I'm sorry about the delay! You're gonna get your fiancee soon, though!!!

 

I woke up to the best news ever!! Visa Issued!! That was stressful but now all we gotta do is book a flight! We had hoped for before Christmas but that's only gonna be the case if God presents me with a miracle deal when I log onto the Delta site tonight!! We HAD enough Skymiles to get it for just taxes and fees but snce it's so close to the day we will fly him now we do not. It's ok though!! I AM HAPPY!!!!!!!dancin5hr.gif

 

Don't book your flight until you're sure you know when you'll have the visa in hand. My CEAC status has been "Issued" since Thursday and I've not heard anything about the actual delivery yet. But then again as long as it's delivered by January 17th in my case it'll be all good.

Yes, we have figured that out now Wheatley. An AP is no walk in the park. We are facing added complications because when we got engaged officially last year, and then started this process, we (naively?!) thought I'd be able to be in the U.S. at least by December of this year. Well, timing hasn't been on our side. Since we assumed that the process wouldn't be as slow, I went ahead and planned a wedding (ceremony & reception) in Canada, as we expected to be legally married and I would have my Green Card by March 29, our Canadian wedding date. However, not only do we realize the G.C. won't be available in time, but the Advance Parole could take up to 3 months to receive -- and applying for an 'emergency travel document' isn't an option because a wedding would not be viewed as an emergency.

 

SO, I am likely to stay in Canada until our Canadian wedding, so I can enter the US on the K1 visa -- not risking waiting for the AP because if we don't get it in time, I'm stuck in the US and lost money on the wedding in Canada that we'd obviously have to cancel.

 

Hindsight is 20/20 -- guess I shouldn't have been so quick to plan a wedding in Canada, but like I said, couldn't have expected the government shutdown, or backlog at embassy in Vancouver (which is why I couldnt get an interview until late January in the first place), or other hiccups along the way. Just gotta stay positive and know that all these trials and struggles are for a very worthy reason!!

 

Don't beat yourself up. It wasn't naive to think it'd all be sorted within a year - in fact that's usually pretty realistic. Between USCIS and the Embassies it usually does take a year. It just seems you got hit with delays and issues.

 

Obviously keep in mind your visa's expiration is 6 months from your Medical (so in my case for example, it expires May) so as long as that all falls within your timeframe then you can have your Canadian wedding but it must *not* be legal. If it is, that invalidates the K1 and means you'd need to restart and go down the CR-1 route. Think of it as I am - when I come back in a year or so (hopefully) with GC or at least AP in hand, I will be having a blessing and reception with my family. That's exactly the kind of thing you need to have this time around in Canada and then have the legal wedding (be it at a courthouse or otherwise) in the US to comply with the visa terms.

I've been absent from VJ for awhile because I was no longer going stir-crazy... things started coming together in October/November for us. We are working with a lawyer (more to come on that later) which has been a blessing, but of course everything we do goes through her which I feel has slowed our process down at points.

 

At the end of November we got my interview date -- for the END of January!! We were heartbroken that we were over 2 months from the date. But then miracles happened - a January 14 date became available, THEN a January 2 interview date became available!! 

 

I had my medical booked for last week, but because tracking down my immunization records proved to be frustrating/tricky, I had to delay until this coming Tuesday. Delaying it, though, hasn't affected the overall process.

 

Moving forward, my fiance and I talked about disengaging with our lawyer to do the AOS phase separately. I cannot remember what our contract stated when we signed it last April/May, but I am now under the impression (based on recent correspondence with her) that we are tied to her for the AOS... which for me, being a worry-wart, isn't the worst thing... it's just more money but I know I need to relax and just let things be.

 

In the meantime, I am still printing off all the necessary forms and copying the required documents (passport and birth cert) in case we sill are able to move forward for the AOS independent of our lawyer. We will need to apply for the 'Travel Document' to allow me to leave the U.S. during the AOS phase, as we have our wedding in Canada planned and obviously must attend. This, of course, all depends on whether or not we face any more delays or complications. Aside from the timing not being what we had hoped, everything else has been relatively smooth.

