US Embassy and Consulate DiscussionSecond Interview? Blue Slip questions from Vietnam
QUOTE (tonytd @ Mar 1 2009, 11:38 AM) <{POST_SNAPBACK}>
This is exactly what is say..

* The Consulate General is unable to issue a visa to you because you have found ineligible under the foollowing section (s) of the US. Immigration and Nationality Act, as amended:
* Section 221 (g) of the Act prohibits the issuance of a visa to anyone who has failed to present the documents required in connection with the visa application or who has failed to submit sufficient credible evidence to support the claimed petitionable relationship. The following remarks apply in your case.

* Based on the information ascertained through the visa interview and through documentary materials, consulate officers do not believe that there is a bona fide fiance' (e)/spousal relationship between Petitioner and Beneficiary. If you have any other evidence to present which would convince a reasonable person that teh relationship exists for a reason other than immigration, please submit it. Please label and itemize all materials submitted.

* PETITIONER: In a sworn, notarized statement, please provide a detailed chronology( timeline) of your relationship. Please explain clearly when and how you first met, how you were introduce and when you began corresponding with each other, when you felt your relationship became serious, date and circumstances of marriage proposal (location, time, setting, etc...) .. Did spouse/fiance(e) propose in person or by phone ? where were you when s/he propose ( give exact location)? Did you accept immediately or ask for time to think about it? if s/he did not officially propose, when did you first discuss marriage? How many trips did you make to Vietnam to vistit your spouse/fiance'(e)? How many times have you seen him/her in total how long did you stay each visit? please give as many details as possible.
WARNING: IF YOU FAIL TO TAKE THE ACTION REQUESTED OR FAIL TO PRESENT ADDITIONAL EVIDENCE SUFFICIENT TO OVERCOME YOUR VISA DENIAL UNDER SECTION 221(g)OF THE ACT REQUIRES THAT YOUR APPLCATION BE CANCELLED.

I finished writing an 11 pages essay telling pretty much exactly our relationship, even my parents trip over there to meet her but without me. So should I include some more pictures with these documents? Should I also include pictures of us and our friends. The "lawyer" lady said that we should only submit pictures of just me and her, but wouldn't it be better for pictures of all the people we hang out with? I am just worried that my fiancee have trouble answering more questions... she does really elaborate more on the questions like I would... so i am worried..

I would asume include the pictures that you have with family. Its better to have more than none. Good luck with the rest but make sure you include alot of evidence.

US Embassy and Consulate DiscussionCo-Sponsor Questions
[quote name='YuAndDan' date='Mar 13 2009, 11:17 AM' post='2734960']
Simple IRS transcripts are FINE.

Moving this to consulate/embassy forum. The I-134 is needed at the consulate, not when filing the I-129F
[/quo

It depend on the embassy that you are going. Most of them want the taxes for 2008 and yes they do want the copy of tax return even for the co-sponsor.

In response to my request for Packet 3 information, I received an email from the US Consulate in Dakar Senegal that provided me the details of the forms my fiancée must bring to her interview. I noticed out here on VisaJourney that many consulates require the DS-230, but that is not required by the US Consulate in Dakar Senegal. In fact, there seem to be many slight variations of requirements that the individual consulates have customized to meet their respective local situations. That seems reasonable to me. I also noticed that the old version of the I-134 is required to be notarized, but the new version does not. I sent the new version with all my supporting financial information off to my fiancée before I received the email from the Consulate. The Consulate sent me the old version of the I-134 in the email. In fact, the other forms sent to me (DS-156 and 156K) were all older versions of these forms. So, my question is, are they just not up-to-date on their forms, or can an individual Consulate actually require the applicant to submit a notarized old version of the I-134 as well as other older forms?

local websites/processes do not always updated timely.... The consulates have great discretion in determining there own procedures.... most will accept newer forms even if they have not updated there files... once in a while a report of an outlier is posted

WHATEVER THE CONSULATE GAVE WE USED. DIDN'T WANT ANY PROBLEMS

Albanian embassy require the old version of i-134 and they do want it nautorized. I did the same thing but not i have to send the new one.

Nothing needs to be notarized.

Not even the NEW version of I-134.

Don't be so sure about that. I think for I-134 to be notarized it depends on the embassy. Albania for example it wants the I-134 naturazied. The best thing for you is email the embassy.

