Although I was asked to attend my wifes interview I knew it was in our best interest to be present, just in case. In situations where they might think your relationship is not legitimate, they want to talk to the petitioner to validate. More than likely they will interview her again and compare her answers to yours as was done in my case.



Rod, Jamaica has recently changed to not allowing the petitioner to attend the interview (with the exception of Ricardo)- If they want to interview the petitioner, they blue slip.

Peace, honestly, from reading your posts - you are one of the few I would advise to retain an attorney so that you have someone review your I-134 and ensure that everything you need is there this time.

Wouldn't matter.

So she gets a visitor visa and comes to the US. And what? He has to PROVE he can support her financially TWICE during the K-1 process. Having a passport revoked because of non-payment of child support will mess that up. Unpaid child support and/or unpaid taxes ARE counted against whatever income you make.



I am not refuting the child support issues that could hold up the application - But to spend the fee for a visitor's visa is like buying a very expensive lottery ticket - one in a million has a chance of winning, the rest might as well burn up the money. To get one and for her to come to the US would overcome the meeting in person issue - Not saying it would overcome the further issues. If you fully read my post, I think I addressed that as well that they need to clear that up - Since they haven't filed and are figuring out how to do so, correcting the child support and meeting in person are the first two necessary steps.

Meet in a country that does not require a passport to travel to, mexico? Think all he needs is his license as long as he is not flying there. Not sure if she would need a visa to go but if she did im sure she could hop the border into mexico somewhere, mexican authorities would nevvvveeer expect that.

Puerto rico? he could then charter a small plane to fly him to jamaica and either attempt a water landing or parachute in, dont ask me how he would get home.

The Cayman islands ( not sure about this one ) but the charter plane would cost less as its a bit closer to jamaica.

or... he could work something out with his childs mother and take care of teh child support thing...


Mexico now requires a passport for a USC - and for a Jamaican, a passport and a transit visa. Puerto Rico would work for the USC, but the Jamaican would need a visitor visa -

And further reading your advice, you are basically advising them to break laws in other countries?

You simply stated the USC could not obtain a passport. I did not imply this was incorrect, I asked what bearing it had to the OP. You made a sweeping statement about a passport not being available to him. Great. Awesome. What bearing did that comment have on the OP? The OP (for the purposes of this argument I am referring to the friend of the OP when stating OP as she is a proxy for her) asked whether a K1 was valid. A passport is not required by the USC in order to get a K1 visa. The OP and their fiance need to have met in person, yes, but the USC does not NEED a passport.


A visitor's visa from JA is VERY hard to get - it's purely a game of chance, even those with all of the required evidence for proof of return have been denied. So, the USC not having a passport / or having his passport denied is a factor, as he cannot travel to JA without one, thereby not being able to visit the fiance and eliminate that criteria.

As for your friend, I would be hesitant and wondering why he is able to send her money and not his children - granted, there could be all types of other factors involved, but if he has a court issue with child support he should try to resolve that first, then deal with the visa issues. Getting a waiver of the meeting in person requirement is very hard, and I don't see failure to pay child support being viewed as a positive reason by anyone.

Sorry to hear - on the upside, congrats on the positive interview - On the otherside, no one can give you a definite timeline for them to print your visa - Someone just waited 3-4 months. Others have gotten it back in a week - Keep emailing, keep checking, and don't buy the plane ticket until it's in hand!

Here's the problem
Sent in 129f, have not even had check cashed yet, and today my company offers me a rather hefty promotion to take over its canadian division.
If I accept, it would be on a renewable 3 year work Visa to Canada, my residency would remain in the US though I would be living in Canada 95% of the time. If I accept this position how would this effect our K1, and secondly once K1 approved would it even be possible for fiance to go to Canada once she is here in US?

Hoping someone has experienced something similiar before.

I don't understand the problem, you can have as many Wedding Ceremonies as you want, have 10 or 20 if you want in various countries around the world. The only issue with the VISA is which country was the legal paperwork filed for the wedding.

