If you are lucky, you are looking at a Nov date, probably a December one though, based on what others have gotten. You can email the embassy and ask them to email you the date - People that got their interview dates in August were given Oct. dates.

Can you please fill out and correct your timeline info though - it will help others to process and estimate, and the way it is will skew the data - you have your country listed as Armenia, your filing location as California, and your local office as Newark -

If you live near Newark it would be Vermont.

Are you saying it is the US citizen petitioner who has/had this issue? If so then yes, it won't even come up. If it is the beneficiary, they may need a more extensive (mental health) medical exam, but it should not be a major problem either.


Not necessarily true - as the beneficiary, they will have to prove that they won't need the public benefits - there was a recent case in Jamaica where a man's spouse was diagnosed with breast cancer - their visa has been held up, because the Consulate is requesting a letter from her husband's medical insurance that she will be eligible for treatment on his plan - but the health insurance company will not provide a coverage letter as she is not in the US - they are stuck in a catch 22.

So they are allowing you to attend the interview? Because they stopped spouses/fiance's from attending a while back. If they need to ask you any questions they will make you come back at another time.


They will not necessarily make you come back at another time - There have been spouses / SO who went to the interview, waited in the courtyard, and were called in because the CO had questions for them. If you are not physically present, they will make the beneficiary come back again with you. If the petitioner is present, it is likely that they will come get you if they need you.

As for the misrepresenting when you met, no I would definitely not advise that - There are plenty of other couples who had similar situations and started dating before the divorce was final - Not everyone who ends their marriage immediately files for divorce, and sometimes the divorce takes a hella long time to get.

That IS true of other countries, too. They can and will drug test if they have any reason to test, and they ask about drug use as a matter of course. My husband's long hair, for example, may very well trigger either--fortunately he can answer NO to the questions, and won't turn up anything on the test.


The point that you are missing is that other countries can and will test - Jamaica ALWAYS tests, reason or not - and its not just a question about drug use - it's a constant barrage of questions over and over to try to get the person to say yes - Then, if even a yes, I tried it many years ago is elicited - its written down as a habitual drug use, and regardless of the outcome of the test, it's a ban. Doesn't matter what turns up on the test, or that maybe the person tried it once in their life 20 years ago. I recall someone who answered yes to the question about smoking (in his mind, cigarettes), and ended up with a ban because of that.

Wow at the responses in this thread - For those of you dealing with other countries - ask people going through those embassies if they test for drug use - 99% of the responses will be no. Jamaica, without fail, will test for drug use - and the doctors will press to ask if they have ever even tried it - Many people get overwhelmed, and think that they will be honest and admit to trying it in their past (ummm.. didn't even one of our Presidents admit to that?) - But in Jamaica, all it takes is the doctor writing down that it has been used - even with a clean drug test, and that is sufficient for the ban.

Samie, I am sorry you are facing this - but you need to prepare yourself for the possibility of a one year ban - just be grateful the law was revised, it used to be three years. It should be one year from the date of the medical - then he will need a new police report, new medical, and a second interview.

For those not familiar with the Jamaica consulate - Right or wrong, this is a reality - Not one faced at many other consulates - so it is easy to debate the rights or wrongs of it - But one simple act as a teenager (something MANY Americans have done / still do) - is enough to ban the person for a minimum of one year. So before you debate the rights and wrongs of being honest - put yourself in their shoes -

If you spent the money to fly your lawyer to JA for the interview - you would be paying for a vacation for the attorney. 99% of the time, the attorney is not allowed to speak at the interview - you are the ones being interviewed, not the lawyer.

As for your frustration - Join the waiting club - There are people who filed through JA that are still waiting for interviews, and they were approved before yours was -

THe issues with the fraudulent entry and jail time are going to come up at the interview - I wish you luck, but lawyer or not, that issue is going to cause you problems.

