NVC will probably approved you based on your current income meeting the requirements, but the income issues will raise it's head at the consular level. The Jamaican Embassy may request a co-sponsor because you will only be able show 1 out of the 3 years in meeting the requirements of 125% above poverty level.

The "HOW" I can't help you with, maybe someone else who has done it for a parent will come along. I don't think you will be buying HI from Medicare, since this is government issued. Try getting a ITIN number for your mother, prior to her getting a SS#.

Getting insurance without social security number is impossible.Then we can even buy from medicare with high price .but she is not here ,and should show the proof in embassy or NVC first.

You will have to get an health insurance policy , call around and talk to some health insurance companies. At the age of 70, there will be a limited number of companies that will issue her a policy. This is something that your mother will need, not having medical health insurance coverage for your mother will be suicidal to you'll finance.

Unfortunately your words of encouragement will confuse someone who is a k1, in thinking they should be getting a check list from NVC. When most don't read or do the proper reading to understand the process, they rely on small snippets of words to lead them down the incorrect or right path.

Maybe if you post this in the correct form, you may get some insight. NVC has nothing to do with a K1 visa, but to act as a rest place for 48 hrs.

NVC checks the Beneficiary and all documents for legalities for those going thru AOS only i.e finance documents

The embassy does a check within the country on the Beneficiary and all documents for legalities... i.e PC reports, prior marriages, etc and name check

Butter, the links that have been provided to you above are a must read. Now, the Jamaican embassy will be looking at your 2010, and 2011 or 2012 income to see if you qualify for the poverty level based on your current family size, this will include your husband or finance.

Your SO's income can not be considered unless he can prove that he will continue to receive this income after he has migrated to the US. If you do not meet the poverty income level, the embassy will require that you obtain a co-sponsor.

Your SO police record MUST be clean, if not the US embassy will deny him a visa. If you plan to go to Jamaica and get marry, then you will have to show that your marriage is real. This will need to be demonstrated by multiple visits back to Jamaica while you are waiting on approval for the visa.

This is a costly process, multi visits, phone calls, and the cost for the entire visa process. This can run any where from $4000 to $6000 dollars. I am only stating this because if you are concern with just meeting poverty level for the 864, you haven't taken into consideration the entire cost for the whole process.

another question..all of that will be fine ill just have to get a second job. not a problem.. but when filling it out and sending the past 3 tax returns. do they have to add up to the right amount or just the current job?? thanks so much on the info, ill try to get the form and look at it, i didnt even know anything about it till just a few days ago.



For the 864, the past year and current year will need to be above the poverty level if not then you will need a co-sponsor.

Mrs. Palmer: I am sorry to hear you'll are having such a time with getting the GC, but in the end it will all work out.

Remember everything happens for a reason, so it just gave you'll more time to look at job alternatives.
As far as the adjustments, they are just the norm. It's when you are no longer having fun, that would be a cause for concern. But knowing you, the fun is only getting better.

Joel and I are loving and living life together. We will be taking a trip back home in Feb, for 2 to 3 weeks, to celebrate his B-day and our 2ndyear wedding anniversary. I am so looking forward to going to Ja, where there will be some heat, it's very cold here.

NAT, I have always gone thru the JA citizenship line since I have been traveling to JA, and noone has ever ask me for proof of citizenship thru marriage. I have always stated that I was visting family or my husband and they just say "0kay". Stamp my USA passport and say WELCOME .Just a FYI.

I just got off the phone with the IRS cause I was doing my taxes online and they ask the question if you are not a citizen or resident alien. If you select that option it tells you to fill out a 1040 NR and I know he is not a non resident alien but I went though the whole scenario to make sure.

Hr Block states:
U.S. Citizen or Resident Alien
You're a U.S. citizen if you were born in the United States, have been naturalized, or have at least 1 parent who was a U.S. citizen, and met specific conditions of U.S. residence at the time of your birth. Resident alien status is determined by possession of a green card and by meeting the permanent resident or the substantial presence test under immigration laws.


( that last statement is what threw me off)


So of course I go to good ol publication 519

Usually nonresident aliens and dual-status aliens (part-year residents who are not U.S. citizens) can't file a joint return. However, a nonresident or dual-status alien married to a U.S. citizen or resident alien can file a joint return.In that case, both spouses are treated as full-year U.S. residents, and are taxed on their world-wide income. For more information, see IRS Publication 519 at www.irs.gov for details.



Option to file as a U.S. resident

If your spouse is a U.S. citizen or resident on the last day of the tax year, you can choose to file as a U.S. resident, and file a joint return with your spouse on Form 1040, Form 1040A or Form 1040-EZ. This includes situations in which your spouse is a nonresident alien at the beginning of the year, but a resident alien at the end of the year. Using this option might reduce your tax liability because you can claim dependency exemptions and the standard deduction, but you will not be allowed to take advantage of any tax treaty benefits. See the discussion on how to make this choice on pages 10 and 11 of Publication 519.






Called the IRS she did the presence test and he has been here longer than 183 days and entered as a permanent resident married to a US citizen so I can file 1040 jointly and not need to send any documentation to the IRS declaring wanting to be considered a resident alien for tax purposes as he is a resident.

Lawd all this was working on my nerves LOL. Anyone on a CR1 care to chime in on this one, it made my head hurt LOL

My coworker's Husband is from Antigua and she used Turbo tax and this issue never came up LOL and our Husband's have the same status.


The IRS told me to un-check that box we are good!




Philly, I am not counting the days to see if 183 days are met. So, I will uncheck the box, since he is a LPR.

The only thing I didn't like about my embassy experience was that it's too public, I would think it be more private since there is so much sensitive info being handled. I hate that everyone knows when people are denied or blue slipped its so insensitive!

When they interviewed D Separately he was screaming all of his answers through the window, most I wouldn't have cared but my age and everyone turns to looks at me :blink: . I was hotter than fish grease when he was approved I snatched all the documentation off the counter and gave him such a look and he knew exactly why but we were approved and I was happy until we got home and I asked couldn't you have slipped him a piece of paper or something, he just ignored me LOL
