Speak to a supervisor. It's a typical NVC tactic to fob people off. They took over 2 weeks to reply to an email of mine and in it they basically told me to sod off and contact the embassy.

Okay, once you get your Packet 3 (the checklist as you call it), it will have a date at the bottom of it stating how long the petition is valid until. If you do not complete the process by that date, you will need to check with the embassy to see what you need to continue/revalidate the petition (in London, we need a new, notarized statement of intent from the Petitioner).

 

It is generally advised you hold off doing the medical until Packet 3 because this will also have your embassy case number on it. I'm not sure what the code for Brussels is to be honest.

And on an extra note, when we called NVC for the first time, they did not receive our case until 09/11. So how is it possible that it was created on 09/10?

 

It's feasible they send electronic data regarding the application over as well as then the paper files or somesuch. They do that when they transfer between service centers, so it's a possibility. I wouldn't lose sleep over it.

 

That said, if you're now showing "Ready" as of today's date.. I'd say that means the petition's in Brussels.

Usually when you progress to the Embassy stage, the things you have to pay for usually include the following:

 

-MRV/Visa Fee

-Police Certificate

-Medical

-Cost of getting any other evidence together like birth certificates etc.

 

You do NOT have to be paying anything for the I-134 or joint sponsors, or anything like that. As far as who pays it, well.. you can transfer money over to Belgium if you have to as some things are paid for on the day in most cases (Medical, for example) and others are paid in advance (MRV/Visa fee). Note you also do NOT pay the $165 Immigrant Fee through USCIS - we K Visas are exempt from that.

 

I'd recommend now you're past the USCIS stage to go down to the Europe forum and ask questions there. Someone else with experience of the Brussels Consulate may be able to give you better advice.

Are the forms required for K1 visa now compeltely different? We were going to fill out the forms beforehand so we were prepared..... but now it seems like DOS changed the requirements.

It might vary depending on embassy but certainly for London we only have to send in DS-160's confirmation page and DS-2001 now. I checked the Islamabad Embassy site but trying to find info on it regarding any specific K-1 procedure is like trying to draw blood from a stone.

 

I'd assume at this point that you send DS-160's confirmation page in along with DS-2001 and then of course take I-134 and everything else in on the day of the interview.

I like to think I have made my point. I just hate anything that comes across as ignorance, not just to me but to others. We are all in this together and so what some questions get repeated. Like you said, when people get their NOA2 approved it does make them excited and want to be ultra prepared. I have researched a lot, I just like that extra bit of reassurance to make sure I haven't missed anything. It's really not a big deal, lol.

It's the truth, though. Yes, it can get annoying answering the same questions day in, day out. But let's be honest - we all started out needing help of some kind and it's only fair that we help others without making snarky remarks about it. Case in point: Sinead came to ask for some clarifications, now she's helping others out as well. It's Karma.

Also, just while I read the UK forum (which is another source of excellent advice, especially Nich-Nick's thread on the London Embassy) remember that London tend to issue your visa with a validity from the *medical* date, not the date of interview. So if you leave a large space of time between medical and getting everything else sent off, you may cut it close.

Not helpful at all.

The guides (specifically the K-1 Visa Guide and K-1 Flowchart) will give you a hand here. Basically, your petition gets passed to the NVC (National Visa Center) - who will then, assuming all is well, mail it over to the London Embassy.

But before then, start ringing the NVC to see if you can get the case number and get the medical at Knightsbridge booked. You'll also need to sort out your ACPO certificate. Like I say, the guides have all the answers!

I went through this reissuance of K-1 Visa before.

 

- Contact your US consulate for advice, to see if they will reissue the K-1 Visa.

- You have to resubmit all the paperwork (I-134), new medical checkup, new police record according to the K-1 visa checklist.

- Schedule the interview and pay all the fees again.

 

All these must happen before the 90th day from the 1st date of entry to US.

I don't believe so, no. The K1 is a one-shot - once you go past the border controls at the POE and they give you the all clear, that visa is used up and gone.

 

However, you may have an alternative but I would rather leave someone more experienced to explain that because I'm not 100% sure (regarding Advance Parole and all).

John, I'm glad you attempted to contact your Congressman but unhappy they didn't help you. Your next step on that route is the two Senators for your state if the Congressman won't listen, and maybe try the other Congressmen for your state too. You can also send an email to the CIS Ombudsman at cisombudsman@dhs.gov and complain to them, give them your receipt number as well so they can look into it too.

Yup, they say since July 29th but actually it's before that they started (a month or two ago in fact). The problem with this is now that there are some of us May filers in limbo who haven't been transferred but also didn't get picked up in the sudden surge that VSC had over the past three weeks or so.

