US Citizenship General DiscussionHow long does green card replacement take?

1. Online E-Filing Form I-90, Application to Replace Permanent Resident Card.
2. Filing a paper Form I-90, Application to Replace Permanent Resident Card by mail.

Should I use E-filing or paper filing? which is faster?

Also, will this take longer time than citizenship applying?

I applied online. You still have to mail the papers by mail even if you applied online. Not sure if it makes any difference in processing if you applied online or by mail. My I-90 took 4 months and citizenship took 5 months. Some places you might be able to get it N-400 quicker in the offices doing the same day oath. Depends on your field office. If you are eligible for N-400 you should apply for it soon.

US Citizenship General DiscussionInterview for Naturalization

Hello everybody,

I am residing in the state of Michigan. This is what I received through e-mail:

"On March 14, 2012, your N400, APPLICATION FOR NATURALIZATION was placed in line for interview scheduling".

I have not heard nor received any further communication regarding my interview appointment, time, location, etc... yet.

I was wondering if there is any other "Michigander" in the same boat I am in????

Thanks much.

Normally it might take them 7-14 days for you to receive the letter. They say wait for 15 days before calling them. I would say before end of this week you might get your letter.

US Citizenship General DiscussionGot my passport+passport card
Today I got my passport card in the mail. That completes my process. Now I have passport book + secondary passport book + passport card.

Now I am wating for my OCI from indian consulate. India does not allow dual citizenship so I have to surrender my indian passport and apply for the OCI card. It is an indian version of Green Card in India. It is expected to take another 60-90 days to get it and then I can travel freely to india.

In the mean time, since the weather is getting nice here, I am thinking of renting an RV and travel with family coast to coast and see the rest of the country.

It is a great experience and I can not beleive it I made it finally after waiting 32 years being in US. Good Luck too all of you who is waiting in the process to become USC.

Once we become US Citizens is there any requirement for reporting the change of address? I know we have to submit AR-11 if we are green card holder. Is there any similar requirement once we become US Citizens?

US Citizenship General DiscussionUSC Non-custodial Parent

Hi all,
It's time for me to fill out the N-400 application and I'm faced with the same old question on my stepdaughter who is not exactly a stepdaughter because my USC husband doesn't have a joint-custody. He is a non-custodial parent. We only have her 30% of the time and my husband pays some child support.
Do you know if I still have to count her as my stepdaughter for the naturalization purposes? :help:
- M

Yes. You have to declare. Child is a child. Custody has nothing to do with when declaring family information.

US Citizenship General DiscussionUSC noncustodial parent - additional question

I have an additional question. USCIS's guideline says that "If you have a dependent spouse or child(ren) who do not live with you, send . . ." supporting documents such as "court order . . .".
I don't know what to do in this case because our stepdaughter lives with us only 30% of the time and the court order is to my USC husband and not to me (I have no obligation to pay support for her). Do I still need to attach these documents? :help:
- M

You can always make info pass appointment and find out the details.

US Citizenship General DiscussionFiling N-400 for Bad credit

Thanks. I do not have a problem with child support. Is there will be a problem if I filed a bankruptcy to relief from my debt..

I do not think it should be an issue, since it is a protection offered by government. I filed for bk in 1995 to stop a foreclosure due to bad economy, but later withdrew my bk request as I did not want to go through with it. I would check with atty but it should not effect n-400 application.

As far as I know Bankruptcy is not considered as an issue for citizenship. You can double check with atty.

You have to worry only about arrest and criminal record. Financial situation should not effect that much unless you have problems with child support.

So what are my odds here? I would like to apply for citizenship this year, should I get the Status information letter and try to explain the situation on my interview or should I just wait before my 10 year green card expires and apply then?

Thanks for your help,
Carlos

I would say apply. What do you got to loose. Worst case if they decline the application you can always appeal to higher court for review.

US Citizenship General DiscussionScary experience at the bank
I would not worry about it. Most of the banks ask you if you were a "citizen/permanent resident". That is a standard question. If they ask you for more information then you would choose PR and possibly they want your country of citizenship. Most of the time the question would be stated as "Citizen/Permanent Resident". Dont worry too much. Unless you have explicitly claimed you are a citizen or if you have voted in an election pretending to be a citizen or served on a jury pretending to be a citizen then you are ok.

