K-1 Fiance(e) Visa Process & ProceduresChildren to Follow Fiance on K1 Visa (Jamaica)

The children WILL need the mother permission, even id she is MIA.

ALL children and adults regardless of age will need passports and medical to migrate to the US.

If the children are follow to join, they do not need to be present at the interview with him.

IF the fathers's name was not on the BC at birth, but added later, the children will be required to obtain DNA testing.

The father should have the children's Bc before he leaves JA.

Exactly - if you intend to bring the children on follow to join, you have to have listed them on the K1 petition - within 1 year of him getting his visa you can schedule their interview and get their visa - if you wait more than a year, you have to file a new I-130 for each child - Work now on getting him added to their BC, and be prepared to do a DNA if the embassy asks for it - The mother will also have to give permission, so that is another talk to begin having.

K-1 Fiance(e) Visa Process & ProceduresCourt Records For K1 Visa in Jamaica
If it is on the PC and you did not declare it, then you have an issue of having committed fraud and lying to the government - which I know sounds way bizarre, but believe me, it is enough to find you ineligible - I have a friend that got denied his GC and deported because of this happening - something he thought was minor and not a criminal charge was on his police report.

Make sure you see the report BEFORE you go to the embassy, and that the insurance charge is all it is listed as - you never know what gets listed with the JA police.

traffic offences are not recorded as criminal records in jamaica

They will show up on your court record - there was someone whose visa was approved, pending him resolving his outstanding tickets.

I would agree with Stace - Although the cert of non impediment might not expire - it would have to be fairly recent - someone could have gotten married in the meantime - six months sounds about right to me -

Yes! I spoke in person to one officer in St Mary parish and then another on the phone, both reassuring me that these records can be picked up at these local offices!??

What office did he go to? I don't understand how it says on the website for St. Mary parish office that it can be LOCAL ONLY records yet the officers on the phone say nooo they'll do the foreign ones too...

I would not trust that the police report you need for this process is one that can be picked up at a parish office - There are two different types of police reports - Everything and everywhere tells you that the one you need for immigration can be picked up ONLY in Kingston. Why take the chance that you got misinformation from someone (cause we all know that never happens in JA  )

Please clarify this - I believe you MUST pick it up in person in Kingston, even if you do your fingerprints elsewhere -

K-1 Fiance(e) Visa Process & ProceduresKids Visits
You need to list the kids on the petition, whether or not they will be living with you - it asks you to list all children - it does not ask if they will be immigrating.

And, visitor's visas from JA are hit or miss.

K-1 Fiance(e) Visa Process & ProceduresAddress question

I know....I am already prepared that I will not have my family's support. I have never had their support when it comes to relationships, to the point that I don't even bring anyone home anymore. Unfortunately because they had me later in life, they are very old fashioned in their ways. I don't even feel comfortable discussing my relationship with them, because they have always been so judgemental and critical in the past. I do understand they want the best for me, but life would be so much easier if they were more open minded and not so controlling. I have a friend who is supportive, but I am also hesitant to share with my friends that I am bringing my man to the states because I really don't want to hear about how I should be careful, and how its too soon, and how men in the Carribbean use white women from the states for money and for entrance to America, etc. I am aware of all of these things, and I hope and pray that i am doing the right thing. I know my friends and family would just be looking out for me, but I need more support now than opposition. Did you go through any of these things at any point in your relationship?

To play Devil's advocate a bit here - If you met this man at home in New York, you had known him for two months, you were able to see him every day, etc... - ask yourself honestly, would you be planning to get married? Would you be even thinking about it yet? There are MANY factors involved here, and the transition to a new country is not easy for anyone - Your fiance will not be able to work for 6-8 months after he arrives, or even start looking for work - He won't be able to drive, he won't have any friends here at first, there will be many aspects of life in the US that he just doesn't get at first - These are all huge challenges to get through - even something as simple as the difference in food - in order to make it through all of this as a couple, you need to have a truly strong foundation - one that takes time to build.

