K-1 Fiance(e) Visa Process & ProceduresDS 260 Online (Manila Embassy)

When i had my interview last Sept. 12 they didn't ask for DS-260 nor DS-230 Part 1. Some of the applicants included the DS-230 but it was removed by the embassy staff at the tent upon entry. :)

Thanks ??

You put in your current (estimated) annual income, if working two jobs then the combined income.

Ok, will do.. Thanks so much for clearing my mind! smile.png smile.png smile.png

K-1 Fiance(e) Visa Process & ProceduresI-134 form (Affidavit of support) questions.. needs help pls..

does the I-134 need to be notarized? thanks....

No, it doesn't need to be notarized.. per USCIS website:

"You must sign Form I-134 in your full name. (Note: Signing Form I-134 is under penalty of perjury under U.S. law).  For this reason, it is not necessary to sign Form I-134 before a notary, nor to have your signature notarize after you sign it."

HunNeeFemalePhilippines2013-09-22 22:58:00
K-1 Fiance(e) Visa Process & ProceduresI-134 form (Affidavit of support) questions.. needs help pls..

You only complete one I-134.  You write your gross income for the year in the " $____________"

If there is not room on the form to list both places you work, added the info on a sheet of paper for listing the company names and addresses.

USEM will want a copy of your most recent tax return and W-2 (or in your case two W-2s)

If you income meets or exceeds the 125% poverty guidelines of the I-864P you do not need to list any other assets, nor include bank statements and such.

A copy letter and pay stubs are good to include.

Again, Thanks Hank! smile.png

So il add my 2 jobs income then and put on that "$________" line...

But do I put my 2012 annual income? (which has supporting w2 and tax transcripts) OR my estimated 2013 annual income? (which has supporting paystubs and letter of employment)

HunNeeFemalePhilippines2013-09-22 19:40:00
K-1 Fiance(e) Visa Process & ProceduresI-134 form (Affidavit of support) questions.. needs help pls..

Option 1:

Since they want you to attach the tax returns (2012 in this case), whatever you have on the 2012 tax return as your income (from 2 jobs from last year) should be on your I-864 (AOS) Part 6 Line 13 (a) and also on Line 10. The fact that you have a different job combination in 2013 does not have to be on the form as you do not have a tax return for 2013 yet, anyway.

Note only 2012 tax return is required. Returns for 2011 and 2010 (second and third most recent years) are optional. I had included all three of them myself.

Option 2:

Use letters from your two current employers to substantiate your estimated income in 2013. That estimated 2013 income  should be in Line 10 and also Line 13 (a). In that case you still need 2012 tax return amount to match with what you put in Part 6 #13 b (in this case).

My recommendation would be Option 1. You do not need to mention 2013 jobs and income because it is not over yet.

Thanks! smile.png  I understand what you're saying, although we don't use I-864 but we use I-134 for K1..

K-1 Fiance(e) Visa Process & ProceduresI-134 form (Affidavit of support) questions.. needs help pls..

It doesn't matter.  Look at it the same as a bank loan, they won't add those in either.  They go only off base pay.  To calculate base pay take your hourly salary then multiply by 2080.  However, it really doesn't matter cause you should qualify without the differentials.

I'm really not understanding this 2nd job.  It doesn't need to be on as your above base salary should qualify you.  If this is not taxed income as most per diem isn't taxed then I definitly wouldn't put it on.

Whatever you claim in this line you need to have letters from companies stating your annual income.  Meaning you need two letters of employment if your going to put both down.

Hmm.. Okay.. Now i understand.. I think il just use my full time job then.. Less complications.. (Per diem is taxed income by the way).. And oh! Why 2080?? When i did that, my income increased by $10k.. Is that for 40 hrs or 36 hrs? Am only working 36 hrs.. Or i just don't know how to compute! LoL ?? it would be nice if it's that high..

Looks good to me. My LOE just stated I'm currently a part time employee, in good standing and make $x per hour. I brought a long about six pay stubs from my FT job as well. I think just with your BASE income you will do just fine.

