My husband, for example is a full time student and army veteran, so he does have income just not from the regular job. Can that be listed on the AOS since he did get tax return with it for the last year. One more thing, can the money that he will just start getting (over $5,000 a month) also be used as a proof that he can support me? Thank you very much, best wishes to all of you.

You still haven't indicated the nature of the income from the military. Is it a pension, disability award or temporary educational assistance. If it's permanent income, you don't need a joint sponsor. The I-864 affidavit of support is the US Citizen petitioner's responsibility. Get him on it, as you'll be spinning your wheels trying to do it for him.


The income from the military is a disability income. He is on it, I'm just stressing out alot since I'm the type of person that likes to have things under control. Thank you all for your help.

The father can file is income taxes for 7 years back, if he needs to do it. Also, the father can file thosse taxes on line, or go and see a tax consultant.

Ok, so we're having a confusing situation with filling out our AOS form. We've received our NOA2, got our NVC case number and emailed the Choice of Agent to them. I have all my other documents ready, the only thing left is the AOS (and the hardest one too). My husband is a former military (he's receiving money from the VA) and also a full time student, so he has no income from a regular job, only his VA and school money. Apparently, school money can't be used as an income (please correct me if I'm wrong), but we could use his dad's income as well (he lives in the same household). The issue with that is that his dad didn't file for his tax returns... don't ask me why, guess he was too lazy to do it :( So, what are our options now? Can he still file for tax returns now or what? Any ideas how much would it cost to have a lawyer do the AOS for us? I'm 4 months pregnant and losing my mind over here. Please :help: if you can. Thank you

Hello everyone and thanks in advance for your time and good will. I have 2 things to ask.

First.
We paid the AOS Fee Bill and the IV Fee Bill online last Monday (a week and a half ago). The IV Bill showed as PAID in a few days but the AOS Bill still shows as NOT PAID. Any idea how long it may take till it shows paid? Is there anything we can do about it or waiting is the only option here?

Second.
#13 in the last part of the I-864A goes like this:
"I, the sponsor ...... in consideration of the household member's promise to support the following intending immigrant's and to be jointly and severally liable for any obligations I incur under the affidavit of support, promise to complete and file an affidavit of support on behalf of the following ...... named intending immigrant(s)"
So, this is maybe silly, but I wanna be completely sure everything is done correctly. What has to be written on the second empty line here?

Assuming all goes well at the interview and I get visa approval, is there a time period within which the spouse must travel to the US?


According to the info I got from the US Embassy here in Croatia, the spouse must travel to the US within 6 months after their visa is approved. Hope someone will correct me if I'm wrong.

Hello dj's baby, thank you replying me back to my posting. Yeah, I am really sad about I heard in his family, I feel his family doesn't like me, I don't know, I don't have idea... but my husband always said that his Mom really loves me and she always emailed me and praying that my paper done quickly. But now in my mind, I don;t know..I feel empty..and losing hope.. I really miss my husband and i love him so much.. Anyway about his friend he is afraid because of some financial problems. I really thankful because his friend open his arms for me and to my husband to help us, but now in family I don't know..I am really disappointed with them. Well, I am keep praying that his family especially his step dad who is the one who helping with me and to my husband because he have the capacity to meet the NVC requirements.. Ok, I will tell to my husband to his friend about this.

We all know how you feel when you say that you miss your husband so much... feel free to contact me whenever you need encouragement or someone to talk to. Talking to someone that's in the same situation and understands how I feel first hand has always been helpful to me.

Hello my dear friend in VJ. Me and my husband starting to find co sponsor for future NVC processing because He can't meet the requirements so we need co sponsor. His family don't want to be sponsor because they are afraid to be liable with me in 2 year. I am so disappointed in that way..but this is not a final that they want to be co sponsor they are afraid.. I feel bad so much..sad mixed emotion. But my husband have friend that he willing to help us but he afraid to do that meet the NVC requirement about financial, he have own house, etc.. but still he afraid to do not meet the requirements. So now we are finding and hoping to find co sponsor.

Any help and advice from you friends..