I think you are right that it depends. The instructions from USEM for applying for K1 visa in Guatemala specifcy that I-134 should be notarized.

Embassy and Consulate websites tend to be out of date on this issue. The new I-134 is not notarized. They WILL accept it, just like they've been accepting the non-notarized version of the I-864 for the last three years.

I hope you are right but my fiance went to the embassy to drop the documents and the counselor told him that they need the old version of I-134 and it has to be nautorized. They required it.

Good afternoon,

I realize that many people have posted regarding the chat logs via Skype and Yahoo Messenger. However, does anyone know whether there are some programs that can print the chat logs for MSN Live Messenger?

I would like to be able to give the log to my wife on her interview. (Right now, I have to print the chat history, instead.)

Right now, line by line chat log will produce around 500 pages. I really need some condense version like couple of people suggested in Skypelogview. They printed only the summary with time stamp for each day.

Please advise. Thanks.

A text file is hardly "evidence". You don't need a program, just a system function. If you want to use the log as "evidence" simply position it on your computer screen as large as possible and hit the button labeled PRTSC, then open a word document and "paste". You'll see an image of your screen in the document. Rinse and repeat as often as needed to get the entire log in a single docuement.

Text file or Word doc will look exactly the same when you print it. Will look like this:

Date Time From To Message
5/25/2006 10:01:27 PM Scott Andrew Norman You there?
5/25/2006 10:02:17 PM Andrew Norman Scott yo

5/25/2006 10:03:48 PM Scott Andrew Norman I want to be in that meeting

Try what I said to do exactly and you'll see it looks quite different. It looks exactly like a picture of the computer screen because that's what it is. It can't be faked. What you just pasted in can be faked, so it isn't "evidence" of anything.

Just to demonstrate, if needed, your method can be faked.

5/25/2006 10:01:27 PM Scott Faked his chat record You there?
5/25/2006 10:02:17 PM Andrew Faked his chat record No, I'm sleeping

5/25/2006 10:03:48 PM Scott Faked his chat record I want some of the good stuff you had last week

This..... can't be faked.

I think i can print 200 pages of them and they don't prove anything. He said to use printscreen and that can't be fake. How can you fake that? You can do a print screen even when the camera is on.

US Embassy and Consulate DiscussionMoldova and Documents
My fiance is having a horrible time trying to get two documents. She was told she needs two notorized documents. One is a letter stating she has never been married from the government. The other is a police report saying she has never been in trouble. My question is do these documents need to be in English? The reason she is having trouble is because for the proof of never having been married she has been told the document she has must be confirmed at 5 different government agencies.

Thanks for any help anyone in Moldova might have had with these 2 documents.

My fiance called me from the US Embassy in Romania. She said they told her that the visa was approved. They also made her wait, and said that they were having computer problems and she could come back tomorrow for her passport because they couldn't finish her visa.

Has anyone had to wait after the approval for the visa? I thought it was done same day. I am freaking out. I just want to make sure that computer problems could really happen.

Its very tough because she got a bad cold in Romania and has a 14 hour bus ride back to our home in Moldova.

Someone please offer me some advice based on experience. Is this delay of a day common?

US Embassy and Consulate DiscussionInterview Date?
Hi,

I recently received my NOA2 Approval. I was wondering when I would find out when the interview date will be? I know the next thing I will receive is the NVC, but when do they tell me when my interview is??? I am assuming my interview will be in about 60 days or so, but as I plan on flying to Chile to attend the interview and because I am anxious, I was just wondering when I would find out that information.

Thanks, I've now been down there 3 times in the last year (plenty of receipts, pictures, etc), so I can definitely show an established relationship.. US Embassy and Consulate DiscussionPossible Denial of K-1 Visa?
Ok maybe now that I received my approval I am getting paranoid of what could go wrong - haha, I know real positive.

I am really nervous that the Embassy will deny us because of no common language.. He speaks spanish fluently and hardly any English. I speak English and not so good Spanish. We do speak for hours on the phone because the Spanish I do speak he understands (one of those odd couple things), and I can understand him if he speaks slow enough. We have spent 3 vacations together and between the Spanish I speak and the pocket dictionary I possess, the language was not a problem at all. I really wanted to go to the interview with him because the prevoius two times that he went for a tourist visa (after him and I met and had my name on the forms when he applied) he got denied, for the pure basis they did not think he would return to Chile.

