The child would not have to be an orphan - The parents could be living, but have terminated their parental rights - The question to research would be how to go about getting that done - Both the mothers and the fathers - Whether it needs to be a court order or what -

But based on the criteria, if she can get the parental rights terminated I think she could adopt them and get them status - they have lived with her more than 2 years and she is the primary caregiver.

It wouldn't necessarily be easier - because you have to prove that you can support him here in the US, and to do that you will need proof of income - so moving to Jamaica might make that difficult.

No one can say what is the right way or the wrong way - for the fiance visa technically you have to prove you have met in person 1 time in the past two years.

To be honest, and trust me I know how hard this is to be apart from the one you love - if you have only met in person 1 time, I would say slow down a bit and take more trips - the more time you spend together, the stronger your relationship. You say you are in college - can you go down in the summer and stay for a month or two? This process is difficult as it is, and the stronger your foundation is with your fiance, the easier it is to get through the adjustment.

And that is helpful how? If you are responding to my post, you might notice I was posting at 5:30 am, so forgive me if I wasn't 100% accurate or coherent.

Regardless of what his status, he should have been carrying SOMETHING to prove that he had status here in the US - Look at the new law passed in Arizona that makes it a CRIME not to carry immigration documents - it also gives the police broader powers to detain anyone suspected of being in the country illegally.

While I think there are other circumstances involved here that no one knows - The bottom line to it is that whatever he was stopped for or why - showing his Jamaican driver's license does nothing to prove that he has a right to being in the US legally - and he was in Florida, which is an area known for illegal entry, look at all the refugee boat landings.

OK, this has nothing to do with the original topic, per se but...

I have heard that LPRs are required to carry the GC with them at all times but as others have mentioned, it is very expensive if it is lost. This got me to thinking... Isn't a newly issued RealID-compliant driver's license/state ID sufficient now to prove legal presence in the US? After all they won't issue it with an expiration date past your GC/visa/etc. and you need to jump through more hoops than ever to prove your identity before you can get one.

Not sure why they stopped him - but a GC holder is required to carry their GC at all times - the fact that he only showed his JA license, and not any proof that he had a valid right to be here in the US, they probably arrested him as being illegal and put him in deportation - sounds like there is definitely more to the story thank you got.

I don't think TSA has name lists - it could have been random -

You need him to sign the DS-3032 (choice of agent) and the DS-230 part 1, and complete part 2, a copy of his BC, 2 passport photos, a copy of the bio page of his passport - You would also submit the police report here, but I don't recommend you get it until you have NOA2 because of the stupidity of people having to get new reports from JA

c. Completed and signed form DS-230 Part 1 by the beneficiary

The only difference in the situation were they were K1 v. CR1 - They both admitted to using in the past and were given a two year ban and that they would have to reapply - they chose to marry and reapply that way instead of filing another K1 - At the same time frame they went through this, there was a member from Mexico whose fiance admitted not only to using this but other substances - and he was approved, no issues!

But this law is interesting, I will be curious to see what the result is -

No positive test - admitted to past use, "trying it" in the past and it was a 2 year ban for each of them. Both were originally K1 - they married during the 2 year ban and filed CR1

I am curious as to what the result will be with Sooo confused - this is the first we have seen under the new rule.

I completely get where you are coming from KJ - but honestly, the first battle to overcome is thinking that way - A child with a disability is not disabled - they have a different way of accomplishing things. There are so many riches in their lives that do not exist in ours, and different views of their abilities will bring great joy. I worked for a long time with the mentally retarded and autistic, and they have so many gifts - Children with downs are also born with an overwhelming capacity for love and happiness and joy -

My cousin is mentally retarded - he and his girl friend were the first MR homeowners in our state - they both live in their condo, work in the community, take more vacations than any of us, and have a great life - They have staff that pops in a few hours a week to help them with menu planning / bill paying / shopping, but that's it.

Mrs.Palmer. you're making me tell the board what Ii wante to wait another month or so to tell.
When I went to my first prenatal visit and did ALL those blood work, it came back that 1 of my X chromosome has a slightly high level of fragile x syndrome. So I had to see a genetic counselor and schedule what's called a Chorionic Villi Sample procedure, where they're going to take a sample of the cells around the placenta and test if I passed the gene to the baby. It is best if this baby is a girl and not a boy because if it is a boy then it's chances increases drastically of the baby being mentally retarted. All my family had their kids in JA and so I don't have the comfort of looking at my family history for comfort. I am overwhemled, stressed and just want to curl up and cry until I get the results, which will be month from now. Be thankful that you are not in my shoes and just pray that as your pregnancy progresses that the baby will be fine, but I know all too well what it means to worry...


KJ - I can only imagine how hard that is. A very dear friend of mine has a daughter with Downs - actually, She married a Jamaican man through a K1 visa, this is their 2nd child together and she's 2 now - she has a blog about their experiences. which might give you some help, and she is wonderful if you want to reach out to her.
