Speaking of Affidavits and such - we called the Embassy and co-sponsors are, according to them, allowed and used all the time.

However, there is one more technicality I am unsure, but curious about. We hope that, financially, what my fiance will have by the time of the interview will be enough. We'll also have a signed and overall ready co-sponsor Affidavit, but we'd like to not turn it in with the rest of the documents at the Embassy, but instead to give it to the CO in case they asked for more proof (documents, whatevers) during the interview. Is this even possible? Or is it better to hand in both Affidavits? Would they just ignore (and therefore return) the one signed by the co-sponsor if the petitioner's was sufficient?

The problem might be the fact that my fiance won't have tax returns for any year other than 2008. He makes enough money now, and has been in 2008, overall. Before that, he was in college and didn't file taxes.

Badgerella, I read somewhere about a girl who had two sets of fin-l dox too, her fiance's and their co-sponsors. When she was called to submit the documents before the interview to one of the consulate workers, she gave her fiance's financial papers and said that they also had a co-sponsor, however she was told that she would only need to present them if the CO asked during the interview. And I believe he never did.

Thanks for your help. It'll be awesome if it ends up working for us that way.

US Embassy and Consulate DiscussionNOA2 expiration date
Our NOA2 is valid through April 10th 2009. The case is at the Embassy in Zagreb now, my interview date has been scheduled. We 'lost' quite a bit of time (52 days) in AP at NVC so things are a little bit out of order now.

My fiance would like to be here for the interview, which is why we need to reschedule the date. Only two dates work well for us (airline, his job, etc) so the interview could be on April 2nd or April 9th. The USEM in Zagreb processes a very small number of immigrant visas, is very friendly and has no problems with interview dates being rescheduled.

I have the following questions, though:

1. Is it too risky to ask for our interview to be scheduled for April 9th?

What happens if we get denied, put into more AP, or if they simply ask for more documentantion, or anything that would happen on, say, April 11th or after? I was told, at NVC, that a case cannot expire as long as it's in USCIS/NVC/USEM hands - it gets automatically extended as long as they have it. Is this correct?

2. How hard or bad is it for your case to be extended? How does one go about it?

Thanks in advance for all your help.

US Embassy and Consulate Discussionquestion about medical exam
I had my medical today, in Zagreb, Croatia.

I had a blood test (HIV and syphilis - nothing else). The panel phyisican filled in some Embassy form that I had to sign, and that was about it, right there at his office. He wanted to know if I used medications, smoked, had asthma, diabethes or high blood pressure problems and asked if I knew my height and weight. He listened to my heartbeat with a stethoscope, as well as my lungs. My vaccination chart showed no need for any other vaccinations. Then I was sent to get a chest x-ray, got the results right away, brought them back to him and that's where it ended.

There were no pregnancy tests, no questions asked about drug use, or basically any of the things people from other countries often mention.

Could he call the consulate and request a later interview date? I don't know if anyone has done this, and what the implications are, but it would seem to me that the consulate would be more annoyed by someone not showing to an appointment than if someone calls and says they can't make that day.

We had no problems, at all, rescheduling our interview. I know of at least one more Croatian person who has done it. We told the truth - we wanted my fiance to be here for the interview and the original date didn't work for him.

US Embassy and Consulate DiscussionIf I was to call the embassy will they answer my questions?
I have, of course, no idea about the Embassy in Colombia, but here in Croatia, it's really easy to get them to answer one's questions on the phone. One is given a lot more details and overall better information than in an email. An email, of course, takes longer, too.

On the DS-230 Part 1 form, starting on question 14, it asks me the name of my "spouse." We are doing a K-1, so are not married yet -- I only have a fiancee. Am I to write his name in this field or leave it blank?

Directly after that, there are questions saying "father's date of birth, mother's date of birth," etc etc... but it's unclear if this is related to my fiancee (spouse?) or if it's asking ME for MY parents' info.

Help? Thanks.

Maybe different at your embassy but most embassies require a DS 156, DS 156K and a DS 157 for fiance visas. DS 230 is normally for immigrant visas. K1 is nonimmigrant.

The letter I got from the Embassy says I need two copies DS-156, DS-156K and DS-230 Part I.

33. Do You Intend To Study in The U.S.

I plan on finding employment for the first year or two whilst we get settled and my AOS comes though, but after this time I plan on going to a community college then onto a university for Civil Engineering.

Do I answer Yes to this question and add an explanation of my plans with the area for the address? Same with 32. Do You Intend To Work in The U.S, should I simply put Yes and "Employer Unknown".

Final question, my parents will be travelling with me but on I-94Ws. 34. Names and Relationships of Persons Traveling With You , I presume I answer this as No, because they will be going through immigration as their own party and I will be going through alone.

Thanks for any help guys, just got my packet 3 today biggrin.gif
Martin.

I had the same doubts with this, as well as other forms. Here's the thread where I was given some advice.

