Maybe it may help both of your to relax by reading the embbassy reviews on this site. It seems most of the embassys are more concerned that you have your paperwork in order. I plan to be there for moral support for my Fiance.

Maybe the two of you are feeling pressure and sometimes that can create added pressure for the beneficiary. Have a rehersed stock answers could come off fake. Let her answer with the intention that she loves you and I am sure you will be fine.

So read the embassey reviews.... you will feel better...

I am sure your reasons are bonafide and you can not go.. But honestly I do not blame her for being upset. It is a daunting process for her to change her life and eventually move her whole life to the USA. She s sacrificing a lot... From a woman's viewpoint she should be upset... So maybe you can tell her the reasons why you know she is upset so she can at least feel you know what she is feeling....
Maybe you can talk to get on Skype before and after the interview to soften the blow

I know where it is tsc... My congressman confirmed it today by speaking to them

I was pointing out that the TSC does not currently process I-129F petitions. It could be possible they would be transferring some of the load there. I do not know. No one will know for sure where their petitions were transferred to until they get the actual letter in the mail that tells them.

TSC does not currently process I-129F petitions. Only the VSC and CSC do. IF they are truly being sent there for faster processing, then this will be the first time in years that the TSC will be dealing with I-129F petitions.

If it snt he tsc.. Then where???

Bad idea ... Stay honest with you visa... They do extensive background checks... Do you want to take the chance that they deny you visa and you fiancé or husband can't enter the USA... Use you time in India to get to know your family and pan your wedding... Always be honest with your visa!!!!!!

I know this thread is old, but I've just started my K-1 petition process, and I still feel a little confused on the answer to this question.  My fiance and I met online through a matrimonial website.  We fell in love with each other, and told our parents about it.  My family lives in the USA, and her family lives in India.  Both families talked on Skype and reached conclusion that both wanted to go forward with the engagement, but first wanted to meet in person.  So my mom and I flew to India, met the family, got engaged in a small family function, and then I flew back to USA and filed the K-1 visa.  The process may take some time (as we all know :P ), but my whole family was going to travel to India in November (we made this plan even before I met my fiance).  So we decided "why don't we have our wedding ceremony in November itself since we'll all be there anyways."  So although the K-1 visa petition has been filed, we are planning on conducting our wedding ceremony in India, BUT NOT REGISTERING IN THE COURTS!
 
Now my fiance and I aren't experts on what constitutes as a LEGAL marriage in India.  We can of course ask court members or lawyers there, but I just thought I would ask people on this forum instead in case someone already found out this information.  So sorry for the long lead in.. but my basic question is:
 
In India, if we have a wedding ceremony with a priest and "ferahs" and all and NOT register in the courts, is this a legal marriage or not?  I understand of course that my fiance should not provide any photos or evidence of this ceremony to the consulate because they might consider this as marriage regardless of the legal aspects of it.  Just wondering in case they find out somehow, then my fiance should know how to defend herself.

Exwife US citizen or did you apply visa for exwife? If exwife US citizen you have a minor red flag on case that you will need to explain but shouldn't be a major problem.
If Exwife not US citizen and you brought her here on a K1 or CR1 visa, then you have a nightmare scenario ahead of you.

I would attempt expedite based on USCIS error, highly unlikely it was postal service problem. Just email USCIS and request for Expedite.
You need to write about the delay and fee change and then explain the financial hardship you will endure because USCIS lost your petition and did not properly log it in when it arrived originally.

Doesn't hurt to try, I got an expedite on my stepsons petition for my own error and USCIS processed it in 35 days.

Did your previous fiance stay in the U.S. beyond 90 days? I would be very careful here because you are on shaky ground if she did in fact stay longer then 90 days without getting married.
You would be party to immigration fraud at that point. You best thing to send to USCIS is proof that she returned to her home country prior to the expiration of her K1 visa and prior to marriage.

I spoke with a nice person at USCIS who told me about the current status of the "recalled applications" to the Vermont Service Center.

The "files" were recalled along with the "Petitions" from the foreign embassy. My petition was still on its way back to square one so I could be sent my IMBRA addition (ironic considering we met in USA and IMBRA is applied to all K-1 now).

So now she tells me that once my file and petition are in the office I will get my RFE and my case along with everyone else affected will be expedited. She said the RFE's sent out due to IMBRA will be mailed in bulk from the Vermont Service Center.
How can that be true if I am hearing that other people using the Vermont Service Center have already got their RFE's?

She said my case was of course recalled like everyone else's due to IMBRA, but I am hearing that other people have already gotten their RFE.