 

On the topic of the transfer and a "reset" - so far what we've seen is that TSC are usually pretty quick at making decisions but then they take their time sending them on to the NVC (in fact they were tending to send them back to VSC to do that in batches, slowing it down for a lot of people). So while you may get approved a bit quicker, the overall process might not be affected unless TSC have started to send approved petitions directly to NVC.

1) You haven't set which country you're from. That would help greatly because every country has a slightly different procedure for the post NVC stage (for example whilst most embassies will give you an interview date themselves, some allow you to schedule yourself).

All that said, there's a simple solution to this. If you cannot remember the email address, password or security question to get into the system, you can just use a different email address and sign up a second time. In London, if we don't follow the correct procedure for paying our MRV fee and then booking the courier, it screws us up and we have to use a different email.

 

If you're going to try and schedule your interview via the embassy, you're going to want to wait until they've sent you Packet 3 (the first letter from your Embassy telling you they're ready for your DS-160 confirmation page and DS-2001 Interview Readiness form) and until you've had your medical.

Otherwise you are just spreading more misinformation. If you actually bother to look at the form itself, you will note that while we K1's do get a case number, we don't (at this point) get an invoice number from the NVC, meaning we can't really log in to complete DS-260. Furthermore, if you actually bothered to read the Department of State website, you'll see it mentions I-130 petitions rather than I-129F petitions. So if people are going down the CR1/IR1 route they need to fill out a DS-260 if their embassy requires it.

 

OP, to answer your questions:

 

1) No, you don't put "none" in the blank lines regarding previous places you've lived. If you don't need to answer a question because it's not relevant or if you don't know the answer, put N/A or Not Known respectively.

2) As K Visa applicants we don't need Part II of the DS-230. What happens at your interview is that you will sign the bottom part of DS-156K as your oath that you're going to get married in 90 days and that you're free to do so and all. Essentially the DS-156K is our DS-230 Part II.

Every POE is different. Some will get you both to go through the USC line, others will have both of you go through the Foreign Citizen line. Your best bet is to ask one of the line staffers on the day what they want you to do. You shouldn't get separated.

So many areas I'm wrong. Well, I'll concede the law for the period of validity for the k1 visa has changed to six months. but the rest I am correct. Now, let's first take the the OP posted in how many words? An obscure question wondering whether there was a problem with a round-trip ticket. Why would anyone buy a round-trip ticket when they only have a k1 visa? Doesn't make sense. First you gotta get into the US and get married. So, buy a one way ticket and make it happen. 

 

What I'm wondering is how you get so much out of one sentence from the OP. How's that work? Vulcan mind-meld?

 

You'll find that for some countries, a RT is cheaper than a OW. It was for me, and in fact when I cancelled my return trip the day after landing I got quite a nice refund - 2/3rds of the original price I paid, in fact. I had no issue whatsoever checking in with a return ticket on the K1 visa, and CBP didn't even give it a second thought when I was in Secondary at Newark Terminal B.

 

The key thing you have to do if you do get a return is cancel that return segment. You don't want to be having issues at AOS because of an error by the airline saying you left when you didn't.

Yeah.. CEAC is generic, a catch-all for all the different visa types. Stick to looking for what I said:

 

1) Your "Case Updated" field changes - that means they've logged the affidavit.

 

2) A status change to AP - That means it's all finished up and they're just doing some last checks.

 

3) A status changed to Issued - Visa's printed, in the passport and on its way to the courier.

 

Thankfully though, Loomis seems to be working for you as far as taking in documents. DX Secure over here in the UK is messing someone around about taking his documents and passport in (despite the fact the Embassy has said they're to be used for this) and keep telling him they don't do it. Nearly at my wits end since London changed their bloody procedures..

Watch your CEAC status. If it changes to Administrative Processing then it means they're working on it. Even better, if it goes to Issued then that means your visa's been printed and put in the passport.

Please pray everything goes well and that he arrives. WE had many issues with airlines and France. He was suppose to be on his flight on dec. 17, but they did not allow him because he did not have a transit visa. with this said emotions have been everywhere I just really hope he makes it! I woke up to the best news ever!! Visa Issued!! That was stressful but now all we gotta do is book a flight! We had hoped for before Christmas but that's only gonna be the case if God presents me with a miracle deal when I log onto the Delta site tonight!! Don't book your flight until you're sure you know when you'll have the visa in hand. My CEAC status has been "Issued" since Thursday and I've not heard anything about the actual delivery yet. But then again as long as it's delivered by January 17th in my case it'll be all good.
