K-1 Fiance(e) Visa Process & Proceduressome interview advice and logic... please!

QUOTE (pushbrk @ Feb 2 2009, 05:51 PM) <{POST_SNAPBACK}>
What makes a divorce final varies widely even within the US but if USCIS approved the petition, it would be rare for a Consular officer to question whether a divorce was final.

No judge banged any gavel for either of my divorces.

I think we are also really hung up on what date to say he was divorced. because it is never clearly stated. Just this paper was handed to this person on this day, and this person said this on this day, and agreed to this at this time on this day. Never does it say, and boom, divorce final on this day.

So I'm afraid he's going to get hung up on dates and they are goign to be like, woah, wait a sec, not right, and all hell breaks loose...

SARAH!!! Re-read my review of junior's interview experience. It was so brief compared to what others have shared. I was freaking out because we have an age difference...and they never even asked anything specific about this or about my kids...I think you are going to be just fine. What I would suggest is that you are sure you have your dates straight in terms of when and how you met and when you became boyfriend and girlfriend. They may actually interview you and Yader separately, so just make sure you agree on these dates! I can't advise you too much about the divorce papers, but I think the more confident you are the better things will go. You are so close...my thoughts are with you in this final stretch!
Hugs!
Emma

K-1 Fiance(e) Visa Process & ProceduresShould I Report a Scam Artist to INS?
Since she's been careful not to actually apply for the visa, there's not much you can do. Maybe start a blog about your experience to warn other men. Marriage agency would have been a red flag.
Good luck and I hope you find true love.

K-1 Fiance(e) Visa Process & Proceduresa little advice- getting ready to file first set of K-1 papers
I would agree with others--we filed using the information, guides, and examples on this site without the assistance of a lawyer and received our NOA1 and NOA2 with no problems. Our application is now in transit to London! I wish you the best of luck as you file your application.

K-1 Fiance(e) Visa Process & Procedures129F question 18 Overkill?
Thanks for all the input everyone I finally figured it out. I guess I miss understood the question on the 129F where it ask about how we met within the past 2 years. I thought this meant exactly how many times I've seen her or visited her within the 2 years, when in actually from what you guys are saying it just means how we first met.

So I made a 2 sentence answer to fit in the box and left my romance novel as kind of something to explain our ongoing relationship haha.

As far as evidence goes I included copies of itineraries and boarding passes. Also i used my passport as my proof of citizenship and it has my visa immigration stamps from Korea in there as well that should work right? And the School enrollment cert. from Korea includes attendance dates so it should be fine.

I mailed it to the VSC yesterday with the whole sha-bang in the packet. There goes 455 dollars wacko.gif haha but we are happy that we have begun our visa journey! good luck to all the rest of you October filers!

K-1 Fiance(e) Visa Process & Procedures129F question 18 Overkill?
Hey guys, I've just finished getting my petition together and ready to mail it tomorrow. I was just wondering is a page and a half single spaced overkill for the 129F supplement? Also are 14 pictures too much to include in the packet?

I've just been following the K-1 Guides on the site and I swear Ive checked every form at least a thousand times but can I just use some airplane tickets from when I went to Korea, and a Certificate of enrollment from the school in Korea that was attending this past summer to learn Korean as proof of having met?

Finally is it really necessary to include proof of an ongoing relationship if its not one of the requirements for the 129F? does uscis even check for that?

K-1 Fiance(e) Visa Process & ProceduresQuestion on Fiance Letter of Intent

if you're talking about the example form here in VJ, is the date when you submit your application (I-129F) or when you and your fiancee sign the letter.

Hi Yakad, right now the form will go with the I-129f package, so the information is needed for the address of the service center in Vermont. When they approve the petition(and they will!!:)) then the form needs to be filled out again, this time with the address to the Embassy. Thank you for all of your help, I still may have some questions in the future to ask:).

K-1 Fiance(e) Visa Process & ProceduresQuestion on Fiance Letter of Intent

The example letter of intent is written to show you the two 'versions' you will need. The first is for when you submit one (from each of you) to USCIS along with the petition. The second when you both send another for the interview stage.

Both examples are shown on one single page. For the USCIS stage - delete the references to Embassy - for the Embassy stage, delete the stuff for USCIS. Make sense?

Thank you Otto und Karin, now I understand, that makes perfect sense. I would never have thought of that myself though:). Thank you very much for helping me with my question.