Let me if anyone is along the lines of my timeline and has heard back from the VSC.

I posted a question titled RFE Please help in this K-1 foum today regarding this:

I received a letter from the Montreal Consulate-but it's from the Consulate General office in Champlain NY. It asks them to supply them with the Canadian beneficiary's proof of Citizenzhip or residence. There are no specific instructions as to how to send it to them- or where. I am currently trying to figure that out.


The letter has 6 numbered options. First it says "Thank you for your communication regarding the below-referenced immigrant visa case(what communication?- I did send them an email asking for status update, but that's it.) . The following check marks pertain to your case.

Mine has #1 checked: PLEASE FURNISH THIS OFFICE WITH PROOF OF YOUR CANADIAN CITIZENSHIP OR PROOF OF RESIDENCE.

Currently my fiance and I have not yet received packet 3. The consulate sent this letter the day the received our case from NVC.

I don't recall ever seeing instructions to include the beneficiary's proof of Citizenship or residence in the I-129F, G-385 or anything else. So is this an official "RFE" that will delay our process or something else?

I have emailed scans of her resident card. I will fax it to them as well. I suppose my fiance will also send it to them from Canada via DHL. Anyone have any advice. Thanks!

Well s&c1 my fiancee isn't working at present so she doesn't have that. She does have a track record of always coming back in time. She will have either the NOA2 or interview letter, a car title and her word. I would think that having a Fiance visa appliction pending at the Consulate would tell the border agent that she HAS to go back to finish the process and that an overstay would risk everything... but of course it's all backwards. So she will be open and honest with all questions and say that she has time to visit me while we wait for the Montreal Consulate to do their job sometime before we all die of old age.

By the way the Department of State Visa Service will be able to tell anyone their current case status at the Consulate/Embassy. Their number is 202-663-1225. Ours hasn't been received yet even though it was sent on Jan31st.

At the moment we are considering whether or not we should try and have her visit the U.S. after we get our interview date. I read the "Yes it is ok to visit" thread somewhere on here and while most of the stories were positive, some scared me silly. I'm going up to visit her this weekend in Toronto :)

You don't know how surprised I was to find out that Toronto doesn't do K-1 visas. Very little in this visa process makes any sense at all.

Hello everyone,

This site has been a godsend to me and my fiancee. Our process started seven months ago and we are currently waiting for Packet 3 from the Montreal Consulate. I am the petitioner and a U.S. citizen applying for the visa for my fiancee who is a Peruvian citizen and a permanent resident of Canada. I have posted our timeline in the signature section. Like many of you we have a host of questions and have found a lot of guidance on this site. I thought perhaps our story would help others currently in the process or thinking about it. Right now my biggest concern is the Montreal Consulate. They do not answer the phone, have a rude message about huge delays on their answering service, and take 2 weeks to answer an email if you are lucky. I have looked a little at the Montreal Forum on this site and not not seen much encouragement there, I notice that some with a similar timeilne (a month ahead) to us have an interview in May. I think that is beyond ridiculous. I'm sorry for any of you that have to deal with this Consulate. I am praying that everything will go smoothly for us and we will get Packet 3 and an interview soon. So concerning all this I do have a few questions:

1) When can you actually schedule an appointment? I have a Montreal Case number from NVC- MTL xxxxxxx. Is that the one I would use to make the appointment?

2) What is a reasonable amount of time (considering it's Montreal) for getting Packet 3? What if you don't get it?

3) Besides the medical , are there more Visa Fees to pay? I paid the $455 when I sent the I-129F packet in.

The form to give to DHL asks for a Reference ID- which is supposedly displayed on the Applicant summary page http://usvisa-info.com. I don't have an account on that website. Do I need this Reference ID? If I do, should I or my fiance create an account and get this Reference ID? It seems like that everything about DHL courier is for appointments, while we are just trying to send an RFE document.

I am in the U.S. and my fiance is in Canada. I am the applicant.

Hi,

The Montreal Consulate received our case last week from NVC. They have sent to me (the U.S. petitioner) in the mail a RFE letter asking for the benefciary's Proof of Canadian Citizenship or her legal immigration status. She is a permanent resident of Canada. For whatever reason I did not include that in the I-129F packet. I never saw instructions to do so. I was thinking they would ask that with Packet 3. We haven't received packet three yet though. The letter says "please furnish this office" with the evidence. The letter is from their office in Champlain NY.

