K-1 Fiance(e) Visa Case Filing and Progress ReportsJune 2008 Filers!
hi everybody, I just wanted to share with you that today i had interview at embassy at Zagreb, Croatia and my visa is approved. Everything was really easy and fast just 25 min smile.gif
First, one woman gave me medical results and xray and told me that i should bring that with me. I just gave her documents from the list that i get from embassy, she took my fingerprints and i spoke with consul for about 5 minutes. He asked me when did we meet and where (when i said that we met 1998 he asked "what took him so long and he start to laugh), and who from my family is planning to come for weeding. He didnt ask for no evidence, for no extra paper or clarification.
At the end he told me that somebody will call me tomorrow to tell me that i can come to pick up passport with visa cause they have to print it and everything. And that was it. kicking.gif

Congratulations, everyone who's gotten out recently.

I would assume we're still stuck. It hasn't been even six weeks.

I'd call, but my fiance hates hearing about it, so... we'll give it a few more days before I talk to another person. Hopefully this next one will actually speak English, heh.

We're getting sick of this all, and the 'worst', crucial part has yet to come. We're still worried that AP can affect the outcome of the interview. In a negative way, of course.

...I can let you know in about ten days time if there's anything to your theory...

I hope you'll get your visa right away! Good luck.

We're just really worried because of all the bad experience we've had with the visitor visa. Back then, there were no reasons at all for any of the four to be denied, but, of course, each and every one was, for some really weird and stupid reasons. It's just hard to believe that now, all of a sudden, they'll decide to actually act the way they should. Meh.

I just counted the days. Today is - 5 weeks.

In our case - no previous marriages, name changes, police records or any other things that would, in any way, at all, be considered out of the ordinary. Stuck in AP since Dec 18th.

All four times they read the same phone number - my fiance's landline, and they asked basically the same question. Usually they want to know if that's our/my phone, once they asked if it was my fiance's phone number.

I, of course, never called from that one, since I'm stuck on the other side of the world.

do you know if the beneficiary is allowed to call and ask?

I'm the beneficiary and I've been calling from the beginning.

You need to have your case number ready, both the petitioner and beneficiary's date of birth and they'll probably ask you to verify something (they keep asking me the same thing). Some of them ask who you are, some don't.

We had two letters from NVC, both identical. The first was recieved on the 12th, and the second on the 16th. Both of them said that our case would be forwarded onto the appropriate foreign embassy 'within a week'. Has anybody who got stuck in AP had this letter, or do you get it at the end of the processing?

Just want to know if we're 'safe' from being stuck at NVC yet.

We got that letter (in mail) long before we had any and all ideas about this AP thing. I hope that's not happening to you, too. KimandRuss had two letters as well, as much as I understand. And then spent three weeks APing.

Wasn't our case.

Unless the person I talked to today couldn't understand at all what I was asking or saying. Why? Because they basically speak no English. Heh.

Still AP, said the mysterious foreigner.

Aaaaaa.

I talked to NVC Monday evening, CET time...

I did a DHL search today. Something left NVC Tuesday afternoon and was received today. Zagreb, Croatia. Someone named Skrnjug signed for it.

Considering how many Croatians apply for a visa that has to go through NVC.... it could very well be ours.

Considering our luck, it's not ours.

Should I call or... should I not?

Aaaaaaaaaaa. Temptations. Grr.

Yeah, this kind of waiting is really horrible.

I mean, we weren't really thinking we'd get denied at the USCIS stage, I have to admit. Then the NOA2 came a lot sooner than expected. Awesome. Now the case is 'lost' at NVC (or Washington?!?) and... it's eating us alive. Not because we're waiting some more (we wanted to reschedule the interview in the first place), but because we just dont' know anything.

As for the 'just in case' options... we can't really think of any. If we get denied... ugh.

EDIT: My fiance now wants to know what those 'just in case' options actually are. :)

As for the worrying, it's not just that. It's just disgusting. The whole process alone, let alone all the unknowns and indefinites. After all, I guess it's not that easy to import a cow, heh.

Do we know people here who were in AP at some stage of the process (or, more specifically, the NVC part), but still got their visas without problems?

We're beginning to think that this can't be a good sign.

Do we know why people end up in AP in the first place? Does something need to show up and raise flags, or is it actually, at least in most cases, just random? Like... additional checkup for a certain number of cases, which then catches the unlucky?

I just worry that, even though there is not A SINGLE THING we've ever done that could raise any red flags at all (legal or, actually, any basis at all), they'll find some nonexistent thing, turn it into a flag or a special note and just have us get denied at the USEM stage.

I really hope I am worried for no good reason at all, other than getting angry and impatient. =/

I would have waited until later tonight, but because of my work schedule I just can't afford staying up too long this week.

Either way, I just got done talking to a female operator, far from professional, at least in terms of having even the slightest idea of what she is supposed to say and, above all, of how she is supposed to address me. She called me a sir, then realized right away that I was, in fact female, then apologized, called me a ma'am, but then went on and on and on with her sir.. ring. Oh well.

####### aside, she went to talk to her supervisor when she opened the case (heard her typing, then she excused herself). I would assume she wasn't sure what she was supposed to say about this. "You're under a process that we call Administrative Processing.", she said when she came back. I asked what it meant, she said - nothing at all, not a word. Our case is being reviewed, quite possibly in Washington (it was pretty hard to understand her un-professional way of conducting the conversation), as part of the standard AP procedure. Timeframe does not exist (I asked). They'll forward the case to the Embassy as soon as it's cleared and ready to go. (Oh really?)

I also asked about expiration dates and she said that it's impossible for anything to expire as long as it's in USCIS, NVC or an USEM hands. At least the latter is, uh, some sort of a comfort?