K-1 Fiance(e) Visa Process & ProceduresQuestion on Fiance Letter of Intent
This form seems very straight forward but one thing bothers me. After you put your address and the Service Center address, in bold red letters it says" or when submitting for interview". Below this they ask for the name of the Country where Embassy is located, the address of the Embassy and then a (date mm-dd-yyy). Can anyone explain this form to me?. I am a little puzzled. Thank You.

K-1 Fiance(e) Visa Process & ProceduresQuestion on Form G-325A

5 years is sufficient. It is not unusual for a beneficiary to have lived at the same address sll their life. In which case, it is what it is. If they have been at their current address MORE than 5 years, that is OK also.

Thank you Gary and Alla for your help. I am very grateful.

K-1 Fiance(e) Visa Process & ProceduresQuestion on Form G-325A
On this form it asks for applicant's residence last 5 years and applicant's employment last 5 years. On the example sheet the applicant lists their residents since birth. On the employment it says list ALL employers. Is it necessary to show all employers and all places of residence, or is going back 5 years sufficient? Thank you.

Welcome Hilary - You need to prove that it's a legitimate marriage, not how many visits you have and to where - Do you have bank accounts in common, utilities, insurance,.... pics of the two of you, affidavits from friends verifying that they have witnessed your life as a married couple,......

This whole journey is a lesson in patience - as stated, you were lied to with the 45 day timeline - and also be aware that the 5 month processing time is for the first step - not the entire process, and also it's an estimate - may be faster, maybe longer - It's frustrating, and difficult - but you have to prepare yourself for a wait -

Check the timelines here - you have however long it takes at the service center, then time at the NVC, then waiting for an interview....

If I were in your situation, I think I would hold off the visit till around the interview time - Although you aren't allowed in, there have been people who got blue slipped to have a spousal interview - Jamerican was the most recent, they just got approved this week and I don't think she's back yet so we don't have full details of her interview.

There was someone that was waiting outside the embassy for their SO, and the embassy sent for the spouse to come in. Personally, I would rather be there and make sure they knew I was there then have to go back a month later.

IR-1 / CR-1 Spouse Visa Process & Procedurescr1 entry

Excuse the comment but why isnt he contacting the US Embassy or he should already know the status of his case
I dont mean to be rude but why is he asking some body here when he has the Embassy to contact and get details of this ? ? ? ?
Surely we dont know ALL DETAIL OF YOUR SITUATION..but how do your think they will just change it from a CR-1 to a IR-1
if they dont have the paperwork. USCIS cant make changes along the way if they are aware of your changes along the way
unless you advise them of your situation. Upon Entry the US INS cant make a change out of noplace, without documents
and of what your trying to do. INS at the border just allows or disallows your request to entry. Without
the Embassy's yellow envelope how will he entert the USA at the border. To file a IR-1 you have to submit paperwork so upon entry they have the correct info from the Embassy on the status of the Visa and the and kind of Visa your entering the USA on.
Visa entries to the USA are limited usually to 6 month after they are issued to come and enter the USA.
If you come after this time you have to re apply for a new Visa since the one you have has expired 6 month after being issued.

Better go to the US Embassy and ask them and be sure you have and can enter the USA with a expired Visa

And regardless who or what time frame it is. you cant have a visa expire and come into the US later asking for something else but what the Embassy provided them but a CR-1. He should go to the US Embassy to ask them or e mail and ask the Visa office what they suggest to do. Thats the only word he needs to worry about. USCIS HAVE RULES THEY MUST FOLLOW ALSO, and we cant just change them to make them fit our needs. Thats why they have regulations and procedures & rules to follow also.

Good Luck

Your post is so off base to the question asked - Where did anyone mention having an expired visa, or anything about the 6 month period after issuance? In reality, it could easily take JA 2 months or more to issue the visa after it is approved - it's happened before.

Vett - yes, you can ask - I would make sure he has a copy of your marriage certificate with him when traveling so that he could prove it if he is asked - I also seem to recall someone who got the wrong stamp in their passport at entry, and they were able to make an infopass appointment and get it corrected.

I would definitely wait the two months -

IR-1 / CR-1 Spouse Visa Process & Procedureshu? DNA Paternity Testing??

It sound to me like an very usual request. I have never heard that DNA test of a child is needed to prove a spousal relationship. It seem like the consular officer is confused. DNA test is strictly voluntary . Consult an experienced attorney before you do anything,

Portbar, not correct - DNA is NOT strictly voluntary - However, I would be on the phone to my Congressman, Senator, etc... and let them make some inquiries - Your wife's visa should not be contingent on the child's DNA - you registered the child's birth abroad and got her her American citizenship, etc.... - I would explore all avenues, but also start preparing to suck it up and shell out the funds for the DNA test. Sorry to hear of the delay, but know that it will soon be done!

