After changing the last digits on the USCIS case status tool to get a feeling of where we are at, I noticed that a May filer who is in the same batch as those who received their A# on May 15th was approved yesterday, July 14th.

 

I'm a May 16th A# so.....we'll see...

 

Were they also at Vermont though? If so, then keep your fingers crossed that this may be a good sign of something to come.

On the topic of transfers to TSC.. I'm of two minds. Yes, it means the petition may get approved faster. But then if their recent actions (judging by some of the threads in the Service Centers forum) are anything to go by, they'll keep the bloody thing back or send it back to VSC, who then send it back to TSC before going to NVC at a snail's pace. Not to mention the fact that on June 13th all those RFEs from TSC were overruled by someone higher up the chain of command and switched to approvals.. yeah. Not too sure about all of it!

 

But we'll just have to wait and see. I have other things to do like plan a 6-week trip to see Amy for Thanksgiving and the Holidays.. plan the wedding (which is coming along nicely) and recover from this blasted surgery.

 WOW.  Its 3:00 am in the morning and I just got text from my finance.  He finished his interview and was approved.  We are so happy with the experience with the US Consulate in Jakarta.  They treated my fiance so fantastic.  We were the first gay couple to be granted K1 at the Consulate.  They expressed their full support of DOMA and the right of all couples to be happy in marriage.  They made him feel so comfortable and asked very good questions about our relationship. Of course they ask about how we met and communicate.  Questions about me, my job and house. And my finance indicate the interviewer genuinely was happy to see our pictures and mentioned we looked so happy together. He wished us the best of luck and was happy to approve our visa.  

 

By the way our timeline indicate 85 days to interview and approval.  We couldn't have done it without the great tools on VJ.  We did get some weird advice from some members who didn't understand DOMA but maybe they will get educated.  But in terms of process of visa everything was very beneficial. Thanks again everyone.

If you don't mind me asking - and this is mainly so we can collate info as yours is one of the first post-DOMA approvals I've seen - did you guys file your paperwork pre-DOMA (and therefore get your case re-opened by USCIS) or post-DOMA? Reason I ask is because you've gotten a full approval in just under 3 months which by all standards is lightning fast. I'm genuinely curious as to whether USCIS are expediting any-and-all same sex petitions or whether this was just really lucky.

 

(I will also point out for anyone wondering - No, it's not so I or others can scream about how others are getting treated differently. I'm interested to see if USCIS are keeping their promise of getting previously denied same sex cases through the system quickly.)

No. Do not attach them like the DS-156K says. Take them with you to the London Embassy on the day of the Interview. Note you won't need evidence of engagement, though. London doesn't want to see that.

So I've finally received my Packet 3 from the London Embassy... one line on the letter caught my eye:

 

"The K1/3 petition is valid for four months from the date of action (priority date at the bottom of the letter) and must be valid to process your case to conclusion.  To revalidate the petition, please request your fiance(e) to make a notarized statement of intent to marry within ninety days of your arrival in the US and present it on the day of your interview.

 

.....

 

Your priority date:  10 JUL 2013"

 

My issue is that I'm about to go to America for about 70 days as a tourist and by the time I return, this four month period of validity will be closed.  What am I supposed to do here?  Do I get a letter from my fiancee while I'm over there and bring it back with me in December to my interview (when it gets scheduled)?  Do I need to do anything, besides sending in the forms requested, before the 10th November rolls around and the window closes?  :\

 

You'll need to get a new Letter of Intent while you're over there, signed by your other half and get it notarized. Thankfully it's not difficult to find a Notary Public in the States, so google in the local area for where you'll be. A lot of the courier companies (like FedEx, UPS etc.) seem to have them in their stores from what I'm told.

I understand that the I94 is now done automatically, that there is no "paper arrival form" and that I must apply online to retrieve it after I arrive. My question is, to those that have already travelled on their K1 Visa, I assume that you itemise each and every item that you're carrying on the flight on the rear of the form as all items will remain in the US? 

 

Also, just to confirm, a one-way ticket to the US is fine?

Not sure about the Customs side of it, but I'd believe you have to. A lot of stuff where it's been used or worn so much might not have much value, of course.

 

As for the flight? Sure, a one-way is fine but it's not going to be as cheap as a return. In the travel industry, one-way tickets are almost always the fully flexible and refundable kind, whereas your return doesn't have that (and is therefore cheaper).

You don't need to - but by doing so, you'll be able to get your medical booked sooner which might then mean less waiting around at the Embassy stage.

Maybe if you actually read what the embassies want, or the Department of State site itself. Most, if not all the embassies want DS-160 now and have done since around halfway through October or so, if not earlier. The DOS considers K1s to be nonimmigrant despite the fact that a K1 visa allows you to immigrate via the AOS process later on.

