Am I reading that right??? Your visa has been approved in 3 months? Forgive me my eyes may have deceived me as i have indeed worked all night and dead tired. But if so then you give a shimmer of hope for my soon to be in your shoes situation this coming month smile.gif.

You can re-use what you already have. The USCIS only needs copies of the original documents and copies of the translations. No need to send originals, no need to get anything notarized nor apostilled.

Diana

Diana just looked at your timeline, did USCIS schedule your husband's interview and Oath ceremony together or it was a coincedence? That would be beneficial to us since our service center is so far to be able to do both at the same time. Just curious if you planned it out that way.

Yeah kinda figured. Thanks Diana and everyone else. I cannot believe how much each of these applicant forms cost. CR1 Visa + I751 + Biometrics + Visa Interview fly out + N400x all the other thousands or hundreds of thousands of applicants each year and the US government is still in debt.. Gotta love it!

Hi all, long time since I posted on here and its been such a smooth ride sailing through the entire immigration process (albeit pretty damn expensive too!) However we are happy and we are looking forward to life's next challenges for us and the next obstacle will commence soon in October. As a Future October N400 filer, I wanted to know since the requirements are for a copy of our marriage certificate to be sent, since its in espanol was there some kind of requirement for the translations done in Colombia (as well as the apostilles) to be updated as well or has anyone had any success in just reusing what we already have from when we first submitted this for the CR1 visa? Please let me know! Thanks!

To be brutally honest, they don't give a damn. They need to see joint tax filing and joint money accounts. Life insurance, health insurance, bank accounts and the like. To them, any two strangers can pose together for pictures, but it takes a lot of faith and trust to share financial burdens, privileges and liabilities. All I sent was financial stuff, most importantly - joint tax filings, and I got approved last week. No RFE, no interview, just a simple approval.

With that said, if it makes you feel better, send the cute stuff along. Just make sure you give them what they need first, they want to know that you're taking this as seriously as they are.

How do you know they "don't give a damn"? I imagine when they see that my son drew a picture (including names in his handwriting) in school of "who I live with", and it includes my husband, that adds a little more proof that we're living together. The newspaper articles with pictures of the two of us, also with captions of who we are, also shows that we spend time together. Yes, the financial (and 'social') stuff is important - and we have the deed to our house that we bought together, a car title, tax returns, utility bills, credit cards, drivers licenses, life insurance, retirement accounts, the trip to Morocco, pictures of us together at (no joke) both a wedding and a funeral, cards and letters from friends/family and businesses, etc. But remember that there are (despite jokes to the contrary) actual humans opening and inspecting these packets. They are the ones who get to decide whether or not to send an RFE (and maybe pick us for an interview or flag us for suspected fraud), and we all know that mood influences their decisions. Backing a strong case with cute evidence (like pictures of people with cookies in their mouths) can possibly make the difference. Some people get approved with much less, some people get RFEs and can't figure out why because they sent everything on the list. You just never know. The more you send, the less you stress while waiting, I think.

And in my case, my kids are excited that their school papers, drawings, etc. are being copied and sent. You can't put a price on that.

If nothing else, it makes us and them (at USCIS) smile a little.

Congratulations on your approval.

venusfire

About the extra tidbit and financial information. My soon to be bride is located in Colombia and I am not sure how to go about including her in all my financial paperwork. We will have to rely on all these photos and affidavits from family members in our cause. I heard you cannot even file joint tax returns until your spouse actually lives with regardless if you are married. So i have to do it the 'cute' and original way smile.gif

Removing Conditions on Residency General DiscussionMilitary here, CR1 Visa app but traveling out of country...
Yes my wife was approved of her CR1 visa and is now entering the country in January. However we have sooo much to do and so little time to do it and i need everyone's help or suggestions. I guess my situation is only unique in the fact that my wife is entering on the 8th and has to get all her stuff done before she leaves with me in March/April time frame for South Korea on a 1 year tour at Osan AFB. Does anyone know the best route to go? We absolutely want to be together and Osan a military installation is still considered US soil but im still worried that at the port of entries that they won't allow her to board the plane or enter the US after we get back from the Korean state. Please let me know what i need to get done because I am slightly confused from what the USCIS lady said. I think she was a little rude and ignorant to put it bluntly and the info was no help at all.

thanks in advance

I am a little shocked that people want this to continue in this manner? Sure everyone who already has their loved one can sit back now and lay low. But would you want someone else to go through the same heartache and trouble as you did before when you went through this process? Thats a bit selfish if you should think that someone else after you has to wait in line like the rest of you people. I know you waited a long time but the system should be always getting better. If it has gotten better in the past it should be continuously getting better till one day the results are exceptionally quick. So whats gotten USCIS's attention in the past? What seems to work in fighting for our rights?