Any thoughts on this?

Hi All,

Just wondering about some processes - sorry to always have tons of questions..#1 - who am I going to find out the interview date from? The department of state or the American Embassy in Chile? But then should I be receiving a letter from ? stating my interview date? I plan on going to the interview with him so the sooner I find out the better. #2 - the Affidivat of Support forms - Will I be receiving a letter stating what I need to fill out? I know that there is forms everywhere I can go off of, but I would rather receive something official first stating what they want from me.
Thanks,

I had a question regarding the passport. My wife changed her name when we got married and this is shown in the marriage license. However, her passport shows her madien name. I asked the same question a while ago but never got a concrete answer. My question whether my wife should renew the passport to indicate the new last name as she changed it when we got married. On all other documents, this has been changed, for example the marriage certificate, her birthday certificate etc. They all indicate her new last name.

However, she still has the old passport. My question is whether she should change it prior to the interview or will it be okay if she uses what she currently has?

If she can still use the old one, will the visa still be in her new name?

Thanks in advance for responding!

US Embassy and Consulate DiscussionVisa Package three
My Fiancee and I confirmed our visa petition is in Bogota. My fiancee had called and she was informed package three would arrive at her house in about 20 days. We would like to fax and mail the documents now instead of waiting for package three to arrive. Could anyone help and list what I should be sending exactly? Some documents I believe are needed to send now are as follows:

134 ( I have a copy and an original) should I mail the original or bring it to the interview?)
230 part 1
passport ( a copy of her passport)
169 ( question, the 169 is just a form that needs to be signed at the interview? ) Does my
fiancee need to complete this form in anyway? Also should I place the reference number
assigned at the Bogota embassy on everypage

Any suggestions or information would be greatly appreciate. i really want to get the information faxed before 4/15 so hopefully we can get an interview date in May......I just do not want to make any mistakes. Thanks

Feel like crying. I thought we only had to send in a paper then gave us when the 2 year card was approved and then a 10 year card would be issued. I better start reading visajourny other forums and get on track.

No, I think you're getting confused.

If you're just filing for AOS after being married for 2 years you will have to pay the same fee, $1,010 to get the 10 year card.

If you already went through AOS and already got the 2 year green card, then two years later you have to file form I-751 to Remove Conditions in order to get the 10 year card. That one has a filing fee of $465 for processing and $80 for biometrics, $545 total.

Diana

Thanks Diana,
I have to pay for my step-son also, but I beleive I only have to pay for his Biometrics. Right?

What are the fees for the 10 year card? Anyone know? Hoping I was done paying!

There is no end, Corey. laughing.gif The fee is the same for 2 years as it is for 10 ($1,010) and the time only depends on how long you've been married. We missed the date by three weeks, so we get to pay another $500+ in less than two years. (Actually, USCIS missed the cutoff.... to their advantage, of course.)

AWESOME BUCK AND PAOLO, MAY GOD BLESS THE BOTH OF YOU!

Good News,
Had my mother-in-law return to Bogota for her 2nd interview at the Embassy. We were more prepared and it paid off. She was granted a tourist visa!
She stood there crying and crying after approved and had to be calmed down by the Consular Officer. My mother-in-law had a female Officer who placed her hand against the glass window and my mother-in-law placed her hand on the other side of the glass. The Officer just kept telling her to relax, you are approved, it's okay, as she tried to comfort her. I guess a few of the Officer's have a heart there.
Looking forward to having mom here for Christmas. She might regret getting that visa when she feels the cold! I live in Connecticut.

Charles,
Enjoyed reading your post.

Maybe we need to start a new thread called , Moving to South America! I am really considering moving in about 5 1/2 years. I have been trying to educate myself on Argentina right now. My wife is in agreement with me on the move and I have her support 100%. We are looking at a City or Country in South America that is safe, has good healthy care, good schools for our son, housing costs and a stable goverment. I hope to visit Buenos Aires within the next year. Anyone interested in traveling, let me know. We could have a Colombia Club get together.

Would be nice to have a community of Colombia Club members in South America.

Buck,
if you like I can send you my wife's email address, so your wife can talk to her and maybe make the transition of living in America a little easier. Verizon Wireless is free nights and weekends so they can talk away!

