Aye, but I think like this new MRV system we're going to have to play this one by ear. I'm assuming that the limited rollout is now done and they've moved to rolling out the DS-260 worldwide. When logging in to it, NVC case number is self-explanatory but invoice number? That I understand for CR-1/IR-1's but do K1's ever get an invoice number given we pay our fees at the embassy stage?

Do we put N/A on what does not apply or leaving it blank is okay and it won't affect the populated barcode? 

 

I also noticed the country is not UK it's listed as Great Britain for his local address in UK. for state/providence should we put UK?

IIRC you want to put N/A on anything that doesn't apply rather than leaving stuff blank.

 

And yes, if UK isn't on there then look for Great Britain. As for State/Province I'm not 100% sure, I'd do as Nich says and search for it first personally.

Once I have the K1 visa in my hand, how much time do I have to enter the U.S?(I know it's 90 days to get married once you enter the U.S). Also my NOA2 was in April, by the 16th Aug my time period is up for the petition to be valid. Do I need an up-to-date letter from Jeff saying he still wants to marry me?

 

1) 6 months from your medical date.

 

2) Best to check with the embassy (or someone more knowledgable here), I've heard conflicting views regarding expired petitions.

Secondly - to answer your question? Yes and No.

 

No because you've clearly gone and gotten everything done yourself which is all the letter tells you to do.

 

Yes because it may mean you have an issue getting your interview letter for some reason. Go to Plan B - any time you see your "Case Updated" field change on CEAC after having your medical, ring the Department of State and ask what the update was.

USCIS Service CentersSequester... any idea?

I know that USCIS runs based on fees received by applicants but is SEQUESTER could effect the processing time for all cases? It seems like both CSC and VSC has been slowing down but could it get worse?


There's a thread discussing the sequester here down in the General Immigration Discussion (can't post a link yet, sorry!)

But from what I've read of it, despite USCIS being ran on the fees taken, their budget is still set at a Department or Federal level. Time will tell if that means things slow down - so don't panic just yet.

Oh yes, I've noticed that a lot got transfered, while our case is just stuck there. As you indeed saw inmy signature, we've been having trouble with it for sure.

It's just really frustrating to see others that applied later than us either been transfered or approved.
So that's why I asked.

Anyway, did not try getting in contact with anyone besides USCIS. I actually have no clue how to do that, where or what it would cost.
Any help would be appreciated.





 

What you need to do is find out who the Congressmen and Senators are for your state (in the case of a Congressman, try to contact the one in your district), find their websites or email addresses and send them an email laying out what's happened to you up to this point (including the fact you've put in a Service Request yourself as well as contacted USCIS numerous times to no avail) and ask if they can assist. Point out that other cases around your NOA1 date got transferred to Texas and got approved but you're stuck at VSC "with an officer".

 

If they're going to help, then you'll probably get asked to sign a privacy release form so they can act on your behalf - you usually need to fax this back or take it to their offices if you're local. After this, don't forget to keep in contact with them. You'll usually be working with their immigration aide rather than the politician directly, but it can still add weight to your case and give USCIS a kick up the ####### sometimes.

From my perspective (note that word, perspective) it's slowed down. The reason that highlights this is that all VSC I-129F's are now being re-routed to TSC without exception (as of July 29th officially, but it's been happening earlier than that). That tends to suggest there's a problem, or they're expecting a deluge applications for something else. I-130s and DACA are being sent to NSC and ROC petitions are being sent to CSC.

 

However, on the flipside: Those of us in March-May as far as NOA1's go who are still waiting at VSC are within the 5 month mark generally, so it's still kind of on track. Though that may change, as always.

 

Re-edit: Never mind. Just checked your sig and you've gotten in touch with USCIS. Have you also tried getting in contact with your Congressman and/or Senator?

Secondly, have you got a link to an article or news update from USCIS saying that Texas is now the *only* place where I-129F petitions are going to be processed? Because I can't see one. Which means you're effectively conjecturing given that no transfers have taken place from CSC to TSC. The only transfers at this time are from VSC to TSC.

Thank you!  So I have just completed out DS-260 and my husband is sending in the supporting docs via FedEx tomorrow.  My understanding is that in London he can't make an appointment for his medical until he is assigned an interview.   So now I guess I am confused as to how he can get a medical without his appointment letter, but I can't send the readiness form until the medical is done. 

 

Try calling Knightsbridge and see what they say. Their site - http://www.visamedicals.info/us.asp - says Interview date (if scheduled). So you might be able to book it in advance.

 

Unfortunately I'm not as clued up on the CR1 process as I am the K1 process, and with Nich-Nick now gone because of some moderation stupidity unfortunately I'm one of the only people holding down the UK forums...

Anyway, to answer the actual questions:

2) You send it in when the following two conditions are met: You've completed your DS-260 and you've got your Medical booked or completed.

 

Complete all the fields required (so don't touch the K1 ones, and if no-one is coming with you then don't fill out those fields but DO fill out the one asking for your intended date of travel. If you put this as a reasonably close date - say in 6 weeks or so - you may get a quicker interview).

 

After that, it's unfortunately just a case of "wait and see". You can, as always, check with the NVC after 3-4 weeks to see if a date's been assigned.

That being said, a word of caution.

 

If you have a Credit Union account (like myself and the other half do) then you may find they have different procedures to straight-up banks. Namely we have to send stuff to a central account and have the forwarding details for our specific account attached. They also don't take straight international transfers, you have to transfer to a bank first.

DMV's in big cities suck from what I hear. Even if they could spot me a temporary paper licence that would do.

 

Yeah, and typically as an Out-of-Country person they want you to go to one specific DMV location (for us it's Cranston) so they can examine your documents. Anyway, this is what Montana wants:

 

 

Individuals with out-of-state licenses who wish to obtain a Montana driver license must:

  • apply for a Montana driver license within 60 days of moving to the state if seeking a non-commercial driver license and within 30 days if they need a commercial license
  • provide the required documents
    • proof of identity
    • proof of Montana residency
    • proof of authorized presence

They also may be required to pass written and driving tests, in addition to a vision test. However, driver examiners may, at their discretion, waive the written and driving tests for individuals who have in their possession a valid license issued by another state.

Unfortunately, I got treated like an idiot at the RI DMV last Friday when I tried to do it. Basically got my documents thrown back at me and told to get lost because there was only 4 weeks remaining on the I-94.

 

Problem is it took the better part of a month to get bank checks with my name on it (which is one of the proofs of RI residency). As it stands, I'm not sure whether I can attempt again once I have AOS NOA1 or my EAD/AP card, or worse yet my GC. And the RI DMV being as useless as all buggery didn't make that clear, they just told me to get something "more long-term".

 

Anyway, to get back to the questions. As it's a state-by-state thing you're probably best off checking what the Montana DMV and their requirements for Out-of-Country are.

All that means is "Don't keep asking us when your date is, we won't tell you" - contact them only in one of those four situations.

 

Of course, that doesn't mean you can't ring the NVC in a couple of weeks to see what date you've been assigned. And ring them here and there, unless your interview letter comes in first.

And this is a prime example of why you don't use a lawyer. There are many tales of lawyers sending the wrong form, not sending forms at all or otherwise screwing things up. The only time you need a lawyer is if you require a waiver of some kind or you have to go before an Immigration Judge.