Good luck!! smile.png

Thanks for your answer.. smile.png

does my annual income in I-134 form question 7 that I have to fill out, be the same with whatever annual income amount's written on my letter of employment?? to be consistent?

HunNeeFemalePhilippines2013-09-22 05:44:00
K-1 Fiance(e) Visa Process & ProceduresI-134 form (Affidavit of support) questions.. needs help pls..

I'm actually in the same boat.  I think you just have to make over like 30k or so to pass the poverty guidelines.  So your alright there as my company just put my base salary as well even though I get night, weekend diffs.  You could also put in the second job if you want however, I think you might need a letter of employment for that as well.  I would just put the one, and include the W2's from 2012.  My base is actually low as well and I usually make 20-30k with OT/Diff's etc.

You can also show stocks/savings accounts, mortgage etc.

So now am beginning to wonder how they're gonna write my letter since am paid hourly.. do they just write $ hourly rate per hour OR compute it for a year to have an estimate for my annual income (although it won't add up the differentials cray5ol.gif).. and I want to put my 2nd job as well, it's the same hourly rate.. the only problem is my 2nd job is only per diem so it's not fixed.. I only work if they need me.. so basically, once or twice a month..

ah wait.. on my recent paystubs, it will show my differential earnings, etc.. can I just follow that? and ask HR to write something like this ---   _______ earns a base annual salary of $48k, not yet including her night and weekend differentials and charge nurse pay. To this date (most recent date), _______ has already earned $$$$ for this year... --> Do you think this is okay??

K-1 Fiance(e) Visa Process & ProceduresI-134 form (Affidavit of support) questions.. needs help pls..

Annual income is verified by a letter from your employer.  Get a letter from your current employer, search around and it tells exactly what it needs to say.

On Line 7, I would put your current employer.  It's fine you've had 2 jobs, just include both W-2's and your 1040 will show that.  Since you don't have 2013 W-2's you can't submit that information.

For I derive an annual income it will come right off the letter from your employer.

thanks watdog for ur quick response..

I don't get paid by the salary; I get paid on an hourly rate basis.. and I work 36 hours/week.. I also get paid differentials like night differentials, weekend differentials depending on when I was scheduled to work.. so the problem, am pretty sure, Human Resources will only add my regular pay rate and that's just $48k.. A very big drop from last years.. Will they accept this??

And 1 more thing... (sorry)

since i changed jobs this year, there would be a $20k-$30k income difference compared to last years income.. Am confused which annual income am i gonna write? my 2012 annual income?? or my 2013 income (estimate)??

K-1 Fiance(e) Visa Process & ProceduresI-134 form (Affidavit of support) questions.. needs help pls..

Hi Vjers!

Am about to fill out my I-134 form..  my 2012 total annual income was $95k.. and that's because I had 2 jobs last year (a full-time and a part-time job).. this year 2013, I still have 2 jobs but i changed my part-time job to per diem and with a different hospital now.. And I kept my full-time job with the same hospital as of last year.. here's my question.. number 7...

-- i am employed as or engaged in the business of ________ with __________ at _______ (address) ----> how can i put the names of my 2 jobs? or do i need a separate form for each? do i put my 2 jobs i have this year 2013 or the 2 jobs i have last year 2012? (coz my previous job is what's written in my W2, which of course am gonna submit to USEM)

-- i derive an annual income of:  $_________ ----> do i write the total annual income which was the $95k added from both jobs?? Or do i need to fill out another I-134 form for my 2nd job so it'll show the annual income in each job/hospital?? And if ever i just add the annual income from both jobs, which hospital am i gonna write on top? (see above)

wheew.. that was long and confusing.. am sorry.. i hope you guys can understand what am trying to say.. and thanks in advance for all your help! smile.png  smile.png smile.png

Yes.. both of you can access it.. coz it will require you to make  password and all so you can return to ur saved work.. just make sure you save it everytime.. and once you start working on it, you only have 30 days to finish it and submit it or else it's gonna get erased and you need to fill one up again..

