I take that to mean, the CO asked you 2 separate questions:
CO: "Are you single?"
Joe: "Yes."
CO: "Do you have a girlfriend?"
Joe: "No."

Is this correct?


My opinion is that if you did not consider her your girlfriend at the time because of gf/bf relationships not acceptable in your culture, then it was not a lie and not misrepresentation.

1. No, because he would be coming to the US with intent to immigrate. AOS by a tourist is only legal if they did not have intent to immigrate when they entered the US.

2. You would be petitioning for him to come on a CR-1 visa, because you've been married less than 2 years and because the K-3 now gets closed and the CR-1 is processed instead. On the CR-1, he will have LPR status as soon as he enters the country, and will be able to work. That he has capital does not affect it one way or the other, as he would be entering on a family-based immigrant visa.

Hello! This is my first post, but I've been reading this site for a few months, since shortly after my fiance asked me online to marry him, a few months before the "official" "in-real-life" engagement. It's been very informative and a huge help, so much so that any questions I've had until now, I've always been able to find the answers in the Guides, Example Forms, or by searching the forums, and I'm confident we can get through this process without a lawyer. So I'd first like to say, great job and thank you for all your help! smile.gif

Now I do have some questions of my own. wink.gif


My fiance and I met in person for the first time two weeks ago when he came to visit me in California. He flew into SFO and we do have photocopies of his boarding passes and visitor visa stamp, but he stayed with me and we used no public transportation. He used his debit card in a few local ATMs/businesses, but to my analytical mind that proves nothing more than that he was *here* during that time, not that he was here *with me*.

I have two or three photos with proof we've met in person in the past two years, but that evidence requires some verification of facts. One shows us in front of a business that opened earlier this year. The second shows media content decorating the suite door of a business; content that they acquired in the past year and a half. The maybe one shows the sign outside a business that moved location in the past year, at their new location. For the first two, I have printouts from online news articles regarding when the businesses opened/announced the visible content, and for the third, we're hoping to receive e-mail reply from business stating what date they moved. On each such photo, I wrote on the back how it establishes time frame. Will this likely be acceptable proof that we've met within the past two years?

I'm also a bit worried they'll question the photos are from the past two years because I'm often mistaken for younger than I am. I'm afraid the USCIS will look at the photos, look at my DOB, and deny the petition because they believe the photos must be from longer than two years ago! >_< However, my fiance doesn't look like he could be much younger than he is, so maybe that will help... huh.gif

When my fiance was a child, his stepfather adopted him. His biological father gave up his rights to his children.

My fiance and his mother believe his birth certificate has his stepdad's name listed as his father. The only copy of his birth certificate that he has in his possession is a wallet card that does not have fields listing parents.

When the G-325A asks for the name of his father, do they want the name of his legal adoptive father (his stepdad) or his biological father?


My thought was to list his adoptive (step) father in the fields asking for father's information, and include a supplement like we do for other fields that are too long to fit, explaining the situation and listing the same asked-for information about his biological father. Would this be acceptable?

Please disregard question 1; he's decided to not bother changing his name until after we're married. From what I can find, Connecticut does not have the space on the marriage form for a man to change his surname with the marriage, so the man must Petition if he wants to change his surname no matter what. And it looks like the space on the marriage certificate, if the state has it, would -only- be to change to the -spouse's- surname or a few other choices that do not apply to us. So we will both need to file petitions with probate court anyway. I'll need to see how much time that takes and see if we can do that between wedding and filing AOS... :s

My fiance's legal surname is hyphenated, but other than on legal documents he goes by only one of those names. Let's say for this site that his legal last name is Smith-Jones, but he normally goes by Jones. He would like to legally change his surname to Jones. Then the plan is when we get married I change my surname to Jones.

My questions:

1. Is it ok for me to file the I-129F now, with his surname Smith-Jones; then he does a legal name change in Canada and we can send in to the USCIS some kind of form once it's changed, noting that, just like the Change of Address form? Or would him changing his name in Canada while the K-1 paperwork is going through present a problem?

2. If he keeps his name Smith-Jones for now, would we both be able to change our surnames to Jones in the States when we get married? Would that be the easier route?

I really do not want to wait to send in the forms, as we're aware of the processing time, and don't want to have to spend any more time apart than we have to. :/

We're having ours on a Sunday too. There's a date that "would be nice" for us, but realistically it's probably a little too soon to get the visa, book everything and give guests time to reply. So we realise it'll probably be a month or so after that date, which will be easier because that gets into wedding off-season, and that's ok.

