Hi all, alexndillon2125 here. My fiance (the US Citizen) filed our k-1 petition in April at Vermont, therefore we are April filers biggrin.png.. my fiance and I met online in September 2012 and he flew here to the UK in Jan 13. He proposed on Valentines Day and we sent our package I-129F package out in early April. He shipped out to Fort Benning for Infantry Training at Boot Camp for the U.S Army on 30th April and is due to graduate in August (I'll be flying out late July to stay with his family). It is possible he will be deploying a month or so after graduation, so my question is, would we be able to expedite for military reasons around August time incase he gets deployed? Or would they need valid proof of his deployment? Also.. I am due to have an operation on my left shoulder in June/July time where I will have a few screws and ligament and muscle repairs done... would this class as another good reason for medical expedition? I understand its hard for everybody being away from their partners for so long during this gruesome wait for approval, but think, some of you guys can skype/phone/email each other during the process, whereas we can only once a week and have no phone calls during bootcamp! Each of our forms and paperwork included were separated into plastic wallets and labelled with our names and D.O.B on, and both sets of pictures were put into an envelope with our names and D.O.B on also. Hopefully no RFE.

Thanks. We sent in over 60 photos of us together, and with him and my family at family events (BBQ's, meals, birthdays) also.. along with plane tickets and restaurant receipt tickets including the one from the night he proposed, and also a few letters we sent to each other before he visited. However we forgot to include skype and facebook messages, with one message including a screen cap of a call of 25 hours we had. Hope we included enough evidence. Thanks for the reply :)

Hi all, I've been a reader on here for a couple weeks now, but never really came across this question. My fiance and I forgot to date stamp both sets of passport photos and the photographic evidence we sent with our petition. Does this mean a reason for an RFE or possible denial? My fiance (the USC) is currently in U.S Boot Camp so he would either have to have his parents reply to the RFE on his behalf or he waits til he graduates in August to send the requested fixes. Hi all, hope you're all keeping your heads up and spirits high while waiting for approvals!! I have a bit of a stupid question, but here goes... Okay, I'm 17 and my 18th is in July. I know we won't get a decision anytime before that (VSC), which means I'll be 18 when we receive a decision. Over the last two years I've had various medical things going on, unable to graduate and finish high school cause i was signed off by the doctor as my big brother died in 2011 (1 week before final exams.) I was unable to get employed so I  was on Job Seekers benefits up until September 2012 when i started a Mechanics course at my local garage. Since then I had a dirtbike accident and separated my shoulder and tore my muscles etc so now Im waiting for surgery which makes me unable to work again.. so I'm having to claim another benefit called 'Employment Support Allowance' here in the UK. Since there are requirements for the financial support side of the visa, will these benefits and tax incomes in anyway affect my chances of getting the K-1 Visa? I am the beneficiary not the petitioner. My fiance (the USC) has no money troubles since he is in the U.S Army and has an average monthly income of $2,000. Thankyou!!!!

So I'm a VSC March Filer and just got moved over to Texas on the 12th. Now everything is moving along I took the time out to sit and think about the next steps. Everybody is saying about tax transcripts and stuff? I'm 18 on July 21st and my fiance is 20 and recently joined the U.S Military as an infantry soldier, he graduates in August... BUT he never worked before that. I'm so confused on what I gotta take to the interview in London, we have proof that he can support me, we have army documentation of his pay charts and we'll have bank statements from the last few months to show his pay each month which is $1,900. Once we get married his pay will rise as I will be living with him on base as a dependent. Is it possible we will be denied because we won't be able to show good tax transcripts from say the last 2 years? I don't think we'll need a co-sponsor because his income is good, but if we did because of the tax transcripts we wouldn't be able to get one anyway because his mother, him and his sister were made homeless 3-4 years ago and his mother is now on some kind of housing program in the U.S. My family are unable to do it as my father is ex military and bankrupt and my mum is a stay at home wife. I'm so so worried, please help in any way you can, maybe I have all this tax transcript stuff confused, my head is all over the place.

