K-1 Fiance(e) Visa Process & ProceduresRFE for evidence that qualifies us for the exemption to have met within the past two years
I don't think anyone is saying there is no problem. There is one and it's called - RFE. In order to at least attempt to solve it, the OP needs to submit any and all proof they have and just, basically, hope that it's recognized and accepted.

It's none of our business why the people in question didn't meet before sending in their application. Judging them or their actions, even less so.

Lifetime ban is a scary thought but before you go trumpeting this as a consequence, do you even know for sure that this would be the final outcome?

Nobody even knows what exactly happened, so I really think it's safe to assume that a lifetime ban is just one of many possible outcomes.

K-1 Fiance(e) Visa Process & ProceduresHPV vaccine required for K1 and K2?
It is indeed required for all females between 11 and 26 years of age.

Luckily, I am a bit too old for the vaccine. Otherwise I would have had to fight hard to avoid those shots. Too much risk for basically no benefit at all.

K-1 Fiance(e) Visa Process & ProceduresInterview Question
The best and safest way to find out is to contact the Embassy in Kazakhstan, unless you can find the detailed information on their website. Personally, I would never choose to rely on what's written on any government-issued website. So far, none I've seen has had 100% correct information.

Call them or send them an email and ask.

Some embassies require the packages to be sent in advance, at some you bring the papers with you to the interview. Some don't even have real packages, etc.

K-1 Fiance(e) Visa Process & ProceduresWhy would my case be delayed?
I would assume the background checks they are talking about are, in fact, Administrative/Additional/etc. Processing that can happen at any stage of the process - USCIS, NVC or USEM level. The only thing we know about it is that can be either random, or for a reason (lately it seems to have been happening at random a lot, but mostly at the NVC level) and that it does not have a fixed timeframe the officials could tell you about. The current NVC/AP cases seem to be hanging around there for 50-ish days.

Of course, all of this is just my (un)educated guess. Considering your background, they might have had a reason for additional background checks I honestly don't know anything about.

QUOTE (HelloWorld08 @ Mar 14 2009, 03:19 AM) <{POST_SNAPBACK}>
it's the 21st century, internet relationship is normal now... so you are ok...

While I am well aware of the fact that this is the 21st century and that internet relationship and just the internet overall are perfectly normal and common, I still wouldn't agree with this.

While my fiance and I met on the Internet, too, in a game that, oddly enough, wasn't WOW, I still won't be surprised if anyone asks questions about it. Why? Because I was outright denied a tourist visa a year and a half ago because of - the Internet. The only problem the CO had with me was her 'confusion and worry' about how would someone (I am an adult, and not even in my 20s anymore) dare travel overseas to spend time with someone they have not seen in person, but instead met online. So she said she couldn't grant me the visa, basically for my own security.

Welcome to the 21st century, lady? And that kind of thing.

We'll, however, stick to the truth and hopefully this time it won't bite us. It has in the past, heh. With this, as well as many other things.

It appears that Gabriella will get permission to take her son with her when she leaves Brazil, just not in the time frame we thought it would be possible. We are looking at 3 - 12 months more before we get the authorization from the Judge. Her interview at the US Consulate is 3/24.

Should she go to the interview anyway (without her son), and hope that she will receive the authorization for her son sooner than later, then apply for her son?

Should she ask for a delay in interview?

Thank you for your advice.

The best move would be to contact your embassy and ask about the options. Quite often there is a chance of delaying one's interview, but to be safe, do not try to do anything without the Embassy's blessing.

It's likely stuck at NVC for Aditional/Administrative Processing.

Your best bet really is to call the NVC and ask about your case status. If it turns out to be AP, I'd recommend this thread.

QUOTE (rnkew @ Mar 15 2009, 06:32 AM) <{POST_SNAPBACK}>
Hello!
Questions from a newbie... who is very happy to find this site....
I met my boyfriend while I was on vacation in Argentina. He attempted to obtain a B2 visa in Feb 2009 (he has never traveled outside SA). The consular didn't even truly interview him. He was one of 100 people, and only about 5 received visas. They didn't look at any of his documentation, which included a letter from his boss (who is also his cousin) and bank statements, plus a roundtrip flight reservation. He is going to apply a second time, this time with additional letters. How can we be absolutely sure that his documentation is reviewed by the US Embassy? And if he is denied a second time (I don't think I could handle it-- I just want him to meet my family & friends--he is definitely the One), does that hinder our chances of approval for a K-1 visa in the near future? Also, I would love advice from anyone who has dealt with the US Embassy in Buenos Aires...
Thank you!