We all know how hard the distance is, but it takes time to develop a solid enough relationship to survive the struggles of this process - If you love each other, that love isn't going anywhere - Why not get things sorted out here first - find a place to live, ensure that your income is enough to support you both, visit a few times, deal with your family, etc... - before thinking of filing?
susFemaleJamaica2011-09-26 08:33:00
K-1 Fiance(e) Visa Process & ProceduresAddress question
If you are concerned about your parents' reaction, why rush to file so quickly? Why not tell your parents about him, take a trip to Jamaica with your parents, let them get to know him? Although its hard to be apart from the one you love, time only makes the relationship stronger when the love is true - One of the questions you will deal with with immigration is about your family, has he met them, talked to them, etc... - Why not go in there being able to say yes?

K-1 Fiance(e) Visa Process & Proceduresfiance daughter

Sus mi born and grow a jamaica so me know dem nuh hi tech like good ol USA. It was a simple mistake on my part..no one was trying to deny her existence. i could have sworn i read somewhere once you add the kid(s) on the application i would be obligated to pay the same all the fees the visa entails. I dont know if i have "created a mess" when u have people who forget to put that they were previously divorced and still get approved once they did add it on the form... but never the less I have sent embassy a detail email hoping to clear up the matter. i know jamaica embassy can gwaan bad sometime but we will see what happens, weh dem a guh do tell him him denied from now and nuh bada come a di interview and lose out pon di $350???????
**fyi it was the ds-230 & the I-129f that i didnt put his daughter name on. the ds 156 he didnt even do yet since the interview is a month away.

LOL, MrsSmith - My comment about knowing how the system works was to DandMe, not you -

It was a simple mistake - It has happened other times plenty - there are even people that have come to the US and oops, guess who has a child back a yaad? Just explain it at the embasy - Put her on future paperwork - include a note with it explaining the mix up - No worries -

Nah badda stress yuself or vex yuh man!

K-1 Fiance(e) Visa Process & Proceduresfiance daughter

I think you created a mess especially with the Kingston embassy.. Just because you enter them on the application does not indicate they will be traveling, it indicates he has kids. Now you have provided false information. He should be honest from here on out and state that he does have a child and that he does not have contact with her.

I think it would be ludacris for him to deny her when I am sure the government knows he is the father. I am not sure how this will play out but I wish the best of luck and God grace!

How are you sure the government knows he is the father? Do you know how that system works in Jamaica?

I would have him explain it at the embassy just as you stated - That you interpreted the forms to mean that she was coming with him or would be coming, but that yes, he has a child that he does not intend to have come to the US.

K-1 Fiance(e) Visa Process & ProceduresFiance did not get visa b/c of insufficient evidence

Sus, since this was not how she explained it, I can not comment on her visits, as I have stated to her , i wish this good luck on this journey. If she feels this is enough, then proceed I will not tell anyone what will get them approved or not. It is up to them if they feel this will convince the CO.

I don't have any information that you wouldn't have available - when I saw her post, I clicked her profile - their story is written there - I am not speaking on whether or not they will get approved, as no one can guarantee that - what I am stating is that her story is different - they did not only meet one time - They met and dated in the US, and then had one visit after he returned to JA - Trying to compare that to someone with one in person meeting ever is like comparing apples to oranges.
susFemaleJamaica2011-10-17 07:44:00

Did your fuyure husband give you a list of names so you can contact these people to verify this fact. I have seen or heard of any of those couples on VJ that have gone thru the Kingston embassy that has met that criteria.

Good luck on your journey.

Have not read this whole post - but as far as D and Me and only having one visit - it is not one visit where they met and decided to file - From reading her profile - they met in the US, and she only has 1 visit since he went back to JA - and there were people on this site in that situation who met in the US, didn't have ANY visits to JA until interview time, and were approved.

K-1 Fiance(e) Visa Process & ProceduresWhat happens after denial?

By the way I'm truly sorry to hear that, I truly understand the pain. BUT, I don't why I can't find the details. Let me say like this, you may help me. When they asked "when was the last time that he smoked" doesn't it mean that they found s/th in the medical? AND the second question is: Doest it really stay in our system for 5 months? From December to April??? Did he smoke in December only once?

I hope you can help me out cause I'm worried, my brother has his interview next 10 days, and he smoke ONCE about 67 days before in a party and he didn't even inhale it (may one or two PUFF). Do you think it would be a problem for him? I'm going crazy since I read your post here. His interview will be in UAE!
your reply to me is highly appreciated.

