I believe I made it quite clear that what I was saying was my own interpretation. I made no attempt to present that interpretation as solid fact. Hell, I even made a point to show the OP that I had, in fact, been disagreed with before. It was not advice I was offering but merely an opinion.

The consular officer at the embassy/consulate has the right to ask to see the originals of any documents submitted as copies in the original petition.

To me, this means that if the USC used their passport as proof of citizenship (instead of their birth certificate) or if you used passport stamps from the USC's passport as supporting evidence, then the foreign fiance ought to have it with them at the interview just in case.

However, others have disagreed with me on this in a previous thread saying it is unrealistic to expect the USC to send their passport to their foreign fiance. I suppose in the end it comes down to what you are comfortable with. Personally, I plan on having absolutely everything with me at my interview because I don't want to take any chances. Of course, my fiance is planning on attending the interview with me, so the issue of mailing the passport doesn't apply to us.

We checked OTHER and put K-1 Visa down. Which is what I have on the example form I got here at VJ. Have they changed recently or something? You are NOT applying for Naturalization at this time, so you definitely shouldn't be checking that box.

While all the information that the petitioner/beneficiary are required to fill in is the same on all four pages of the G-325A, they are not all identical. You'll notice the bottom of each form (parts not to be filled out by those applying) are different from page to page. I wouldn't expect USCIS to accept four copies of the first page only... has no one had problems because of this?

This would be letters similar to those submitted with the I-129F petition. You would just need to modify the date and re-sign them. There is a template in the example forms section here on VJ.

Until your fiance becomes a US Citizen (note, *citizen* and not just a green card holder) it is unlikely that he will be able to retain his permanent resident status even if you do wait to move to France until after the AOS process.

To put it simply, you must reside in the US to be a permanent resident.

Here is a link to where the requirements for maintaining status as a permanent resident are listed on USCIS's website.

Alternately, if you were to move before your fiance adjusted status, I imagine that would do away with any chance to do so and should you choose to return to the US to live, you may have to start the entire process all over again.

That said, there is absolutely nothing to prevent you from choosing to move to France. Like Kajikit said, there is nothing that states that a K-1 Visa holder has to stay in the US. You just need to be aware of how such a thing will affect your status in the US and take that into account when making the decision.

I used a couple small binder clips to hold plastic bags with the passport photos onto blank sheets of paper, as well as to section off each G-325A (this probably wasn't really necessary, but as we both had attachments for the form, it made me feel better to sort of clearly define it that way). I had everything two-hole punched at the top and held the entire petition together with an ACCO fastner. I also put tabs along the bottom to help locate specific parts of the petition (I-129F, G-235A Petitioner, G-325A Beneficiary, Supporting Evidence, etc.). And then it was just put in an envelope and shipped to NSC. It was actually very presentable on it's own, so we didn't bother with folders. Besides, a folder would add a whole extra second to the waiting time for approval :P

That's a new one to me, I've never even been asked Brian's name before, let alone to write it. It was always just "who are you visiting?" "My boyfriend" and then various things such as "how did you meet?" "where is he from?" etc. Strangest question I ever got was "Why do you have a boyfriend in the US?". Hehe. Brian's been asked some silly questions on his way up here to visit too, but it's never been anything that worried us.

Strange that they'd have you write the name down. I wonder what exactly they would have been looking for in the computer.

This is kind of straying from topic a bit, but something Jaylen Brit said has triggered my memory on an issue I'd been thinking about.

I've seen several people mention the correct way to answer the "business or pleasure" question. Now I know flying to the US from Canada there is a small card you have to fill out with some basic information and you can check a box for either "business" or "pleasure". You then present this card to the customs officer and they start in on their questions. Not once has the officer ever asked me "Is your trip for business or pleasure?" they have always asked me things along the lines of "Why are you visiting <insert city/place>?" This is, obviously, not a question that can be answered with just a generic "pleasure" line. In the past I've always just stated who I'm going to visit and possibly why (my friend for her wedding, my family, my boyfriend for his graduation, etc.).