I bought my dress and accessories and am making the cake topper, since as others have said they'll be used at some point. For some things, we have first and second choices: venue, DJ, photographer, officiant. I've explained the situation to the vendors, and when he gets the visa, I'll find out what Sundays our first choices are available, and we'll decide then what date will work best for us.

My fiance and I were going through the DS-156 quickly on MSN because he has to pay for time on a library computer, which is the only way he can use a printer. Yes, the mistake was my fault, I know this; I *did* read the Guides and Examples, but last week read somewhere (that I can no longer find) that for a K-1, the correct answer to Q.26. "How Long Do You Intend To Stay in The U.S.?" is "90 days", so that's what I e-mailed him last week and that's what was in my head when we were going through the form today. It's also my fault I didn't send him printouts of the example forms, and that I was looking at the same page he was looking at today instead of the Example one. My question is what to do about it *now*.

He has printouts of the DS-156, and they have the barcode, so it was submitted. But for Q.26 it says "90 days" instead of "Permanently". I'm guessing it would be wrong to add anything handwritten to that section now, clarifying that he intends to stay 90 days on K-1 visa but to adjust status after marriage and stay permanently? (Wrong because the consulate already has the submitted data.)

So should he do a new one when he can, print out *that* barcode, and just ignore that this first one was ever submitted? (There's no question asking have you ever *Applied* for a U.S. Visa, only have you ever been *Issued* one or has one been *Revoked*.)

Or, is "90 days" an acceptable answer for Q.26 and he should just leave it be and if asked say that he intends to stay no more than 90 days on the K-1, but to adjust status after we're married and stay permanently?

It is up to the CBP officer that day, so it's not a 100% certainty you'll be able to get in on any given visit. Showing proof of ties to Canada (employment verification letter, housing lease) and bringing your K-1 paperwork to show you're going through the process legally work in your favour. Being confident and matter-of-fact in your answers to their questions helps, too.

To help with the confidence part.. my fiance crossed in his car, said he was visiting his fiancee, and got through in 5 minutes with no hassle. http://www.visajourn...r-i-129f-filed/

Hi majay, If your fiance went to his medical, it sounds like he is the beneficiary, and you are the USC (United States Citizen) petitioner; is this correct?

Packet 3 and 4 are sent to the beneficiary, not to the petitioner. In Canada the packet 4 is what tells the date of the interview, so yes it's sent before the interview. I don't know if Liberia does this differently. Some countries have a packet 3 and no packet 4. Has your fiance received anything in the mail?

Also, please fill in your timeline, it will help others know where you are in the process to better answer questions you may have. :)

After you marry, along with AOS you may apply for Advance Parole http://www.visajourn.../Advance_Parole to travel, but it takes time to process. ("As of late 2007 AP's were taking up to 100 days to be issued").

It's possible to reschedule your interview date, though if you're going through Montreal I don't recommend that, because people are waiting 5-7 months for a rescheduled interview.

It's also possible to be approved at the interview but then have them hold off issuing the visa. From trailmix's post here: http://www.visajourn...ost__p__4051359
"A few have requested, at their Montreal interview, that their visa not be issued until later - basically you mail in your passport when you are ready to have it issued. Be forewarned though that Montreal is very slow in getting through mail, it can take weeks and weeks for them to get to additional documents that are mailed in(...)"

As canadian_wife said, the easiest way for you to hold off the interview once the process is started is, once you get Packet 3, to not send it back right away.

No, you don't have to include every e-mail. A small selection would be good. People here say one or a few e-mails per month.

If you can do a search on an e-mail address in your Inbox and Sent box, you could also include screen captures of those, to show you've submitted a small selection from many e-mails. It's not necessary, just one idea. :)

I never used Skype, but what you said sounds good, paste call history in Word.

We chose K-1 because to us, having to be apart during engagement seemed the lesser evil than having to be apart after getting married. And at the time we decided, we thought the K-1 would get us together more quickly, we didn't know Montréal took so long. Even knowing, though, we would have chosen the same.

Thank you for starting this topic, Lucy. I've had the easier time than my fiancé dealing with the wait. I've been patient and optimistic for 7 months. Two days ago, my cheerful patience vanished. I was too depressed that day to make a post about it or even a one-line status update. I could not make myself stop frowning on the drive home from work, and I could not make myself care about anyone other than him or anything other than finding out the interview date and being with him.