IR-1 / CR-1 Spouse Visa Process & ProceduresBiggest Mistake of My Life?
Hello,
First off I am sorry you went through this the hard way. Its an unfortunate thing with the immigration system being it can be such a pain in the butt to get through. The reality is that we live in a world where nations have to protect their borders and interests when you have terrorists and illegal immigration running rampant. I am not saying you are either one of those by no means but the laws of the land are put forth to protect its citizens for a reason.

The best thing to do in your case is to marry the girl in your country as I have done with my wife in Colombia. We filed a simultaneous K3 (when that existed) and a CR1 but believe me, we were much happier with the CR1 visa route than the other way around. It has saved us much money and heartache. Also read and heed the advice given on here and in the forums relating particularly to the type of visa your after. I believe you even have a forum dedicated to your home country regarding visa issues so Id check into it. Goodluck man, Canada is much cheaper/friendlier place to get to than what some of the other couples on here have endured.

IR-1 / CR-1 Spouse Visa Process & ProceduresAffidavits of Support for I130 Package
Hello all. As I setup my package for my fiancee *soon to be wife on April 30th*, my dad asked me if he should wait on doing his affidavit of support. I am including a friend, two brothers, and my father for affidavits supporting my marriage and my fiancee is including her mother, sister, friend and coworker from her country. I was just wondering if it makes a big deal if they write up their statements before we actually get married and say that they support the engagement and future marriage of us like some of our friends and family that will be unable to attend or should they wait till after we get married and write their statements supporting us after the fact. Only her sister and her mother will be able to attend the wedding in her country. My curiousity was deepened because on the issue of her name changing to carry my name the statements might have to reflect her name being her maiden name before we marry and those that write after the fact will have to write her name reflecting the name change. Please let me know either way. Thanks!

Please let me know your secrets smile.gif. Also did you send copies of everything for the USCIS and originals to the NVC? I am still debating on sending a copy of the marriage license/ and spanish to english translation because im worried they may never give it back. I opted to get two of them from the Colombian notary just in case this happens. Do you recommend sending the authentic original or what?
James

Thanks everyone!

Caliboylost,

Its purely luck! However, I did try to include only the required information and nothing else. When I got approved fast the first time, I was scolding for writing what i did by many people, but it was my experience. I did the same with the NVC process and no rfe's no issues.

There are many different ways to present your case/information/data. I just choose to make it very idiot proof. I ticked and tied everything for the reviewer. I labeled and marked every document plus color coded the labeling. I also made sure that all my copies of information were colored copies not black and white (pleasing to the eye). If I didnt understand a question I asked VJ members then re-confirmed with the USCIS and NVC, however the NVC responses were more polite then the USCIS.

All my cover letters I had notarized. Its not required by any means, but it makes the presentation look official (pleasing to the eye ;-). I didnt type any of my documents I sent them in, hand written with blue ink, so they knew they were originals and not copies. At the USCIS stage I gave all copies no originals. I did not include copies of the copies just one set. For the NVC, I included originals/certified copies plus photocopies in color.

As for proof, I only included two wedding pictures and color copies of all pages of my passport to support my traveling. My packet was very light/thin, less for them to get antsy about when processing.

My experience. I hope that helped.

PS> I would include the translated documents, I think they are required in your case. Note, some cases require different information/data. Make sure you research research and reserach and ask for help, especially from those that have already been through the process for your country. This site is wonderful.

Ahh not to beat the horse again with the same stick but for this line "For the NVC, I included originals/certified copies plus photocopies in color." Did you include copies of the originals as well the originals? Or just all originals?

And you shouldnt get scolded for saving everyone a major pain. You should be our hero lol. If everyone did the same maybe the visa process would be much faster for everyone making the whole system go faster and faster.