I think you are in good position and you'll get approved. Technically they can take upto 120 days to make the decision, in your case it might not take that long. Just relax and wait for them to complete the back ground check.

Even if you did not required to file the returns due to low income you are still required to file the returns. You might want to conact IRS and ask them to give you letter that you are not required to file. Any corresponce from IRS in that regard would be extremely helpful to you.

US Citizenship General DiscussionDenied Citizenship due to disruption of continous residency

Hello. I'm a newbie here!:)

I filed my N400 in April and done with fingerprinting last June 20th. I was wondering if anyone here had experienced being denied or approved in the interview in regards to staying outside US for more than 6 months but less than 1 year.

I got my GC in '07 through parents but stayed 9 months between '08 and '09 because I was a graduating student from college back then. After that, I stayed here in US from then on. Got work and has been paying taxes since 2009.

My immediate family were here while I was out and I did not work abroad. I didn't have any tax returns for 2007 and 2008 for I was still a student and totally dependent to my parents and have proof that my father had sent money from US to the Philippines. I also didn't have bank accounts, credit cards, etc.

Everyday, I'm scared as to how this journey will end up. I m still waiting for the interview letter and hoping that I can get some advise betore the judgement day!

YOLO

I think you should be ok. Please give exact dates so we can calculate dates and total time you are in US.

I am not sure if your husbands affidavit is necessary. Simply you can say there was a misunderstanding and things got resolved. I am not sure if Atty is necessary but you can get one if it makes you feel better. Good luck.

US Citizenship General DiscussionPossible Deportation? GreenCard? N400?

This attorney's advice is to leave the US because your cousin "could" be denied for renewal of his green card? Is your cousin okay with this? Is he willing to fight for the right to stay in the US?

Is the criminal lawyer knowledgeable about immigration laws?

The I-90 Application to Replace Permanent Resident Card does not require your cousin to disclose his arrests or convictions.

400 grams of pot is almost a pound. That's a felony in all 50 states.

The felony drug arrest and the failure to file taxes makes it highly improbable that your cousin will be able to naturalize.

---------------

An LPR is a guest in the US. We don't like guests dealing drugs and failing to pay taxes. This is a guest that you kick out, not one you invite to stay permanently. The US government does not welcome these guests. That's the harsh reality for your cousin. He could probably stay an LPR, but he probably not be able to naturalize because he cannot meet the good character requirement.

I understand in I-90 application one does not need to voluntarily disclose the convictions. But what I know they will be doing complete FBI back ground check and what if they find the details during the I-90 processing. Will it not cause problems and deportation proceedings if they find some thing during the FBI check? From what I read for both I-90 and N-400 they take Biometrics data and processed through the FBI Database.

You can talk to a good immigration / criminal atty and the convictions could be vacated. Not knowing the details, we can no suggest, but talk to an atty who can help you.

From what I heard you can leave country with other passport but when you return to US you must return with US Passport. Check with passport agency and they have expidited service and you can get your new passport in 24 hours. You have to show them your ticket with the airline.

US Citizenship General DiscussionHave CMT convictions (one/two), Can i apply for naturalization?

I came to USA during 1991 as a F1 visa holder and was arrested for a felony (grand theft) for writing a bad check (though I paid back the money to banks even before I was arrested) on 1994(This incident was CMT I confirmed it with UCIS as it was Bank check kiting). The charge was reduced to misdemeanor 1, I had plead guilty and had 28 days jail time with 14 days suspension and paid 250 dollar fine. On 2000 I was arrested for a shop lifting for 50 dollar items. Had finger printed and released. Never went to court, did not have any plea guilty (communicated only with my lawyer). Did 16 hours community service. Case was dismissed and all records were expunged and the arrest was never reported to FBI. On 2002 got my green card based on citizen wife. I disclosed all the incidents and submitted all court papers. On 2004 I was stopped at immigration (airport), was questioned regarding my arrests. They recall my green card application; made sure I disclosed everything with my application and then let me go. On 2005 I traveled overseas again without any incident. On 2012 I renewed my green card.
Now, Is there anyway that I can be naturalized in anytime in my life? The reason is Immigration laws are more political than socio-economic. Today I may be o.k. with green card. But tomorrow there might be a new law which may lead me to notice to appear. I have clean record since I got green card if it matters at all.

I think you'll be ok. They look at the past 5 years. If you have clean record for the past 5 years, you should be ok.
