US Citizenship General DiscussionHave CMT convictions (one/two), Can i apply for naturalization?

I came to USA during 1991 as a F1 visa holder and was arrested for a felony (grand theft) for writing a bad check (though I paid back the money to banks even before I was arrested) on 1994(This incident was CMT I confirmed it with UCIS as it was Bank check kiting). The charge was reduced to misdemeanor 1, I had plead guilty and had 28 days jail time with 14 days suspension and paid 250 dollar fine. On 2000 I was arrested for a shop lifting for 50 dollar items. Had finger printed and released. Never went to court, did not have any plea guilty (communicated only with my lawyer). Did 16 hours community service. Case was dismissed and all records were expunged and the arrest was never reported to FBI. On 2002 got my green card based on citizen wife. I disclosed all the incidents and submitted all court papers. On 2004 I was stopped at immigration (airport), was questioned regarding my arrests. They recall my green card application; made sure I disclosed everything with my application and then let me go. On 2005 I traveled overseas again without any incident. On 2012 I renewed my green card.
Now, Is there anyway that I can be naturalized in anytime in my life? The reason is Immigration laws are more political than socio-economic. Today I may be o.k. with green card. But tomorrow there might be a new law which may lead me to notice to appear. I have clean record since I got green card if it matters at all.

I think you'll be ok. They look at the past 5 years. If you have clean record for the past 5 years, you should be ok.

You have an option to appeal and I am sure your atty can make a big difference when you appeal your case. Or you can wait for 5 years since the date of conviction and apply again. In your case it is a better idea to engage attorney so they would not start deportation procedure against you. It may not happen but now that you have told them what you did, they can initiate a negative action against you.

Hi All,

Long story short, I was married to US Citizen. Arrived on Fiance visa, got CGC but then divorced. I applied and received my Permanent Green Card last summer.
My question is, because of this divorce I understand that I have to wait 5 years now to apply for my citizenship. However, my father passed away recently and I want to move back for a while to be closer to my mum. However because this is such a big move, I dont know if I want to be restrianed to the 2 year leniency that the US give for leaving the country. Is there anyway I can speed up my process under particular circumstances to waiver this 5 years? Anyone heard of anyone doing that? I would just move back to UK for good but I have a fiance (who will also move back to UK with me) and I need to be sensible and considerate to him and get citizenship so we are able to move freely in the future and not be restrained to one country for rest of our lives ( i know I can reapply again for green card but its such a long process and seems silly if im pretty close to getting US citizenship.

I really doubt if you can have any shortcuts for USC at this time. If you are away from US for more than 1 year then your 5 year clock resets and you have to wait 5 more years of continuous residency before you can apply for USC. You are better off discussing with an Atty and find out more choices. In your case since you have a GC you could travel often between US and UK and does not exceed the allowed out of country stay and then apply for USC.

US Citizenship General DiscussionCertificate of Disposition Original or COPY?

Here is the situation. I was arrested for driving with expired license and was released after paying about $125 before the judge. When I go to get my certificate of disposition, it is FREE and they never charge me. I believe that it needs the original stamped and signed certificate to all applications, but the thing is that it is starting to not make sense. I had to go there and get a copy of it for every application; i130, adjustment of status, remote condition and not for n-400 and maybe later when I petition my parents. Does anyone know if a copy of this certificate will be enough?

I do not think your case would be very bad. You could have forgotten or did not notice your license is expired. It is an innocent mistake and can happen to lot of people. If you were involved in accident or hurt some one while you are driving with out valid license can create more problems. I think you are ok. Make sure you have a court certified document and you should be ok.

unfortunately she has to attend for immediate family funeral (should be there in a day or two). Seems like a complicated process at this point..

After taking the US Citizenship you can travel up to 90 days with your indian passport to india. After that if you use indian passport for travel they will charge a fine. Not sure what is the amount you can check on the indian consulate website. In this case you can travel up to 90 days on your indian passport. Getting the OCI can take up to 90 days from the date of approval.

Why do you want to change your mind ? Is it due to a legal or criminal issue? If you have any convictions you might want to check with an atty before you go for the interview as they can take adverse action and you could loose your green card. On the other hand if you are simply nervous about things that is pretty normal and let the process work out. Trust me I went through and I know how hard it is to go through the process. What ever the case it might, you'll not be entitled get your fee refunded. You can ask but unlikely they will give you money back.