IR-1 / CR-1 Spouse Visa Process & ProceduresI130 Question 16...
Have you ever had a question that you wanted to revisit after sending off your application simply because you want to make absolute sure everything you said was 100% accurate? Well this is one of those questions and it pains me to even think that this would be a reason for visa denial at the end if we were not honest enough. My wife tried to get a tourist visa back in October 2008 but was denied however upon looking over question 16 I answered that she did not have any previous visa proceedings simply based off the answers that you have a choice from. Out of Removal, Exclusion/Deportation, Rescission, and Judicial Proceedings there was nothing that could accurately describe that she just applied for a tourist visa and was denied. So i just answered no and put N/A through here. Does anyone believe this is a big deal or what? For the I129 K3 Visa I noticed there was not a similar question so I just assumed that if it came up at the interview and the Colombian US Embassy saw she did try for a tourist visa I would say it was to visit me. Your thoughts are appreciated.

you can file head of household since your wife did not live in the country for 6 or more months in 2009 you do not need to include her on your return(that's the year you are filing for not 2010) next year you would file married filing joint or married filing separate

So I will still get a nice return right by filing with her Social Security Card when it arrives and going to a professional tax adviser?

Yep, its that wonderful time and being in the crosshairs of a very busy and hectic schedule here I am only briefly understanding how to file for my wife and I for taxes for last year. My wife and I married in April 30th 2009 and she finally got inside the country on January 8th 2010. She is supposed to recieve her Social Security card before the end of this month, i want to clarify something with all of you professionals out there. Can i include her social security number for my taxes for last year or do I have to file to get a tax payer identification number for her even though shes getting a Social. My logic intuitively tells me that I should be fine with her social security and just file as normal - married filing jointly and online. But i just do not want to get dinged and hit with an error that says I left out the part that her social security only applies for 2010 and i need a tax ident # for last year.. Please let me know.

That's right, you need to send only photocopies to USCIS, and later, after you get a case number assigned, at the NVC stage - you send originals and certified copies of requested documents. As about the pics, you should send some from few different places, photos taken at different times. We sent about 20 pages with copies of photos and explanation under each one when and where the photo was taken, and who is on the picture tongue.gif
Have a safe journey smile.gif good.gif

at NVC u dnt need t send any bona fide evidence ..only original biographic documents. .

I was under the impression you need to send original and notarized copies of everything from old divorce decrees, birth place certificates, and the marriage certificates rather than copies. Also I noticed that you were approved very fast.. Is this the new norm nowadays? The timeline shortened up or did you file expedite?

Are you sure there is nothing you can do to work things out? Sometimes woman can be quite emotional ,especially, away from loved ones. Its difficult enough for a Long Distance relationship... and on top of that more stress that comes along with this VISA issue.

I think there are many moments that my fiance and i were frustrated with our situation, especially with our busy work schedule. We tried so hard to see eachother at least every 2 months. Which we did for the first year. We are thankful that our k1 Visa process went along so smoothly, so he's able to join me in July. But trust me... when she's upset, she might say hurtful things.

I say, give it some time and see if its going to work out?

Ah man this is really a sad cornerstone that I am sure you can get through. I think the frustration of the LDR in itself is the biggest reason why sometimes stuff like this happens. I am not an expert of the matter but I do think what you said about women liking strong men is just barely scratching the surface. You have to keep the spark going that makes relationships so much fun.

A man who is strong makes a women feel comfortable but teases her sometimes just to challenge her, makes things interesting and rewarding, making decisions about the future and standing by them, having an active life, being apart of something constructive, and showing that you care and mean it are great ways for a man to be a man. The showing that you care has to be infrequent in a way that you can still surprise her and mean it. Anyway give it some time and maybe start doing somethings in life that will make you happy. And when your happy this will make you glow and when she sees this via your program for communication preference then she will be amazed.

K-1 Fiance(e) Visa Process & ProceduresWhats the hardest part

Not being able to hold his hand, touch his cheek, to rest my head on his chest and listen to his heart beat, or to ruffle his hair.

