The age old question is debated a lot on here. I am sure I did all the work and research on my case cause it was my life and future but I ended up using an attorney I found through our states list and asked some past clients reference. The reason I used a lawyer wasn't due to complicated case I am sure I could have done it on my own like I did anyway but to have the lawyer who has done this hundreds of times successfully for others do it immaculately and literally exactly how it needed to be was great piece of mind. It did slow me down a little at times but these times were stop check points during the process to take a breath and understand everything. I know there are horror stories I did not choose my attorney lightly I knew her record of success and it didn't cost me as much as I thought because I did most the leg work she just made it all come together and sunmitted a sweet packet and not front loaded. It really is a personal choice it's not necessary to have tons of billable hours choose someone carefully who will work with you on time and what they can offer. I was scared to death about filing due to getting married quickly on first visit and even though I knew relationship was real. I didn't know they knew hee hee

OP is elligible to work. As he is on CR-1 visa. You get I-551 stamp in your passport, which is the same as GC.

Technically eligible sure but what to put in application for social sec number "applied for " maybe? In theory the as card is automatically applied for but we had to take the passport stamp 551 to ss office to apply for card and number that way she was ready to go for employment

I have the most important advice is to use the guides and forums on visajourney.com do extensive research.
I have no idea what kind of attorneys you are talking to, maybe free advice is worth nothing. If you are paying attorneys a lot of money to process your case, they are just lazy?

I used this forum and site for every turn and the resources here are proven. My wife has her 10 year green card now as a direct result of this forum, from I-130 to the last possible step.

You say it's nerve racking to fill out forms and guess what to include?

Well you should take this as the most important form you ever fill out so you definitely want to directly respond to the RFE exactly!

I don't believe in kitchen sink front loading.(Just my opinion others have their own)

I don't know if there is too much. We did not front load our application, it was exactly enough to assure no RFE (well technically I did expect an RFE due to a missed signature on a form but I had actually sent a follow-up mail with the corrected signature before they contacted me). Our interview material was the overwhelming evidence including thousands of pages of communication, hundreds of pictures, and every kind of thing I could possibly acquire by comparing others here.

Take your time and don't freak out, it is a process that will lead to the rest of your life : :yes:

This comes up a lot here. Front loading your petition with a bunch of stuff they dont ask for I'd a personal decision. Not including the very minimum will get you in trouble. My experience was to submit the very very skimpy minimum required and have a buttload of evidence in my wife's hands at the interview. I found I sent a document requiring original signature but sent the wrong copy but realized it and sent a second envelope with just that original signed document and explanation. I got a technical rfe but since what they asked for was already with the petition it was ignored and I was approved on the very minimum. Do your homework on here there are too many posts to mention that will guide you and submit everything you can anticipate what an rfe would ask and track the second envelope and clearly write all the information to match it up with the first submission. Waiting and regretting and fearing what might happen is bad way to go This is sn aggressive process and you need to go after this without waiting what might be. Become educated and professional petitioner this is not a DMV renewal this is your life. Make it your expertise

I'm not sure the entire range of choices so I will give my experience and opinion. You are married and don't you think it would help your case to file married jointly? I am just seeing the Bonafide support. You can get the itin number and file even amended. Any foreign income for your spouse is exempt up to like 87,000$$.
Im not sure if it does indeed apply to you but I would certainly do it and I did do it. I did have trouble with the itin notirization requirements of foreign notaries but I did not get that rejection until months later so I submitted my joint return as documentation and ammended with a ss number later. But you might want to check with a professional tax preparer to gain the best choices for your situation

A lot of posts came and went while I forgot to post early on but I'll put a little perspective.
Me 13 years older than wife.
married on first visit 8 months after finding each other online.
did not make second visit until 9 months after marriage and this was due to wife needing operation.
made third vist 3 months later exclusively for Guz interview. spent days ahead of interview going over documents and drilling questions
First marriage for both of us so in theory less red flags but still all these add up to possibly questionable bonafide
We skyped phoned etc every day multi times a day all the time from first day of finding each other and we had tons of documentation and interview was very predictable. I was confident but still didn't feel like we could say 100%
Result was pink even with the less than perfect facts.
OP is so right to be there with her now and it Iis possible that this couple will get the unheard of second chance I really hope for the best for you. As I can attest sometimes what looks questionable on paper can be overcome with sincere proof of relationship and good practice