Martini, they are supposed to be in the know - but it's scary how often they aren't! It could be a proposal - but that's a long way from becoming a law (insert the old Schoolhouse rock song here!) There are always proposals that make their way to Congress or the Senate - we rarely hear about many of them, because they are so out in left field.

There are always proposals = a few years ago there was a senate bill that wanted to cap family based immigration, but increase employment based - It failed. It's a good idea to keep your ears open about the law, but also good to research what is proposed and what is fact.

I did take my ex's last name when we were married, so I sent the marriage certificate, as per the instructions, as well as the divorce cert. I think it's with the original I-130 that asks for it, if memory serves...

Unless there is some type of medical reason they need to travel the instant after the interview, your far better off waiting until you have interview in hand, then making travel arrangements a few months out allowing for you to find the best air fares and best connections on the flights.

I front loaded the petition and application with so much documents of evidences that I thought this is an easy case.

I should have pushed my wife to spend a lot more time to prepare and memorize details information related to my family etc.

They scrutized my wife for 10 minutes on questions related to my ex-wife, which she totally wasn't quite prepared. She just never was interested in knowing too much details of my ex-wife. She knoew how we divorced and when it happened, but she wasn't really interested in knowing all the personal information of my ex-wife.

It's rather ridiculous they would quiz her on my ex-wife, instead of quiz her on events in our relatiship, which is more relevant.

Now how do I get the case to stay in the Guangzhou Consulate and get a second chance?


Was your ex-wife on a visa? If so this is an automatic denial in China, because the reason for denial is that they believe you are just applying for visa's for women for immigration purposes. I highly recommend you head over to Candleforlove.com and contact Marc Ellis, a Attorney specializing in denials in China.
He has a great track record, and his services include interview prep when you go back for next interview.

Tj, I think your case will probably be approved for expedite.

I know everyone is screaming WAIT, but for some of us at least for me, I'm fully expecting to wait. I know that mine is going to take longer. There is going to be a "red flag" just for a previous petition ( actually 2-k-1's). Whenever the "red flag" appears in an adjudicators box, it needs to be cleared before approval. I remember reading a little over a year ago an exchange between a former adjudicator and someone on this site interviewing the former adjudicator. That adjudicator was also a member of VJ, and had currently gone through or was going thru the process at that time. Although they could not give specifics, the person did clarify many things that happen and the process of how a case progress's. If anyone could find that, it's certainly worth reading.

I am interested in what kind of assistance your received form your Congressman's office. Did the just brush you off with lots of words but little action or did it sound like they would be able to help you. I knew someone in the service who did this and he told me he was done in 2 months.


It is my understanding that service people do get special treatment.

The congressman, actually one of his "case workers" handled my case. My case was kind of screwed up. I received an RFE for someone else in the mail. No numbers matched up, names obviously didn't match. But both had my name on the top of them. I also received a correctly addressed RFE with names and numbers that matched, for a certified divorce decree from a previous marriage. Because of this screw up, I thought I had a case to present to the case worker.

She was very helpful, at least to calm my nerves, she did exactly what she told me she could do, which wasn't much other than to verify an address, verify that the incorrect RFE had nothing to do with me. She did say that she could not talk directly to the person handling the file, but was assured probably by some supervisor with a "response list" as to where my application was, in backround checks! As far as speeding up the process? I don't believe it. I was only 6-1/2 to 7 months before my NOA-2. Also got tied up for a month in NVC. But honestly, it was the best thing that happened. I would have married a girl that I was very much in love with, but she obviously was not in love with me. The case worker was prompt, and returned calls as promised as she found out information, this took no more than a week if that from the first time I met her until I received an answer from her, and even a month or so later received a follow up call from her to ask how things were going. I don't believe all case workers are molded like that.

I know everyone without approval is getting real frustrated. I know I am. I've been in this boat before. had to go the congressman route just to get an answer after 6 months of waiting. Luckily, I am very busy with work this time of year and it does tend to occupy most of my time. there still is that daily conversation with a buddy that works with me.."any approvals yesterday?" Well, last time I checked on Tues, there were none, now I saw there were 3. None for yesterday, but maybe some have just not gotten back from the celebration party to update there profile.

