How often do you call or e-mail the consulate? Are they friendly when you ask for a status update? Just curious about how you are dealing with the wait.



I have emailed the embassy 3 times in 6 months. They are always friendly and it is always a personal email to the questions I have asked in the email. And it always says about the same thing. Using my words it boils down to .... just wait and we will let Xuan know when we have made our decision... but alwasy differenty and always nice.

Do you really think you are the only person that feels they have gone through a tough time? Read my time line and the time line of many others on this site for the matter. It seems to me that EVERY one of us on this site have had to jump through hoops. Granted some less then others, though they still had to do some jumping. People here are here becaus of the tough time and are trying to help each other out with advice and most of all SUPPORT.

Please try to understand that you are not the ONLY one.

What are you talking about. I have spent well over 10k so far there several people who have spent less than 1k and have gotten there visas simple because they have money. Luckytxn said he only made one trip and I don't know if he even had an engagement cermony. Plus he didn't even pay for his plane ticket he stated it was her relatives. That is several huge red flags but he got his visa simple to have money is all that is needed not how much you spend. If your rich then you will get your visa if your poor it doesn't matter thhey will try to deny you. Don't get me wrong i'm happy he got his visa along with the other people but I think its very unfair how the poor or non wealthy people are getting screwed. I don't know if luckytxn is wealthy or not but there are several people on here that got denied there visa's that have stated they have money problems and there are several people that had the same red flags that got there visas that don't have money problems so you do the math.


Don't drag me into this idiotic theory. I am far from rich. I am just a over the road truck driver and make ok money. I had a engagement party and much other things that we all needed just like any other. I am no different than any other here.


Well put Tex wink.gif . I have had to struggle as well. I am not rich but I do have a mortgauge, some ok credit and I can hold a job. I tell you this, if I were rich I would be living in Vietnam. At least as much as I could. For me I do not understand why the rich stay in this country. As some know I was a U.S. Marine and I have done my part for my country. I know that America offers some things while taking away others. Every country have those things that make it good and bad. If I were rich I would not go through all of this, I would just move there where there is far less trouble. Or that is the way I see it anyway.

Thank you all for the well wishes. We did infact get the Pink Sheet today and it says we can pick up the visa on May 5th. We head back to the states on May 13th.

On another note, the price of a one way ticked is as much as my round trip ticket. What a crock. But it will be worth it to fly back together and have Xuan with me.

Here is the latest,

After 1 green sheet, 3 blue sheets, 2 medical exam's. 2 interviews for Xuan, 2 phone calls to her father, 1 phone call to me, about 6 emails from me, and a visit to the consulate to talk to a counslour officer we have been Approved.

After I got here to HCMC on April 14th I sent another email to the counsluate telling them I was comming to talk to them about the case. They replied saying that Xuan had been approved and they had to send a request to the State Dept. to have her name removed from an ineligibility list due to a prior visa request that was a few years ago (long story). I took that email and went to see them anway. The lady I spoke to was very nice though not much help as she did not know much about the timing of the State Dept. I did confirm that Xuan was approved but as we all know, until the visa is in hand, anything can happen. We got back from visiting her parents today and after the mail ran here she got another letter from the Consulate telling her that every thing was done and she needed to bring her passport to the consulate and recieve here acptance letter (I assume this is the pink sheet). We will do that on Monday 4/27. Not sure how long it will take to get the passport back with the visa in it but I am sure we have enough time left so that we can fly back together.

I am very much looking forward to ending this portion of the journey and moving on to the next. Will there be any supprises at the port of entry I should know about for those of you who have gotten that far? It will be Texas I think.

If anyone is going to use that 1 hour of time the embassy gives on Tue and Wed now, my advice is to show up about 3:30 or so. It seems to be first come first serve.

We got the pink sheet today at about 4:30pm April 27 and it said to return at 4:00pm on May 5th. I know there is a holiday in there as well so for others it may be a day or 2 shorter. I looks like about 8 days for us.

