i read tons of person accounts trying to find out exactly what happens at the physical and no one mentioned it
it was marijuana the doctor called him and told exactly what it was

 

Generally those who  fail the medical don't come back and report it to the board, so you don see many cases here on VJ.  But this is a know fact by those who have been here on VJ for 5 years or more.  Some countries claim they are not tested, but that is a myth they just wasn't part of the group that came back negative.

 

It use to be a 3 year ban, but 2 years ago the government shorten it to 1.   So celebrate the fact that you'll only have to wait a year instead of 3.

To be fair, I've also never read anything about the medical being a drug-testing session either, but I would have assumed so without being told.

 

 

Why would the US government tell you what they are testing for, that would null the point of testing.

Where did you get the information that he could re-apply after a year period of time, if the embassy told him this than that is the case for him.  This would be the case if his medical showed illegal drug substance in his urine or blood.  That would also be the case if he admitted that he has used illegal drugs in his adult life.

 

Going thru the next process you'll will have 3 issues to overcome, one that your relationship is still valid, and two that the Beneficiary has taken steps to discontinue his use of illegal drugs. The third would be that your income could qualify for a household of 4 individuals.

What about living with him for a couple years?  England isn't so bad.  Maybe you could be a dentist, I'm guessing they don't need school there.. ha ha.  Ok joking aside, it sucks the situation you are in, especially with pot being legal in some states anyway.  You can receive all the benefits you want, it is him that can't.  The co-sponsor would be sponsoring him, and essentially he couldn't get benefits or would possibly be punished in some way if he did.  Does your fiance not have a tourist visa?  

 

Having a tourist visa will not assist him in this situation, if he had one it has now been cancelled based on he information from his interview.

 

BTW, states have made pot legal, not the FEDERAL GOVERNMENT and he is asking the FEDERAL GOVERNMENT for a visa.

Just filing a new petition will not grant him a visa, he muss now prove to the US government ha he is not a  chronic smoker of illegal drugs.  The proof on this will be on his end.  How he does that, is by means of suggestion that have been given to you.

Your petition is now dead, it was denied.  He will not be eligible for ANY type of visa for any entry into the US before a 1 year of suspension is up.   The US embassy is under no obligation to spell out the terms of this type of denial.. You can contact  an  immigration lawyer to understand better what proceeding the beneficiary will need to enter into to qualify for a new visa application after a year has passed.

 

Please note, nor a lawyer, nor senator or congressman can assist in this type of denial.

 

 

BTW, the beneficiary knows more than he is sharing if not than the didn't ask he right questions at the interview.

This topic has been discussed every 3 months on this board, and every 3 months everyone acts as if they have never heard of drug testing being done, or " not my country" only the countries that all informed people wants to assume it shopuld only happens to.   I have said this many times from my last 7 years on being on this board, DRUG testing is done in every country, some are lucky and some are not so lucky.

AP is a name check thru the FBI data base, that is one of the checks. Common names sometimes hit up against each other.

My father claimed me last year and the job at which i did pay taxes earned about $2500.... If i have to file jointly with my friend would i have to submit my dads taxes too showing that he claimed me?

My friend is going to do it and makes 32K a year, he only supports himself. Does that income pass the poverty guideline?





32K is enough for 2 people to be above 125% of the establish poverty level.

Yes, filing any immigration papers will bring this issue back to life. Was she charged with anything, such as a misrep charge?

Question2- who initiated the US divorce, she or her ex?

Question3- has she now attained a certified legal divorce.

Question4- WHY was a fax divorce paper necessary in the first place,

We filed with the I-134 the same form I used for my sponsor info for the k-1


Email the embassy and ask them if they want the 864 filled out for a joint sponsor.

Do you and the joint sponsor reside at the same resident?

My fiance had his interview today and we were blue slipped for a joint sponsor...but we already had one. My dad was our joint sponsor and he makes over 47,000 a year and had about 300,000 in assets proven on the I-134 that was at the interview. For a family of five (this is including my fiance) the 125% poverty level is 32,000. So either they "misplaced it" or never even looked at it!:bonk:

My question is can I just send my fiance with all my dad's things again? They kept all of our documents that we submitted today.

This process is so frustrating at times but I pray with this blue slip we can get a fast interview and be approved soon.


You probably didn't file the correct form for the co-sponsor, that is probably why they didn't review the joint sponsor documents.

Then you didn't answer my question correctly, when did he start working the part time job, if he had been working since 2008, then that income would have been included with his 2010 taxes when he filed. Then his 2010 taxes should have reflected the income from both jobs, and if he was over the income, why was there a need for a letter from his employers.

If left blank, then the adjudicator doesn't know if the question was answered or not. Therefore if it doesn't apply to you, then write N/A, if the answer is none, because you don't have one, then write none, but leaving it blank does not answer the question.

This piece of advise should be taken and used on any forms that you are completing for any government agencies, or job applicants.

Whoa whoa, I'm just hearing other options here, understanding they may not work for us, but knowledge is never a bad thing! Even when it may not apply to my situation. And you say the doctors at the embassy will only accept certain documentations, and that's what I'm asking: What documentations will they accept? If the blood test is avaible would they even take it? Will they hear him say he's been in school so assume he's gotten certain shots? Will he go the medical exam with no documents and we'll pay hundreds of dollars for a whole bunch of shots? I am hearing what you're saying about the school, I was asking which school would be better to check with also.




The doctors will accept a copy of his immunization record from school, to eliminate the need to give him duplicate shots. Most of the immunizations listed are childhood immunizations, therefore he would have only gotten them when they were required for his age. So, even now if it is proven that he did not receive the immunization for his age group, he would not be given them as a adult. That is why most people as an adult has only been receiving 3 to 4 of the required shot.

I have tried to share with those who are going thru the Jamaican embassy, process and procedures that will work in their favor, if the OP wants to take the advise of those from other countries so be it. But, I will say this only one time the Jamaican embassy have their own acceptance process. The medical doctors for the embassy will only accept certain documentations, so if you wish to follow a process that they are not accepting, then that is the OP's money.

Most individuals in Jamaican did attend school, every year before going back to school, Jamaican school children are required to have their immunizations updated, if they were not completed and updated, then the school would not have accepted them back for the school year. That is why I have suggested to you to check with his school, they may have something on file. It doesn't matter how long he has been out of school, Jamaican schools are not yet computerized.
