You will get denied as he most likely has at least a 10 year ban from the deportation. YOu can file and it may get approved by USCIS but will get denied at consulate, then you will have to apply for the waiver at that point.
In cases like yours it is highly recommended to hire attorney because of the many issues you will have to deal with.
And yes he will get to file waiver, but getting that approved is the hard part.

Do people really ever get rejected?

Yes many people get refused, however if you have the patience and relationship can survive the long tasks of appeals and re-interviews almost everyone in the end will pass.
Unfortunately many relationships do not survive the long process of over-coming a rejection.

It also depends on Country beneficiary is from, high fraud countries have a much lower rate of success.

2nd Interview

If it is a stokes interview they will ask simple questions looking for common answers since they will seperate the 2 of you to different rooms.
Example
What side of the bed do you sleep on? Then ask this same question of your fiance
What is your favorite food? again asking same question of fiance

Stokes interview is designed to see if the two people actually know each other. Names dates etc can be memorized, but the questions in a stokes are designed to surprise you with simple day to day life details.

Question that catches many people for those people that talk on video chat or phone daily, because people will bring tons of emails etc to an interview to prove bonafied.

What time does your fiance normally call you everyday?

Answer honestly and don't be nervous. A valid relationship will easily pass a stokes interview. A non valid will be found quickly.

Experience of cold feet before interview?

My wife got rejected at our first interview K1, though she didn't tell me until after she successfully passed her CR1 interview, she wanted to just walk away the day before interview and go back home. She had no desire to end our relationship but she was scared to death of the interview the day before and really really did not want to go because of the fear of rejection.
The interview process is hard on the nerves, I was waiting outside the consulate for 4 hours at that second interview and that 4 hours was the worst of my life. Several times I would have sworn my watch was turning backwards.

The one thing about the nerves, the stress and everything that goes into the entire process........

That moment in time when she walked out of consulate and I looked at her face, the smile and the look in her eyes I will never forget. Life has been great ever since that moment.

Travel shortly after entrance

Its all a none issue, once you have stamp in passport you are good to go, besides that you will get actual green card in about 2 weeks after entry. My wife got hers in mail in 10 days after POE.

Based on above line, if PCC is in official language of Brazil, it should be fine. But if NVC wants to validate what it is, how will they do it? Or do they need a Brazilian person to confirm it in NVC office?

does that mean that security certificates also must be translated. My wife is from Brazil, is that not where the application for the visa is being made? I do have translations of marriage certificate, which was needed for USCIS, and I have translations for both my wife and her son's birth certificates. Should I get translations of police certificates as well?

yes, you will have to wait till tomorrow and then call and speak to an operator. Have your paperwork in front of you, so that if you know you sent something, then ask to speak to a supervisor. the supervisor will explain in detail. It was shortly after I got off the phone with the supervisor that I received 2 emails from the previous day, and then that night I received another 2 emails from the discussion with the supervisor. Both emails explain exactly what is missing or incorrect and was complete with a checklist response cover sheet. So if you do in fact have a ledgit RFE or checklist as it is called with NVC, then send in the requested documents with the coversheet and your all set. The worse part from what I hear is waiting for them to be entered into the system. And DON'T LET YOUR GUARD DOWN! Keep checking the AVR and the log in page, just in case they pull another fast one....

NVC MAKES MISTAKES.

was approaching week 3 of NVC, decided to log on and check for sif, no sif, ah what the heck, I called, and the AVR said missing documents. Called back and spoke to an operator. Operator said Civil Brazilian Certificate needed. Asking myself what is this? they only need a federal police certificate and seguranca do publica (state police) certificate. So I emailed the embassy. they responded very early the next morning with: "we suggest you call back NVC and have them clarify what they want, we only require the federal and state police certificates". So this time when I called I said that I had emailed the embassy and they specifically told me to call you back because they don't know what the *&$% your talking about! Was immediately transfered to a supervisor who explained to me that the state police certificate was not in the correct format, and that they needed the correct certificate to complete the process. this was back on the 1st of October. so I called my wife immediately and told her to get a new one and mail it to me asap. She mailed it on Oct 5, ( to this day, I still do not have the certificate from her). I stopped paying attention to NVC, no calls to AVR, no log in's to the website, (why should I do this if they need a document?) Then on October 14 received and email that case was completed on the 5th or 6th, can't remember now and that your interview date was set for NOV 8th. HMMMM, how could this be? The wife did NOT mail the document to them, and there is no way that they would have received it that quickly even if she did mail it to them. Word of advice, even if you have been given a checklist and you believe you sent in all the correct documents, still pay attention to NVC.

Kruz, I would say your NOA 2 is in the mail, but since you did get a touch, I would suspect that you will see the update online before it arrives in the mail. My wife's USCIS progress is still with NOA-1 date and has never been updated. My Step son, has the same Noa 1 date with you, and has never been touched. Hope you get some good news today. I know how frustrating it is.