Great tip on "Al Fresco's". I got a cheeseburger and it was fantastic. If anyone goes make sure you are hungry (which I was). The burger is about 1/4 pound after it has been cooked and the burger comes with lots of stuff on it. There was an egg(which I thought was a bit strange but ok), lots of bacon, tomato, cheese, and some other stuff. Xuan and I got the same think because she did not know what to order. She could only eat maybe 1/8th of her burger and had to eat it in pieces at that. So I eat the rest. Don't want to leave a bad impression of a waistful American after all

I did not use my retrun ticket. I just ate the cost and got 2 one way tickets, one for each of us. It almost cost the same as trying to get a one way ticket on my original return flight and it was a much better flight. If you can my advice is to fly to Nariata/Tokyo. I have to fly to Indiana so on my other 2 trips I would fly to Chiago and then to Hong Kong or South Korea. Each of thoses flights were about 14 hours give or take. I found this time that if we fly to Tokyo then to Dallas the flight is only 11 hours give or take. It does make the shorter flights a bit longer but it is well worth it to reduce the time of the long flight. If you do this a bit of a warning, Tokyo airport is not very newbee friendly. Also be careful what flight you take because a common layover in Tokyo was 10 hours. We got a 4 hour layover and that was just fine.

Well we finaly got the call from the embassy on Thursday May 14. With our luck so far the call came as we were about 30 min into the trip to Vung Tau. They said to come pick up the visa on that day. Of course we could not so we asked if we could get it on Friday and they said no, that we would have to wait until Monday. Monday came and we FINALY got the visa. We went back Xuan's home and I booked a flight out of Vietnam for Tuesday. We are home now and still recovering from the flight. To top it all off, we only have 2 months to be married and the AOS before our application expires becasue the embassy took its sweet time.

BUT at least Xuan is in the US now. kicking.gif

Ok so we got the pink sheet and was told to return on May 5 to get the Visa. Of course there was the May Day holiday in the middle of our 8 day waiting period. Xuan and I go to the embassy 30 min early and Xuan goes in to wait. She waits for about 2 hours and then asked why her name was not called. The woman told her that her visa was not printed yet and they will call her when it is ready to be picked up. She comes out and tells me this so I go in and ask my own questions. After talking to 4 people, 3 of which were CO's, I was told that the CO that approved her visa was on leave (vacation) and that his email to another CO about our case was not understood. On top of that there understaffed due to a flu bug. So now we must wait for their call. I am thinking that is with the CO for our case will be back and will tell them that it is ok to print the visa. I took the pink sheet and left the embassy as calm as I could muster.

Has anyone had a date to pick up the visa but then told to come back or that the embassy will call them? The CO did say that Xuan will get the visa, we just have to continue to wait for the inept embassy to do it on their own sweet time.

Joe, I am with you 100% with this post. I completely agree about the questions. Let me tell you that because you asked this question I now know what questions to ask about getting a motorbike licenses on my trip in a few days and you have answered another question about your job for me.

Keep asking, anything you want, whenever you want. Many of us learn from these questions and sometimes we learn to ask questions we did not think we needed to ask in the first place. I would not have thought that there is a motorbike licenses for the scooters in Vietnam because you are not required to have one in the states for scooters.

Just a quick summary of what being asked to submit:
1. detailed timeline
2. list of her relative with proof of residency in US
3. her ex's name, address and proof of residency

Knowing her since 03/2006, visited her 3 times, engaged last year in September.
Proofs include chat log, phone record for 3 yrs, pictures of 1st , 2nd , and 3rd trips.

This case is one of complicated ones due to her previous mariages. She was previous K1, came to US in 2004, got married then divorced in 3 months before changing status. She re-married with another guy then come back to VN. Thing also did not go well, so they divorced in 2007. All divorces were handled by US courts.

We have all proofs for the ongoing relationship, but we are afraid that HCMC still puts our case under AR after we submitted all requested docs, and finally return our case back to US.

At this point, we are working to have all docs done and cross our fingers sad.gif

Several questions I have in mind:
1. does it help to hire a lawyer for this case?
2. what will happen after docs are submitted? I have heard that HCMC even does ground work, phone calls, etc... for the investigation.
3. Do they have any ground to deny visa even we can prove that our relationship are bona fide?

Your case is kind of close to ours and we really had trouble. Xuan did not come to America on her first petition and still had a TON of trouble with HCMC consulate. I will try to paste a link here so you can see what we went through AFTER we got the pink sheet due to her previous K-1 petition.

I would not do that. I have my packet at the CSC and I wish it was at the VSC because the VSC is processing much faster for some reason. It looks like they are 2 or 3 months ahead of CSC.

That's what I thought too at first that you have to file before the 90 days until I read (and re-read) the instructions and had my husband read it too. You can file anytime WITHIN the 90 days prior to the expiration of the GC and like Cacerez, I received a letter of reminder from USCIS regarding dates that I could the file the ROC.