K-1 Fiance(e) Visa Process & ProceduresQuestion about the DS160?!?

I just got our case number. Can I (petitioner) fill out the DS160 online or does it have to come from my fiance (beneficiary)?

I filled up my fiancé's DS160 online, when am finished, I made him look at it to see if there are some errors, if none, then he signs it electronically..

It's okay if you fill it up BUT make sure that your beneficiary is the one who will press the SIGN button electronically.. Or you can fill it up and sign it yourself and put ur name there as third party who filed it (that is, if the beneficiary can't read or has no computer, etc...)

K-1 Fiance(e) Visa Process & ProceduresHow long did you know your fiance before you filed your I-129F?

i think you would be fine.. as long as you met personally within the 2 years prior to filing.. they'd probably also want some pictures though.. and of course, other proofs..

I've known my fiance for more than 20 years now (we were classmates in elementary and high school), been a couple for more than 9 years now, got engaged last 2010 and filed this may 2013

K-1 Fiance(e) Visa Process & ProceduresDo you guys keep all documents after each step was approved?

Yes, I recommend you keep them especially the originals,  coz you never know, you might need them again in the future.. example is a copy of NOA2 for adjustment of status.. For me, I kept everything since I started the K1 process until now with AOS.. I organized them in separate binders like K1 binder and AOS binder in that way it's easy for me to find the papers if I need them.. Still up to you..

K-1 Fiance(e) Visa Process & ProceduresCan't Change Address Online

Filed an I-129F a couple of months ago for a K-1 Visa for my fiancée, and have moved since then.  I tried to file a change of address online, but even though an "A" number is not indicated as Required, when I try to submit the change, it says an "A" number is required.

I received an I-797C, Notice of Action which has an EAC... receipt number, but there is NO "A" number.

How can I file a change of address without an "A" number?

Thanks

K-1 Fiance(e) Visa Process & ProceduresPRENUPTIAL AGREEMENT

I have read through the posts, but didn't see anyone's real life experience.  So, I thought that I would add my 2 cents.

When we are in love, we are thinking "Forever", but for most of us, "Forever" doesn't last as long as it use to.  In my first marriage to a Filipina, I had no Prenup.  Didn't think about it at all.

Before we even met and all the time waiting on the Fiancee Visa, I tried to make sure that she understood that I wasn't rich--not poor, but sure not rich.  After only a few months after she arrived and we got married, she was unhappy that we didn't have a big house, fancy cars, etc. like some of her other relatives/friends in the States.  She also was unhappy that I couldn't help her family as much as she wanted me too, and for them to have more money, she would have to work.  Working sure wasn't part of her "dream" plans.

Adding to this, were Filipinas we met near us who would act nice to me, but then tell her "divorce this old man and get half of what he has and then get you a young man who can give you more".  Eventually, she believed them, and moved in with a younger man.

So, even if you want and hope for "Forever", it doesn't mean that you will get it.

As others have suggested, a Prenup is for both parties--not just for one.  Even if you don't have much, a Prenup will ensure that you get something in case the marriage doesn't work out.

There is a saying "Hope for the best, but plan for the worst".

Good luck to all and may all of your marriages be "Forever".

K-1 Fiance(e) Visa Process & ProceduresProblems Saving Forms--DS 156k and Others

Thanks Pacharya for suggesting that I download Adobe Reader 11.0.3.  I did, and I can now save the forms.

K-1 Fiance(e) Visa Process & ProceduresProblems Saving Forms--DS 156k and Others

I don't have a printer; so, I want to fill out the forms and save them to be printed later, but I can NOT save them.

Example DS 156k:  I have downloaded and when I open it, I get a message at the top "Click sign to fill out and sign this form.  When you are done, you can save a copy by clicking "Done Signing".

I have click Sign, but can't find where the "Done Signing" is to click.  I have also tried many other ways to save the form after filling it in, but wasn't able to.

I have seen where it says to Save a copy, but when I click it, I get a message that Adobe Reader can only save a blank copy.

Any suggestions?

Thanks
