Update since I haven't been around much.

We have our interview in two weeks from yesterday.

However on me end of things haven't been so good. a week ago i got into an argument with my father, who got physical and pushed me out our front door, where I landed head first on concrete and had bleeding in my brain. Had to go to hospital and then police got involved. week after release from hospital the police decided to arrest us both. me on charges of disorderly conduct. had to spend most of yesterday in a jail cell awaiting araignment, only to be told to come back in 3 weeks and meanwhile i am issued a protective order saying i could not live in the same house as my father, so basically i got kicked out of the house and had to scramble to find a place to stay temporarily. So now I am all worried that this is going to do something to the interview and I am all worried and upset and stuff sad.gif

5) You can also call the DoS to find out your interview date once you believe the embassy has scheduled it.

we did both. They refused to discuss it over the phone, and no response to the email yet. We have almost everything ready, he needs to get a few things but says it would take him like half hour to do it. And I have to mail him some stuff but I am most likely going to be there for the interview so I could just bring it with me instead of hoping it doesn't get lost in the unreliable German postal system...

Did you talk to a person? NVC doesn't enter K visas into the automated system. But if you talk to a person they should tell you if yours has not arrived yet, is in AP or has been sent on to the embassy.


Oh, I didn't know that. I guess tomorrow I will call and talk to a person!

Something to add thats for you not the OP, Germany will now let you apply to get permission to take on another citizenship. There is a fee involved, but if hes interested in getting his US citizenship as well as retaining his German one, he can find out the steps through the German consulate. My mom is looking at the possibility of doing this so she can duel German and Canadian. You are right that with Germany though without that permission you will automatically loose your citizenship if you aquire another.


Yeah we found that out earlier today actually. Can't seem to find much info on it though. Something about having to prove hardship if you don't get that other citizenship. (I don't speak much German so can't decipher the pages :) )

That is incorrect. The USA does indeed recognize dual citizenship. If you acquired dual citizenship with the US and another country from birth, the government does not require you to renounce the other citizenship on reaching your 18th birthday. Also the renunciation part of the nationalization oath is not enforced. Where as in Germany (my husband's country) You cannot have dual citizenship unless you are born with it. (My husband is German and French by birth) However if a citizenship is taken not by birth, you loose your German citizenship. (So my husband cannot take a US citizenship without loosing his German citizenship, but our children will acquire both US and German citizenship at birth, as well as the French one.)

Your dual citizenship shouldn't have any effect at the embassy, for US government purposes you are considered a US citizen (while in the Philippines you'd be considered that citizenship).

I'm currently filling the I-129F form, and me and my boyfriend are confussed as to what to put for his address.

He is currently living in australia, but only started living there 2 months ago, but we are planning to file in sydney because he is working and living there for 6 months.

My question is if he should put his current address in austalia, in part 1, or his england address, then in the other section stated location abroad place the australia address? Thank-you

Is he filing 4 you or are you filing for him? I'm confused. If you are filing for him u shouldn't have to give him anything yet. He needs to give stuff to you. The beneficiary needs to give passport photo,
signed G-325A, and singed letter of intent. Maybe also any evidence one may have receipts, photos, letters, mailings, western union receipts.

If "deception" is the same thing as "fraud" then it would considered a crime of moral turpitude, and would be an inadmissible crime. Your fiance should get the relevant police and court records for both convictions, and consult with a qualified US immigration attorney. He may be denied at the interview, and you may need to submit a hardship waiver application. It depends on how the US consulate interprets this particular type of conviction. An immigration attorney with experience with this particular consulate should be able to give an educated opinion.

There is another section of the INA, 212(a)(2)(B), that has to do with two or more crimes even if they didn't involve moral turpitude. However, that would only apply if the aggregate sentences were five or more years in prison, which I imagine would not apply here. It sounds like he wasn't sentenced to any prison time.


You wouldn't happen to know any other opitions that we would have if he were to be denied.

The DUI is not generally an inadmissible crime. If they determine he's got an alcohol problem then it might be a health related inadmissibility.

I'm a little confused by the credit card issue. What was the "deception"? Was this a criminal case, or a civil case?



Well, it was a long time ago, but it's what he was charged with was i believe "credit card deception", and he believes it was criminal.

My fiance has a 2 misdemeanors from 6 years ago. One is a DUI, the other, due to his ex. not paying her credit cards then during the court procedings, exclaimed that she didn't know what a credit card was. HELP!!!