Sounds like to me the VO is not questioning the baby, but questioning "Are your really this childs mother?"

The child is already a US citizen, the VO is just making sure there is no fraud being the child was born to another woman and now a different woman is claiming she is the mother so she can get VISA.

By the sounds the OP has nothing to worry about, just some additional expense.

The DNA test is a PATERNITY test - not the mother

I would email the Jamaican embassy - kingstonivinfo@state.gov and consularkingst@state.gov - if you can scan a copy of the blue slip then attach it - Explain to them that your husband was divorced in_____, has not had contact with her since___________, has never resided in Canada, has no method to get to Canada to prove his ex-wife's residency, nor does he have any legal right or authority to obtain such records - that you were married in JA on ____, that the Canadian divorce record was sufficient for the RGD, and ask how you should proceed, as you are unable to obtain proof on an invidual that is not a party to the petition.

IF I'm allow to take a guess without the :bonk: of our members then I'll say - that if he doesnt know her whereabouts then he can submit a affidavit saying that he had no information regarding her whereabouts and submit his documents or (a letter) stating that he lived in jamaica during the period.

I would agree with Ricardo, and also have him provide proof of his residence in Jamaica during that time period - I would also call your senators and Congressman, giving them a heads up to the situation. I would email the embassy -

K-1 Fiance(e) Visa Process & ProceduresAttorney Trouble
Speaking as a paralegal here (no, I am not an immigration paralegal) - There are good paralegals out there and bad ones. Without going into a long debate, there are a lot of people who get hired as paralegals without any education or training, and very few states that regulate who can or cannot be a paralegal. When you hire a law firm, nine times out of ten the paralegal is doing the bulk of the work. However, ultimately, you hired the firm to handle your case, and the attorneys are responsible for the work of the paralegal - it's not supposed to go out without their review, and they are liable for any screw up that the paralegal makes. From my experience, I can tell you that 90% of the time the paralegal will know more than the attorney about what is happening - But, there are always those few who don't =

If you aren't satisfied with the quality of the work or the information you are getting, write, call, fax until you get the attorney on the phone. Don't settle for what you are told - if you aren't happy about it, go to the person that you retained to represent you. If you don't get the right answers there, attorneys are regulated by the bar association in each state, and each state has complaint procedures in place, as was already mentioned here.

K-1 Fiance(e) Visa Process & ProceduresNot tourism visa - JM
QUOTE (pushbrk @ Sep 7 2008, 12:45 AM) <{POST_SNAPBACK}>
I take it the OP is asking for opinions about whether she should fess up to her fiance and his family before they all travel to Kingston with the expectation of success obtaining a visa followed by a prompt wedding and life together, that she made a mistake, that the chances of obtaining the visa at all are slim and that while there could be a wedding the couple will have to wait several months to start their life together. Her other option is to act surprised when she gets the call from the disappointed family. She asks, "WWJD?" (What would Jesus do?) but she already knows the answer.

Pushbrk - I can almost guarantee that the fiance and his family know the chances of obtaining a visa - It's common in JA, and well known that a tourist visa to the US can be hard to come by.
susFemaleJamaica2008-09-07 06:26:00
K-1 Fiance(e) Visa Process & ProceduresNot tourism visa - JM
Ryon, if you applied for the tourist visa so that he could come here and you can get married - Yes, you applied for the wrong one - Because marrying on that, knowing that was the plan, is fraud, which could be an issue when you try to adjust status. JA is notorious for being hard on tourist visas - but at this point, I would say let him go for the interview and try to get it - At least he will be able to come and visit you while you apply for a marriage visa or fiance visa - It's not going to hurt to try it - being denied isn't going to prevent him from getting a different visa.

As Honey said - come down to the Yardie thread - there is a whole crew of us that will help you through in whatever way we can!

IR-1 / CR-1 Spouse Visa Process & ProceduresLondon hold up?
Yep, this is London's slow season for sure.
My file was forwarded (per NVC) on 2nd June last year.
I was not advised of my husband's interview date till mid-late July, and that was after emailing them something chronic. The interview itself was scheduled for the first week of September, but then after emailing them again (long story, I emailed them prior to the date being assigned telling them that due to school commitments, I needed an interview date before the last week in August, and they thought it said i needed a date AFTER the last week of August), it got changed to Mid-August, whcih was the on-schedule time - several other files that got sent with mine also had appointments around the same day as mine.

I know that the one time that the embassy DIDN'T respond to my email was when my interview date was imminent, so maybe it's a good sign for you too. Good luck.