 

The one thing I am still unclear about is when I will be able to start work in the U.S. I know I will receive some sort of 'permit' that will allow me to work in the US, as well as travel freely to/from Canada -- but I think that comes with the Green Card, and according to the lawyer, I won't receive a G.C. until about 5 months after the AOS date. 

 

Sometimes this process seems like one step forward, two steps back. It can be hard to shake the feeling of frustration and discontent, but I know this is all WORTH it... for some reason, though, I still need to remind myself to stay positive. Sometimes easier said than done, but yes indeed, this will all be worth it!
 

I hope fellow May Filers are moving along. It's a tough journey, but at least we are going through it with the ones we love.

Specifically regarding Employment Authorization - you send in the I-765 along with all the other things in your I-485 package. You'll get a combined Advance Parole (Travel) and Employment Authorization card around 3 months after the NOA1. That card will let you travel outside of the States (but be warned, you may get pulled into secondary on your return unlike with a Green Card) and work legally.

The K1 is a hybrid visa - the DoS considers it non-immigrant but it allows you to adjust status legally in the US once married. The bolded part doesn't apply to K1s.

Update for me:

 

Got Police Certificate on Weds 14th - No Trace (so all clear).

Medical's booked for 22nd (Fri next week).

E-Readiness Form sent on 12th and logged in CEAC on 14th. So now it looks like it's just waiting for the medical results and then waiting for my interview date.

 

That said, I'll be off to the States on the 24th for a week and a half to see Amy's family for Thanksgiving.

Hi kuletkulet, I called the USEM today and sad to say my physical file is not yet there. A bit worried too but I'm trying to look for the thread  about attending interview without the physical file and notice of eligibility. I will give you the link as soon as I find it. I got the email from NVC informing me that they sent my file here last October 7, so really wondering whats the cause of delay.

 

Yeah.. I only just got Packet 3 today and my file was shipped from NVC to London on the 8th (arriving on 10th/11th). Not sure if there's some kind of delay somewhere in the system whether it's at NVC or at the various Embassies.

I knew about the background check but was led to believe that it is something that they do before sending us the paperwork. I didn't know we had to do something special. Guess I better look into it.

 

Yes, head to the Rio Embassy's website and find the K1 requirements on there, should explain at the very least where to get your police certificate from and where your medical will be.

You really need to read up on some of the posts here. For K1's, your interview date is not assigned by the NVC. It's assigned by the embassy once you've completed their requirements.

 

In other news, CEAC updated for me today. Or rather the date on it did to today's date. I'm thinking that means our paperwork's been logged and now London is ready for us to do the medical and the two forms. When I sort this blasted passport out.

The Awesome One got the NVC letter yesterday so given they tend to take a while to send that one out I'm firmly of the belief we've hit London, it's now just a waiting game for Packet 3. Given the issues with the passport (and the fact that I'm probably just going to end up sending it via Check and Send at the Post Office instead) plus London dragging their feet I don't reckon I'll be there for Christmas. Maybe early January.

for those that's checking CEAC website for status of their petition please note that they are not updating regularly. The embassy has been having my petition for a few days now while CEAC still says it's in transit. it's best to email your embassy with "2nd request and case number" in the subject to see if they have received your paperwork

 

And this is why I say I don't trust CEAC. :P

Anyway, in other news.. I got a response from NVC today from when I asked about my Invoice # for DS-260 (not that I need it anymore now thanks to the change in policy worldwide). They basically told me to contact the embassy.

 

Over two weeks for a non-answer. Bloody ridiculous. That said, I've emailed the embassy via the contact page on their website to see if they'd gotten the petition and/or sent Packet 3 out. I don't really trust the CEAC status.

Thanks for the info, Wheatley. I figured we were being tossed to the side by our lawyer -- she was probably getting annoyed by the number of emails I was sending her, which have been numerous... I mean, who wouldn't want to be up to date?

