I received my second notice in the mail saying that my I-129F has been approved and is being sent to the National Visa Center.
I also received a letter from the NVC saying they are forwarding my application to the foriegn embassy where my fiance is.
My question is when do I send them my I-134 affidavit of support? Do they request it from me? As you are aware it is not sent with the initial application so I just wanted some clarification on when the powers that be will need it?

My fiance received a letter in the mail that says our visa and all visa's are going to be delayed due to new laws of our US Congress. We had it approved and sent to NVC and now her application she sent to the embassy in Romania is being sent to USCIS for approval and then I will have more documents to fill out.

Has anyone heard about this delay that just went into effect. I thought that once it was at NVC and I had all my NOA approvals that we were set?

The letter said this new process will add a 3 week delay.

Anyone else have this experience?

Everything has been approved through NOA 2 and fiance has mailed her packet to the Embassy in Moldova. The problem is that we were notified May 5 that our process was on hold until I received a new piece of paper related to IMBRA and send it back to USCIS. The paperwork has not come yet and I am wondering who I should contact to keep the ball rolling. We are at a standstill until I get the extra addendum to my paperwork from USCIS. Any advice is appreciated.

I got my NOA 1 early in March and on the 1st of May was notified of an impending RFE due to the well known law change. I am just feeling a little left out because many other people who just filed have already got their RFE.

Does anyone know the keys to press to get through to an operator at VSC faster. I have waited much more than 30 days since approval (NOA 2 and NVC approval) and have heard nothing.

K-1 vs K-3 is an interesting debate I have had for almost a year now. I would recommend a k-1 if you want to get married in US. I personnally though of getting a K-3 visa ands getting married in my fiances country but found out it would keep us apart too long.

Keep calling your service center. For your information the NOA 2 looks very similar to the NOA 1. You almost could not tell them apart. Same paper and type as the NOA 1.

The good news is that if you have heard from the NVC it means your NOA 2 went though. All you have to do now is call you local service center and tell them the NOA 2 was not delivered and you need it.

I have a great solution to your concern. You can have a ceremony in her country and not violate the law. Just make sure that your ceremony is not legally binding. Your allowed to celebrate being together, but you are not allowed to be legally married abroad and use the k-1 visa.

Our visa has been approved and now Ana has the much coveted, highly sought after seal of approval. I have waited for this day for so long. I finally have the permission of our government to get married. Oh thank you Mr. and Mrs. United States of America.

I can honestly say that we had to jump through more hoops than a dolphin to get our visa. We patiently waited for so long for this day. We started gathering documents in January and now at long last we have almost reached the finish line. Now it's time to get married.

Ana's trip to the consulate took her on a 12 hour bus ride to the US Embassy in another country because her country does not process k-1 visas. She had her medical Monday and passed with flying colors. She had her interview Tuesday and was approved. Now she is feeling sick and has to wait overnight to get her visa because the consulate had some computer trouble.

Not to worry, she will be home in Moldova soon and I will be jet setting there to spend some time with her before we fly back to America to get married. I am so excited right now. When I have time I will post photos from my upcoming trip to Moldova.

I wish everyone the best of luck and want to thank everyone on VJ for there help. I could not have gotten this far and remained partially mentally sane without your advice.

What is this 2 year rule?
At her interview there was no problem that she was just here on a k-1.

Hi All,

I was looking for some advice. I am engaged to a man who lives in Chile and before we get married I would like him to come to America first to meet my family & friends and to actual see where we would be spending the rest of our lives rather than getting married first. I was told the easist way to get him here was through the tourist visa. He has now tried that option twice. We were planning on having him come here, meet everyone, settle in and then marry. But unfortunately he was denied both times. The American Embassy in Santiago said that he did have strong enough ties in Chile, that he would make a lot more money here, and they don't think he would return. He plead his case, but was denied. Now, I am under the assumption he will most likely never get a tourist visa. I contacted a lawyer and asked about the K-1 Fiance Visa. She explained to me that this could not only be a long drawn out process (which I was prepared to do) but there is a good chance that he would be denied again because the Embassy may feel that we aren't really engaged (although I have plenty of pictures, airplane tickets, etc to prove it), and after all the waiting be denied again. I can possibly get him a work visa from a friend who owns their own company, but I am nervous again the Embassy will see right through that and deny him again. The lawyer recommends me that I marry him in Chile and then bring him back to America. I really would prefer not to do that option as I think it is important for him to be here at least one time first. Does anyone have any suggestions or past experience with this type of situation.