So I sent them an email to montreal-iv-dv@state.gov with a color copy of the front and back of her resident card and a scan of the letter they sent to me. I was also thinking to snail mail and fax them this information. However I received an email back that says:

1. If you have been asked to provide additional documents, please send all the required documents together. Sending documents separately will not allow the IV unit to complete processing of your case. When you have all of the required documents, please mail them together with your name, case number, mailing address and email address to our office using the CSC Visa Information Services <http://canada.usvisa-info.com/> . Please visit http://canada.usvisa-info.com/ to register for a DHL courier location to drop-off your documents. Upon receipt of all the required documents, the IV unit will review your file. In rare instances, you may be required to return to Montreal for a follow-up interview. If the visa is approved, the IV unit will send the completed visa packet to you via the DHL courier services to the courier location you have previously registered for. Please allow six to eight weeks from the time you send correspondence to receive a reply from the Consulate. Please note the IV unit is not able to confirm receipt of documents. Documents received at the IV unit are processed in the order in which they are received.
NOTE: our P.O. Box 65 at Stations Desjardins is no longer in service. Mail sent to this address as well as the mail sent to our office address will be returned to the sender.

Please- what do I do? Is DHL the only way to send them the document they need? So does my fiance have to send these copies of her pemanent resident card through DHL from Canada? Is it a problem to fax or email this to them? Why would it be, they are not originals, we can't send them her card, just copies.

I noticed somebody asked a week or so ago if there was a list of all RFEs so people could look out for possible "boo-boos." So here we go!

My RFE reason was;
The forms we downloaded didn't tell us to add evidence of meeting in the past two years or frontal face photographs. Which is weird because we got them directly off the London Embassy site. So we got an RFE for basically the other half of what you're suppost to send origionally. We started the K-1 appliciation before we found this forum so we were kinda just going with the instructions as best as we could. We say if you're just starting the I-129F download it from VJ...they seem to have the right instructions....

Thanks everyone! I feel much better after reading these responses, I was worried there would be a slight chance he would get turned around after arriving here!! And 3 weeks is not long enough as it is.. I cannot wait until this Ozzie is here permanantly! I will definitely be sending him off with some photocopies and letters, but unfortunately he wont be able to get a note from his boss.. he's afraid his boss might fire him if he finds out he's planning on leaving within a few months or so anyway.. and we certainly can't afford to let that happen!

Oh, good to know! I can't imagine why they would think we would pay money to start a legal process, just to screw it all up by staying illegaly on a tourist visa.. but who knows. I guess crazier things have happened. His boss doesn't know the full plan at this point, he doesn't want him to know that he's planning on leaving to move here because he is afraid he will lose his job, but we will figure something out. He will def have a return ticket with him, and I think I'm goign to type a letter and photo copy the wedding invitation for him to print out and have on him that this is definitely only a visit! Hey everyone!

So.. exciting news today, after 4 months of waiting.. I finally received the email confirmation that the NOA2 is approved and the hard copy is on its way. Yay!!!

My fiance is due to visit June 22nd- July 12th, I've heard sometimes its difficult for them to visit though? Even if its just on a tourist visa like he's been here on twice before? Has anyone else had a problem with their fiance coming to visit the US? He's already got a return ticket scheduled and has to get back to work and he is coming here to attend a good friends wedding with me July 9th. Is there anything he should bring/do before he leaves on his flight to get here?

Any info on this would be very helpful.. I would be devestated if he got turned back around after flying here!!

Got the hard copy letter from NVC today too =) Things are moving along!!

Fiance is due to visit tomorrow as well, flights are delayed due to the ash cloud.. pain in the #######!!! Can't wait to see him though.. been 5 loooooong months.. now I have to wait at least another 6 hours!! He'll be here when the packet arrives to his house in Oz though.. oh well, have mostly everything we need here anyway, should be able to send him back with almost everything assembled. Yay!!!

I just received the email instructions from the US Consulate in Sydney. Listed in the instructions is..

Forms Required: Form DSL-1076 - applicant's statement of readiness to be interviewed

When I click on the little blue link for this, its not a form, just another 5 page list of instructions. Is there an actual form for this? I can't find it anywhere!! On VJ, I googled it.. nothing. Or, should he just write a letter and title it DSL-1076 and state he is ready to be interviewed?? lol.. what do we do here??

Glad to hear, thank you! I emailed the consulate just to be on the safe side. Packet 3 will definitely be submitted way before expiration date, its just the interview I was worried about getting scheduled late. Good to know they are getting them done quickly =) I'll actually be in Oz sept 9-21.. wonder if the interview will actually fall in that time frame, would be cool! I would love to be there with him. I am just a little worry wort, that is all.. but better to worry about this now than Oct 4th.. ya know!