Get married in the Phillipines, dont file paperwork there so it was just a ceremony, then once in the US file the paperwork at your local courthouse and have Justice of Peace sign off. That is the legal wedding

Governments only care about the legal marriage, the actual ceremony means nothing to a government official.

Aubrey makes a great point, planning on just the fees to government would be a mistake. Once your SO is here they cannot work for a few months and you will be paying all the bills.
If you are starting this process, make sure you plan on many things from travel expenses to things your SO will need once here. Example mine will need almost an entire new wardrobe because she lives in a warm climate and is coming to a cold climate. She does not even own a winter coat at the moment.
The process is not cheap, dont jump in and be over your head right from the start, that just puts unnecessary strain on a relationship. Get your finances in order then make the leap, if you and your SO are in love, a few more months to plan carefully will not be problem.

If your concerned about the 10 year age gap, I would not be concerned! There are many here that have much bigger age gaps. I know of some very successful relationships that have big age gaps and went the K1 route. I would think one of the most important questions in the consulates mind will be to the young wife, "are you prepared for 5 kids"? Financial support as well maybe a question, but if you above the poverty guidelines, you should be all set there.

Do be advised that foreigners marrying a Brazilian in Brazil can take some quality time. Luckily, your fiancee lives in Recife, where there's a consulate that can take care of your consular needs... but there's a 30 day waiting period and the license is only good for 4 months, so you will probably need two trips to Brazil to take care of it there, or just do it in the US with no problems.




If you choose to get married in Brazil, you really just need to have your original papers certified at a brazilian embassy here in the states. It does take about a month or more to do. Those papers when certified you take with you to Brazil. They then have to be translated, then you can legally marry in Brazil. It is a hair pulling project to say the least, ( I chose this option ), my wife wanted to be married where her family could attend the ceremony. I was actually in Brazil, when the papers arrived at my home, I needed to have them Express'd out to me so that we could get married. If you choose this option..... Plan Plan Plan, and leave some extra time for goverment efficiency, or should I say inefficiency?

@Happy Bunny - That is true, technically you can get married and apply for AOS now, since there was no intent when she entered the US on the tourist visa, you'll have to prove that on your AOS though, if I'm not mistaken.

@Journeyer - Your case is indeed pretty simple and similar to many here. About her visits, if she had the visa, had no problems getting through immigration on each visa, and never overstayed, I don't see why they'd give her a hard time about it, since she was using the visa as intended. She will be asked about how you two communicate, but if she speaks English (and you some Portuguese), that's just fine. The age gap should be no issue at all, we have a lot of couples here with bigger age gaps. And somebody from Brasil correct me if I am wrong but the K1 visa is only processed in Rio so she'd have to fly there from Recife to be interviewed.


you are correct Ladylethal, all K1, K3, IR1 and CR1's are interviewed in Rio.

Have your fiancee get at least a couple Certified BCs. Take LOTS of pictures with you, fiancee and you, her and her family. Keep all records of your trip. You'll/she'll need evidence of bons fide relationship then.

It sounds like you did not include a description of meeting within the last two years. It is question 18a on the I129F. For most couples, the small space on the form is not enough room to satisfy the requirements. You should type a one-page letter detailing how you met in person within the last two years...supporting dates in the letter with corresponding airline tickets/passport stamps and pictures.

You left out the statement preceding the items you've quoted, so it's not clear whether you need 1 and 2 or 1 or 2. At this point probably both, because they are questioning whether you've met in person during the past two years. I can't tell if it's because you haven't or that you simply didn't provide a clear statement of dates and places backed up with evidence.

Putting aside number 1 above for the moment. What evidence did you send that addresses 2. above? What evidence do you have in addition to that? What can you obtain that you don't already have?



As far as item one i didn't send them anything and i'm not sure what to send as far as number one. On item two list a send them the copy of my passport stamp and few pictures, but i guess they aren't enought.