I am not sure about the mortgage not having both of your names or even a lease but I guess an explanation letter could be included in your application regarding the situation. And as this type of document is to show that you are living together, you can add Driver's License or State IDs that show that you and your wife are in the same address or any other official documents that can show you live in the same address.

Thank you for the link. I thought I was told that we had to wait to apply for the ROC when we had 9 months left before the expiration but no later then 90 day before the expiration. Everything I read on the link said to wait until there was 90 days left before the expiration. Am I reading this worng? I also noticed that it said you MUST file 90 days before the expiration. Also has anyone here not been able to provide a mortgage with both names on it. I would have had to refinance my house to make that happen and that is just not possiable. Getting all the other documents will not be an issue though.

Thank you for listing this information. We have been away from Visa Journey for some time and now it is time for us to also file for the removal of conditions. I looked that the USCIS site and it did not say anything about sending proof but I was thinking that would be very strange as they want proof if you "pass gas". As with your question I am looking for some kind of confrmation on this list and maybe a "sample" of the affidavits. Not sure I can come up with the lease with both our names on it, I rent my house from the bank (mortage). We do have some photos of us together with friends and such but I am sure we can get some new ones before we send it off.

Any other advice on this part of the process would be helpful.

Hi Guys,

Just want to get y'all input if we did provide enough evidence.. these are the ones we turned in

  • Copies of the passport and green card of immigrant wife
  • TWO sworn affidavits by U.S. citizen friends, attesting to our relationship and marriage.
  • Copy of the JOINT Income tax returns for 2010 both Federal and State.
  • JOINT 2 yr lease agreement with the landlord.
  • Copy of JOINT Credit Card account stating IMMIGRANT WIFE as an authorized user of the Card from CHASE BANK
  • COPY of CARD for Health, Dental, Pharmacy Insurance from Gilsbar Health and Vision Insurance (Note the card showing EMP + 1) under the same policy.
  • Pictures together, with friends, and family.
  • Copy of Card address to me and my wife.

We sent our packet today by USPS Priority Mail. It is supposed to be delivered on Thursday!

We also ordered our tax transcripts on the IRS web site. We could only order our transcripts for 2010, so we sent just the tax returns for 2011.



I have ordered these tax transcripts 2 times now. I am still waiting for the second order. The first never came. Have you had any trouble with that?

Hello all,

Guess we will be starting another journey down the USCIS path again this month. My wife’s GC expires in May so it is that time. I am starting to gather the list of required a recommended items now. Will have the priest and other member of our church do the affidavit’s for us. Hopefully it will be as straightforward as it sounds reading other months postings.

Thank you all for all the information posted so far and if I come across anything that may be helpful I will be sure to include it here as well.

Not a stupid question at all.... I never even checked that. Just checked it and I did sign the check. I have no idea what they are talking about, if it is not because we did not spell out our middle names then I am stumped.

The more I think about it, the more I suspect "properly signed" means the location on the form where each of you signed. Can you tell us who signed where on the rejected package?

It was signed exactly where it was susposed to be signed. My wife signed on the line and I signed under as the spouce. There is only one place for signatures that I could find so I am not sure what their problem was then.

So here is a kick in the teeth. We sent our package off on 4/13 and waited,,,,,,nothing,,,,,got a letter saying the package was rejected because my wife and I signed our form with our legal signature. Looks like they want us to spell out our full middle names. So the letter said that all the attached documents were rejected. We got only the letter which said to return with the package "properly signed" and the rejection letter. I recoppied the package, wrote another check, "properly signed" the documents and attached the rejection letter. All that and sent it off again the same day.

Well, the next day I got the "attached" documents/check I originally sent. That package said to send it back as well. So now here we are waiting for them to decide if they are going to accept the new package or send it back as well. They recieved the package on 4/30 and the check has still not been cashed. I assume that the second package will be returned as well so that I can send all of it together at the same time.

This has been a real pain in the #$%..

There has been nothing about this process that has been smooth where our government is involved. From the K1 up to now. It is a good thing we will not have to go through this again for another 10 years.... I hope.

Finally got the tax transcripts after talking to someone and getting them faxed to me. I ordered them 6 times using both the online and phone methods. I started in early March and have yet to get any in the mail.
So with all that and Xuan’s expiration next month I am sending my packet off tomorrow April 13th…. Friday the 13th. Ooooo how ominous :o

We will see how it goes.