Hmm good question. I asked my wife what she wanted to do about name change, for me was not an issue. She said no she doesn't change her name, her mother did not and seems that it is normal to keep name. I said sounds good to me! I guess it is a big deal for some people just not that important to me. I love her and happy to be married that's all that matters!

you can file married filing separately whether your spouse will be filing a tax return or not. It is however better to file married jointly. i did this for 2007 with my filipina wife. i enclosed a W-7 form with birth certificate and marriage contract to have her get an ITIN. this is the suggested method for several reasons. It gives you one more document for the interview (ITIN), will also eliminate questions at the interview of why you filed separately from your spouse. The only real reason for filing married separately would be if you are concerned about getting a stimulus refund because filing joint would disqualify you for the rebate. If that's not a concern then joint filing is the recommended method.

OK I see how this does look good for the process, of course I want to file the best way. Jointly seems like the way, however I am struggling with figuring her income, her forms etc. I reviewed a lot of the IRS site, and various tax prep forums and they use so many Acronyms and Abbreviations and what not it it is very confusing.

Yes My head is spinning about this issue. I was married in 2008 so I have to claim married. But then I see someone says file married filing separately, but then she has to file a tax return for USA, she has never set foot in USA earned any money in USA and currently works in China exclusively. She does not have a Tax number, cannot get a social security number etc. So ultimately do I have to consult my immigration attorney or does someone here actually know hey I filed this way in 2007 and it was cool., or I am filing 2008 exactly this way?

I'm confused.. you mean you are expecting an RFE because you filed no proof that you were married? I only sent the marriage certificate and nothing else of "proof" I was approved.

I check the AVR every day. I did talk to an operator one time, she asked me when my approval came through I said Feb 18, and she was very curt and said sir it takes 2-4 weeks before it even arrives to us and can take 90 days to assign a case number. I replied I know that's what you say but yet I read online forums that all seem to get a case number within a week. She said FIRMLY Sir I am not showing any case number and you need to wait. I asked her if she had access to the same information as was available for the AVR and was I wasting my time calling multiple times a day. She said basically she had access to the only information available and it should be up to date and I need to just wait up to 90 days

Every communication I have also says wait 4 - 6 weeks. I have a third party agent so I'm not sure if I will get a courtesy communication but I have read the guides and shortcuts a million times I just don't get how to get around the fact that if you do anything before they ask for it you will cause delays, but then there are shortcuts and people getting through NVC in a few weeks. So is the answer to call and harass operators all day until someone says oh here's your IIN and have a nice day, I mean no operator has given me different information than wait 4 - 6 weeks, and the Auto system hasn't changed, what am I missing? My Wife lived at school part of the time when she was in University. But she came home every weekend, and during the week even some days, so the actual residence was home not the dorm she slept in sometimes. Of course it was same area that may be different.

Once case number assigned and know the NVC case number, beneficiary can send the DS-3032 by e-mail. Do not wait for mail from NVC regarding DS-3032.
NVC mail is good for AOS package has IIN, which allow you to pay AOS and IV bills.


They keep telling me 6-8 weeks to receive the bills generated. Is this really true? again I feel like I am missing something how does someone get through NVC complete 19 days, 30 days when they tell me wait 6-8 weeks just to have first bill generated?
I'm soooo confused

i meant either send the transcripts alone or the 1040 + W2s. dont send both transcripts and 1040 + W2s together. keep it plain and simple. sending more than requested will only cause confusion at NVC and draw possible RFE

Ok I called Automated System tonight because i was going to wait until the weekend to make sure it was not busy, and then there was a change from "we have no record of your case" to On March 5, 2009 your case was entered in our system and the case number is GUZxxxxxxxxxx
Wooo I know it is a little thing but I love the fact that it is entered. I am using a local only one person runs the whole office attorney who is telling me to be patient. The AVR indicated that "lawyer" would be receiving the paperwork in 6-8 weeks (boo).