UPDATE........first of all thanks to marie_yahya...for your information on Ruth Mills. It worked out this time.

My spouse just got off from the phone after talking with Ruth. She is friendly and told us that our case is currently with one of the IO officer. and Because our case is 5+ months, so she told us that she will send out an email to that officer so that he can do all the best to speed up the work. But she clearly said she can only request, rest is in officer's hand. Not only that, she said she will follow up on this or if not, we can call her back in next two weeks. Let's hope for the best.

She also asked my wife that I can see that you have a travel plan coming up in Nov. and also Ruth mentioned my spouse's email address while on the phone, so upon asking she replied she also received our congressman's letter.....because we never mentioned that my spuose is having a travel plan in nov. while talking on the phone. She said we can expect an approval OR RFE, if not approval, in another two weeks.

So finger's crossed......now I think that touch on 20th sep in my case, means something because it looks like our case is with the officer since then.....

I wouldn't be surprised if you had an email tonight! with "dancing smiley's"......lol........ Good luck. I'm sure your so close that your gonna be in tears of joy soon!

Loto, thats a given......lol.... have you seen the lightning speed they have been approving at? Ok, maybe lightning compared to be before. Since I am still waiting for my Step son's I-130 I still look at the approvals every day.... and my god, they have gone from maybe 9 in three weeks to 9 in 7 days..... that is some improvement! hopefully NVC will start doing the same so you don't have a waiting list to get in the door on that.

The point is that and maybe you can pull up some info on this..... how long did it take "March" to get through? How many April filers have been approved? Why did we go from seeing like 10 approvals a week to 2 or 3?, for like the last 3 weeks! Am I just missing the boat on this?

I agree with the 100% never obtained, but remember, there have not been many April approved. Why is that? and it did take them forever to get through March. Again, my wife is approved, whe will be coming before my step son since he will be finishing his sememster at school there, but, his still is not approved, and I know that I will receive an RFE for him because I did not send his BC, as required. I am not only concerned with his progress, but the many other people in April, that are in that same position. Something just isn't right here. I don't know what it is and we can guess and contribute ideas to many things that are causing delays, but I really believe it's time that some truthful answers are provided to those that are waiting. Quite simply, why have I not received and RFE yet? I fully expect to. It is clear as black and white to me.. To me it means that it has not been touched yet. and tomorrow it will be 5 months!

I hope Mattidil is right, but, realistically, it took them 2 months or more to get through March filers, and they aren't even done yet! How on earth in the next 2 weeks can they get through April, when at the most only half a dozen have been approved?

those that were on some K-1 path , are what- overstays in USA, either after marriage or EWI before current filings?

CR-1/IR-1 path - sorry, disagree - those need 'consular interviews' and if they are in the USA, is not any type of CR-1/IR-1 visa for them.

remember - these were people who were already tagged to be deported. Most were EWI, as well.

How else could they be "on a path to immigrating" if not through some type of fiancee or spouse visa?

I called USCIS to check on case status. Same 5 months mumbo-jumbo. I application is only 25 days away from being 5 months old. I tried to get the woman to tell me what are the dates on the application they are processing now. She doesn't know she said. I'm assuming they are processing early April applications. All the ones left from March are either goign to get denied or they've gotten RFE of some sort.

With my luck, I'm going to end up with an RFE. You just wait and watch. Argh. I'm getting mad already.

I hope you don't end up with an RFE, but if you look at the timelines and numbers of "April Filers" that have been approved, their might be half a dozen. At least two of them I can contribute to expedite. Something has put I-130's on the back burner... Not sure what it is, but the approvals have pretty much stopped! I wonder how a file is handled when it comes in, does it get assigned to an adjudicator immediately, then it is up to the adjudicator to send it through the security checks, then when it comes back as clean ( no flags ), they actually look closely at it? If that is the case, and with the Summer coming to a close now, and vacations pretty much wrapping up, maybe we will see some approvals, however, if the case is not assigned to a specific adjudicator in the beggining, then maybe something else is going on such as the recent articles appearing in the papers relating to Immigration. Even though my wife has been approved at USCIS, my step son has not. His NOA-1 date is 4/14/10. I fully expect to see an RFE for him, because I did not send in a BC for him listing my wife as his mother. Initially I was very concerned with this, but, my wife wants him to finish the school sememster in Brazil, so it is not absolutely important for us to have him approved as of yet.

With that said, I'm still very concerned with the speed of how approvals are coming and the reasons behind them. Maybe someday, a USCIS rep will be doing the same thing and will enlighten all of us as to how things progress.

CSC/VSC resources were NOT 'pulled' to cover those, at all.

I disagree somewhat. They specifically state in the article that "those that were on a path to citizenship", I'm assuming that might include k1, cr1/ir1.... Since many Illegals try to take the short path. Then again, Vacation is over after labor day...... so maybe we will start seeing something next Tues, I sure hope I'm wrong and see something this week though.