I may be wrong about this since I am not from vwp country but it sure does allow B2 to travel like usual even with K1 processing but if your intention is seeing your fiancé, you might want to bring noa2 with you or something to proof that you are going to proper route!
It still depends on the officer whether they want to let you in or not! Hope that helps otherwise the more experience member can help you out

 

If you're not from a VWP country and you're not sure, you should hold off giving advice unless you can back it up with evidence. And if you actually read the OP, you'd see that they're going to file the K1 whilst they're in Texas so she won't have NOA1 let alone NOA2.

 

OP: Once you're in the US, you will be able to fly around with no issues so long as you have your passport with you to be able to travel. The difficulty you will face is getting into the country in the first place. The reason I say this is because you are going for 3 months - which is the time limit on the VWP as I'm sure you're aware (rather, the time limit is 90 days so not always three months). You may run the risk of getting asked lots of questions as to how you can support yourself for that long, what kind of job lets you leave for 3 months at a time, what are your ties back home and so on. If you're going to do this, you are going to need to have evidence - and lots of it - that will convince CBP that you're not going to overstay.

I am from England I was refused entry in accordance with section 217 in May 2013 this was down to me and my American fiancée saying we were going to get married whilst I was using a VWP. I know this wasn't the greatest thing to say but neither of us had a clue about the visas we needed. Anyway in my sworn statement it said before I was allowed re-entry I would have to apply for a fiancée visa. We have now started the process and have received our first NOA and RFE. I was just wondering in the meantime while this is going ahead is there any chance I would be able to use the VWP To visit my fiancée for a holiday as the processing times for the K-1 are around 6 months and we want to see each other.

Anyone got any ideas or have been through this experience?



 

Once denied on the VWP, you cannot use it again. You have to go down the B2 route which costs money and is typically quite difficult. You have to be able to prove ties to the UK (and significant ones at that). Your other half is going to have to come to the UK instead unless you can get the B2.

Im starting to become more panicked as the flight dates looms closer. Im really dreading the interogation at POE in America.

 

I visited in November for a week, by this stage the petition had just been approved.

 

Now im at the stage where the consulate has requested my readiness form once I have assembled the documents. (Irony being we are now the ones slowing the process down). As the petition has [assed through the NVC I presume this information will flag up when i try to pass through POE again for my two week holiday with my fiance starting on christmas day, or so is the plan.

 

Im worrying myself over and over with the thought of being turned away and missing out seeing her again. We plan to get the last two documents before I can be ready for the interview while im there and I really want to kiss her on New years eve.

 

I read so many people getting interogated when they see you have a fiance USC. I plan to take a bank statement with funds, tenancy agreement with current month paid for on bank statement, letter of employment and payslip. Is there anything else people would recomend. I feel so depressed when she is excited that im coming back over, and I just dont want to have to deliver that phone call to say im heading back on the next flight, Ill probably cry and have an emotional breakdown.

 

Any emotional support would be appreciated. I just want to see her again so bad, as im sure eveeryone does with their loved ones, especially over the christmas season.

 

That bolded part is the important part. You're taking evidence of your ties back to the UK. When I went over for Thanksgiving, I also took evidence with me both for the POE in Philadelphia and also the crossing through Canada both for the American CBP and for the Canadian CBSA. Thankfully I didn't need it as they took me at my word, but I had it nonetheless and I'll admit I got grilled a little but not pulled into secondary at Philly.

 

If you've got it, I'd take Packet 3 with you (the letter saying the Embassy are ready for you). That shows you're doing things legally. The important thing is to be honest but only answer their question directly. If you get asked why you're looking to enter the US, reply with "Christmas Vacation". If they then ask "Who with?" - that's the time to say "My fiancee". Don't offer the evidence unless they ask for it. But as I say, you're taking the evidence and that is a very good thing.

Including the depot closest to you today? Jeez.. right, nothing for it then. Try sending an email to the Embassy using the form I gave you (or ring them on that 020 number). Ask them what they want you to do, explain that DX Secure is outright refusing to take in your passport and you've literally been refused service every single time. They might just repeat that it's DX Secure who has to do it but alternatively they might say to send it in another way. I'm half-tempted to tell you to send it to them RM Special Delivery, put all the stuff inside and also a letter telling them DX Secure has said they do not take passports into the Embassy, but that's risky as they might not accept it.

 

Give the embassy a call first and see what their instructions are. And if they keep saying "Use DX Secure", you keep repeating back "I have, and they've told me they won't do it".

United KingdomFrom readiness letter to interview date, how long CURRENTLY?

My fiance's medical records were recieved and status changed to ready on December 5th or 6th. However, we had to get some stuff in order and didn't send his readiness letter till Dec. 24. When we checked the site yesterday it said they're currently setting interviews for letters recieved on or before Jan. 8th. Based on the current times those of you who have recently gotten assigned dates, how long should we expect it to be to have a date? I know it can take 6 weeks to hear back and another few weeks to have the date but is it currently taking that long? If they're processing readiness letters from this week and earlier that should be a good sign, right?