They received our papers on the 18th of December. We've had the letter, hard copy, since the 23rd. So... it's been a while.

And counting. =/

I forgot to add - she also said that so many people these days were undergoing the same procedure. More than they usually do.

So.. what happens if the case gets stuck long enough for the NOA2 to expire? Which is, what, four months?

Who gets what extended? Who do you call? Who do you ###### at? Who.. etc.

Still no news here. Waiting a few more hours before I call.

My fiance found a package delivered to the USEM in Zagreb today, or something like that, but according to the info coming from an embassy email.. nope, not ours. Meh.

According to the bunch of things some woman on the phone told me (more about it here.) it seems AP doesn't necessarily mean AP, but instead - it's a part of some normal, whatever procedure and also could just be some holiday-related delay.

She basically just said our petition was sitting there, waiting to be shipped.

National Visa Center (Dept of State)What is "Additional Processing" in NVC?
QUOTE (conny @ Jul 28 2009, 02:43 AM) <{POST_SNAPBACK}>
I consulted with attorney and he said the Administrative Processing is not the same as Additional Processing. NVC doesn't give details on what each process consists of but apparently those cases in Administrative Processing take longer. Also, apparently many cases (percentage-wise) go through additional processing. The only other difference that was notices between them is that Administrative Processing seems to be done on the cases with obvious red flags.

I don't really hate to say it, but most attorneys don't really know anything about immigration processes, other than how to milk your money.

So, once more, Administrative Processing and Additional Processing are the same. We went through both while our case was there. Why? Because I talked on the phone with different people every time I called. Some used neither phrase, they were just being very descriptive. Just some cases go through any processing other than 'Hi, bye'. Most of it is random. Administrative/Additional Processing is done to ALL the cases with obvious red flags.

Ours had no red flag at all, obvious or hidden. It just went through some sleeping at someone's desk, likely, or they ran it through their databases as a random sample.

You'll never find out, anyway. And it'll be easier for you to just learn to live with the fact that your case will take (a bit) longer to get to its respective embassy. Because of Administrative Processing, that is also known as Additional Processing. wink.gif
BadgerellaFemaleCroatia2009-08-01 12:12:00
National Visa Center (Dept of State)What is "Additional Processing" in NVC?
Administrative Processing and Additional Processing are exactly the same thing. It's whatever the person you get in contact with feels like saying.

This link, previously mentioned in this thread, will likely give you any and all information available.

More than likely, you will never find out was done to your case while it NVC had it and it likely won't affect the outcome of your interview.

US Embassy and Consulate DiscussionQuick B2 visa question (tourist visa)
Hello, Ivy.

I, also, am from Croatia. I've applied for and been denied a tourist visa three times so far. Soon my fiance and I will be applying for a K1, but before that, or technically around the same time, I will be applying for another tourist visa because I want to spend my vacation in the States with the fiance.

Here are my, I must say horrible, experiences with the Embassy in Croatia. I hope these don't discourage you, but I'd like to point out that Croatia really seems to be nothing but lottery.

I'll be applying for that tourist visa about a month from now.

Good luck.

US Embassy and Consulate Discussionregarding the interview...
QUOTE (bogartnoir @ Nov 17 2008, 07:29 AM) <{POST_SNAPBACK}>
we are expecting our NOA2 sometime in january.
(hopefully this will go smoothly as neither of us have a job. i am disabled and he was recently laid off {damn crappy economy} but if not- my parents have said they will sign the affadavit of support, so i don't think that will be a problem).

my fiancee lives in ontario so i believe our interview will take place in montreal. great city. i love poutine etc wink.gif my question is, would it make a difference to the interviewer if we were both there? i'd love to come along to see my fiancee and support him/us!

Easiest way is to call the consulate and ask (or email them, if they answer emails). We managed to get a reply from the Embassy in Croatia - here, the petitioner can come with the beneficiary, but (just like it happened with our B2) the interview is for the beneficiary, they say, and the USC can ask questions or have a say once they're done.

US Embassy and Consulate DiscussionAnnual Income of Petitioner
This is news to us.

Let's say I'm a freelance journalist. I get paid by some number of newspapers/magazines for what I do for them, when required. I don't have to ever see them in person to get the job done, or receive payment (the latter goes through my Croatian banking account). They couldn't care less where I live, who I am married to or what kind of citizenship I will obtain any time in the future.

Does this income count towards the financial requirements for a K1, or does it not? I am the beneficiary in this case.

Speaking of Affidavits and such - we called the Embassy and co-sponsors are, according to them, allowed and used all the time.

However, there is one more technicality I am unsure, but curious about. We hope that, financially, what my fiance will have by the time of the interview will be enough. We'll also have a signed and overall ready co-sponsor Affidavit, but we'd like to not turn it in with the rest of the documents at the Embassy, but instead to give it to the CO in case they asked for more proof (documents, whatevers) during the interview. Is this even possible? Or is it better to hand in both Affidavits? Would they just ignore (and therefore return) the one signed by the co-sponsor if the petitioner's was sufficient?

The problem might be the fact that my fiance won't have tax returns for any year other than 2008. He makes enough money now, and has been in 2008, overall. Before that, he was in college and didn't file taxes.

Badgerella, I read somewhere about a girl who had two sets of fin-l dox too, her fiance's and their co-sponsors. When she was called to submit the documents before the interview to one of the consulate workers, she gave her fiance's financial papers and said that they also had a co-sponsor, however she was told that she would only need to present them if the CO asked during the interview. And I believe he never did.

Thanks for your help. It'll be awesome if it ends up working for us that way.
