just have him find a new co-sponsor or give his parents more information about what they would be signing. This can be solved with communication and facts.

You may diagree with putting off school, but it seems that the parents have done their due diligence and this is what they have found as the solution to the problem.

Walk in the parents shoes, they feel if their son wants this badly, then he will have to find a way to make it work ithout their direct involvement. They have offer in-direct assistant.

The 55,000 is indeed a gift, the final cost of his college education. Why is it so necessary to complete the visa process, if your future husband cannot meet the finanical obligation. Either he needs to put off his education full time and get a job to meet the finanical obligation if marriage is a must for you'll at this time.

He can continue his education on a part-time basis, if this is what you'll want. The 55.000 gift will always be a thorn in your marriage. You are not going to be able to change the in-laws view on this. They have spoken to those who they feel were qualified to voice any opioions on this subject and this is how they are going to resolve it without being directly involve with the process.

I visited a lot when I was younger. Over the past 5 years, I've visited him 5 times and have photos from all trips. What is a GC? I think the fact that we have known each other for so long and stayed in touch for so many years would be a good thing. We have always had real feelings for each other and a good relatinship, but neither of us wanted to get married (to anyone) when we were younger. We have both matured and are ready for marraige now. I think it's good that we have had a relationship for so long and did not jump to getting married right away.

Thanks, I guess you can only do what you can do. I am planning on sending a copy of phone card and phone records showing use. I'll send whatever records I have from my cell from now until the interview.
It's so funny, I've known Nigel for 11 years, we have photos together from when we were in our 20's (now in 30's). We've known eachother longer than most married American couples I know, and I'm still worried about proving a relationship. SIGH!

What does your visitation record look like? How often have you visit him, and do you have pictures from the visitation. Are you saying that you only have photo's when you'll were in your 20's. Now since you have stated that you have known him for a long time as a friend, how will you be able to convince immigration, that this isn't just for a GC. Look at it through their eyes.

I immediately set up an international calling plan with my cell phone company (they provide records online), but I have no way to prove past calls from calling card. I have the calling card and proof that I used it on my cell records, but it does not show who the calls were actually made to. My petition is at NVC now, how long will it take until the interview? How many of months of phone records should be provided at the interview? Will the calling card and proof of use on phone records count for anything??? I'm so stressed!!!

Your interview would probably be scheduled within the next 2 months, i.e Sept or 1st of Oct.

No he didn't come with a visa, his parents brought him here when he was two and didn't tell him he wasn't legal until he was 10, they tried to apply for citizenship and they were supposed to receive citizenship within a year but then that was right before 911 and apparently he said after that happened that just stopped receiving information from the government and couldn't seem to get in touch with anyone to tell them what's going on.

Ok well we're getting married in a year...what will we need to do is there something special we have to do before getting married?

If he didn't enter the US legally, then your situation isn't that simple as it as been implied. He will have to leave the US to be abe to be eligible for a visa. If he leaves he will trigger a ten year ban. You will have to apply for a harship wavier, as to why the US must allow your husband to return to the US. A hardship wavier is only avavilable for a husband, not a K1 So now you have to make some decisions, do you marry and hope and pray that the US will allow your husband back if he leaves, or just continue life as is.

The web site http://immigrate2us.net is where you will be best assisted with your problem. The folks over-there are in the same situation as you and your friend.

K-1 Fiance(e) Visa Process & ProceduresFiance did not get visa b/c of insufficient evidence

Have not read this whole post - but as far as D and Me and only having one visit - it is not one visit where they met and decided to file - From reading her profile - they met in the US, and she only has 1 visit since he went back to JA - and there were people on this site in that situation who met in the US, didn't have ANY visits to JA until interview time, and were approved.

Sus, since this was not how she explained it, I can not comment on her visits, as I have stated to her , i wish this good luck on this journey. If she feels this is enough, then proceed I will not tell anyone what will get them approved or not. It is up to them if they feel this will convince the CO.

yes he did about 3 of them. One of them lives in the Miami area to date and he had not even heard of VJ. I talked to another friend from Mexico and she said alot of people get VISA's and do not get on this site. She did just last year for her fiance and never even came to this site.

Dan, yes lots of people get visas and they do not come on this site, and lots of people get denials and they don't come on this site either. You asked for advise and I gave it to you based on what I have heard and seen from those who have gone thru the Jamaican embassy. I myself went thru the Kingston embassy, so I can only base my experience on the Kingston embassy, not Mexico.

If you an your SO feels that the one visit is enough evidence, then continue on, but you asked for advise. It seems that people wants advise, but if it isn't the answer they want to hear, they wants to agrue the point.

Please read what Gary/Alla has stated and understand the difference between pettioning for a visa application guidelines and the guideines that the consular uses to issues a visa. Here is his statement "There is NO LAW that says you only have to meet once. That is for the PETITION it is NOT for the visa. For the visa you must convince them you have a realtionship that is NOT established for immigration benefits. There is no specific requirements to do that. It is your job to have "enough" evidence, whatever the CO determines is enough."

Look, these one visit a year, is very hard for the CO to believe that you'll have a true relationship. You are from Jamaica, so it seems that you would be visiting more often if your relationship is that of two people who are madly in love and looking to spend the rest of their lives together. You have the income and you are not burden with children, so there do not seems to be an obstaculars in your way from visiting the love of your life.

You'll burden of proof does seems alittle weak.
LIFE'SJOURNEYFemaleJamaica2011-10-14 18:38:00
K-1 Fiance(e) Visa Process & ProceduresI am now TOTALLY convinced
Sherry, first let me start off by saying how sorry I am about the way things have happen in-regard to your visa application.

Now, it is very hard for outsiders to tell you how to resolve this issue with the best outcome. Why you ask, because your application was denied based on the CO's interview with your SO. We don't know how he reacted to any questions asked or what his body language said to the CO. We don't even know if the embassy had done any outside interviews and what their responds and body language relayed to the questions asked. It seems as if the CO has some reason for concern, and they have held on to their reason for denial, even after two interviews and interviews with outside family members.

Now, you may need to take a step back and analysis all of this and try to find that needle in the haystack that the CO's have reason to be concern about. It maybe nothing, or it could be a giant error for you.
