K-1 Fiance(e) Visa Case Filing and Progress ReportsDecember K-1 filer touched on 2/17/08 (Sunday)?

Happy St. Patrick Day! Anyone else got approved?
Good luck and best wishes to all~

I'm still waiting and have not recieved any news from uscis. O well, wait wait wait.

I was able to speak to someone today who told me that my case was assigned to an officer last Wednesday and we should have a decision within 60 days, but she expected it to come much sooner!

I feel a bit better knowing that it's with an officer at least.... but this didn't generate a touch.

Back to the waiting...

K-1 Fiance(e) Visa Case Filing and Progress ReportsDecember K-1 filer touched on 2/17/08 (Sunday)?
We received our NOA1 from VSC dated December 13th, 2007...
Touch on 2/17/08 and nothing since sad.gif

It looks like there are only 9 or so of us December VSC filers still waiting for approvals.
I'm so worried that I'll be forgotten!!!!

Please keep posting with updates on touches or approvals...it's great to have the company!

I'm not a december filer. I'm just dropping by to wish that you will have your NOA2 the soonest... It really pains me to see people who applied before me still waiting for NOA2. sad.gif .. If only we can make better sense of this system.

I'm keeping you and all those who are still waiting in my thoughts and my prayers. rose.gif rose.gif rose.gif

Hope the coming Easter will bring good news to many people still waiting.

Thank you! and Congratulations!

K-1 Fiance(e) Visa Case Filing and Progress ReportsDec. VSC Filers still waiting?
It looks like we're one of the last 6 or so December Filers to Vermont Service Center on VisaJourney....

I'd love to be in touch with anyone else waiting.

I was told that our case got assigned to an officer last Wednesday but have had no touches or emails yet...does anyone know how long it usually takes once it's with an officer?
(please god, not the whole 60 days!)

I was touched on the 17th too!

And I can finally check my status on the USCIS website! I know it doesn't tell us much, but after a million phonecalls trying to get them to fix the glitch that was not allowing my number in the system, it is just so nice to be able to see it there on the screen smile.gif

Hopefully we'll all hear more soon!

K-1 Fiance(e) Visa Case Filing and Progress ReportsVSC NOA1 Mar 13... still no NOA2!?!?! Been 36 days or so... something wrong?

I know other service centers are slower than VSC but I am concerned because there is no approval yet. Anyone else have this many days at VSC? Seems march filers from that date are all approved.

Any ideas what may have caused delay?

I do have past DWI charges. Would that slow the process?

My NOA1 was March 14 and I had a touch April 10th and nothing since. So at least you are not the only one. I dont know about you but it makes me feel a little better knowing that I am not the only one waiting in the dark. Right now I would be happy with a RFE just to know my petition is not sitting on someones desk who decided to go on vacation. At least with a RFE I can do something about it. Hang in there maybe we will both get some good news soon.

K-1 Fiance(e) Visa Case Filing and Progress ReportsNOA2 for March filers (Vermont only)

Ugh. I just got the email for an RFE.

I feel bad that you had to wait 13 days for them to decide to notify you of the REF. Hopefully the snail mail request will come real soon. My last touch was April 10 but now I have some kind of a timeframe of what to expect. I think I would prefer a REF just to get things moving again as long as it is not a difficult one where I need more info from Ming in China. I understand that when they receive what they request approval usually comes just a day or so later. Please let us know what the REF was for. I hope it is a easy one.

Good luck to all the NOA2 recipients, but I am getting a little (understatement!!!) nervous myself. NOA1 was March 14th with a touch the next day I believe. I had one more touch on April 10 and nothing since. No e-mail notification about the touch either. I see so many who filed after me receiving their NOA2. If they are looking for more evidence should I not have had that by snail mail by now?

US Embassy and Consulate Discussioni-134 help
QUOTE (Stephen + Elisha @ Sep 2 2009, 09:22 PM) <{POST_SNAPBACK}>
It's a little-known fact that the I-134 is not, as a strict matter of law, required at all. Most consulates require it as a matter of course, but it's entirely at their discretion. Many consulates in Western Europe will allow K-1 applicants to demonstrate financial self-sufficiency and don't require the I-134 unless the applicant's income and savings are insufficient.