Folks, It's getting close now. I do believe they will pick up the pace. Try to occupy your time such as Tom has done with Kayaking. I read someone even wanted to get a little pt job. Now thats thinking...... if I only had the time for that.......lol. Sure would be nice to have a little extra $$$ coming in..... but then again, if I just work a little longer, (self employed), I could make a little extra dough. just so many hours in a day, and up here in CT, we have had nothing but heat.

I've been around "THIS BLOCK" before..... read into that. I know first hand how a petition progresses. I've seen the K1 first hand, 2 times..... I think I have smartened up this time though. All I can say is I know how you feel. It is very stressful seeing no touch's, approvals or even others approved with dates beyond your filing date. I've had the congressman involved and all.....

If you want to keep your sanity. relax...... there is no sucking up here.... we are all in the same boat. If USCIS reads this then they all know how we feel. My personal feeling, I'd be willing to bet that FEB and March filers were extremely high and/or the Chicago lockbox mis proportioned the petitions to even the load.

I not only want to see my own petition to be approved, but I want to see movement. But not knowing how many petitions were really filed in Feb and March, and then factoring in how many are members of VisaJourney....... we can only speculate. There are just to many unknowns here to jump on each others throats.

If you want to blame somebody....... Blame Bush, everyone else does!

Well, I'm hoping that's NOT the case, because I filed my I-130 solo mid-March, but it seems like in the few Marchers that filed both I-129F and I-130 and have received their NOA2, they each got touches and then approvals on the I-129F with the I-130 approval following soon after.


I'm picturing this whole super efficient, not at all ridiculous USCIS process to go something like this...

Two happy people that just happen to be on opposite sides of the world get married (or engaged) and send in their VISA package to the USCIS, package arrives at USCIS location where it is sent down a gigantic mail shoot into a basement overflowing with paperwork from hopeful couples across the globe, mailroom trolls scurry about and separate the cases by petition type (ie. I-130's to pile A, I-129F's to pile B, both I-130 and I-129F to pile C [and if you originally mailed in just the I-130 and then later send in the I-129F, your file is later taken from pile A and sent to pile C]...you get the point), USCIS caseworker sits at the end of something similar to a drive-up bank tube shoot deposit slip sending thingy (hopefully someone knows what I'm talking about) and puts the cases on the bottom of their allotted pile as they come in. But this is where things start to change...The workers that receive the I-129F cases are like the elves in Santa's workshop...happy and cheerful and cranking out toys (err...NOA2s) just as fast as their little elf bodies will allow. The I-130 caseworkers USED to be Santa's Little Helpers too, but they were all apparently laid off at the beginning of March (inadvertently screwing all March filers in the process), and were replaced with workers who are more like Willy Wonka's Oompa Loompas...weird and kinda angry and too busy singing stupid songs and wheeling off little kids that have turned into giant blueberries to actually approve any cases! UGH!

Come on March NOA2s!!!! :)

I think you guys hit the nail on the head with your words. One other thing I would add is to those that are homeless... Tom, when you have visited the Phil's you probably saw this, young children, filthy dirty, no shoes and in bad need of a haircut with their hand out for pesos..... At least here when you are homeless, their are shelters. I am sure there are cases of extreme here, but generally as Tom said, "no one here is really poor". Especially when the poor ones are driving "souped up caddies, or suv's". Heck, they drive a better vehicle than me.......

good morning all. I have been reading your posts for a couple of weeks faithfully on a daily basis. I have been through the K1 process completely before back in 2004. never got married and the the fiance went back to her country. I am somewhat familiar with the process, and was pleasantly surprised that it went through rapidly. from noa-1 to poe, about 5 months at VSC.. Recently, I've spent alot of time in Brazil, many vacation visits. my last visit I married a wonderful woman. Started the cr1 process, and am currently waiting like the majority of you for the Noa-2.
