Well we got an answer back from our Congressmen office. Looks like they were just told the same the same thing I have been told, nothing but waiting. The only thing they got out of them that I haven't heard was that the next Oath ceremony in Little Rock Arkansas is July 13th.

I cannot believe they are going to leave me hanging till July that is 7 months after my interview. What a load of BS, I would of rather gone to Memphis TN since it looks like they have been doing Oaths ceremonies there monthly.

I agree. 7 months is a long time to wait. They could do an executive oath in the same office like many other offices offer the same day oath.

It is one of the autmated options. Not sure exact numbers but there is an automated option where you can request the transcript faxed or mailed to you. Search the board and you'll find information.

Liquor store gets robbed. You are walking the dog a few blocks away. The robber is described by the store clear as somebody who remotely looks like you. Police is checking the neigborhood and arrest you for suspicion or robbery. They find out you were not the bad guy and all charges were dismissed.
Are you now a criminal?
Are you now a person of poor moral character?
Should you not be allowed to become a U.S. citizen?

Step 3: brain processing stage:
If charges are dismissed, that means you were found not guilty of any wrongdoing. Thus, this has no impact on anything.

Step 4: conclusional stage:
Yes, it is okay to apply for citiznenship.
No, it will not have any impact at all.

That is exactly correct. You might have to show the court certified paper to IO at the time of the interview.

What after 30 years as a Green Card holder made you decide to give it up now, if you don't mind my asking?

Hi Bob, I think it is about time I have done it. There are several reasons why I have not done so far. I am one of those nervous wreck type and worry for things, second my country did not allow dual citizenship, third for some time, I did not apply for the minor conviction even though it was vacated. Lately, when I am was travelling, I am getting hardtime from IO's due to my old green card even though it does not expire.I ask USCIS and they say it does not expire and dont need new one. Finally, I have decided to apply for the I-90 replacement card. I have no idea when I'll get that. In the mean time I have been thinking, my wife and kids are US Citizens and it is about time, I would take the opportunity to become a US Citizen also. Also, I want to participate in the political system and vote in the elections that would influence the future of my children. I am meeting with Atty tomorrow to get his advice and getting all the papers ready in the mean time. As you suggested, I might apply my self or let my Atty do the work. Let us see what he says tomorrow.

In any case, really takes an effort to make sure all questions are filled out accurately. Instructions say takes an average of six hours to fill out the form and gather the required evidence. In our case, was more like 40 hours after reading and studying all the guidelines plus gathering all of that evidence. Is a lot easier for the five year as an LPR, also have to meet the resident requirements.

Best to ask specific questions on each line.

Hi NickD, I see the question in the part 2. I have been a legal PR for 5 years. So I am not sure if I need the divorce papers. It is good to have the documents together any way so I went and got my wife's previous marriage divorce papers and my marriage certificate papers. I need to go ahead and get my previous marriage divorce decree. I have a copy of it but not original, I'll go ahead and try to get it. Obtaning these documents can take weeks at times so it is good to be proactive and get all things together. I am sure Atty can help but it will take him same if not longer time to obtain these papers and charge me for his time. I am trying to do what ever leg work I can do ahead of time and gather the information. Thanks for your input and suggestions.

Hi NickD, I am confused with what you said here. I have been a GC holder for last 30 years and why would I say for the 3 year? Also, I dont see any question on the N-400 that says 3 / 5 year. Where do you see it?

It takes a mentally retarded person about 20 minutes to fill out the N-400 form. That happens online by clicking with a mouse. If you need a lawyer for that, you most likely also need a nurse when going to the bathroom.

I am going to see my Atty next week and start finalizing the application for N-400. What is your suggestions on these questions?

1. Both me and my wife were currently married for 20 years. But before that we both were married to different people and divorced. I have my divorce papers from previous marriage. Do I need the divorce papers from my wife from her previous marriage? Do I need to send it along with the application?

2. I had couple of arrests but the cases were dismissed. Do I have to get the court certified record of the outcome? They are 15-20 year old incidents. If the court does not have the record can they give a court certified letter stating the record not found? What is the document requirement to send along with the application?