 

Here is what the CEAC website said about our case when I entered our case number:

Immigrant Visa Case Number: VAC***********
Your case is in transit to the Consular Section. Your interview date was provided to you by the National Visa Center.
 
Does this mean our case is actually in transit to the embassy in Vancouver? Would this also mean that both the petitioner and our lawyer should be receiving a hard-copy notice with my interview date? 

I'm about to send another email to our lawyer -- pretty sure I'll be her least favourite client ha!


 

 

 

Yes. That means you are actually on your way to Vancouver.

 

But you didn't read what I said about interview dates. They do NOT apply to K1s, the Embassy gives us our date when we send in all the forms and they have the medcial results.

I know my post technically falls under the NVC Forum, but it is not as active as the May 2013 Filers forum, so I wanted to post it here to get a greater number of responses.
 

Hello VJers,

 

A little background on us and our case:

We hired an immigration lawyer to help us navigate the K-1 visa process. As we are not her only client (!!) it has come to my suspicion that things are not moving as quickly as they could. You see, we waited 44 days for our case to be sent from CSC to the NVC -- and it wasn't until I called the NVC that I got our case number last Friday; our lawyer hasn't yet received a hard-copy notice of the NVC receiving our case.

 

When I called, I only got the case number and did not ask for a receipt number. Apparently we need both, according to our lawyer, before we can move forward. Since we are paying the lawyer the big bucks, I know I should let her do her job, but I also have a burning desite to be my own advocate to get the ball rolling. My lawyer advised me that I should not be contacting the NVC for the receipt number (?). 

 

So my question for you all is:

 

When did you find out your receipt #? Did you need your receipt # to book your interview at your local embassy?

Note: Someone mentioned that I could check the status of our case at the embassy/consulate with only the case number -- if you know this to be true, can somebody tell me where I can find this out?

 

 

Your lawyer is an idiot and is taking you for a ride.

 

The receipt number is your USCIS number - your EAC/WAC number. Your case number is the number NVC gave you and it'll start with your embassy code in front (London is LND for example).

 

Now... how the process usually works from this point on is when your case leaves NVC it goes to your embassy who then send you a letter called Packet 3. This details what you need to do to get to the interview stage. Now you have the case number you can book your medical at the embassy's chosen physician. You can also send in the forms they require.

 

As for checking case status? Go here: https://ceac.state.g...ult.aspx?App=IV and put your case number in the field there. Ignore anything it says about NVC scheduling an interview for you, that is false for K!s and we have to follow the procedures of our embassies instead.

Followed the link in there to the U.S. Immigrant Visa Applications page.  Make an account, go to add an applicant, and now there's problems.

First, there is no K option in the list of visas.  Second, it asks for a DS-160 number, which we didn't fill out one because we submitted our documents back in September.

 

What gives?

Then hit "Paying for a K Visa" first.. Don't go down the list. However, as you now have seemingly used your email registering for the other kinds of visas you will need to use a different or new email address.

You will be fine if you take the notarized letter of intent with you on the day of your interview.

 

I cannot say the same for trying to extend the petition all the way to around May-July in the other case, mind. That might require the letter of intent being sent in the mail with a written request for an extension.

Currently on the 12th. Which is somewhat accurate - I sent the electronic confirmation on Tuesday (12th). They updated CEAC yesterday (14th). So now it's just my medical on the 22nd and then the waiting game.

I used Premium on the other hand as I wanted to speed things up a bit. Sent on Monday via 1st Class Recorded, delivered on Tuesday (also got confirmation email from them at 7pm), arrived in post on Thursday. However I will note I live in Hampshire where you send the stuff off to so that might be another reason why I got it so quickly.

Hello - I am waiting for an interview date as well - but I'm a bit confused by the situation. So I was under the impression that after I received NOA2 and the British Embassy received our package - they would contact my fiance with a package pretty much explaining what he needs to do next and what forms are required of him. We've been trying to get in touch with the embassy in London over the past month to do an address change, but it was hard to get through to anyone that could help.