Having looked at your timeline, you haven't received NOA1 yet... The petitioner (US citizen) will receive a hardcopy NOA1 (Notice of Action 1) which will include a case number of which you can enter on the USCIS website and check your case status. NOA2 (approval) will be posted on the website once you've been approved, and a hardcopy will be sent in the mail to the petitioner (US citizen).. all other files from then on (forms and checklist from NVC) will be sent in the mail to your fiance.

Hi all, thanks in advance... I have a question about form DS-230. Questions 14-18, it asks for information about my spouse - name, date of birth, occupation, address, date of marriage. But, we're not yet married and this has to be given at the interview? Is it referring to previous marriages? I don't see how I can fill this part in since my fiance and I aren't married yet?

Thankyou! I just got that one done online and have it printed ready for Wednesday... as for the part about taking my NOA1 and NOA2, I don't have those, they're with my fiance's mother in New York, I only have the case number and dates of approval, could I print out the approval page from the USCIS website and just take a copy of the I-129F packet we sent? I also don't have many ties back to the UK barring my return ticket and hospital appointment letters as I'm unable to work and awaiting shoulder replacement surgery. I don't dare take the folder full of papers including my DS230 forms to show we're sticking to the process incase they stop me at customs and assume im going to stay in the US  for the rest of the proces...

So I got my NOA2 July 24th and I'm heading to NY then Georgia for my fiance's army infantry graduation in August, I'll be flyin out August 7th. And returning September 5th. Since I'm in the UK will I have to fill out the  ESTA Visa Waiver Program form before I go and take it with me? Or will this in any way collide with my K1 Visa process?

So I've been scouring the forums for a couple hours reading up on some stuff, and I came across a post... someone said that after I marry my fiance (USC) on a K-1 visa, and after I've filed my AOS, after 2 years of marriage we have to file the I-130 in order to get my 10 year green card? Is this correct? I spent weeks researching and getting everything together for this whole process and not once did I come across anything on any of the official sites stating we had to file the I-130. I thought we filed the AOS, then when the time comes I apply to have my conditions removed then I can apply for citizenship. This site is extremely helpful but sometimes also very confusing at the same time.

Just saw your edit. I have the evidence, it's on his LES's, I also have his enlistment papers to show he is active military. He will be getting promoted in the next week or so his earnings increase, and since we are living on-post we will receive an extra $1230 BAH (Basic Allowance for Housing) per month. He also wrote a letter explaining why he has no tax transcripts. I hope this will be enough.

We won't be able to get a co sponsor, he's only just been stationed at Fort Benning and doesn't have any friends that he knows well enough that will do something like that for him yet. 

 

Edit: I went through his recent LES's and worked it out, he will be bringing in MORE than the 100% poverty guidelines, so I don't see why we'd need a co sponsor.

He doesn't have any, hes 20 and this is his first job. We have no co-sponsor. My father is UK military and they screwed him over and so he was made bankrupt. My mother is a full time carer for my brother, and my fiance's parents are both retired.

I'm flying into Newark Airport November 19th, i know from previous experiences that normal POE is as easy as pie there... regarding the I-94, i can't remember if I was given one before on the plane or not, I'm pretty sure it was a green one they gave me cause I entered on the visa waiver program, but this time I'll be travelling on my K-1 Visa, so will I have to request the white I-94, or will they already know and have one on hand? Orrrrrr would I have to fill one out before I go? :)

My fiancé and I really need help and guidance in our journey for the K-1 visa. He is back in the states and I?m here in the Philippines. He?s really tied up with work that he doesn?t get enough sleep with one day off only. He is really working hard to make ends meet. He was thinking of getting a lawyer or a consultant over there but I?m opposed to the idea because we might end up spending a lot of money.

