We had new statements of intents to marry that we brought to the interview. First ones were sent with our petition and then we read somewhere around here that brand new ones should be brought to the embassy. Even one of the forms (forgot which one, though) asks for proof of engagement, which, we learned around here, again, is that particular letter.

It's the information I got from the staff at NVC, as well as the Embassy. We were scared something would go wrong, at any point of the process and that we'd end up with an interview date and an expired petition, or anything along the lines of 'harro thar, you're screw*d'. So, once we knew the petition was on its way to Croatia, we shifted to calling/emailing the Embassy. Just to be sure, or to have at least some sort of spoken or written.. or any proof.

I'd also advise you to try to contact the USEM in Bangkok, if anything, to make yourself feel better about it. It was probably really easy for us to do so, though, because it seems that here in Croatia people don't really apply for anything but tourist, student or work visas. For any even remotely immigrant related things, there's pretty much no waiting and, when you call them, they know you by your name.

Steve and Grace, I'm afraid your congressman, or anyone else for that matter, won't be able to do anything at this level. You'll just have to wait it out.

If, for a valid reason (they didn't really list what those would be, when we asked), even the petitioner and/or beneficiary can ask for a NOA2 extension, once the case reaches the Embassy level. We were about to do that, but the Embassy found a way to 'squeeze us' into their schedule when we asked for the initial interview (March 12th) to be postponed. They decided to do that, they said, because it was easier for them than doing all the paperwork that's required for an NOA2 extension.

The visa, once issued, is valid for six months, not four. The petition, once approved, is valid four months (start counting from your NOA2 date). However, it cannot and won't expire as long as it is being processed by (or just sitting at) USCIS, NVC or an Embassy. They'll just automatically extend it.

Example: our petition (NOA2) was going to expire on the 12th of April. We were stuck at NVC for 50-ish days and then, on top of that, rescheduled our interview from March 12th to April 8th. My visa is valid through Oct 7th.

You don't need to worry about your case expiration date - it won't expire. Once your visa is issued, it'll be valid for 6 months. Whenever, during that timeframe, you enter the US, your visa becomes invalid and you have 90 days to get done with your business (marrying/AOS-ing, leaving.. whatever rocks your boat!).

Actually the consulate cannot deny an approved petition at the application stage, they can just send it back to the US with a "suggestion" for lack of a better word.



I thought consulate could reject. For example, in cases of material misrepresentation - let's say applicant claims to be unmarried but is in fact married. Does the consulate refer it back to USCIS, or just trash the application outright?

I don't think a consulate can reject a petition - once it's there, it's already been approved and the decision can't be overthrown. What consulates can do is visa denial. After that, the petitions are sent back to the USCIS and I'm sure that, in case of, say, misrepresentations of materials and the like, they'd send it back with a note attached to it. (Meaning - once it's back to USCIS, that kind of petition wouldn't be looked at ever again and any and all later attempts of the applicants to apply for whatever would be somehow flagged.)

I've never heard of case being denied at NVC stage for a K.

At the consulate level.....sure.

But administrative processing IS something you will get out of. Even if right now, you feel disheartened.


I remember someone posted on this thread way, way back in the early days (around Dec/Jan) that NVC does not have the power to reject a petition outright. All they can do is delay it indefinitely, but they must pass it on eventually to the consulate. Only CSC/VSC, or the consulate, can reject a petition or visa application. Which kind of makes you wonder why NVC would even bother holding a file in AP since they are obligated to release it and pass it forward. I don't believe they can even issue an RFE (at least, we here on this thread have never heard of an AP case being given an RFE). All cases apparently just pass through with no ability by us to understand why they are being held, for how long, what exactly is being checked, or why. It's a very frustrating, maddening experience. The only thing we can say with some certainty is that it will end, and it your case will eventually get to the consulate.

Any other old-timers (cdneh, Talyss, Badgerella ,....) can you comment any further on this?

I don't think any of us can say a lot more than this. The process itself does, definitely, have an end, but it doesn't mean you ever find out what it was all about. Cdneh reported seeing a stack of papers with checkboxes on it (or something along the lines of that) and her interviewer mentioned her case being stuck in AP 'at random'. During my interview, I saw nothing at all at the CO's desk that wasn't one of the required documents one needs to submit for the consular stage of the process (DS-156, or whatever it's called, as well as those Part I documents and the like). Nobody mentioned our Administrative Processing, the reasons we spent 50-something days in it, or any and all things related to the outcome of the actual thing. That leads me to assume they either found nothing at all or... that our case actually sat there on someone's desk, waiting for the person to, pretty much, remember to forward it to Croatia.