 

Finally, yesterday my fiance got to talk to someone!! He said he would set up an account online for him and that he had to fill out a DS-160 online as well as select a Courier service to receieve anything. I'm so confused as to the timeline of things now. I've been following the timeline on the USCIS website as well as Visa Journey religiously and I've not seen anything about this.

 

Has anyone else been through this?

I think we're in the right direction, but I just want to make sure we're on track now.

 

You called the misinformation line and hence got misinformation. A K1 does NOT need to fill out DS-160. Whatever idiot you got on the end of a phone line doesn't know what a K1 visa is. Plus you do NOT need to have an account on the online system to get anything from the embassy. That account that they set up may not work correctly and consequently you may need to set up a new one. If the one they've set up allows you to select the "Apply for a K1 Visa" option on it, you're good. If not, then you'll need a new account using a new email account, and if this is the case then in the "NOA2 to Interview" thread there are instructions on how to use the online system.

 

Packet 3 is a misnomer. It's no longer a packet, just a sheet telling you the locations of the forms online and telling you when you have to file by. That's sent out automatically. If your fiance changed address without setting up a long-term Redirect with Royal Mail then he's going to need to contact the embassy using the online form here: http://london.usemba...ntact_form.html and select "My inquiry is about immigrant visas and not covered by the website". Then explain you need to do an address chang.

 

Now. Onto what you have to do. First off, you should have your fiance's LND number (your case number from the NVC). He needs this to schedule his medical appointment with Knightsbridge. Secondly, visit here: http://london.usembassy.gov/iv_15.html - this details everything you now need to do regarding forms you need to send into the Embassy. When they get DS-2001 and your fiance's medical results (direct from Knightsbridge), then they will give you an interview date (they call this Packet 4 but again, it's just a single sheet of paper).

 

A word on DS-260 on the Embassy website, though. Your NVC case number is your LND number. But your invoice number is something we don't usually get. You can try putting in your fiance's date of birth (YYYYMMDD) in that field, or you'll have to call NVC for that number. You will also need to print off the "submission" page right at the end and take that with you. Apparently the Embassy needs that to access your DS-260 a bit easier.

At some POEs people have been advised to go through the Citizen/LPR line and have done so without issue so long as their USC fiance(e)/spouse was with them. Either way you can go through the same line, but as for which it depends on what the line staffers say on the day.

Anyway, in other news: A post on the Visa Services blog outlining how the new Collection/Delivery system works (it confirms kind of what we already knew but explains it clearly - collections are included in your MRV fee but if you want it delivered, the cost is £30.)

 

 

Once you have attended the Embassy and your visa application is approved, your passport will be returned via the courier service, DX.

DX will deliver your document to a regional hub nearest your place of residence, where you can collect the passport by presenting I.D.  This service is included in your MRV fee, there?s no extra charge for the courier!

If you wish to do so, you can select ?Home Delivery?, an additional service which will have your passport delivered to your door.  This service is an additional £30 per applicant and can only be selected once you have booked your appointment at the Embassy.  You can select Home Delivery by returning to your applicant profile once you have booked an appointment.  Please note that Home Delivery can only be booked using a credit card.

For the I-134, are any tax forms needed?

 

Will I list my total income (job + child support + maintenance) on the I-134, provide a letter from my boss, pay stubs, a court order showing my child support amount and a list of those amounts being transferred to me? Have I missed anything?

 

You can use tax returns (including the W-2) or IRS transcripts if you want. But seeing as you have a letter, pay stubs and those court orders along with a record of payments made you will likely be okay.

 

 

 

Do I list anything on the "specific contributions" line of the I-134? Would the cosponsor?

 

Unless you're going to make regular payments at set intervals or transfer over one big lump some or something, then I wouldn't worry about it. Some people put "support as and when needed" or something along those lines but London seems to gloss over that section of the I-134.

After you're approved, they recreate the case as a Non-Immigrant case (as that's what the K1 is in the eyes of the DoS) with the same number as before. So what happens next is you have a "new" case which will go from Ready > Admin Processing > Issued. That last one is the important one, it means they're ready to hand off to the courier and you should be getting your visa soon.