My father in law was really wonderful on that matter and he did everything he could to help us out, so I can only imagine how you feel.
However, I think it would be a good idea to inform your husband's friend on what are the poverty guidelines (http://www.uscis.gov...form/I-864P.pdf) and find out a bit more about using assets for meeting the requirements (I don't know much about it cause we didn't use those, but I'm sure a lot of people on here know). If his only issue is being afraid that he can't meet the requirements don't give up on him before establishing whwther he can meet them or not.

If I am living with my mother, who is the owner of the house, would she fill an I-864 or I-864A? Does ownership of the house have any affect on which form she would fill out? Thanks!


I think it has more to do with the fact that you are living in the same household... and that she should fill out form I-864A because of that. My husband lives with his father and he had him fill out the I-864A, but neither one of then owns the place, they are renting it, so I suggest you check that with older members on here just to be sure. Hi I posted this in a similar topic but no answers yet. My USC fiance soon to be hubby( next couple of months) is a student and not earning anything. He's also going to Med school after graduating next year. Would my savings, assets , well over the 3 x spouse limit be enough or does he need to get a sponsor? We're planning to go for CR-1 visa so it gives us more time. I've graduated and now on OPT and hope to work asap once I return to my country. When the process is at the stage for the petitioner (i.e my husband then) needs to fill the 1-864 form can my earnings, assets, savings be included? The instructions on the form says that the intended immigrant spouse's earnings, assets can be included. Just need confirmation from anyone else who has gone through this. There must be young students who fell in love and got married before their career began? Thanks for any advice you can give.


My husband is a student (used to be in the army, but he's a student now) and I've just finished college not too long ago. He is the US citizen, we got married in my country (Croatia) and we went with his dad as the co-sponsor. But yeah, your assets and savings can be included in the I-864 form.

I'm not really sure how it works in Cairo, but every time I emailed embassy here in Croatia, I got a response from them in 1 or 2 business days... so you can try either calling or emailing them.

Ok, so we got a RFE. They mailed it to my husband on June 28 (we didn't actually receive it yet) but the operator told us that it's just about the mistake that's made on my husband's I-864 form that we need to correct and send it back.
My question is: can we send it back right away or do we have to wait to receive the actual FRE in the mail and then send it back all together?

Yes, your right... petitioner is not required to go to the interview, it's a optional thing :)

And about the fees... lets see.
At the NVC stage you'll have IV fee bill = $400 and AOS fee bill = $70.
After that there's the medical that costs around $150 here, but I'm not sure about the prices for Canada and then some minor fees at the embassy for them to send you back the passport and such.

We have sent the documents on June 8 and we have the same story. On Wednesday, when we called NV? they said we have not received, not yet. And when we called yesterday, the answer was we received 16 June dokumente. But when u call machine, it is completely different story! And I cant understand them! :(

We sent both our IV and AOS packet to the NVC on the 1st of June... and they still didn't receive/enter in into their system. All they keep telling us is that they get a lot of mail every day and to give them 4-6 weeks to do this... it's been 4 weeks already :(

Your stories made me cry cause I can relate to them. We wanted this baby so much, but we were naive and thought this will be over soon and that we will go through the pregnancy together. It gets so hard and I'm trying not to stress out cause I don't wanna stress out our unborn baby.
It's not the same without him... I'm sending him ultrasound pictures of the baby every time after the doctors appointment, but it's just not the same. He wants to be with me, be there for me cause this pregnancy has been (and still is) very emotional for me, he wants to see the baby and feel him kicking me... and he can't. It's sad and it gets really hard.
We're still hoping we will be together for our baby's birth.
It's so sad your kids can't be with their daddies and that your husband's can't watch them grow. They grow so quickly and I really hope we will all be reunited with our families soon cause this is so painful.

