When you asked this same question last week, I suggested that you e-mail the Embassy and ask them the same question or ask if you could drop the documents off, so they would have time to review them.

The only thing I know for sure in this process is that the Embassy works on their timeframe, not on the requestor.

Banj, IMO, the Embassy will have to review and validate the documents that will be submitted with the I-864. Remember, when a CR1 is issued a visa, they are being issued a Green card aswell. The K1 is not issued a Green card until they have done AOS, therfore K1 visas are handle differently.

but the thing is, marrying him is not going to change the reason he is inadmissible...

I don't understand WHY they told him we should get married.... we are still going to need a waiver... and we are able to file a waiver as fiancé's... just does not make sense to me... if you have Federal Legal advice that will clear it up for me by all means send the PM on girl!!

The US govt is trying to protect itself. The I-864 makes you responsible for him, the day he arrives on US soil. The I-134 does not have any legal financially attachment to it. You are not responsible legally for someone who arrives on a K visa. The US is looking at who would be leaglly responsible an indiviual if they are grant permission to enter the US.

You are correct in saying the K and Cr1 can file a waiver, but the question would be , which one would they be more acceptable in granting a wavier, a K1 or a CR1.

I have seen and read the FAM on waviers, but the consular will have the final say on who's waviers are approv.at

We have already provided the tax info., letter from employer & police cert. I'm not sure who he sent all the info to. I ask for copies of everything but don't get it. It's like I'm hassling him to keep my own records but have provided everything to him at least 2 or 3 times. I wasn't sure if I was able to contact the NVC direct if I have a rep on file... I just don't want to create more issues by being impatient ... I just wanna know what is going on.

You the petitioner can contact NVC, but remember the entire process for the CR1 takes up to 8 to 9 months. Try calling NVC later tonight when the lines aren't busy, they are available up to mid-night. They will give you status updates, but they are sending are requests to your rep.

My husband & I got married 07 Mar 2010. I went to a place for assistance with our paperwork & have had nothing but problems with getting any kind of straight answers from them. Luckily enough so far no issues with the paperwork itself. They told me the whole process would take 5-8 months. They delayed our initial filing for a month by requesting copies of all correspondences, which was taking a long time for me to print & read through as there are intimate conversations. It would have literally been boxes of papers. Then to be told they don't need them yet. ugh! Filed and received notice end of May (my exact dates are at home, will provide if needed). Every time I ask how long I'm told 3 month. Then was told he would be here (CA) by Christmas. Not so much.

We filed for an i-130 then a 1-129f. both approved on the same day so the i-129f was closed. We have payed the online fees to the NVC. After paying the fees he sent off another packet with my proof of support, mailed 7 Jan 2011. I just called his office to ask questions and was told this process didn't sound right and was asked to call back in an hour. I don't want another line of bull... so i haven't called them back. I am at wits end & am about to contact my congresswoman for assistance but don't want to create more issues since I pray we are in the last phase. He told me last time we are just waiting for final approval packet.

I want to know if we will receive notice from the USCIS or NVC once the proof of support is received and when paperwork is transfered from USCIS or NVC. When checking the USCIS it shows post decision activity, which I assume is the transfer is in process but not sure. Also, want to know if there is anyway to track when the paperwork is in the NVC's hands.

I am so confused as to where I'm at and where to turn for help or direction ... if you can help please advise.

Okay hold up there is no need to contact your congressman about the lack of communication you are having with your hired help. It sounds as if you'll are at the NVC stage, there are important documents you should now be gathering, such as your tax transcripts, letter from your employer and your husbands police certification. You can call NVC to verify if they are receiving the requested documents from the lawyer.

Good Evening VJ,
I always receive good feedback so here we go again. So, my husband went to the Embassy in Kingston on Tuesday. During his last visit, he was told to complete a new medical examination (after the one year anniversary of last admitted marijuana use). He completed the examination and returned to the Embassy. An officer (not the same one that he has had during his two previous interviews) took the medical package and asked for his Passport. He was given the slip to pay DHL and told him that the package would go to the Consulate and that he will receive his Passport back in two weeks. I love my honey to the ends of the earth but he had no answer when I asked "so were you approved?"
I emailed the embassy in order to receive a clear, concise (ha ha) answer regarding the same question, "are we approved" "denied" what? This was the response:

The Passport and new Medical has been passed to the Officer. Once the officer
has reviewed the documents brought in they will prepare the package for
printing.

Hi LIFE'SJOURNEY... I'm hoping he won't be denied but I was just jumping the gun I guess. They asked him all of the run-of-the-mill questions like:

When did we meet?
When did we last meet?
Where do I live?
Do I have kids... does he have kids?
Where he works?

I thought it was odd that they didn't specify needing more information from me or from him. He's has never had a petition filed before and I've never done this before either. My income is well above the requirement. I provided all the documents they would need to prove financial stability and proof of our relationship (calling card receipts, Digicel receipts, bank statements, etc.)

Not sure what more they want at this point.. so I guess it will be a waiting game once again. :(

I don't know that there WAS a prior K1, but I have seen this type of thing here before and it turned out the consular had found a prior K1 and believed the relationship was not legit...


