So Rhode Island is your POE. Nice place stayed there for 3 months back in 2002. My daughter was pretty young then so she went to a school called Thornton. First time I didn't have to make a school run myself as the school bus came to pick her and drop her off. It was great. Loved providence that's where we were spent most of my time being a mall rat since I had nothing better to do lol. I could swear I had cheeks that resembled aunts Anne's pretzels I ate it every day in 3 months I got myself a 20lbs weight gain doing nothing lol. Can you imagine being 130 to going to 150 lbs that when I knew it had to stop so got myself a ab- dor. An began excersising dropped the 20lbs when I stayed away from the mall. Too much food there the temptation is so great to taste things. Learned a lesson though. Don't try everything you see or you will be fat lol.
Loved the fact that Massachusetts was tax free great shopping experiance. Went to boat on to watch the Boston celtics play great experiance. It's a nice quiet place to live RI. You will enjoy living there makes a change from busy London.

Good to see Texas has received your file now fingers crossed in the next few weeks approval;)


 

Well, technically my POE will be Washington or Newark but otherwise, yeah I'll be living in RI. I really liked Newport and Providence when I was there, shame Newport's an expensive area to live in. Amy took a long weekend at a spa in Vermont a fortnight ago so it shows just how close you are to other things in New England. But yeah, I'll be looking forward to settling down somewhere a little more quiet than where I am now.

That said, I just got Email #3 stating the case is now at Texas well and truly, so here's hoping in the next two weeks or so we hear good news.

I received the letter in the mail today stating that my file is now in Texas.....praying for a quick approval.

Mine should be with Amy by Wednesday, I'm still thinking. As for the case itself.. well, ours seemingly got sent in the same batch so I'm assuming mine's with yours in Texas by this point.

You know I have to say they don't give too much info on that letter. Just had to ask Nich-nick about my daughter since they didnt even mention if she need to prepare any forms or even say anything about her medical or if she needs to attend the interview with me. I guess am not going to know till packet 4 hopefully they actually give more info there. She's not even coming till later so makes no sense for her to interview now.

 

I saw that post down there, aye. The entire process is full of pitfalls no matter where you're applying and what you're applying for it seems.. I think that those of us in some of the low fraud countries such as Australia, the UK and so on are quite lucky usually.

Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Once we receive the requested evidence or information and make a decision on the case, you will be notified by mail. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

 

 

You won't know until you have the hard copy of the RFE stating what you need. Go and look at the RFE Master List thread for ideas regarding what they usually ask for.

To re validate the petition please request your fiancé to make a notarised statement of intent to marry within 90 days of your arrival in the US. And present it on the day of your interview.

 

You don't need to take a new letter of intent unless you've not been in contact with the Embassy since they sent Packet 3 for 4 months or so. They put that on there just to inform you if you don't contact them in the 4 month timeframe from when they log your case you'll need to extend the petition by getting a notarised statement of intent. The fact you've got one anyway is fine, but I don't believe you'll need to show it. I'm sure Lost or Nich-Nick will probably say the same if you check with them in the London Interview thread.

We sent in G-1145 with our original petition and we have only the first update online about the transfer to another office.

 

I reckon if you give it until Weds/Thurs and see if you get another then you might be alright, if not then you might want to get on the phone to them and ask what's going on.

 

 

 

haha so much confusion. I think i will just wait till my packet 3 comes after getting my noa2.

 

The US Embassy sites just seem to have done a blanket update to their sites not realising that K-1 visas don't currently get the correct login details to be able to use DS-260. If at some point we do, or our Packet 3 letters tell us to use DS-260, then we should go ahead. And even then, the Department of State site says nothing about using it for I-129F petitions, only for the ones listed there (which include I-130s).

Oh by the way in regards to the DS230 form i think it was, you were right, they have a new form to be done online (I think DS260) as the paper one will become obsolete as of sometime in early Sept. Not sure which day exactly.