I would suggest asking people what happens at the embassy in your own country - Jamaica is a complete different animal when it comes to this -

Yes. We're getting married in July and refiling in September so we can interview shortly after April 23rd. Luckily, I'm a teacher, so I'll be living there this summer.

Before you do that, I would email the embassy and research this a bit more - Because the law is a one year ban post use - So he might be able to re-test in Dec and then get his interview again under the K1 - Did they give him a denial letter, or how did they handle it?
susFemaleJamaica2012-04-26 09:48:00
K-1 Fiance(e) Visa Process & ProceduresWhat happens after denial?
Search back on the posts here - they changed the laws to be the one year post use - There are a few other yardies that this happened to, and they married and refiled to get the interview right after the ban was up - One's hubby has been here a few years now, they have a beautiful baby - it was before they changed the law. So, my suggestion, if you want to marry regardless, is marry in JA and refile - make sure his interview is one year post this interview and you will be fine.

K-1 Fiance(e) Visa Process & ProceduresHAVE YOU EVER SMOKED CANNIBUS...THAT IS THE QUESTION...COULD THIS MEAN THE END
You won't know anything till after his interview - If he has the ban, then you will know the specifics of when the ban is up and he can re-do the medical and re-interview - There are others who have gone through this - Just be grateful they changed the law - the ban used to be 3 years, not 1.
susFemaleJamaica2012-08-29 08:06:00
K-1 Fiance(e) Visa Process & ProceduresHAVE YOU EVER SMOKED CANNIBUS...THAT IS THE QUESTION...COULD THIS MEAN THE END
Admitting to having smoked, even with a clean test, can possibly trigger a ban - it is a one year ban, so he would have to wait one year, retake the medical, and reinterview for his visa - Definitely be honest and prepare yourself for all possibilities.

K-1 Fiance(e) Visa Process & Proceduresprocedures fo adapted children

Are they your children, and your fiance is bringing them with you on the K1?  They need all of the same forms that you complete, as well as a medical exam - if they are (I believe) over 14 or 16, you will need a police record for them.  You have to pay the visa fee for each child -

No, it will not be an issue - There are plenty of people who not only got engaged before their SO was divorced, they married shortly after the divorce -

K-1 Fiance(e) Visa Process & ProceduresTiming question on after receiving noa2 for 129-f and interview at Napoli consulate

It seems to me, just from looking at the timelines on this site, that it usually takes at least 2 months from noa2 until the interview anyway. Therefore I would wait until the recipt of the noa2 before notifying the employer.

Thank you. That is very helpful.....

you all still have a looooooooong time to wait. Several months. I would wait until you at least have NOA2.

After your visa is approved, you must enter the States within 6 months. So he could even wait until his visa was in his hand before he gave his 2 months notice to his job.

Thank you! I do not think we want to wait to long after he has his visa. Like everybody else here... we are excited to start our lives together asap!!! Appreciate your input!

K-1 Fiance(e) Visa Process & ProceduresTiming question on after receiving noa2 for 129-f and interview at Napoli consulate
Hello all
Just wondering if I could get an idea of how the experienced folks here would handle this timing issue.

My fiance lives in Italy. We are in the blind spot of waiting for out noa2. We know can be from 4-8 months. But ...My fiance told his boss of his plans to move to America and get get married. For my fiance to received back pay and pension. He must leave his job on good terms and give two months notice.

We are wondering of the general timing of how much time passes between the time you get your noa2 and the interview. We would like to plan it that he gives notice, and there is a short period of time that we go to napoli and he would not HAVE to return to work. But I know that is tuff. My thought is he should give his notice when we receive the NOA2. But my fiance feels it should be now. But we only receive our NOA1 on Dec 13th! We are just beginning our waiting... I feel we have at least 5 more months to go....

Your feedback would be greatly appreciated.

K-1 Fiance(e) Visa Process & ProceduresAugust 31st Wedding

As far as not knowing what to do now... I think you do know ;-) If you can live with the very real chance that your Visa will not be completed, and thus
miss your wedding date, then do it.

If not, well, then don't set a date.