How I see the process, now? A case comes to NVC. Most of them get forwarded to their respective embassies right away, while a certain percentage stays at NVC. Names get thrown into the system and, likely, within minutes (maybe hours or a day.. or something like that) the results are displayed. The (insanely long) wait exists because: a) it takes a while for the case to be entered into that whatever check-system; b ) it takes even longer for the staff to pack it back up and forward it.

More random ramblings: c) Every John Smith, Margaret Thatcher, Barrack Obama or Saddam Hussein gets entered into the system right away. Just i case.

Every SomeOtherPerson gets in there - really at random.


Unfortunately, all of the above is really nothing but my random ramblings. I don't think we'll ever find out what exactly is going on there, or why. Hopefully no one ever finds out what all can be found and, later on, used against the applicants. So far, we've all been fine!

No need to worry about your NOA2, or any other things expiring - as long as your case is in USCIS, NVC or USEM hands, it can't expire as it'll be automatically extended. We were in the same boat during our AP stay and our interview was postponed to a date just a few days before our petition expiration date, so we checked both with the NVC and the Embassy here in Zagreb. You'll be safe!

I asked if my case was being treated differently than others ... I asked why I was sent a letter saying that my case would be forwarded "within a week" to my consulate. I was very polite but persistent in asking what this delay meant.

The only answer I got was that it takes up to 4 weeks and I will be contacted when it is sent on. They always confirm my phone number and email address when I call for some reason. I find it hard to believe that they would ever call me!

I just would love to know, as I suppose everyone here would, why this delay happens and what a legitimate assessment of the wait will be. The waiting isn't the worst part ... Its not knowing how long the wait will be.

Darn it! I've got a wedding to plan!

This reminds me of pretty much every single one of my calls to NVC.

Blago tebi sto ces odmah dobiti GC na 10 godina.
Sva ova papirologija me ubija. Nas plan je da zivimo tu max. 5 godina i onda povratak u Europu. I onda ce sav taj proces biti uzaludan, i svi novci koje smo potrosili.

Joj tu je prije par dana pocela sezona uragana hahah. Sada skoro svaki dan pada kisa, a kad prestane postane vruce i sparno...

Ja sam jos uvijek u kuci i cekam svoju radnu dozvolu ko ozeblo sunce. Vise stvarno ne mogu biti doma. Vec su prosla 4 mjeseca da ne radim sad.gif

Sto se tice vozackog ako imas vozacku iz svoje zemlje tu trebas proci dva testa na kompjuteru. Prvo je 20 pitanja zakon i 20 pitanja znakovi. Mozes u svakom dijelu pogrijesiti 5 pitanja. Naravno sve je multiple choise. Ako to prodes ides na voznju po parkiralistu i to je to. Ja sam bila gotova za 40 minuta. Sve kosta 27 dolara. Ovo sto se tice zakona odes prije u njihov ured pa ti daju malu knjizicu kao neki casopis i tamo sve pise, to procitas dan ranije i sve ce biti u redu.

Cini mi se da ako nemas vozacku od prije moras otici na neko predavanje od 4 sata i to je to, samo ne znam koliko kosta.

E da i ne mozes na vozacki prije nego dobijes NOA za AOS.

Ivancicas sretno sada s pakiranjem, brzo ce ti proci ovih mjesec dana. Sada kad se sjetim sve mije izgledalo kao da nikada nece doci dan kada cu krenuti, radila sam tjedan dana prije polaska i na kraju sam sve radila u zurbi.
Ja sam imala srece sa svojim stvarima jer sam jedan kofer dala muzu da mi on odnese mjesec dana prije nego sam odlazila, jedan kofer sam dala muzovom bratu koji je dolazio na vjencanje i puno stvari mi je donjela sestra koja je dolazila na vjencanje, a sama sam isla s dva ogromna kofera i rucnom torbom. U New Yourku gdje sam presjedala i morala promjeniti terminale proklinjala sam svoje stvari jer sam mislila da cu umrijeti vukuci sve to, ali pokretne trake su pomogle smile.gif

Meni je danas konacno dosla vozacka tako da vise ne moram okolo hodati s putovnicom, hrvatkom vozackom i medunarodnom. Morala sam samo za dokumente imati posebnu torbu smile.gif
Veceras idem negdje van samo da mogu na ulazu pokazati svoju novu vozacku.... smile.gif

nisu mi trazili nista od dokumenata,a nisam ni nosila,samo pasos i lekarski,cak nisu uzeli ni slike jer su rekli da imaju.
To sto mi nisu rekli da sam odobrena ili odbijena,me malo cudi,ali kad sam pitala ovog amera da li to znaci da je sve gotovo,on je rekao da jeste.
Sutra cu da znam sta je u stvari,mada mislim da je sve ok.