The background story is that my finacee was living in Sydney for the past 8 months. Recently he has moved back to England. We were hoping that the visa would of been completed before he left but due to the 6 month wait time in the US he has already moved back. Also i attempted to change the consulate during the initial approval, and at the NVC stage and it has already been sent to the Sydney consulate. I just recieved Packet 3, but need the consulate to be changed to the one in London. I have already emailed them requesting the change. If anyone knows anything else that i can do, or how long it take for them to respond to emails at the sydney consulate that would be great. Thank-you

I am desperate! my husband visa was denied on January 23/2012. The interview was only 20 mins in the USA Embassy in Casablanca, Morocco. They ask him all kind of unfair questions, he bring pictures, conversations for 5 years, receipt of rent of the houses and apartments we rent there and they didnt give him a chance to show them nothing!He was treated really bad and my husband left the embassy feeling so depress and rejected. Yesterday I call USCIS they say I need to wait 120 days for them to answer me about their decision. I dont know what to do now? Some people say I need to re-apply all over again for him and others say I dont. Do I need a lawyer? Do I re-apply? Do I wait for ever? i am about to submit my AOS packet soon but i have only the pay stubs for 3 months because i have started to save my photocopies of checks after filing the petition.. so its been only 3 months and my last year federal tax income is lower than the poverty line but i am currenty employed and income is more than the poverty line ... so here i am confused and want some help from vj members : 1) do i submit the AOS with 3 month pay stubs based on current employment OR do i submit my total assets so they can multiply with my last yr federel tax income which is lower than poverty line.... thankx to everyone and good luck u all

Hi listen I applied for my husband with a employer letter saying how much I make per year gross thats all! forget about paystubs! u r wasting time! get that letter tomorrow ! stating ur yearly salary thats all. Plus ur last 3 years taxes income even if they were under the poverty level what matter is now no before. Dont wait more time for paystubs..omg!! lol!! u are wasting preciuos time!. When I apply for my husband I was working only 1 month and with this letter everything was fine...so run to HR and get ur letter!! good luck!

Hi listen ur wife need to get 1-130 form from the USCIS web site, fill it out, pay 420$, fill out the G-325A biography for u and her (2), affidavit of support also she can find it in the USCIS forms, get a letter from her job stating how much money she makes per year, u need to send her a picture with white backgrown and she needs to take a picture the same white backgrown and more things. All the intructions are on the I-130 form and all she needs to give them, marriage licence, translated to english all has be translated to english, USCIS will not accept it in french or arabic. I did mine by myself I marry in morocco too. if u need more help just feel free to ask me...and this pettion has to be done here in the USA not in Morocco!...Also she can find an agency called "International Institud" this agency can help her with all this....Good luck...

I've searched and been unable to find this answer elsewhere. I'm not sure what to put for question 7 of the I-134, "I derive an annual income of:"

My situation: I'm currently employed in a contract-to-hire position, on a 6-month contract that started in May 2010 and will end in November 2010. I am currently paid hourly.

Do I put:
- What I expect to make if I continue at my current rate of pay for the remainder of 2010?
- What I expect to make if I continue at my current rate of pay for the duration of the 6 month contract?
- What I would have made if I had been employed at my current rate of pay for the 12 months of 2010?

(I know it's gross not net, and I know that I and my joint sponsor each need to fill out an I-134).

My father is retired, and is joint sponsoring my fiancé for the K-1 visa. I have two questions about my father's I-134.

1. Math word problem! My father gets income from 3 sources.
His pension + social security = $x.
$x + what he decides to take out from his 401(k) each year = $y.
$x by itself is sufficient to sponsor (Above 125% the federal poverty guideline for a household size of dad's household + fiancé). He can provide statements for social security and pension amounts. However, his tax transcripts show his income as being $y, not $x. He would rather not provide bank statements. So he has statements to back up $x, but the only information to back up $y is the tax transcripts.

For "I derive an annual income of:" does he put $x or $y ?


2. The verbal portion! For question 7. "I am employed as or engaged in the business of"
Type of Business: "Retirement" (sounds better) or "Retired" (less ambiguous; 'Retirement' sounds like he may work in a company's Retirement Services division)?
Name of Concern: "<The company from which he retired>" or "N/A"?