I called NVC again because I wanted to ask a couple questions. First did I have to fill out any kind of DS-3032 if the lawyer already was listed as the contact person? answer was no I did not have to do that form it was already established, next I asked hey wasn't I supposed to get another number which is an invoice ID number? answer no that will be on what we mail you. I tried but no luck oh well! The lady on the phone was very pleasant and helpful, unlike my other experience with an operator. I was in a good mood after my call yes.gif

So I had my wife run around and get the documents had to wait in lines and pay fees and then we got forms filled out and signed and then she mailed them all to me so hopefully we are ready to go on her end.

I have not filled in any forms yet for me, I have been gathering documents, work stuff, I have all my old tax info, but since I am going to be filing married jointly taxes I am waiting for my wife's package to arrive with the signed W-7 form.

So I am ready to have this all together, and already have been asking my wife to do more homework for medical and interview (it's hard enough she has to give up her whole life in China as a teacher and leave her family and friends but NOW I am asking her to go and wait in more bureaucratic lines, pay fees, and get these documents poor thing)

I have been wondering as a personal note if a lawyer is necessary for most people, and since I am doing all this leg work is it worth it? Well again my lawyer is a woman who does everything herself, with personal attention, not some clerk , and I tell you what she does is pretty slick so I am glad to have piece of mind. I am paying her about what my annual pass to disney world and a trip costs so I can give up that for piece of mind and being able to enjoy Disney with my honey in the future (I told her she has to accept the fact that a 45 year old man is obsessed with Mickey mouse)

So to those who have sped through NVC congratulations and to those with me or behind me let's think positive and make sure you say I love you to your spouse and blow them a kiss! heart.gif

After reading many stories here about paying too soon, showing paid then not paid I am very paranoid. I got the email saying AOS and IV bills were generated I read it over and over and then called the operator and she was sooo nice and quite playful because I sounded like I was a blathering idiot I said I was so nervous I would screw this up like can I pay it can I really is it too soon I got the email but I just didn't believe I could pay it but when I put in the Invoice ID number it showed can be paid and I paid both one at a time then it said receipt and in process. Well I am calm for the moment. I have all the info together except final filling out of 864 and then meet with my lawyer, who i really need to be the calming factor in this process I look at my wife's eyes in the web cam and we talk matter of fact about mailing signatures back and details about the travel for interview etc and I am freaking out inside!
I have done so much research but still feel useless with short cuts and guides seems like you ultimately have to wait for them to process and accept and generate and all that jazz. I know of all the success stories here but I really don't want to take any chances I want my hunny here !!

Hello all,
For all whose case is complete, did you guys include copies of original documents (such as Marriage certificate, Birth Certificate, PCCs) in the package along with originals? A friend of mine went through this process last year and he had included copies of following:

1. Passport’s Biographic Data Page of the Beneficiary (so basically two copies in package)
2. Birth Certificate of the Beneficiary
3. Marriage Certificate of the Beneficiary and the Petitioner
4. Police Certificates of the Beneficiary

Well now I have thought about this and I must say I did not included extra copies of anything in my mailing. I gues sI mis-read this thinking it says make copies in case they are lost etc. So this includes copies of everything in the envelope, a photocopy (not origiginal not certified) of ds-230, biographic passport page, marriage cert, police cert, i-864, taxes package information all copies of every single page I sent them? And do you think I should send copies now separately in an envelope that will arrive a day later? HELP now I am so worried

Seems like a red flag in many ways. The most important thing is what kind of relationship do you have with your lawyer? You should be getting clear communication and timely information from the person you have working FOR you. I decided to use a lawyer even though I know the lawyer slows the process a lttle for me. My lawyer is slammed with H1b applications right now but still communicates advice and process. I also call NVC often and read forums and prepare the details with my wife. I am not sure what you want to do, but communication with the person you pay is first.

I was wondering if you can tell me at what point of your AOS process did you get the RFE, or if you could update your timeline in your signature to follow process.

I sent my package a week ago, just got the first NOA, but I am very nervous about the joint sponsor income. Also, like you, mine is self employed and not all the income shows in form 1040.
What has happened since you got your RFE, did you submit new documentation or not yet?

There has been a major slowdown at NVC so plan on about 30 days for them to receive your case from the service center. My approval was July 11th and they just received my case in their office on Aug 1st. Once they receive it you can plan on another 2-3 weeks for them to enter it into their system.