K3 viza je mozda prije bila brza, ali sada izgleda da je brza K1 viza. Neki prosjek je 4-5 mjeseci, kako koja zemlja.

Kod mene pada kisa od nedjelje (valjda nije padala sve skupa 4-5 sati od kad je pocela). Puno cesta i kuca je pod vodom, sva sreca nama nije nista. Jedva cekam sunce....pa dosla sam na Floridu koja bi trebala biti sunshune state smile.gifsmile.gif

Ja sam do sada bila jedanput kod frizera i to prije vjencanja. Mislim da je pranje, sisanje i frizura bili 40 dolara. Isla sam u mall jer je to bio jedini frizeraj koji sam vidjela. Osisali su me super tako da cu valjda tamo opet, mislim da je samo sisanje 25 dolara.
Inace sam cijelo vrijeme radila pramenove, ali par mjeseci prije odlaska sam se farbala u prirodnu boju (tamno plava) tako da ne trebam kod frizera dok ne vidim gdje i sto. Ali sunce je ucinilo svoje tako da sam opet plava smile.gif

Nakon vjencanja trebas opet skupiti sve papire i aplicirati za zelenu kartu (AOS adjustment of status), radnu dozvolu (EAD employment authorization document) -> ne kosta nista ako saljes s papirima za AOS a moze biti odobrena prije zelene karte i neki apliciraju za AP advance parole -> ako hoces putovati izvan usa prije nego dobijes zelenu kartu. Ja nisam aplicirala za AP.
Sve u svemu traje nekih 3 mjeseca proces.
Sto se tice lijecnickih papira za AOS mi smo slali kopiju lijecnickog koju sam dobila u koverti na intervju-u u ambasadi zajedno s slikom puca. Odvjetnica nam je rekla da ako nemamo nista od doktora da se mogu i slati racuni da si primio sva potrebna cjepiva. Najbolje da poneses sve papire od doktora da ne moras opet tu nesto raditi, a i kosta.

Vec dva dana pada kisa bez prestanka....

Ma sto se odjece tice trebat ce ti nesto lagano. Inace nisam ljubitelj klima, a ovdje gdje god da udes drze temperaturu na valjda 15 celzijusa. Ja sam stalno sa nekom vestom/majicom u ruci i stalno se oblacim i skidam, ali sto mogu kada je vani vruce, a u zatvorenim prostorima hladno.

S obzirom da niti moj muz niti ja nemamo nikoga tu u usa imali smo malo vjencanje, vise radi papira, a kad se vratimo doma imat cemo tulum s obitelji i prijateljima.

Mi smo imali vjencanje na plazi, stvarno malo nista veliko. Nakon toga smo isli u restoran gdje muz zna vlasnike. Pripreme su trajale sve skupa 5 dana ukljucujuci vadenje dozvole za vjencanje.
Mala preporuka za cure koje pripremaju vjencanje: probajte nabaviti sve sto vam treba doma jer kad dodete tu necete znati bas puno ducana, frizera gdje kupiti cipele ili buket...ok buket cete morati imati svjezi:)...
Ja sam imala namjeru kupiti neku haljinu u Zagrebu, ali na kraju je vrijeme tako brzo proslo i nisam nista nasla. Nisam htjela imati vjencanicu vec neku haljinu. Na kraju sam zavrsila lutajuci po Orlandu i dva dana prije vjencanja kupila haljinu, jedinu koja mi se svidjela...

Pozdrav svima... da vam se i ja pridruzim.

Dosla sam u usa prije tri mjeseca sa K1 vizom i trenutno cekam zelenu kartu i radnu dozvolu (ne mogu vise ne raditi!!!)...Nadam se da cu sve brzo dobiti. Vidim da se neke od vas sele na Floridu, gdje? Ja sam u Daytona Beach.

Inace sam zavrsila ekonomiju u Zagrebu, ali za sada nemam pojma koliko ce mi koristiti. Na faksu sam trazila da mi izdaju diplomu na engleskom pa imam to. Inace bi htjela upisati neki master samo kad pocnem raditi. Razmisljela sam i da upisem neki college pa da dobijem jos jednu diplomu bachelor...Bas cu sljedeci tjedan otici vidjeti da li mi se nesto prizna i koliko bi ispita morala dati ako upisem nesto vezano uz ekonomiju.

Sto se hrane tice u Daytoni nisam nasla nista s nasih prostora, a niti sam upoznala nikoga iz nasih prostora. Jucer sam s muzem isla do Jacksonvilla pa smo prvo naisli na jednog taksista iz Bosne koji nas je uputio u ducan s nasom hranom tako da sam se opskrbila sa slatkim i slanih stvarima (inace ne volim kuhati tako da to prepusam muzu)...