We need to support each other, keep the faith ladies (L)

Actually yes.
Everything happened so fast, I'm still confused lol.
My husband sent in an expedition request to NVC cause of the pregnancy, they sent our papers to the US embassy in Zagreb right away and the embassy gave me an interview like a few days after that. I'm leaving next friday... wow.
I'll post all the details a lil later, tryin to book the ticket atm :)

K, so we're in the final stage with the NVC... and expecting everything to be done soon (if we don't get an RFE, of course). Our baby should be born on September 17 and we were hoping I'd actually be able to have the baby in the US but time seems to fly and I'm not so sure that will happen anymore, since there's no chance for me to get an interview before August, in the best case scenario. Am I right? And according to the airlines I can only fly by the 36th week of the pregnancy.
So, what I wanna know is... what happens if our baby is born in my home country (Croatia)? What happens with the baby's paperwork if I have an interview before the baby is born? And what happens if I have an interview after the baby is born?
Any ideas if we'll have to file a new I-864 if the interview happens after the baby is born?
One more thing... if I get an interview in September around the date that our baby should be born, I'm not so sure I'll be able to go cause the US embassy is like 4 hours away from where I live and I don't want something bad happening to me on the way there. Do you think it would be possible to get a new interview date in that case?

I know it's alot of questions, but I'm hoping someone on here could know the answers.

I finally received Packet3&4 today, and they're full of outdated forms, most of which are in Croatian, instead of English, which is just beyond weird. I also have no idea who I am supposed to send my photos to, and why I need to do that, and just that - immediately. I have no idea if anyone's ever felt degraded once they've read the contents of these packets, actually its medical part, but - that's exactly how I feel. I mean, hello people, yeah, sure, I'm a pretty healthy piece of cattle. Just feel free to import me, ladies and gentlemen.

I've known all along that a positive HIV result means no visa, but once you actually read it, black on white, it really makes one feel like sh*t. And that's when you actually don't have disease.

Congratulations to all of you who have gotten your visas. At the same time, I hope everyone else soon gets what they are waiting for - approvals, missing files, APs, visas.. etc!


Our case made it to the Rmbassy in Zagreb yesterday noon-ish. My fiance couldn't resist emailing them so he's the one who was given the info about my interview, too, haha. They were supposed to mail me my whateverstuff (instructions and interview information) yesterday, but I guess they're procrastinating a bit since I haven't received anything yet.

They told my fiance that my interview is scheduled for March 12th. I am waiting to receive those things they're sending me so I can call/email them and ask for the interview to be pushed to the beginning of April. My fiance can't make it to Croatia before then and we want to make sure we have all the paperwork ready as well.

Based on other people's London timelines, your interview will likely fall during those dates anyhow smile.gif. We were extremely lucky in how fast ours was processed, but I know of many other people on here who have waited quite a bit longer to get their interview date. The last interview date that was scheduled for London (to my knowledge) was Feb. 24th and you figure by the time the medical is done and packet 3 paperwork sent and returned, you'll be looking at around another month.

We called DOS and asked if it was possible to reschedule an interview for a later date if necessary (we didn't want it to conflict with our trip to Spain) and they said absolutely. So don't worry!

I'm in Croatia. wink.gif I mentioned UK because that's where the case really is at the time. They're expecting it in Zagreb on Monday, Tuesday at the latest.

There are very few K visas (basically other ones, as well) here in Croatia, so I'm sure I'll need to reschedule the original interview date. They'll make an appointment so soon that I won't even have time to gather all the documents in time. wink.gif

I talked to the Embassy just now.

They have an electronic copy of our file, the date of the interview has not yet been set (the guy said it often is the NVC that sets it, but our case says nothing about it). I mentioned the 7 week wait, he said there were no notes about it, at all - so.. our case spent seven weeks at NVC sitting at someone's desk?? Who knows. Either way, they'll contact me with instructions and some interview date as soon as they physically receive the case, which should be next week. Funny fact - they knew me by the name, they didn't need my case number, or anything. That says enough about the number of K1 cases that go through this embassy, haha. Another funny fact - I asked if he wanted the case number to check if they had it and he didn't need it because - the cases just sit there in his drawyer if they have it. So there really are just a few of us going through this process in Croatia.

Now we wait. DHL says our case is in Ohio right now. Should be here tomorrow, I assume, but I doubt there's anyone available at the Embassy on Saturdays.