You are from Canada though, not Cambodia... so why not actually do the wedding ceremony on the 31 of August here in the States (or Canada). If the paperwork is done by then, then make it official.
If not, then wait on the marriage certificate. Go through the ceremony so you can have your guest, loved ones, etc., and then do a courthouse wedding to make it
legal?

Natasha and I are taking this route. This summer I will be in Ukraine. We are doing a Ukrainian wedding with her family and friends present. We will go through all the motions,
but we are not going to make it legal. This way she can get "married' in her country, have a great memory from it. When she gets to the states, we will do a simple courthouse
wedding and sign all the papers, etc.

No no no.... When you get married in the states you must get a license, blood test..etc... I would not risk getting married before your 129-f is approved and you visa is giving to you after your interview. REMEMBER They are doing backgrounds checks on you during this process. They could find out though official town records that you appied for a marriage license. SO ....not worth it.

I originally wanted a july wedding. But after seeing the average wait times here , there is a good chance my fiance in Italy will have the interview in August ( about 8 1/2 month after noa1.. so...there goes my dream of a July wedding! But just imagine how wonderful it will be during your wedding day when EVERYTHING in is place, your visa is approved and you can marry honestly and ready to start your new life here.

Good luck ( we all need it!)

Okay so those who are still waiting on approval for a k-1 fiance visa. I just had a thought cross my mind as I will trying to get an update on the current processing times and seeing that they havent updated... Then looking at igors list and seeing all those update in the last 12 months
http://www.visajourn...tion=3&sortby=2

The VSC is actually moving faster then it appears. I have only been here since Dec 13th. But I CLEARLY remember looking in Dec and the processing times for those getting approved were in MAY 2012.... so in just 7 weeks ( the time I have been waiting) they are now approvig AUGUST... So In 7 weeks they have been touching and approving the months of May,June,July & August.... NOT a bad average if you think about it...

SO keep up the great work VSC.... and PLEASE get to DEC Filers soon LOL!!!!

Keepig the Faith...

TOGETHER IN THE JOURNEY

K-1 Fiance(e) Visa Process & ProceduresTHESE TWO THINGS ARE IMPORTANT FOR ANYBODY CONSIDERING K1 VISA!! MUST READ

GET MARRIED AS SOON AS SPOUSE ARRIVES IN USA!!!! I DO NOT UNDERSTAND WHY THIS IS SO HARD FOR PEOPLE TO COMPREHEND!
DO NOT PLAN WEDDING CERAMONEY UNTIL SPOUSE ARRIVES IN USA! AGAIN, I DON'T UNDERSTAND WHY PEOPLE PLAN WEDDING CARAMONY BEFORE SPOUSE ARRIVES OR BEFORE SPOUSE HAS ARRIVAL DATE AND THEN COMPLAIN THAT THE PAPERWORK IS TAKING TOO LONG!
IF YOUR SPOUSE HAS TO LEAVE THE COUNTRY BECAUSE YOU DIDN'T GET MARRIED WITHEN THE 90 DAYS, IT IS YOUR OWN FAULT. 90 DAYS IS MOR THAN ENOUGH TIME TO GET MARRIED!
IF YOU PLANNED A HUGE CERAMONY AND ARE UPSET THAT YOUR SPOUSE WON’T BE HERE WHEN YOU HAD PLANNED, AGAIN..YOUR OWN FAULT! DON'T MAKE PLANS UNTIL THINGS ARE SET IN STONE!
JUST TRYING TO HELP PEOPLE BEFORE THEY REGRET THEIR DESCIONS.

Meant with some tongue in cheek but with a message to this poster....

First...there is no need to shout. I do not understand why you dont understand that when you use capital letter, it is shouting.

Second.. this is called visa journey.... The definition of journey is taking a path and discovering new things. So if folks type things that seem repetitive, it is only that they are discovering things on their journey. This isnt caled "visaIKnowEveryThing.com. I do not understand why you do not understand this

Third This journey we are all taking is a long, hard and emotional one and sometimes some people may need to vent things when they are upset or frustrated because we are all in love and miss our loved ones. So are you venting because you are frustrated If so , I can understand it but maybe you should vent about your own issues and not blast others for trying to learn and understand what to do on their own visa journey.

Meant with the kindest of intentions........