So what I'm curious about is, how many of you are actually just asked the simple "business or pleasure" question?

The whole "speed things up by a month" thing is just dandy for those of us who were, based on Nebraska's timeline trends, due to be approved right around the time of the transfer.

I'm inclined to believe this has more to do with restructuring than anything else, though I really do wish it could have happened just a few weeks later.

I don't think the timeline statistics are worth much currently for us anyway considering the stand still at the service centres. Not to mention none of us have any idea if we're going to still be processed by our current NOA1s or if we're going back to the bottom of the pile.

Really, the timeline info is the least of our worries right now. I'm just holding off on making any changes of any sort until we know more about what's going on.

(I will, however, again point out the fact that those who apply at TSC and are transfered to CSC seem to always keep their info as TSC.)

I think it's probably best at this time for those of us former NSC-ers to keep our timelines as is... if not just for the sake of tracking who used to be there.

Anyway, I don't believe those who filed at TSC and then were automatically transfered to CSC changed their timeline info. We all filed with Nebraska, regardless of where we've been sent to now, so we may as well keep that info as is.

Naturally, this is everyone's own choice. Just my thoughts here.

Just got two e-mails from USCIS and came to check my case status. I've got a touch from CSC and the status has changed to show that they have recieved it.

"On June 14, 2006, your I129F PETITION FOR FIANCE(E) was received here for processing. We will mail you a decision as soon as processing is complete. You can use our processing dates to estimate when this case will be done. Follow the the link below for current processing dates"

Though I am curious if this is a sort of "new" NOA1... which would, from the looks of it, unfortunately mean we're all back at the bottom of the pile. :angry:

Let's hope California speeds up a bit at least.

Did we? Apologies if I jumped the gun on my statements above. I was out of the loop for a couple weeks there and only recently got caught up on everything I'd missed around here.

Like I said though, we all pretty much know anyway whats going on with the restructuring. It's a logical assumption. But what I don't understand is why a few cases got left behind. The pre-March 6th stuff makes sense because they were likely already in the middle of being adjudicated, but the few from after March 6th are a bit puzzling.

I hate to be a pessimist here, but I'm pretty sure all the touching recently is more likely to be due to the transfer than the issuing of any RFEs. Seems logical to think that it may take a little time (maybe a week or so?) to actually start sending out the RFEs. Yes, automation makes it a very fast thing, but someone's got to initiate that step first. And not one of us can say for sure what the government's definition of "immediately" is anyway, though I'm sure they really are going to get them out rather quickly.

As for the "fact" that Nebraska is no longer handling I-129Fs... this isn't yet a fact but really just a very logical assumption. As of right now, there are still people (from both before and after March 6th) who have NOT been transferred to CSC. Yes, we all know that USCIS is doing a lot of restructuring. And yes, in the end it's almost definitely going to end up that NSC will be specializing in another sort of petition. But with I-129Fs still sitting there we shouldn't really be saying that they don't handle them anymore.

With that said, I'm actually highly optimistic about everything in general right now. As several people have said in the other thread, all this movement in general is a good sign and is bound to make us all feel loads better.

When Brian called the customer service line after I moved (I'm the beneficiary), they asked him to submit the request via fax. We were touched all around the time the fax was sent, so we assume it worked. (note to self: bug Brian to call and confirm the change!)

Now, we have not recieved our NOA2 yet so our petition is still at the service centre level. If you're petition has been approved and is now at an embassy I think that you may be able to just contact the embassy to have the address changed.

On that note, it may be a good idea to add information to your timeline so in the future people can answer your questions more accurately. Also, all the statistics on this site are pulled from member's timelines. :)

I just got back from a trip to see Brian in Columbus last week. And all the worries I had beforehand were pretty much for nothing.