I wrote that I might study sometime in the future, that I intend to work as soon as I get my authorization and the field about people traveling with me I left blank (as well as some other ones that were referring to things that were, at the point of my interview, unclear or not yet decided on - for instance, I of course couldn't tell how long I'd be staying in the US, so instead of typing 'forever' or the like, I left it blank). I had no problems at all with these 'blanks', all I did was warn the CO about them, so they wouldn't be surprised and - they were perfectly fine with it. They said DS-156 was a general form, anyway, and that many of the questions on it simply didn't apply to K visas at all.

We only had them for 2008. but, of course, if you have more, include them. They did not ask for any of them, though, which probably does not apply to many other consulates or embassies (we weren't ask to show anything other than the required forms).

We had no problems, at all, rescheduling our interview at the Embassy in Zagreb, Croatia. We called them on the phone and all I got was a new invitation letter which, according to them, wasn't necessary in the first place.

Of course, Embassies/Consulates vary, so make sure to contact the one in China and ask if it is possible and what one needs to do to make it official.

It might make the process go a tad faster if you bring the certified copies or originals AND photocopies. That way, they won't have to get up & make copies themselves. Small thing, but they may appreciate it!

hi, what is the difference between Original and Certified copy???? blink.gif

thanks

Birth Certificate, for example: The original is the one issued when you were born. If you still have it, great! But if not, you can request a certified copy, which will have the raised seal on it.

I would assume this depends on a country.

Here, a birth certificate is issued whenever you request one. Every time it's issued, you get the original. A certified copy (of that same birth certificate, for instance) would be a notarized copy, or a copy of some whatever document with the stamp of the issuing place on it.

I gave them the originals - of my birth certificate and a certificate that wasn't required, but I brought it anyway, that states that I am not currently married in Croatia and that I plan to marry my fiance. They made copies and kept them and the originals were returned to me.

I have not been previously married, so I can't help you with any divorce-related documents. Both police certificates (for Croatia, two are required) were originals and they kept them.

We had a huge briefcase full of evidence, but the CO asked for none of it. He only looked at the forms we submitted at the Embassy stage.

The briefcase contained about 100 pages of printed emails, chat logs, skype logs. Phone records for the past few years. A fat stack of photos. Boarding passes. Addresses from many of the packages we sent to each other in mail. Some postcards and letters. Some receipts. Probably a bunch more things I can't even remember right now.

We wanted to make sure we had anything and everything available, if asked to show more proof. However, none of it was needed.

you give it to the customs and border patrol (CBP) people who will check your visa and allow or deny your entry to the usa.

According the the instruction given to me at the Embassy in Zagreb, Croatia, the evenlope is to be given to either the CBP people or a public health representative, when I first land in the US. Nobody else, under any circumstances.

I think John has offered good advice here. I would also add that DS-230 was just updated in February and changed a fair bit. Now rev 02-2009, previous editions obsolete.

Which document is evidence of engagement to your fiance(e)? does it have a document number?

Thanks for your help. I'll look into the new, updated DS-230 when I get home from work. In my posts, I was referring to the old one, the one the Embassy sent me. The 'Evidence of Engagement to your Fiance(e) thing did not have a number attached to it, but I don't have the form handy here at work and therefore can't check either.

As for the school-related question, I don't think I'll be able to squeeze in all the schools I've attended, so an additonal sheet might be made.

One more question I am unsure about:

DS-230 Part I
* Question #23: List below all educational institutions attended. (School and location; From/To; Course of Study; Degree or Diploma)
What all does this include? Elementary, high school, college? Private additional schools? Courses that are completed outside 'regular' school, that also give me a degree of some sort? For instance, for 17 years I attended English lessons at a private language school. I have a diploma, as well as a diploma/degree issued by the Cambridge University in the UK. Does this go on the list, too? Considering the fact there are only four lines on the actual form, and if all my education is to be listed, I won't have enough room to list them all. Do I add an additional sheet, the way we did for our I-129f and the other forms that were sent to the USCIS?

One of the documents that must be attached in order to apply for a fiance(e) nonimmigrant visa is 'Evidence of Engagement to your fiance(e). What, exactly, is that? Another signed 'Intent to marry' letter? I can't think of any other evidence I could provide, that would be acceptable in form of a document. I do have a Croatian official document stating that I am single and planning to marry my fiance (both our names are listed on it) and that our marriage will be recognized by the Croatian law whenever I come here, but I assume this is not what the form wants me to provide.

Check the Guides above. http://www.visajourn...mp;page=k1guide
There are many things you need to get together and your fiancee needs to send you a lot of documents before the interview: pictures, e-mails, letters, original documents.

Thanks for your help!

We have all those things ready and my fiance will bring them here in person - he's coming to Croatia for the interview. It's just that I don't really understand what this 'Evidence of engagement to your fiance(e)' would be. Is it that 'Intent to marry' letter, or something completely different?