3. I have already applied for I-90 replacement card. Will the N-400 application processing will have any kind of effect on my I-90 processing?

4. They ask the details of children. My daughter goes to school and lives on campus. Do I put her as living with us or put her campus address?

Please give me your thoughts.

With the N-400 downloaded the M-476 manual and all instructions, plus the form, and studied them, printed all this stuff out. Used a read pencil to circle what applied to us. Was very time consuming. Even with an attorney, you still have to carefully read and study the form, his excuse is he only put down the information you gave him which is a damned good excuse. So you really are not home free. But feel with an attorney on your form, you IO shouldn't try to pull anything. That is one bad experience we had.


I agree with you NickD. I am doing all the preparation my self just to make sure as accurate as possible and reach out to him if I have any questions. In the end it is peace of mind that I have some one who would help if I need help. My Atty is also charging me a flat fee for N-400 and agreed he will answer what ever questions I would have for him. I dont know how much he will help or not, but at least, I have peace of mind some one there with whom I can discuss my concerns. I have lot more information to fill out tonight for the forms to send additional information.

I believe N-400 form asks for the trips for the LAST 5 years since you become a permanent resident. So when I filled out mine, I counted backward from the filing date back to 5 years prior. So my filing date was 6/1/2011 and I listed all trips all the way back to 6/1/2006 (although at the date of filing I had been a permanent resident for longer than 5 years). Answer was accepted with no dispute.

Seriously, the purpose of that question is to check if an applicant meets the continuous residency requirement. If you only have a few short trips in the last 5 years from your N-400 filing date, I do not think your case officer going to scrutinize those dates. If you are really unlucky and get a really nasty officer, just stay calm and explain the truth.

Question C: List all the trips you have taken since you are LPR. That means all the trips for the last 30 years in my case. I can account for most of them except for the quick trips to canada. There are no stamps in the passport since we are very close and went in the car. I dont want to put wrong information and they come back and claim I was not truthful. I would rather say I dont remember.

Did you not get any stamps in your passport when you cross the border ? If not, can you look up old credit card statements for transactions incurred in Canada to figure out some dates ?

If you only have a couple of trips in the last 5 years, and there is no date stamps in your passport, they likely won't grill you over the trips nor verify the dates. In my case, due to the super long list of trips (work related) on my N-400, the case officer went through every page in my expired and current passports to check what I listed matched what were stamped in my passports. She did so because she needed to ensure those trips did not trip me over the continuous residency threshold.

Hi CoffeeBeans, Thanks for your input. As for the last 5 years there are only 2 trips that lasted total of 10 days and there is stamps in the passport and I can diclose those dates. But we have to indicate all the trips I took since I became LPR in 1981. I took a trip in 1982 and I lost that passport and it is been close to 28-29 years and my memory is not that good to remember. Also I took 2-3 trips to canada that lasted approximately 3-5 days and they do not put a stamp in the passport. I want to be upfront about it and tell them that I am not sure about those dates.

Do we need to send the court certified documents along with the application or we should be ready to give them at the time of the interview or can we send them as an update once we file the application?. These documents or 10-20 years ago and looks like it will take some time to get the court certified documents from courts. Are you applying with the 3 year married to USC status? I have no idea why would they want the BC of spouse.

I think it is better to bring them just in case they ask for it. When I had my interview I also prepared some documents like pictures, bank statements, and utility bills with your name on it. They just wanna make sure that both of you are living in the same place. Sometime they won't ask for the documents but it is better to be prepared than to go back again for another interview.

Normally do they send you a list of documents to bring for the interview?

On the other hand if your fear is founded on imaginary worries, then you are making yourself anxious for nothing. If you have lived in this country for 30+ years with only two minor offenses which your attorney already confirmed not an obstacle to your naturalization, why can;t you have some faith that everything is going to be fine ?