 

DS-260 is not relevant to K1's at this point. We can't even access it because we don't deal with the NVC like the IR-1/CR-1 crowd do. We don't get one of the two pieces of info (the NVC Invoice Number) required to log in to the DS-260 form interface.

As was said in a thread in the Service Center forum regarding how the transfers work:

 

Email/SMS #1 is sent out when they transfer the electronic contents of your file.

 

Email/SMS #2 is sent out when they send your physical file to Texas.

 

Email/SMS #3 is sent out when Texas has gotten and logged your physical file.

 

Anyone who was transferred on Wednesday should have gotten #1 and #2 assuming they were signed up for case updates either by doing it online or by sending in the G-1145 with the original petition.

Is there any reason why my fiance didn't get the notice of transfer on his phone or email? We know his email works because they sent an email to him when the file was received. So he's not getting any notifications.

 

He might need to check his settings on the USCIS page or something, that doesn't sound right.

There's a Colombian guy going round the forums spreading misinformation about the transfers (he's going around saying "OMG TEXAS IS THE ONLY PLACE TO PROCESS K1s!!!!) which means now that other posters are panicking about any transfers and whether they're good or not.

You have to admit transfers as got to beat sitting around Vermont and collecting dust. You guys must be the las of the files gone. You booked your plane ticket yet? You might find you will be seeing Amy sooner than you though smile.png

 

Just being a bit realistic given it's USCIS and all :P But yeah, got the second text from them, I think the third and final one will be to let us know it's reached Texas.

 

As for plane tickets.. no, not yet. I'm not doing that until I know for sure about interviews and all.. but maybe, just maybe we'll be on track for the end of November or start of December.

We just got our approval, and the NOA2 hardcopy in the mail yesterday. In the letter, it stated our case was forwarded to the local embassy (Vancouver) -- no mention made of NRC or NVC. Do you think I should be calling the embassy in Vancouver and finding out what they know/have with regards to our file? Should I try downloading "packet 3" on my own? Things have moved along quickly since our approval a week ago, so I sure don't want to be delaying anything -- or having anything getting lost after my approval.

 

 

They might say it's going straight to the embassy but it never does. It's going via NVC. Your best bet will be after a week or two, like Nurseling says, to ring the Department of State to get your case number so you can book medicals and such.

I must say Ryan these people change things and neglect to inform people. We are constantly trying to find out information by ourselves. Would you believe I still have not received packet 3 I put everything together through the help of this site and sent it off without hearing from them. God knows when I will get packet 3 in the mail lol.

 

Problem is, none of us know whether K1's actually have to do it or not yet because it only covers some of the forms. We still have to do the DS-156, 157 and 156-K if memory serves.

Yes, and if you actually read the posts regarding my complaint to the Ombudsman you'll see I mention that all petitions past that date are automatically re-routed at the introduction of the complaint. It's been going on longer than July too, in fact closer to the tail end of May. But there are a small group of us who have not been transferred or processed as if we're stuck in a black hole. That is what the Ombudsman has been contacted about.

 

It is not a case of "OMG APPROVE ME NOW". I can wait until October if needs be so I'm within processing times. It's a case of "We don't want to be in a black hole and forgotten". And the fact that VSC have basically up to this point shrugged their shoulders and said "we don't know if we'll transfer or process ourselves, we can't decide" is not good enough. It is akin to leaving some of us May filers in the black hole I keep mentioning.

My goodness this whole process is wearing a lot of people out. I really am sorry to hear your having to bang your head against a brick wall trying to get these people to do the job you paid them for. You were approved before me we should both just be waiting for a interview date right now. It hardly makes sense how the system works. Lets say as they tell us files are going out in batches . Doesn't it make sense to get the first approved ones out first. You had at least a 4 day difference in date from mine. You should have been assigned a case number already. I am seeing so many people frustrated over this issues that honestly my heart goes out to everyone. Please hang in there and keep calling till they get fed up and do there job properly.