You can't be sure that the documentation is reviewed and it often won't be. It's up to a CO, even though the rules and rights they have listed on the website say that every case is treated separately and that they'll look and consider everything you show them. They just simply won't. I've had four B2s denied and only twice the COs actually looked at my papers or talked to me about anything other than my name and a few other generalia. To make it even more weird, Croatia has a really low B2 denial rate and is not what's considered a high fraud country in any way. My problem was, likely, the first CO, who was a middleaged woman, who marked her decision as - "I can't issue this visitor visa for your own safety, as you intend to go visit someone you met on the Internet." (?!?!?!?)

Either way, we're far through the K1 process now (interview happening in a few weeks) and we've not had any problems so far, other than Administrative Processing at NVC level, which may or may not have something to do with those B2 denials. Likely not, as it seems more and more people get stuck at NVC (and never find out why).

Good luck!

Nothing but the visa forms (to simplify it) is necessary, but - the more proof, the better. After all, it's all up to the CO himself to decide whether or not one's relationship is bona fide. What you, as a person, or a couple, have to say, or actually are, doesn't necessarily have to mean anything at all.

We have phone records for the past few years showing only phonecalls from me to my fiance in the US. We talk on the phone, at least shortly, on a daily basis, but it's pretty much always been me calling him. The other way around, the quality of the calls was just way too bad. I hope that won't be a problem. Most of our conversations happen on Skype, anyway, and we have a bunch of those records, as well.

It does, but the Embassy employee said I could/should fill it in by hand, the whatever form they sent me (of course, they had no idea the form expired in 2004 and was in Croatian, which in and of itself doesn't work) and bring it with me.

For my K1 interview in Croatia I need the mentioned form, filled in by hand - they specifically said I shouldn't fill it in ONLINE and submit it electronically, but instead bring the copies with me to the interview. Apparently, they can't process this type of visa electronically. I can't seem to find the form ANYWHERE on the internet. The only way I can get a copy is to hit the continue here and print out a blank form with a barcode on it.

Has anyone else done it this way? Or any other way that DID NOT include the electronic way of filling in the DS-156?

The Embassy sent me a copy of DS-156, but it's in Croatian and it expired 5 years ago so I did not intend to use that particular one.

Just so you know - when you complete the electronic version of the DS-156, it does not submit your information (electronically) - it simply inserts all the data you entered into the bar code - anyone completing the DS-156 online still needs to print it out and submit it via traditional methods (most bring to the interview). If that helps. good.gif

Thanks for your reply.

So I should just fill it in electronically, print it out the same way I did every time for a visitor visa and then bring the forms with me, just like I did for the visitor visa, too? The barcode on it, I assume, won't matter?

We sent no such letter along with our I129F, but were thinking about bringing them to the interview. I suppose we must have forgotten about them eventually, as I don't remember deciding not to have them. We came to the interview with over 200 pages of printed chats and emails, then years worth of phone records, two huge stacks of photos, postcards, package covers... but the interviewer did not want to see any single thing.

However, we're still glad we had all those things with us because one can never tell or be sure things will go smoothly. What doesn't hurt you can really only help if need be, so go for it!

What do you want to use the passport for in the interim months before entering the US?

If for ID - then don't use it! Use your drivers license, national ID card, etc. instead and leave the passport at home.

If for travel - then just be careful with the dang thing, and treat the K1 & passport itself as a valuable document- always in purse/hand luggage, never out of your sight, etc. Do you really have that much international travel planned during these next few months? I just looked up on Wikipedia that Croatia is not part of the Schengen area. You can travel to neighboring countries (Italy, Hungary, Slovenia) without a passport but to travel further into Europe you do need the passport. (http://en.wikipedia.org/wiki/Schengen_Area#Special_arrangement_on_entry_for_Croatians)

We have other ID(s) so that's not what I need my passport for. I have a whole lot of international travel planned for the next few months (Europe is small and we all do a lot of traveling on a regular basis) and I'd actually like to make it all happen. For instance - my fiance is staying with me in Croatia right now, and we'd like to visit a few countries. I am well aware of the Schengen agreement and its borders, as well as the list of countries Croatians can get into without their passports, but we'd like to see more of that.

I must say I am not insanely scared I'd, all of a sudden, become careless and lose my belongings, including my passport (even though things like that can always happen), but I can't stop thinking about a careless customs/border control person stamping the visa page either by mistake or, well, on purpose. The latter, I've heard about it happening.

K-1 Fiance(e) Visa Process & ProceduresCan K1 visa be reprinted?
Does anyone know what happens if one's passport, with an unused K1 visa in it, gets lost or ruined/destroyed in any way?

I asked the staff at the Embassy here in Zagreb, but they knew the answer only for B2 (visitor) visas. They've had no problems with K1s ever so the person couldn't give me an accurate answer. B2s get reprinted (if the passport gets stolen, or washed in a washing machine, etc.), but you have to pay the fee and do the interview again (as much as I understand, you won't be denied).

Has anyone ever had it happen, when it comes to K1? Or does anyone know what happens? Do you have to go through the entire process again (starting at the USCIS level), or would it still work with just an interview at the USEM?