I agree it is not a good sign that they gave the passport back... :(

Hi all, I am in need of some serious counsel now. My fiance' had his interview today. However, after a short question and answer period, the consular told him that I (the petitioner) would be contacted and that they couldn't issue a visa today. He then proceeded to say that my fiance' would hear more from me. They kept all of our paperwork except his passport and personal cards, photos, etc. The consular never said he was denied.. never gave any denial letters or denial stamps in the passport.

What does this mean? Has anyone gone through this process before? Do they mail a denial/approval letter? I'm sooo confused as they never stated what additional information they need from me. Is this a form or administrative processing?

They will send you a denial letter, why do you think your finace was denied. It doesn't sound good if they didn't keep the passport.

What were the questions asked of your finance?

It may be possible that the consular obtained negative information about the beneficiary (prior K1 filed on his behalf...?)

There is no way for us to speculate with any accuracy, you will have to wait to hear from the embassy. :(

You can try to call or e-mail them and ask why the visa was not issued...

There is no need to notify USCIS, they have the marriage cert and your bith papers. At the time of interview in Kingston, you will have to show them some type of ID, they too will have the marraige cert and birth papers and they will put 2 and 2 together.

My recommendation would be that you do a lot more reading on the requirements for immigration process into the US from start to finish. Your previous post leaves one to think that you are confusing the different situations. The first and initial statement also lend one to believe that someone is looking for a quick and easy fix to their situation, note there is no quick process for legal immigration status into the US.


There are guides under their appropriate Forum or Guide tabular up above that will give you some of the best guidance into the legal immigration path to the US. On the USCIS.gov website there are guides which will give the intended immigration guidelines on what rules they must follow to maintain their legal status in the US after they have been granted a visa to enter. I strongly suggest that you'll read these guides as well, since it looks as if you'll were not tying to have residence in the US for a period of time.

Hello I got some questions to ask about the medical part

I filed for my husband that lives in Jamaica.. I want to know after the nvc documents everything is accepted.. When do they let my husband know about the medical appointment??

He will be mailed an interview date letter along with instructions on when and where to obtain his medical.
do they make the appointment for him or he have to make it on his own??

He or you must make the appointment.
how do they contact him about the medical..our ds3032 was approved through email.

They contact him thru postal mail, if he doesn't receive it in a timely manner, you can call to verify the date, since you will be given your interview date at the NVC stage.
Do they tell him where to go? if so where do they have to go to get the medical done at? my husband lives in ocho rios..

Also the vaccination I heard he can get this done himself at his doctor?? is their any documents out there where I can send him on all the vaccine he needs to get done??

There was a post just the other day that listed the required vaccinations, but be careful of getting the vaccinations too close to the medical appointment date, the Medical has implemented a new policy of not accepting vaccinations proofs if it is within 45 days of his visa medical. What that means is that the Visa Medical will require that he receives the required vaccinations from them at his medical.

My husband said he already got all his vaccine done by his doctor already, is there some kind of proof he can get from his doctor that the NVC will accept??

and when do he have to turn in all of his vaccine and medical information paperwork to at the interview or what??

The medical is turned in a sealed envelope at the interview. So, you nor him will not know of the results until you are being interviewed. There have been cases of great surprises. If you husband has proof of receiving his vaccations then his doctor should have documented this information on a vaccation card. he can take that with him to the medical.

He CANNOT use his own doctor, he must use the approved doctors listed by the embassy. This information will be told to you after the NVC stage.:wacko:



My one and only advise to you, is that you should read any and everything on this site that has been posted by a fellow Yardie, it will help you'll to be successful at the end. There is so much that has been posted about this process and about the Jamaican embassy. A good Saturday and Sunday of reading will only help you to achieve the best result.

Hoping I can get an answer here. Per Dept of State's Jamaica site on non immigrant visas it states

Approved nonimmigrant visas will be delivered directly to applicants through a professional courier service, DHL. At the time applicants are approved for an NIV, they will immediately proceed to the DHL counter. Each visa recipient will pay a fee and will arrange all delivery details with company representatives. DHL will deliver the passport with visa affixed approximately four (4) business days after the date of the Embassy interview.

I AM WONDERING IF ITS POSSIBLE FOR MY FIANCE' TO GO BACK THERE AND ACTUALLY PICK IT UP HIMSELF INSTEAD OF DHL DELIVERING IT?

The visa will be released to DHL only, he can pick up from DHL or wait until they delivery it. DHL will inform him when they have received the visa. There is no pick-up from the embassy.

Your interview date probably won't be until late July or early August. Also the 4 days after approval is not guaranteed, so don't book any air flight until he has the visa physically in his hand.

Then call them, Mike, I have never known them to speak to anyone and give out information over the telephone. MOST people dealing with the Jamaican embassy have gotten their best results thru e-mail. You do what you think is best for you and your, I can only tell you what I have seen to work for all others.

Have BIG Brown envelope in his hand, not in his luggage. Do not open the envelope. Just read the signs at the airport and follow directions. he will be leaving Jamaica with other yardies on the plane, they will direct him in the right directions. No need to worry if his phone doesn't work, another Yardie will always be glad to lend him a call.