Looks like there is a possibility it is approved. I am not sure why asked for the green card to be mailed. I gave mine to at the oath ceremony. So I am assuming it is approved since they asked for the green card also.

I really don't know what method they use to prove your residency. But some times it is hard to prove exact dates. I think you should be ok to apply as long as you do not purjure your self in the application.

Hello.
Has anyone applied the expedited passport in Hawaii? If so, how long did it take to get the passport and did you need to make an appointment with the passport office or just walk in?

I applied for naturalization under 319b and am going to have naturalization interview in Honolulu Office. If I pass the test I will have oath ceremony on the following day, which is on Wednesday. I was just wondering how long the expedited passport will take. Someone in this forum mentioned that In honolulu office, the oath ceremony will be held at 2pm on wednesday, which means that I won't be able to drop the passport application off on the day, and have to wait till Thursday morning. I have to fly back on Sunday, so I have 3days, but I believe that the passport office won't be open on saturday and sunday. So In that case, I have to get the passport by Friday.

Is it possible for me to get the passport in a day in Hawaii?
Or should I consult with the same-day passport agencies?

I really don't know what facilities are available in Hawaii. I am sure you would be able to get the same day or next day passport. Check with the local authorities to find out additional information. You can also call the national passport office who can give you the information.

I think he should at least report the last address he stayed. It is a violation of the PR status not notifiying the the change of address. His application could be declined just for the fact he did not keep the address upto date.

I would say at this point, do not do any thing. Be happy you have a green card and move on with life. If they have approved, they would have approved by now. Do you want them to officially decline your app? What would make you happy. My advice, forget about that you ever applied and be happy being a GC and let what ever happens let it happen. I know how you feel. You would want to know what happens. May be some times it is good nothing happened and may be it is the best. Don't torture your self. I now it is easy for me to say what I am saying, but think it over and put your mind at ease instead of torturing your self.

Today I received a response letter from my district member of congress and the letter they got from USCIS saying date it 6/6/2012 we have received your constituent's inquiry. Although we are trying to resolve the case as quickly as possible. we need more time to thoroughly research this matter.The Congressional Liaison unit will update your office as eact significant action is taken on your constituent's case. I kind of knew that was coming the saga continues......

My suggestion, I would say relax and hold your horses and let things happen as they happen. Unless you are looking for a job that requires USC or some thing else that you need right away to become USC, I would say just give more time and let things happen. The more you push that might aggrevate the agents at uscis.

You have a cause of action in Federal court after the 120 days. All that means is you can file and force a decision. Otherwise, they can keep you in limbo until they decide whether or not to deport you, if that is what is hanging up the case. That is lawyer territory for sure.

I agree. This is some thing you should involve an atty or at least consult with one in case if they try take negative action against you. It never hurts to be over prepared.

Lady's and Gentlemen, I'm a U.S. Citizen.
It didn't go well at first and it was rather stressful because my name change request wasn't done (again). Calls where made and my request was quickly approved by the court right there. I was allowed to attend the ceremony and became a U.S. Citizen. After the ceremony I was asked to go with the IO from the court house to the federal building where my certificate of naturalization was written. I'm very glad this is over. Monday morning I have an appointment at the passport office in DC because I'm leaving this weekend on a trip.
What a ride!

i call uscis to speak to sencond officer today and basically told me that they haven't made a decision yet and if i do get denied that it dosen't mean nothing that i can still apeal it and to give it about 30 more days and to call back and keep waiting........

I went to my oath ceremony today, but couldn't participate because they did take my request for a name change into consideration. The officers where really friendly, but it's still a bit disappointing how messed up my case is. Three to four weeks longer for me.

Keep you chin up. As long as they did not decline your application you are in good shape. I beleive they have to process your application in 120 days and if they do not then it gets sent to a court where you can explain your case to the judge. So you have plenty of opportunites. I know it is hard to wait and count the days. I felt the same way too and I know what you are feeling.

Had the interview today @ 8AM in Baltimore. Interview lasted 20 minutes, and passed :thumbs:
Was told to come back @ 11:45AM for the oath ceremony, ceremony began @ 12:30PM and lasted about half-hour.

Glad it's over, finally!