I'm asking because I had my visa issued last week and I won't be using it for many more months (I'm aware of its validity and willl use it before it expires, though!). The visa is, of course, in my passport which I use pretty often and would like to continue doing so before I leave for the US. Passports can be stolen, lost... or customs officers can just, say, have a bad day and stamp some wrong page....

Either counts towards the total number of your visits, of course, but, just like others have been saying, check the Embassy info to see if you'll be allowed to attend the interview, or to enter the facilities and interact with your fiancee or anyone else in any way.

If I had to choose between a 'normal' visit and one for/around the interview date, I'd go with the latter.

There is a small add-on kind of thing for Skype (I forgot what it was, but can ask my fiance later) that lets you print any and all history that you have, that is no longer visible in the small history window in the actual program. It looks awesome and can, of course, serve as proof. Considering the fact that I've had the same computer for years, my fiance and I had printed proof of Skype video calls (and other) for the past few years. Engagement rings are not necessary. You may, or may not have them and they may, or may not ask for them. We had none and nobody asked about engagement at all. All we gave them (along with the required forms) were letters of intent signed by both of us. All other proof of relationship was in a separate briefcase, but they wanted to see none of it.

Of course it's the more proof, the better, but nobody is asking you to buy an engagement ring of any sort.

It's none of my business, the part about scam, or not a scam, so I am not getting into that.

What you could, or actually SHOULD do, is contacting the Embassy yourself. As an USC, you have all the right to do so, and you are likely to get a faster response to your question than a non-USC would.

My fiance and I had countless questions, ideas, thoughts and fears during our dealings with the USEM here in Zagreb, and every time we wanted to know something, or just make sure we were on the right page with the process, we'd call them on the phone or email them. Zagreb Embassy is small and not at all busy when it comes to K visas, so it's really easy to get the staff to help you on the phone. Emails would usually take a day or so to be replied to, but after we were done with the interview and had my visa in hand, that part became faster, too. For the most part, it was more than enough to just say my name and they knew what or who it was all about. My fiance, as an USC, had no problems at all getting all the questions answered. The Embassy was in fact pleased to help him/us with anything we need them.

So contact them and find out what exactly happened there.

K-1 Fiance(e) Visa Process & ProceduresK-1 visa application after B-2 Tourist visa denial
First interview was in September 2007 and the second followed only a few weeks later. Why so soon? Because I listened to the interviewer and came back with more proof as soon as I had time to do it all over again. That was, as much as I remember, at the beginning of October 2007. Next one was end of November, that same year. Last interview was in September 2008 and my fiance attended it with me (before that, he was just my boyfriend, or, well, friend for those who asked at the Embassy). At this point, we were denied because we had our K-1 already pending.

I had a full time job at one of the biggest companies (a bank), with a salary above the Croatian average, was a final year college student. I had rather big banks savings, a lot of family and friends, etc etc etc etc. Nobody cared about any of this, pretty much. The problem was the Internet.

Oh well. All is good now.

Simply because of the first one, that was denied because of the CO's.. point of view. She denied me because I wanted to go visit people I met on the Internet. She said it wasn't safe (it was an older lady, the interviewer). My take on it (confirmed by the employers of the same embassy, pretty much) is that I shouldn't have been so truthful during the interview(s). Last one was denied because I had a K1 pending.

Croatia is not a high fraud country and it is, normally, extremely easy to get visitor visas to the US. I had everything I 'needed', but it just didn't work out.

K-1 Fiance(e) Visa Process & ProceduresK-1 Visa Questions
Now you wait for the Embassy to contact your fiance, or he contacts it - I don't know how it works in Japan, you'll have to check on the USEM website or Japanese regional forum here (if there's one). Here in Croatia, the Embassy contacts you once they have your case.

The letter you received is NVC's standard notification which may, or may not be true. I don't mean to scare you, but there's always a possibility that your case isn't forwarded to the Embassy right away, but instead is undergoing Administrative Processing at NVC. The number of the cases that get stuck is not that high, though.

The best to find out about everything would be contacting the Embassy. In Croatia, you don't send anything in, other than two passport-sized photos, but instead bring all your documentation with you to the interview. The photos are sent after the embassy contacts you, too.

She works for her parents company, she can provide all of those financial requirements that she would go back. She has had her tourist visa since she was a kid. She just wants to be with me and go back once her package is received at the embassy.

We are just trying to make sure it wouldn't be against her to wait out the process here instead of her country.

The fact that she is leaving her child behind (to visit you in the US) could and likely would be used as a tie to her home country. In this case, the younger the child, the better. However, no one can tell whether or not any of the proof will be enough. It's up to the CO to decide.

Using her valid visitor visa wouldn't be used against her, for sure. It doesn't matter at all, for that mattter. Even B2 denials don't (as long as the reason isn't something illegal the person does).