My wife asked me if NVC needs Apostilled documents... Birth, Divorce and Marriage...I know Police needs apostille.. I asked Georgian Consulate and they said not needed.. Someone from Georgia who lives in America, told my wife apostille is needed.. I know Georgia is part of the Hague Convention..I have all her documents translated and notarized..
I was trying to find on NVC website where it said if apostilled documents is needed or not..


Before I went to Georgia for our wedding I asked my lawyer if we needed to have them apostilled or not and he recommended that we do at least the wedding certificate just to avoid hassles. We spent an entire day in Tbilisi having all of our documents translated notarized and apostilled. It was quite expensive... I believe it was 100 Lari for each document at the apostille but we had them done on the spot instead of waiting a day. I would recommend that you have them done if possible!

To make a long story short I was approved today after my Congressional Liaison got involved.
I had RFE because of a passport photo. I helped a friend do his I-130 in January with the same type of photo
I shot from my camera. He was approved Monday. I voiced my displeasure and frustration to my
representitive and at 500pm I saw an email from USCIS............. Approved mine was 154 days.

My wifes Birthday is the 14th so this is a nice surprise....

Dont worry about it! People do that quite frequently. I knew my husband just short of two years via skype, facebook and phone. I went over in february and everything that I thought I felt for him was intensified in person! SO WE GOT MARRIED!!! Who wouldn't want to get married in such a beautiful place such as Georgia ;) We got married in Sighnaghi and let me tell you that NO place in the USA could produce such a georgeous background for our wedding pics! Ya simply cant help falling in love!!!

That being said, all you need to do is show them you are in love! Print out everything you can think of to show a consistent ongoing relationship and you should be fine. Georgia is not a high fraud country and as a nation are usually considered to be very honest, hard working, hospitable people! (I know my hubby is lol) I just dont foresee this to big a stumbling block. If anything maybe you can set a precedence in the consulate so mine will seem normal when it comes across their desk in a month or so.

LOL I know! I couldnt even imagine a Georgian asking someone that but just in case I told him the answer is PINK! I will bring a whole weeks worth of pink just to make sure lmao. Heck half the time I cant even remember what color I put on in the morning let alone him. Guess it is just to see that you woke up together, got ready together, and have the level of intimacy to know these things.

After our honeymoon my husband went home and researched through the lists of possible questions. He called me the other day and said he was sooo happy because he knew the answer to every single question! I was quite impressed. But after knowing each other for this long and as much as we talk I think we had it all pretty well covered already!

Oh and Brusik that is what I have noticed also. Seems everyone who goes there experiences a 10-15min interview and then an approval. One of my husbands friends used to work at the consulate and gave us quite a bit of info. He said that they do not process very many and that they very very rarely have any applicants who raise red flags. That being said if you do raise a flag for some reason you are probably doomed lol... but in general if what you have is real and you are doing it all by the book you will be just fine! He did say that during the interview they almost always ask the following questions...

What color underwear is your spouse wearing
Which side of the bed did you each sleep on last night
Where was the last place you two went together
Where did you have your last meal and what did you both eat

They want to know that you were together the night before! So remember the specifics of your last moments together before the interview!!! Other than that he said its smooth as a babys butt at the georgian consulate :thumbs:

Nah I know I wont have anything to worry about when it comes to the financials. I easily clear 80K per year which is a lot more than their guidelines. Plus I already have a job lined up for him here and he will be a full time student finishing up his Masters degree.

Nice to know it only took you a few weeks EAbbas. I really feel like we would be receiving an approval within a few weeks anyways as a bunch of April people have received their NOA2's. But the guy said it could be up to 3 more months so an expedite request would be my best bet. I couldnt believe they let me ask for one.. let alone grant it! I cant wait to have him in my arms for good! :dance: :dance: :dance:

Pallidin... I think you may have taken my financial hardship situation the wrong way. I have a great job here in the US and make way more than the required amount. But he is now unemployed in his home country. Basically it would help us financially if he were here faster as that way we would not be paying for two residences and all that goes along with that on just my income. The officer suggested for me to file for the expedite as he felt it to be a compelling reason. I didnt much expect to get an approval but hey I'm not gonna complain lol

Brusik... Thats AWESOME!!! Glad you have made it through the NVC process. I am going to use all of your posts as a guide since we are both dealing with the Georgian consulate. It would be so cool to be able to be all there together for our interviews!!! From what I hear they do not process very many there so I am really curious to see how fast they schedule your interview!