I read a lot of your responses to this but the one that disturbed me the most was the USC and his significant other's interview experience in Ecuador.. I find that horrible that this person brought evidence but the CO didnt buy into it and treated them rude and unfairly. There has to be a way for USC to wager more power in the mater. COs like this do not need to be working.. They should be more like judges in a courtroom looking at the facts and reading common sense vibes from a couple or person that is there before them. Is there a way USC can file a complaint to keep these aholes from being the ones that ultimately decide on us? I'm not one that is willing to standby and let someone else dictate my wife and myself's lives.. I let the military do that lol.

K-1 Fiance(e) Visa Process & ProceduresWhats the hardest part
The above posts were hillarious but yes the hardest part remains the long wait. I used to think if I went overseas to serve in a number of bases out of the country I might have found someone in the surrounding area. I was thinking that you can just marry and take your spouse back with you with no questions asked but upon learning the cold harsh facts you have to realize that the US has to protect itself somehow from even innocent and legitamat immigration because of fraud, narcatics, terrorism, and human smuggling.

I will definately remember all that I had to do to bring my loved one closer to me. It truly is a monuemental life changing experience that touches a lot of people from both sides of family.

K-1 Fiance(e) Visa Process & ProceduresLooking for a little advice...
QUOTE (kevin.l @ Jun 29 2009, 01:55 AM) <{POST_SNAPBACK}>
Hello all, this is my first time going through this visa process and was wondering if anyone would take the time to give me some advice. To sum most of it up; I'm young, in the US military, and currently deployed to Afghanistan. My fiance is from the Philippines, and thats currently where she is at right now. I talked to her for a little over 6 months before meeting her, and we got engaged on my first visit last February. I returned for a second visit in March, and in April I shipped out to Afghanistan.

I already filed an I-129F on her behalf with the service center in Vermont, and I received a receipt and got a case number. So our plan was that hopefully by the time my deployment is over in December, she will be close to getting her visa. For now, she is trying to get her passport there in the Philippines. She has met almost all of the requiremens but ran into a problem getting a certificate from the CFO. She had to go to a seminar and they asked what her passport was going to be intended for. She told them our story and that she is going to be getting a fiance visa. And then they started harassing her with a bunch of personal questions and demanded legal documents from me. Is all that really necessary? I have trouble believing that all that information is required just to get a passport. I told her to try again, and tell them that her passport is for tourism. To try to minimize the interrogations.

So anyways, if someone has run into a similar situation i'd appreciate any help you could offer. And if anyone else has some advice for the petition, visa, passport, immigraition processes, etc. that could help my experience go smoothly, that would be great.

I know that you are already deployed but you may be able to file for an expedite. Search up expedite for military deployments in the forums. Im sure there is something that will help point your path to the right direction.

FBI NNCP Process Step-by-Step:

Agency/entity submission to the FBI’s NNCP. Submissions are accepted via magnetic tape, hard copy, telephone, or fax.

Electronic “batch” submissions are searched against the UNI. The majority of the batch names are electronically returned as “no record” with 48-72 hours. A “no record” indicates that the UNI database contains no identifiable information regarding a particular individual. The UNI is searched for “main files”, files where the name of an individual is the subject of an FBI investigation, and for “reference files”, files where the name being searched is just mentioned in an investigation.

A secondary “manual” search of residuals from the batch run identifies an additional number of names as a “no record” response.

The remaining paper files and/or electronic files are reviewed to ensure they are germane to the name check request.

Identifiable files are then analyzed for relevant or derogatory information that may be disseminated to the requesting agency/entity. Approximately 1 percent of the requests are determined to contain possible derogatory information. If applicable, the NNCP forwards a summary of the information to the submitting agency/entity.

Interesting.. I hope this process can be speeded up for all of us like they keep promising.

USCIS Service CentersSO Its true...
From looking on the boards and hearing about people calling the service offices I can understand a little bit more of why some people's applications get processed faster even when their NOA1 is more recent then someone who might have filed much more earlier. Its the dang FBI and their dang name checks... Yes I can understand that everyone's case details are different but why does an FBI name check take so long? My information is so basic cut and dry, squeaky clean I shouldn't have nothing but a leftover thin film of wood polish residue on it. I imagine most of the good people on VJ are the same and maybe a healthy percentage who even attempt this long and painful process are also in the good. So lets hope for the best.

James is griping and bored at work on a friday night...