I read somewhere that it?s better to do it ourselves as long as there are no complications since this would really make the expenses much lesser. However, I found myself unsure and a little bit confused as I read the entire process and everything involved. I suddenly thought of going to an agency that provides full assistance on immigration or visa application to play things safe. I made an inquiry and just found out today that it was quite expensive. Now, we really need advise whether to this pursue this on our own with minimal cost or go an agency with full support and guidance with a considerable expense. Please help us. This has been our dream to never be apart for the last 7 years and now we?re finally able to this. 

Honestly, the process is all quite easy once you have done your research, and this forum also helps ALOT, you'll find all the answers and get all the help you need on here. Lawyers and agencies sometimes make mistakes also, and can't always be trustworthy. It's a decision only your fiance and yourself can make, but remember Visa Journey and its members always there to help!

Well the police certificate can only be done at Alagbon police station in Ikoyi,here in Lagos......But if you probably far from Lagos,you can still apply thru the police station where ever you are,then they will tranfer it to Alagbon police station and after there check on your criminal records and you have not committed any crime...they will issue a police clearance certificate on your name and sent it back to which ever station it came from,Then your fiance can pick it up afterward... .but might probably take few weeks before he will get it but if it was done at Alagbon which is the approved station for it,he can probably get it in a day or two because all the criminal records in Nigeria is been transferred to the station after each case no matter which state you are in Nigeria............

Well i have my own question.............My fiancee is very worried becouse our case arrived Lagos in 14th March,2011 and we have not heard anything from the Consulate about our interview date....He is saying that am not following up because i just started working few weeks ago,but that is not true because i email the Consulate few days back and i just get the auto response which i forwarded to her but they have not replied my email....Pls how do i contact them to know my interview date and what next to do.....is been like 2 weeks our case arrive in Lagos.....Thanks

Well is not a do or die issue,i know how you feel but the truth is that anybody here that took out time to read and relpy on anybody case just wanted to help in one way or the other and Trust me....No body is against you contacting the congessman,Just that sometimes we should try and be realistic......i know after the long wait of going thru the approval process from USCIS and the money spent and all that,it really hurt but somehow you need to accept that delay or is not denail and we are all here for a common goal which is to find a way to be with our love ones.....................If you contact Congressman and get re-aparoved by the embassy,All VJ members will be happy knowing that aleast we finally had a success.....but what is the point of after going thru the process of getting the Congessman and still not have them do anything,or Maybe having your lawyer do what ever he has to do just to get approved without having a good result at the end which no body here pray for.....Whereas you and your fiancee would even focus maybe trying to plan a trip and either marry in Ngeria and file for Cr-1 sebsequently after marriage in Nigeria....Is a hard thing to accept but most times,is something we cant help but just accept that is our fate..............

I have heard crazy story about interviews which there case are even far more easier and clean....Like both partiner has never been married,made like 2 to 3 visit back and fort and still get denied at the end at the embassy level but somehow they figure it out and move pass that and some of which are here in the US today.....That things work for someone else dosent mean is easy and will work for everybody.....Contacting the Congressman is a good thing and Trust me, everybody that gets denied at the Consulate level would have at some point thought about that but whats the point that at the end of the day and the whole stress of getting them involved didnt yard any help.....Like you said,Getting a lawyer is a good thing but i can only say that this lawyers dose not have much to do when it comes to visa decisions at the embassy....They can only help you put your decuments together and advice when necessary but cant influence any decision on issuance of visa....That is one thing most people dont understand but is just the true fact.......One thing i want you to know is that getting an Immigarnt benefit is not a right you have in your own hands....So dont waste so much money paying for lawyers to help you where they dont have so much they can do............

i wish you the best on which ever you choose to do and i pray you find a way to sort it out.....i will always check back to see on how the case as it unfold and pray it goes on your favour...Like i said...still have people advice you more and go from there...Wish you the best result you ever desire