 

This is why I contacted the Ombudsman about those of us stuck at VSC and who haven't been transferred - hell, when Blakcajun rang VSC, they told her they hadn't made a decision on whether to transfer us or not, which is simply not good enough. They've had plenty of time to make that decision and they're now messing around. Regardless, the Ombudsman has passed my concerns onto a manager there who will get in contact with USCIS.

 

While some of the old timers here may disagree with this course of action, I do urge anyone who is stuck at VSC to make your voices heard and contact the Ombudsman. Give them your receipt number too so they know we're not just complaining for the hell of it. Eventually they will either transfer us, or they'll start sorting out approvals quicker.

I called USCIS again and was told they still have two months to process me but legally they can hold my petition for up to 11 months!!! she also stated that it is not certain if VSC will process the remaining petitions or transfer them later and that I will find out when a decision is made

 

That last part there is not good enough. I'll add that to my complaint to the Ombudsman.

That being said, I would like to add some further information which may help. Having written to one of the other beneficiaries waiting for a decision, she was told tonight by a Tier 2 ISO at the service center, and I quote: " that it is not certain if VSC will process the remaining petitions or transfer them later and that I will find out when a decision is made."
 
I am sure you agree that such indecisiveness is going to unduly hold up petitions at the Vermont Service Center and keep families (and potential families for that matter) from reuniting and spending the rest of their lives as productive members of American society, which as I understand it is part of the President's policy or plan on immigration reform. I would ask as an addendum that you pass this information on to the manager in question so they can raise this with USCIS as well.

No worries. I would think it's a good idea to contact them yourselves as well just in case and make sure they're aware of you. Include your receipt number as well.

 

That goes to any May filer still stuck at VSC (so Blakcajun/Jeanne, that means you too!). While they've said they'll take my complaint to a manager who will then speak to USCIS, more of us raising the issue will mean they act on it more urgently.

I write to you today to point out to you that the rate of I-129F petitions being adjudicated at the Vermont Service Center has slowed down significantly to the point where they are being dealt with exceptionally slowly. While I am aware that since July 29th all of these petitions are being re-routed to the Texas Service Center, according to the experiences of others as well as myself it seems a group of us have been left behind at the Vermont Service Center, effectively in limbo.
 
Since the transfers to Texas began, petitions from June, July and even the start of August have been approved, and this is also the case in California at their service center. I am extremely concerned that myself and my fiancée Amy as well as others who sent in petitions between April-May have fallen into a black hole of sorts by not being transferred to Texas along with other files. This occurrence is not unusual, as this has happened with the first wave of Texas transfers from Vermont in December 2012-January 2013.
 
While I appreciate that at this point our petition is within the official processing times, I would ask that you investigate the current procedures at the Vermont Service Center to ascertain why there has been a significant slowdown in the processing of cases and whether any cases currently still in Vermont can be adjudicated quickly, or as an alternative transferred to Texas and adjudicated quickly there. In our personal case, our receipt number is (redacted).

At what point would it be appropriate to call somebody to inquire about the length of time it has taken to get an RFE response? Should I wait until one month past their receiving date of our reply? 

 

 

I'd say that would be a good start, though they might just say something to fob you off. Make sure when you ring you ask for a Tier 2 officer - and say you will hold. Do *not* accept a callback in 5-7 days from the first person you speak to. When you're transferred to a Tier 2, you'll be given the option of a callback within a few hours instead. Take that if you don't want to be hanging on the phone for a long time.

Ugh, really? I wonder how long it will take for us to hear back from USCIS. We had an RFE August 1st, and we sent it to them August 7th or 8th via our lawyer (who apparently 'overnighted' our reply to CSC)... BUT they didn't show receipt of our RFE reply until August 19th. I really hope we get some good news soon!

I've fired off a preliminary email to the Ombudsman today stating that there has been a significant slowdown at Vermont for those of us *not* transferred to Texas and asking them to look into why this is the case and if those of us stuck at Vermont instead of being transferred to Texas could be dealt with quickly and efficiently. I doubt anything will happen as it's within processing times but if this keeps up, I'll keep on their case.