All you have been very helpful and supportive. Here is one more question and need your advice. I talked to my Atty last week and getting ready to file for the N-400 Applicaiton next week. I am having second thoughts if I were to go ahead with the App or wait. I have 30+ year GC that does not expire. I applied for I-90 Replacement card in August and completed Biometrics in September. Should I wait for the replacement card to arrive and then apply for the N-400 or go ahead and apply for the N-400 while I-90R being processed? Is there any negative impact on N-400 on I-90R ? I did had a small conviction in 1988 that is vacated and NSF check in 1998 and that is Noll Processed. My atty thinks I have good chance of getting the USC. Just for the peace of mind, should I wait for the new GC to come and then go forward with the N-400? I am of 54 year old age and I can not tell if I have done any thing else wrong knowingly in the 30 years I have been in US. One side of me tells me wait couple of months and other side of mind tells, go for N-400 and what ever the out come deal with it and face it. For some reason if they decline N-400 or if they find some thing else they do not like, will it effect my GC status? What is your final suggestion before I go ahead with the N-400 App next week?

Mine took a month before the online system updated. Some DOs take longer than others. However, do you remember when was it last you had your finger prints done? If it has been less than 12 months, I think they consider them valid and will skip the FP appointment.

I thought every application requires its own Biometrics appointment.

I am really confused about this requirements. Is it because OP is filing for N-400 due to 3 year marriage or is it a requirement to produce the evidence of married together. In my case both me and my wife file the returns separately as married filing separate. We have been doing this for last 2-3 decades. There is nothing wrong in doing it. Due to my small business risk of going under and can cause credit problems, we kept our house on my wife's name so in case if business goes under they can not take away the house from her and put her and children on the street. So I can not prove the joint ownership as mortgage deed. If I were to apply for N-400 would these things become a head ache? I am bit confused about all the requirements. Is it not enough, you are a LPR and you file your taxes and stay out of trouble?

In my employment section, I am a self employed and work as a consultant for several companies through my own company. I am listing my company as my employer as I get my paycheck from the company. Should I add a letter to the application and list all the companies I have provided consulting services in the last 5 years. I am not sure if it is required or not, just want to cover all bases. I read through the official checklist, have a question. Would my traffic citations be considered arrests WITH/WITHOUT charges? I have 2 violations which are under $200 a piece, and want to know if I need to send in court dispositions along with my N400 documents.

From what I see, bases on the 5 year rule, I don't need to send in my tax return documents.

I beleive, you do not report your traffic violations unless it is DUI or some other major offence.

Give it some time to arrive if your application was delivered likely on Fri (21) or Mon(24). Did you submit an electronic notification form with your application? If yes, they send you your application number via Email.

In my case, I send my application on Oct 15 via regular mail and I got the Email notification 10 days later on Oct 25. The letter arrived around Oct 29. So for me it was 10 days for Email, and 14 days for letter.

No, I did not send the electronic notification form. I called and they said it would take 10 days for the NOA to come. I'll wait till next week and once I get the NOA then I can setup the electronic notifications. Also once we have the NOA and Case number then we can send them additional information as needed.

From other timelines, I see that NH processing is quick.

Btw, I was also not aware of the form to add your text and email info. Am doing it online now.

I should have done it by my self as Brother Heskel suggested, but instead I asked my atty to file the application so he sent his company check along with the application. I would not know if his check is cleared yet or not. Once they assign the case number, I want to send additional information to them.

If they actually talk to a live person, they might be able to track it by the A#, name and address. Automated system will of course ask for the case number which, as far as I understand, ConcordUser doesn't have yet.

What is A# ? Is it Applicaton number or GC# which starts with A. I dont have the application number yet or NOA yet. I am wondering if I can call them and find out if they assigned a case number or some other number that I use to setup the online alerts.

Please also be aware that the online case status updates can be inherently unreliable! There are many VJ members who have passed their n400 interview, attended the oath and even got their passport, and their online status still shows "schedule you for a N400 interview".

Just saying don't RELY on these updates or you'll go :bonk:

Thanks for your input. The reason I am asking this question is in September, I submitted Biometrics info for the I-90 replacement App. I am not sure if they would need a new Biometrics again or use the one they already have in the system.