IR-1 / CR-1 Spouse Visa Process & ProceduresNVC administrative review
Be aware that all "administrator reviews" are not name/background checks, and there's no need to panic... Unfortunately the operators know why they were referred to DOS ("offices in Washington"), but they won't tell you specifically.
When I got my NOA2 from VSC, it had the wrong priority date on it - they put June 25, as opposed to January 25. Now priority dates really have no relevancy with a CR1, but when the date is three months into the future (As mine was), it is pretty much a red flag, lol. So, I noticed it when it came in, contacted both NVC and VSC and they told me it wouldn't be an issue as priority dates don't matter, blah, blah.... Well, guess what? It did.
I called NVC and got the whole "File being reviewed, administrative processing, Washington DC" stuff. I panicked, thinking I was in for months of name checks, etc. I kept calling asking what the specific issue was, no one would tell me, till I finally asked if it was about the priority date, and they confirmed it was. Again, they couldn't give me a time frame. I ended up faxing requests to the VSC advising them of the issue and who I talked to about the issue in the past, etc., and within a week, I received an amended NOA2, and was out of administrative processing within less than two weeks.
Of course, I posted here and got a lot of "you're stuck in AR hell" and got pretty distraught, thinking their mistake just tacked on 6 months to my wait. Thankfully, it didn't. Here's hoping yours is easily resolvable... I'd recommend you check all your paperwork to see if you or they "missed" anything, and call the NVC operator to see if they will give you a hint, because they KNOW the issue, but won't freely give it out, but at least in my case, they did confirm it once I asked specific questions.
Good luck.

IR-1 / CR-1 Spouse Visa Process & ProceduresPRIORITY DATE NOA2 ?????

OK now as i read more i'm finding that the priority date has to do with NVC tranferring ur case
to embassy they gave April thats like 6 months away any bosy else got a priority sate so far off
its on the approval notice NVC got the case it all seems ok i hope no delays to come.

sorry for the misspelling

Check it again. Your timeline shows your I-130 received by service center in April. Priority date would be the date received by your service center - I'll bet it says April of THIS year, not next. And priority date won't affect you - it has nothing to do when the embassy will schedule you. This only applies to other types of visas where the embassy will say they will process applications with priority date of xx/xx/xxxx. Priority date will NEVER be in the future. And, like I said, it has nothing with CR-1 or K-3s, they are processed as they are received without consideration of the priority date (unless they goofed up on it, as they did mine)....
JAYKEFemaleBelgium2006-09-09 16:15:00
K-1 Fiance(e) Visa Process & ProceduresPriority date has typo

Our paperwork has a priority date of Jan 2005, which is obvisiously a typo as we did not even file until Sept 2005. Is this a problem? we are now at NVC waiting for interview in Montreal... NVC says "shouldn't be a problem" they can not change it USCIS has to.. Should I contact them?? We really don't need anymore delays, especially at this point

I had this exact same issue with my CR-1... and it did slow us down, for about two or three weeks. I too was told on the phone that it wasn't a problem... yet it was.
Our priority date was SUPPOSED to be January 25, 2005, but when they filled out our NOA2 in Vermont, it stated "June 25, 2005", which at the time hadn't even HAPPENED yet. I found out right away, and called both NVC and USCIS and was told it wouldn't be a problem, blah, blah, blah... Then I started to see on VJ that people were getting their Assignment of Agent form, and I wasn't, and I called and got a strange recording, and was finally told after about four calls to NVC that they had to forward my paperwork to the Department of State in DC for approval ("additonal administrative processing"). After pulling teeth, they did confirm it was an issue with a priority date. I then called USCIS, threw a temper tantrum because it was their fault, and got a fax number for VSC, and was told to write them there with ATTN: SUPERVISOR and let them know of the problem. I did this for three or four consecutive days, then got an ammended NOA2 (two of them actually), and things got back on track.
So, yeah, while it may not be a big deal, and the people on the phone assured me it wouldn't matter, I still had my file pended for administrative processing in DC. However, NVC cautght this right at the beginning (assuming because when they tried to enter the date into the computer, it kicked it out as the date hadn't arrived yet). This was also for a CR-1, so the process was a bit different.... Hopefully, things will go smoothly for you...

IR-1 / CR-1 Spouse Visa Process & ProceduresTaking Last name
Does your SO even want to change her name? Name changing is not common in China, most people after married never change their name, and children would receive the fathers family name. Wife usually retains her family name.

My SO and me laugh at this all the time when I put her given name with my family name (just sounds wierd), and we have no plans of changing her name. I also think her parents would be unhappy if she changed her family name.