Also, most of the things you suggested I type in those boxes can't possibly fit in if I do it on the computer. Do I include separate sheets even for my DS-156? Uhh.

US Embassy and Consulate DiscussionDS-156/DS-156K/DS-230 Part I
My K-1 interview is getting closer and I've been looking into the forms I need to fill in.

In Croatia, the Embassy sends you your Packet 3 and Packet 4 together and it includes the forms that need to be brought to the interview. I received a DS-156, DS-156K and a DS-230 Part I. I've read online (both on the USEM website and here) that one needs to make sure they're filling and then turning in a valid form. The forms, also, must be in English (at least in some countries, there are 'help' forms, translated to various languages that help the applicants do the right thing). All of the forms have 'Previous editions obsolete' printed at the bottom of every page. However, the DS-156 I received is in Croatian and it expired on August 31st 2004 (information found in the upper right corner). DS-156K is full of stains, but othervise - usable and non expired (exp date: 09/30/2010). DS-230 Part I is also valid and a little bit stained (both have the weird 'mark' at the top of the sheet, that could be from either the printer or some sort of a paperclip). I only have one page of the latter, but the form itself says 'Page 1 of 4'. Is this enough, just the first page (I would assume that Part I means exactly this, just one page, but I guess one can never be sure).

I called the Embassy to ask about the expired/Croatian form and the lady said it didn't really matter much - according to her, I could either bring whatever they sent me, or print my own copies. I'd still like to do it the best possible way. So far I have learned that what I see on their website, or even hear from them, can never be 100% accurate. She said that the K-1 visas are not processed electronically and that I can't fill them in online the way I would do them prior to a B2 interview (I've applied for four visitor visas to the US in the past and I've always done my DS-156 online. After that, one is supposed to print it out and a bring a copy to the interview.)

The questions I have are the following:
1. Should I print out the forms that can be acquired online, at least the expired DS-156? That way I'd have a copy that's both in English and not expired. The size of the paper will differ from what they sent me (they use the American standards at the Embassy and I only have European printing paper).
2. Should I fill in the forms by hand, or on the computer? Does it even matter?

I also have a number of questions regarding the information I need to provide.

DS-156:
* Question #22: When do you intend to arrive in the U.S.?
On the day of my interview, I won't be able to provide an answer to this question. We plan to have me there sometime in the summer, but it could really be any date, during the validity of my K-1 visa.
* Question #26: How long do you intend to stay in the U.S.?
What does one say here? 'Forever'?
* Question #27: What is the purpose of your trip?
Here, as well?
* Question #32: Do you intend to work in the U.S.?
This one is unclear as well - yes, I do, but of course after I've been issued a permit. During my non-immigrant days (prior to the marriage and AP/AOS, of course I do not).
* Question #33: Do you intend to study in the U.S.?
Again, no, that is not the purpose of my trip and I would not, before I have adjusted my status, etc. But whether or not I ever will - I do not know. Simply - I might.
* Question #34: Names and relationships of persons traveling with you
Nobody is intending to immigrate, but I might have someone traveling with me. We plan to have my mother come to the US with me, but on the interview day, I won't know for sure. If she'll be there, it'll be a B2 trip. However, I won't know much about this a few months prior to the actual trip. If it's not my mother, it could be, basically, anyone (my fiance, perhaps, my sister..) who will decide or be able to travel with me, whenever I do.
* Question #36: Has anyone ever filed an immigrant visa petition on your behalf?
No one ever has. I've only applied for B2 visas and this is my one and only K-1, ever. Considering the fact that K-1 is a nonimmigrant visa, I would assume I answer 'No' to this one.

DS-156K:
* Question #4: Marital status; d) if presently married, how will you marry your U.S. citizen fiance(e)? Explain* (*NOTE - If presently married to anyone, you are not eligible for a fiance(e) visa.
What is the purpose of this option? It does not apply to me, but.. I am curious.

I might be overcomplicating here, but I can't help it. When I see a form I need to fill in, I go - nuts. wink.gif

Thank you for your patience, as well as any and all help! star_smile.gif

ALL documents presented at the interview MUST be in English or accompanied with an English translation, certified by the translator to be a true and accurate translation of the document.

In fact, make sure you check with the Embassy what needs to be translated, if anything.

In Croatia, NO document presented at the interview must be in English. They read Croatian just fine.

My timeline and signature explain it.

There have only been a few of us, all from late August, which was really unexpected. Therefore I think it's safe to say that September won't come all that soon. There are so many people whose applications yet have to be processed and they filed at the beginning of August, or earlier.

The day we got our NOA2, our expected timeline (VJ's) was showing jan 17th-Jan 20-something.

K-1 Fiance(e) Visa Case Filing and Progress Reportspossible to delay final interview??
There should be no problem with that - once you get your NOA2 and have your interview date, you can contact the Embassy and ask for it to be rescheduled. Of course, every USEM works differently, but I know for a fact that in Croatia there are NO problems with this, at all.