I had the easiest time ever going through customs. The officer simply asked "Why are you going to Columbus?"... I said "to visit my fiance"... then she looked at her computer screen, stamped my form, and told me to have a nice trip! I couldn't believe it really... I've had more questions visiting Brian before we were engaged or even just visiting family.

So if there is a period of unemployment for either the Citizen, or the spouse, or an overlap of employment for either the Citizen or a spouse, how do you handle that?

As per the G-325A form 'Applicants employment last five years (if NONE, so state)

One would put NONE 'UNEMPLOYED' within that timeframe just as one would if they were employed.
An overlap of employment dates in which respect?? A full time and a casual job??


Oh man, we are so going to confuse people with our display names :D

The overlap is pretty much just that. Specfically, one summer I worked full time as a housekeeper at a hotel while working weekends at an office supply store. Brian's currently working two jobs and has had similar situations in the past. Such is the life of former college students, really :D

While this won't answer the OP's question as to the need to notarize the affidavit I think there is some misunderstanding about the role of the notary. My ex wife was a notary for many years in 2 different states.

The notary’s role is to establish that person who signed on the document is the person who belongs to that signature. That is why it must be signed in the presence of the notary.
The notary has no bearing on the ‘sworn status’ or anything else about the document. According to the ex they aren’t even supposed to read the document, the contents are not their concern. Their sole purpose and sole legal role is to validate that the person signing is who they say they are.

You swear that the document is true by affixing your signature, it does not seem unreasonable that a notarized signature would be beneficial but I do not know.

If I ever get to this point I suspect I will have the affidavits notorized - it can't hurt.

I also think he has to be in Ukriane for 21 consecutive days before you can file for permisson to marry.

Unfortunate I have at this point only one boarding pass (my return flight from Simferopol to Kiev) and doubt I can find one from my stay there in 2009 - would copies of the e-ticket be almost as good? As to receipts for lodging I stayed mostly in apartments where i am sure the locals were evading local tax law so no receipts. How critical are these?

Anyway any and all information welcome!! I suspect that some is this is highly Ukraine specific so Moderators please move this if need!

2) Jenny is in the process of renewing her internal passport - she lost it. Once that is done she will apply for her external passport. Do you advise begging the filing process while she is getting her external passport or waiting until she has it. I am thinking it would cut 3 months out of the time line if I can go ahead and send in the I-129f while she is waiting for her external passport. But it also looks like Kiev can move fairly quickly once they get the paper work and Jenny has a daughter that will require they will have to get permission or court order. I would hate to have a long wait for her passport mess things up because I moved too fast.

Anyway any and all information welcome!! I suspect that some is this is highly Ukraine specific so Moderators please move this if need!

Today, I received a regular pay statement notification email from ADP that's been integrated with our HR. I logged into the portal and got shocked. The more I read the statement, the more I got freaked out.. completely, totally, entirely! The number is unexpectedly higher than usual, the marital status is changed from Single to Married(!!), my SSN is wrong, the DOB is wrong, the 'exemption/allowances' is changed from 0 to 5, only my name & address appear correct. What?? Seemed my original W4's been replaced with someone else's. Ran to HR! They admitted it's an error, 'most likely it's a system error' , but an 'administrative error'! Maybe.. They fixed it in the system in front of me and said that it'll be reflected in the next stub. They also contacted ADP, ADP will fix it with IRS - that's the last thing I care for now. Eventually, everything will be ok, except one thing.. - they're not able to re-generate the existing stub with correct information as it's already under payroll. They agreed to give me an official letter, stating the issue, but I don't know how this letter would work for the Consulate in Kiev. We're currently at the NVC->Consulate stage. How can he put this '#$# -Married' statement on the CO's table.. Should I ignore this stub & the letter, but wait for the next 'new' ones? How many recent pay stubs are required to be present? How do you see this problem? What would you suggest/recommend? Appreciate your feedback, even a single word.