Well Dude,Congressman or no Congressman,Embassy still have right to denial a visa when they deem its fruad,All the need to do is to back it up with evidence that is fraud,and that is final..... and that is why they are put there for.....Uscis approved a visa,when there is misrepresentation in the embassy level....is denied and that is just it and is return back without questioning..........So i suggest the answer to this is just thinking for a way to move forward and not get stuck with trying to get Congessman or so.....Just a suggestion though.....Even if you tried to and eventually get thru for them to help....All they could do is to write the embassy and ask reason of the denail of the visa and with such reason they gave that your fiancee was not legally divorced when you both were dating......and subsequently filed your petitioner within 3 months of the divorce procedure....i mean is a good reason for deanil and with that,Congessman cant do much on such situation....

i think Congressman help just in cases where the embassy denied a visa without giving a reason,Maybe they just say is for immigration purposes without giving a reason why they think so......Thats where the Congessman questions why do they think is for immigration purpose and have them review it again and possibly have them do another interview but in this case....There is a reason and this reason was that your finacee was dating you when she was not legally divorced....This is US governement and when it comes to immigration matters,it is strict and it has its own standard and thats just it....

Let people advice you more though and like i said,Be strong and take time to plan better,it will work out itself....

Well i feel your pains and it know it hurts....You need to be a strong person and hold hands together with your love and you will get thru it....

From my own suggestion,Contacting Congressman helps sometimes and most times,is pointless and waste of time becouse when the embassy have any suspecision of visa fruad,They will quickly deny immigrant visa without questioning becouse mos most immigrant visas is hard to get denied especially when both people are free to marry and have every evidence to prove there relationship and in such case if it happens that it was denied for no cogent reason,The congressman has the right to question the denial and have them set up another interview based on not having a good reason for denying such visa becouse it was dully approved by United state govenrment,Embassy is just there to follow up with other process and issuance of the visa.....,But in yours,is different,They saw a reason and that is just it.............So i think getting the Congessman to help on your case,Is hard and i dont know.......... Becouse you both were dating when she has not even legally divorced the husband.....Truly the outcome of getting a congressman might still not be favourable.......In your case,They Ebmbassy have right to determine if to approve or deny the visa bases on what the CO sees fit.....,Though here in US,They know is possible and it happens everyday that people still go thru divorce and still date anyhow they want....but when it comes to Immigration matters,It is mostly view differently and there is nothing the petitioner or the beneficiary can do about it......if i was to know you befor the interview took place,i would have suggested you say you both were just friends and she was visiting you as friends all this while till 2010 when she legally divorced,That is at that point that you people decided to start a relationship and eventually decided to marry within few months....is obtainable than the fact that you were dating her when she was not legally divorced......Like i said,this are all suggestions .....But at any rate......Your best bet is just to file to revoke the k-1 and Just have your fiancee come to Nigeria and get married and file for I130 petition .....That way,CO cant help it but to approved it and if they venture to deny it again....Thats where the Congressman comes in becouse they dont have the right to deny it if it was approved on good faith here in Department of states,Unless there is a reason which they find out in k-1,been that she was not legally divorced piroir to having another relationship......

For me,is just the waiting time and the money involved in it,But i think is the best bet for you guys........Pls let other people advice you more on options to take ....Once again,am sorrry and i pray you guys find heart to move on and follow it up....In life ,delay is not denial and quiting is not an option.....Thats my theory....i hope this help you guys

Well like i said,You are very right maybe you never believe you could do it yourself ,maybe somehow you dont like paper works,Maybe you are too busy with work,or maybe the instruction is complicated.......Trust me ,First time user get discourage when they look at the USICS instructions online but the more you read it over and over again with VJ site,You understands it better and see it is easy and well explained.........But all the same,what you is one of the reason for sure but Trust me,what ever is said up there is based on statistics i get online and little experience i get from the people i personally knew that came to US thru family related visas