We received the rejection notice for our AOS today along with all of the original paperwork. The rejection was because I had not submitted a check based on the new rates, even though our package was postmarked July 28. The package was received in Chicago on July 31, so they are apparently basing the rejection on the date received rather than the date postmarked. This is NOT what I remember the USCIS site saying about the dates. Anyone have any printed evidence about the details of the fee change date?

I will try to reach a live person with the USCIS on Monday. Quite frankly, I don't know how we'll pay the extra fees, if that's what we end up having to do. Lorena can't work yet and because of my job, I can't have a second job without approval. I haven't cried yet, but I'm sure thinking about it.

This is happening a lot. The package was suppose to be postmarked by the 30th, not received by the 30th. I do not a link on hand, but I know that it is postmarked not received. I too am waiting for a rejection from USCIS due TO THEIR MISTAKE! I can't believe this gov't agency makes so many mistakes.

You have three options.

A) Make a infopass appointment and take all the evidence that you sent it out prior to the 30th.
cool.gif Submit the paperwork as is, with a cover sheet stating that you sent the package prior to the 30th.
C) Submit and pay the new fees.

USCIS is ridiculous that they cannot follow their own rules.

Lucho, I believe the filing fees increased on 7/30....the application had to be postmarked before 7/30.

New USCIS Filing Fees Effective July 30, 2007 | Print |

We have more government updates to report. The United States Citizenship & Immigration Service has announced that its long-anticipated filing fee increase will go into effect on July 30, 2007. While this presents an average increase of 66%, small consolations include (1) the Service recently had hinted that fees would rise in June, not July; and (2) this is the first major increase since the late 1990s. We have highlighted below the most common cases affected by the fee increase, providing current filing fees and those filing fees for cases received on or after July 30, 2007.

It is important to plan now to maximize employers' ability to file cases before July 30, 2007 and avoid, where feasible, the increased fees. In this connection, we suggest you take the following steps to achieve cost effectiveness:

· Please contact us as soon as possible for new foreign national hires so that we may provide efficient legal analysis, strategic planning and case preparation. We will need to receive all requested documentation and information by July 9, 2007 for filing before July 30, 2007, in order to avoid internal expedite legal fees.

· For cases currently being prepared in our office, please provide requested documentation/information as soon as possible so that we may meet targeted filing dates.

Not sure this will help or just make people more confused

No Update Yet on AOS Filing Fees Post-July 30th

To date the U.S. Citizenship and Immigration Services (US CIS) has not provided any further information about the filing fees that will apply to I-140s and other applications concurrently filed between July 31 and August 17th. The American Immigration Lawyers’ Association (AILA) has requested that US CIS clarify this and several other questions we have.

Many questions have been raised as a result of the US CIS announcement to rectify the immigrant visa availability as per the July Visa Bulletin. Some of those questions include what filing fees apply to concurrently filed applications that are filed with US CIS after July 30th. That is, it has been established that adjustment applications should be filed wit the current filing fee schedule and new filing fees will not apply to those. However there are still doubts about those other applications, including I-140’s, I-131s, I-765’s, filed between July 31 and August 17th. Or, whether applicants will be allowed to "opt in" to the new fee schedule during the period between July 30 and August 17. Yet another question is how filings will be handled where a new application relates back to an earlier-filed application (such as an I-485 where an I-140 is already pending with US CIS, or a request for Advance Parole or Travel Documents is later filed) where no receipt has yet been generated on the earlier filing. Unfortunately there is still no answer or guidance from US CIS on any of these points.

Another issue that is in question is whether US CIS will accept an I-485 filed concurrently with an I-140 filed after July 31, 2007, for an EB-1, Schedule A, or national interest waiver. That is, the question remains whether a priority date must still be established before the August 2007 Visa Bulletin (with all categories becoming "unavailable") goes into effect. Some of our colleagues believe that since the case would then have an August priority date and visa numbers are unavailable in August, then USCIS would reject those concurrent adjustment of status filings.

For now, it appears that the safest way to proceed is to file all applications prior to July 30th. And, since July 30th falls on a Monday, that really means that applications should be filed on either Friday, July 27th or by Fed Ex on Saturday, July 28th for delivery on Monday, July 30th.

We will keep following this issue and will post as soon as US CIS releases new guidance on this issue.