 

Our petition expires Feb. 9 and I know I can send in a new letter confirming my continued interest in bringing him here, but we are hoping to have him come here the very end of March and marry 2 weeks later. So is it still likely to happen? Or are we looking more likely at an interview date of late Feb/early March now? (He needs to give notice at work so having getting his visa and moving here the following week isn't a possibility.)

 

It can take 6 weeks to have the interview letter in hand. Then your interview may be 3-4 weeks after that, or it may be quicker. Gai is right, however. Given London's been screwy, check in with DOS and see if they have your date assigned.

Pay the fee after have know your interview date. I think the latest version of fee and courier scheduling asks the date of the Interview. I've kinda lost track of the various versions they have gone through in the last six months. Somebody who paid recently will hopefully chime in.

Thank you SO much I was really puzzled when I opened it xD. Thankfully I recieved the NOA2 in the mail and addafit of support and an updated letter of intent from my fiancé in the mail today. (I know the updated letter of intent is usually if it's been a long time between NOA2 and interview but I thought it couldn't hurt to have one! tongue.png)

I think I am probably ready with documents now? Like I have my police certificate, long form birth certificate, passport in good condition, the two US sized photos and one UK for the medical. A lot of the things on the list the embassy gives doesn't apply to us (no prior marriages etc)

I have two I-134s, one from my fiancé, one from fiancé's mom. Heres the evidence I have got, since you told me that London wants one proof of income but take two just in case tongue.png

Fiancé
-I-134 which is over 100% poverty level but under 125%
-print out of online page with his employment details, like his hours, stating his full time, a contact number for manager (he works from home for a company based in Texas)
-print out of paystubs from employer website where he views them online (no paper ones issued)
-print outs of online bank statements showing deposits

Fiances mum

-I-134 stating her and my fiances stepdad make over the 125%
-2012 tax return
-certificate showing when the buisness was registered

^is this sufficient for a co sponsor? I figure that the certificate of when the buisness would register would work in place of an employer letter kinda? It has my fiancé's parents' name as the owners so I thought maybe the officer would look at the tax return to see how much they made and then the certificate and be satisfied with that but I'm not certain? XD

and my other question: going to fill out DS-160 tonight, but readiness form before or after medical?

Regarding your Fiance's one - London are generally alright if it's between 100-125%. They may give you a verbal smack on the wrist to say "You need to have this sorted before you adjust status". The evidence is all good.

 

As for his Mum/Stepdad, that's also fine by the looks of it and if they say the one from your Fiance isn't good enough.

 

As for the Readiness form, I personally did mine the same day I submitted my DS-160 because I had my medical booked and I had no intention of moving that date come hell or high water.

The wording on Packet 3 is poor - K1s only do DS-160. IR/CR-1's do DS-260. But you do need to complete one final stage if you haven't already and that's the Applicant Readiness online form.

You should ring the collection number if you don't know which depot is closest to you. Go directly to that depot with your receipts (and printed barcodes if there are any) from the payment site. Say you were told by the Collections line that you had to do this because they no longer collected from home addresses.

Ah, so it is. Hmm. I'm not sure what to suggest then - recently it seems that both DX and the Embassy just point fingers at each other when something goes wrong. As a last resort, try using the contact form on the Embassy site: http://london.usemba...nformation.html - You can try ringing, or click the link at the bottom there. Unfortunately the Embassy won't take RM Special Delivery else I'd suggest that. I'll see if I can get hold of a member here who had to send something in after her interview and see what she says.

Find your closest one, and try ringing them directly if you haven't already. What does it tell you to do on your 221(g) (the blue letter)? What number does it tell you to call?

Yeah. So in other words - 

 

If your AOS is adjudicated any other time than Oct 1st - Mar 31st, you don't need your Flu shot.

 

If your AOS is adjudicated during that time BUT you had your medical outside of those dates, you should still be alright without a Flu shot assuming your DS-3025 is fully complete on all other counts.

 

It's only when you have your medical during that time period AND AOS is adjudicated then as well that you need to have it.

 

Edit: Forgot to mention it's when the AOS is adjudicated as Nich has mentioned. Personally, I had mine anyway as I have asthma and therefore I get it free every year on the NHS anyway. And the above all assumes you get a competent person at USCIS who knows what they're doing, of course.

I think only one of my other past passports had a stamp in it and it was for the czech entry on a school trip prior to EU membership, yes it was that old.

Basically got in the embassy sat down for ages got called to the desk where an American guy took all the paper work explained a few things and told me to take a seat and wait to be called back again. Then I was called and this time I had a very nice American lady she asked me where I met Jessica, when did we decide we wanted to marry?, have I met her family?, do she have a brother? Is her older or younger? How did you propose? I just suggest you don't lie to them cause they are very nice.

 

You don't lie full stop. I don't need to explain the consequences of lying under oath to a Consular Officer, do I?