I think the contributing factors to my sadness were, we got to visit this past weekend and know the next visit likely won't be until the interview; the fact that our P3 was checked in 46 days after Canada Post said the consulate received it and we'll probably never know why the check-in took so long and meanwhile others who mailed their P3s after us already have interview dates; and me deciding to call DoS this Tuesday and not call again before next Tuesday and knowing no news then meant no news for the rest of the week.

How we cope with being apart. We e-mail each other in the morning before work, and talk on Ventrilo for a few hours every night and most of the day on weekends. And text once in a while if we need to, and call once in a great while if we -really- need to. Sometimes we go through some questions from 1001 Questions to Ask Before You Get Married. Silly magical thinking guesses about what Montréal is waiting for before they assign us an interview date: "oh, they're waiting for us to get through so many chapters, or for me to finish painting the cake topper." Hyper planning mode has helped me some; planning for the interview (EVERYthing we need or want to bring, logistics of us getting there and then traveling on to meet his family), and the wedding and the order of everything we need to do before and after it, and what we'll want to get when we're able to move into our own place. Filling time with playing online games, reading humourous websites.

Every time we visit, we take home a shirt the other has worn and not washed, to sleep with the comforting scent of our beloved.

We were careful to sign all the stuff in the I-129F packet in blue. Then I made the two copies of everything, in colour, and found for some pages it was hard to tell the difference. After that we made sure to put a few pieces of paper underneath anything that needed an original signature (instead of signing on a hard surface), because it seemed the indent in the paper would be a truer indication of an original signature than the colour of the ink.

To clear up some confusion in this thread for others even if OP is all set.

I believe it is 5x the 125% number for your house hold.

From VJ Guide for Affidavit of Support:
"When assets are used, the assets must equal 5 times the difference between the annual income and the
needed 125% of the poverty level, this is because the affidavit is in effect for 5 years. For instance, if you
needed $15,500 income and had an annual income of $13,500, you would need an extra $2,000 of assets for 5
years, or a total of $10,000 in assets in addition to your income."

So required assets/savings is not 5 * petitioner's annual income.
It's 5 * (125% poverty level for your household size minus petitioner's annual income)

ya makes sense lets say someone makes 19,000 a year what needs to be in the savings ?

As has been answered correctly before, 19,000 per year for household size of 2 people is over the 18,387, so no need to show assets.

But let's say for the sake of doing math that the petitioner who makes 19,000 per year has 2 children so the household is size 4.
125% poverty line for household size 4 = 27,937. (From http://www.uscis.gov...form/i-864p.pdf)
Back to our equation:
x = 5 * (27,937 - 19,000)
x = 5 * (8937)
x = 44,685
So this made-up petitioner with household size 4 and income of $19,000, they need to show $44,685 in assets.

Hello everyone. Yannic arrived in the states on Tuesday! Said he was the first from economy class out of the airplane and the last to leave customs, lol. Trip home from JFK was fun, we got stuck on the Hutchinson Parkway because the drawbridge got stuck up, so the cops had to come and make everybody turn around and get off an on ramp. Then on Thursday we went to the social security office and applied for his number with only a little hassle. They said it should arrive in 3-4 weeks.

Well, the consulate in Frankfurt said that they were going to mail out his visa two weeks ago. So we booked tickets for Nov 2. Visa never came. Couldnt reach anyone at the consulate. Finally reached someone on Thursday this week, said it hadn't been mailed out because they had technical difficulties. So they mailed it yesterday and it arrived today. So Yannic WILL be arriving here on Tuesday!

I am very sorry to hear about your argument with your father and that you had to find a place to stay.... I am not 100% sure on this, but I wouldnt worry too much about this event as ALL the checking on you has been completed at this stage. IF in the event it does come to light at the interview, which again I am 99.94% sure (ala Gary)... to the best of my understanding, at the interview, they ONLY disclose this to your SO, so the SO knows about it... it does not hurt your chances of approval.... So, with that in mind, dont worry about that... (someone will correct me if I am wrong) (Stephen.... cough... ) smile.gif

Not by any court order, but its a good idea. Just annoyed because its so short notice and I had to wait all day in a cell to be told come back later but we're going to throw you out on your ####. I feel victimized by the system because I was the victim of an assault and I am being punished for it. And I'm not allowed to visit the house and all my pets are there. I am also worried that if I get a permanent place now in three weeks when I have to go back to court I don't know what the punishment will be. charges dropped? fine? probation? And It's upsetting because I didn't even DO anything