That being said, if the I-134 is used, there are in fact some rules—regarding the evidence required with an I-134, at least. These are found in the Department of State's Foreign Affairs Manual at 9 FAM 40.41 N4.6-3: http://www.state.gov...ation/86988.pdf For example, the FAM states that the I-134 should be accompanied by the most recent tax return, including all schedules.

QUOTE (mamajew @ Sep 2 2009, 09:01 PM) <{POST_SNAPBACK}>
how up to date does the supporting evidences eg tax returns etc needs to be? can i get everything prepared even before receiving noa2 or is that too soon?

Again, it should be the most recently filed return. Also useful to show current income are pay stubs (the most recent 6 months' worth are often suggested) and a recently dated letter from your employer stating your position, date and basis of hire (permanent full-time, hopefully), and salary. Hopefully, taken together, these documents will demonstrate current AND sustained income.

Gary is correct in saying that there are no specific rules for adjudicating the I-134. The consular officer must be satisfied that the applicant will not become a public charge when he/she reaches the US. Gary is also correct in saying that most consulates use the I-864 guidelines (125% of current federal poverty guidelines based on household size).

While that might be a little known fact - it's not a particularly helpful one when dealing with Jamaica - Cause I guarantee, they are going to require it, no matter what the financial status of the visa recipient.

Mamajew - You will most likely need 3 years of tax returns / transcripts - the most recent ones. I would not get it fully prepared prior to receiving NOA2, although you can start gathering the documents - The embassy is going to want to see a recent employment letter, paystubs, and the most recent tax return.

Come on down to the regional forums - there are lots of Yardies who can guide you along.

Don't worry about the expiration date - that is for them, and doesn't seem to affect the interview process - Jamaica is a different animal then other consulates - There are 3-4 others in the Yardie thread who are in the same situation you are -

Come down to the regional forum - Others can point you to the right forms and how to get the interview date, etc... by email. Including the interview letter -

Just typed a lengthy response and lost it

Alisha - I understand your frustration and disgust - regardless of anything, your Dad is your Dad - But the embassy will often require DNA, especially if the father was added after the fact, or if the parents were not married. You need to take a deep breath, and get back in contact with the embassy to get the list of DNA centers that they sanction - one of the yardies just dealt with this for her step daughter, and got a quote of $750 -

US Embassy and Consulate Discussionpetitioner and interview
They changed the rules at the Jamaica Embassy - The petitioner is NOT allowed to attend the interview - there have been some who went down and waited outside, even one person who had the consulate send to have their SO come in. If they decide they want to interview the petitioner, they will blue slip and then you need to schedule a second interview.

Do you have your tickets booked already? I am assuming you are planning to go down and then fly back with them - it's not advisable to make travel plans until the actual visa is in hand. While some get it back quickly, there have been others that it took months.

Unfortunately, there seems to be no rhyme or reason behind when they print the visas - some have gotten it in a few days, some it took a few months - did you try calling / emailing the embassy or DHL in Kingston?

US Embassy and Consulate DiscussionCan the petitioner send the I-134 directly to the Embassy?
Sorry, I don't know the exact answer to this - From my belief, I would say that yes, the form will still be accepted - they do this all the time when they update forms - And, if I were in your shoes, I would suck it up and redo the page with the error and overnight it - Better to spend a little now than to take a chance and get a blue slip and have more of a delay.

No, you can't - I would bite the bullet and fedex or DHL it - something that will ensure it gets there.

Also to help eliminate the people who fraudulently try to obtain a visa........

My son and I came up on a K1/K2 visa. My wife is a naturalized citizen. My son and I both have Green Cards now and waiting for AOS. Is my son automatically a citizen because of his mother being a citzen? Can I apply for a US passport for him?

I believe that your son, as long as he is under 18, should be qualified for citizenship based on his Mother's naturalization - But you have to apply for a Certificate of Citizenship by filing an N-600 through the USCIS district office that serves your area - Once you have that you should be able to apply for a passport for him