Jen not sure why you waited so long as you were approved back in June. he could have had his medical before or anytime since then. Not sure what state he is in but he will get the results within a few days. I hope he has had his police check done and fingerprinting? Once he has the medical and all his papers he can send them in straight away over night express. So his app is 22nd August he should have the results back 26th -30 send it all off immediately interviews are wait approx 4 weeks but lately consulate is working really quick as some here have got their interview within a week so that's September so should not be a problem and then the K1 is valid for 6 months.


Yeah, I got the letter in the mail that it was approved approx June 8th, adn he was scheduled to come here June 22nd, so I got everything I needed together for the I134 etc and had that all ready for him.. no point in mailing it since he was going to be here in the US anyway, but he's been back since July 14th and yes, got hte fingerprints done and his passport updated already, but he travels for work..he is away from Sydney most week days and never has any idea where they are going to be and what days until a day or two to a week in advance, so it's been tough getting all of that done. I'm not sure why he waited so long to call to make an appt for the medical, but he did.. can't change that now.. but that is the only thing pending before mailing in packet 3. but either way, it looks like its going to be cutting it close by the time they schedule the interview, because since it will be so close, we KNOW it will be scheduled for 5 weeks out.. haha! I think we should def get an extension. better than starting from square one all over again. Any idea on how to get the extension?? Thanks!! Jenn

Hi all,

So.. we got our NOA2 back in June, and it expires Oct 6 2011. In the meantime my fiance has been working on everything.. getting a new passport, fingerprints etc etc. He just called to schedule the medical which he needs before we can mail in packet 3, and the earliest he can get in is August 22nd. I'm worried that by the time he gets the medical done, then finally sends in packet 3 and then the consulate schedules the interview, it will be close to or past the expiration date. I think we can get an extension on this date? I've searched around this website but I can't find out how. Is anyone able to help me? I dont want to wait until Oct 1st to start worrying about this. yeah, good luck! I'm dealing with the same issue, but we've decided to elope and throw a party later on down the road.
But if this helps:
We sent everythign in Feb 1st, got the NOA 2 June 6th (4 month wait) and are thinking he should have the visa in hand sept, (working on packet 3 now) and hopefully move to the US in November (although they have up to 6 months to move to the US from the day you get the visa). Whcih means, we are getting married somewehre between november and Feb. So, thats 9 months to 1 year from the initial filing of the I129F.

What I would do is overshoot the year by a few months to give yourself time incase of complications, and worst case scenario, your fiance has to wait a few extra months to move here so that the cruise wedding falls within the 90 days. But.. then you're screwed in the freak case that the NOA2 gets approved super early (I have read of a few people on here actualy getting approved within 1 month) because everythign has expiration dates on it.. once you have your NOA2, you've got 4 months to get the rest of hte paperwork/interview done, and then 6 months from there for the fiance to move here.

THe other option, which a friend of mine did, her fiance (from the UK) came to the states in May on a visit, they got married.. and then he went back home after the honeymoon. They will bring him here on a k-3 visa instead of the k1. If you are heart set on having a big cruise wedding right away on a specific date adn dont want the stress of hoping allthe paperwork gets filed accordingly, that might be a better option for you.

I dont imagine it would save any time, as the bulk of the time spent waiting is the paperwork just sitting on a shelf waiting for someone to get to it. I'm not sure even a lawyer could speed that up. Maybe they have some pull though. I do think it would be a waste of money in the sense that its a pretty simple process to go through on your own, providing you both speak english. It is a bit intimidating at first, but with some research and the help of some good friends and guides here at VJ, it's doable =) I looked into a lawyer before we started the process as well, thinking all the legal jargon would be too much for me, and now I'm so glad I didnt. But, I guess if I had the extra money lying around (but who does with all these fees that go along with the process!?!? And of course the money spent on traveling to see the fiance!) then I would have gotten a lawyer. Best of luck!

Hey everyone,

Just wondering.. my fiance is going to be sending in Packet 3 shortly after his medical (scheduled for Aug 22) and I'm flying to Australia Sept 7th to be with him for a couple of weeks, there's a chance that the interview may be scheduled for the time that I am there. Do they allow the fiance to come for the interview as well? or is it a single interview only?

yes, once you are in the US, you can fly wherever you like also within the US.. you just cannot leave the country and come back, so no worries.. just dont get too drunk and head to Tijuana! haha!! Enjoy vegas =)