My fiance and I have gotten through all of the paperwork and now we are just waiting on the interview. When him and I met in November (while I was on vacation), we knew we wanted to get married. After I left Chile he applied twice for a tourist visa, once in February, I then visited him after he didn't get the visa. He then tried again in April, and again denied. Both times in the interview he said we were only friends for the pure fact that I thought if he said I was his girlfriend, they wouldn't think he would return to Chile. After he got denied the second time, within two weeks I then applied for the fiance visa. I didn't visit again until June (where he properly proposed <gave me the ring>- but we always said we would get married and he asked me a million times before that). We are just nervous that when we go in for the interview they will ask why when he interviewed the previous two times he said we were just friends. I can't decide if we should say we got engaged after his second attempt over the phone or in February (when he did actually ask me), but it may look bad because of his attempt for the tourist visa and saying we were only friends? Please let me know your thoughts.

This is Phoebe, on behalf of myself and my Nicaraguan husband! We just got married last week in Nicaragua and now I am back in Virginia ..feeling sad to be away from him but trying to just stay strong.

Anyway, I was hoping that some of you more experienced folks could help me out with a couple of questions:

1. Does that G-325A bibiographical information forms: a. Do they have to be filled out in black ink also (I forgot all about that rule and he filled them out in blue ink while in Nicaragua); b. Does he actually have to fill them out himself or can I do it and then he can sign it?

2. The translation of the marriage certificate: How do you proof that it is a translator who is certified to translate? Is there some kind of stamp or something? I take it that not just anyone can translate it?

3. What is the file number question asking for on the G-325A form? It is like the 5th question.

1. I filled out the G-325A on the computer and printed it out, and took it to China and had my Fiancee sign all 4 pages. Needs to be filled out in black, many sign them in blue to show that it is an original signature.

2. Translation can be done by anyone that is fluent in the langage, all the need to do is signe the translation and write the disclaimer Certification by Translator

I [typed name], certify that I am fluent (conversant) in the English and ________ languages, and that the above/attached document is an accurate translation of the document attached entitled ______________________________.

The file number is the Alien Ide Number. you probably don't have one at this time, later when filing AOS you may have one on your NOA1 or 2 from the NOA1 or NOA2 (I-130)

Ignore what I just said. Just follow the instructions provided by the USCIS. After reading the instructions at the website (especially instruction #10), I read the I-129F it is needed for only "nonimmigrant" visas. Very sorry. This is the path I took, but the rules have apparently changed. A good suggestion is to call the USCIS if you have any questions.

It is a good idea to closely read and follow all the instructions provided at the various websites, especially the USCIS website. However, this forum should provide good information to you, instead of just snippy comments. In my experience, after filing the I-130, I received a form I-797C, Notice of Receipt. Once you have received notification that the I-130 has been received, you need to file an I-129F along with a photocopy of the form I-797C that you received, and any other required forms. Read the instructions carefully in order to avoid processing delays. There will be an additional filing fee. My wife is in China, so visiting her is problematic. I try to go for 2-3 weeks every 2 months or so. Daily, we chat on-line with microphone and webcam two times each day. We are 12 hours apart, so we do it at 10:00am and 10:00pm each day. Sometimes the chats are just an hour, but usually 2 hours or more. Neither of us work, so we are generally available. She always counsels patience, yet I want to scream in frustration! These chats help, but nothing is the same as being together.

Today I called the NVC just to check on things. I was told they have received, processed and approved the I-864 and supporting documents. Next week they will send me (as Agent of Choice for my wife) the actual visa application which I assume to be the DS-230. I assume this needs to be completed, signed and sent back. Fortunately I had the foresight to have my wife sign this form when I was with her last month, so there will be no delays getting her signature.

My question: After returning the DS-230, what is the next step in the process? How close are we?
