So I've been pouring over the forums and getting mixed results. Should my fiancé go ahead and start working on his list of stuff there like the police report and medical? Also, the I-134 should I start prepping it as well? He just left last Monday back to Australia and I didn't think to send it with him. I'd like to have a fast turnaround in him sending back in the packet 3 but it says in the forums that some places ask for other stuff for the I-134 like 3yrs tax reports.

We mailed ours in on 11/27 to TSC and it was received 12/2. They cashed the check on 12/6 but I've yet to receive an email or text about despite filling out the form. I'm hoping that means our NOA1 would be the same date the check was cashed then? That seems to be what most of the other members have down in regards to their check being cashed and NOA1 notifications.

Some hadn't gotten notification for their paperwork through the USCIS website/email/text so for the person who found out today maybe it saved them a few days on mail delivery. I don't know, seems worth a shot to see if something important like an RFE got lost and we didn't see an update.

     I have pictures, mexico phone cards, phone call and text records, plane tickets, receipt of money he sent, receipt from usps from sending a letter/small package to him, letter from him and myself of our relationship and history, letters from brother in law, 2 sisters, and my mother, I will print skype call records (Thank you for that suggestion Ryan H) will you think them being under my sisters name because he uses her skype will be an issue? He doesnt have a laptop, email or skype so he just uses hers.

 

     Other questions that have developed.

 

     I have currently not filed yet, Hubby and I are having a very hard time dealing with being separate, because of this we are thinking about me sending in package and then me moving back to mexico and living there the whole time it processes. I worry that if I do this I will have had no job this whole year. I feel like I will some how get in trouble for being there for such a long time period, and that we will face problems of no income/no assets.

 

     1. What would happen when it is time to file my affidavit of support?

     2. Would it be better to go there, get a fm3, live there for the time needed and then file DCF I-130 from there? Or would it still face similar fate? 

     3. Would they be understanding to the fact that I had no job due to being there with them, and be ok with that so long as I have co-sponser?

Ok also.. My sister, her husband, and my husband are all in Mexico right now, they wrote affidavits for me.. should I have them all notarized, they said they were having a hard time with it, or do you think as long as I get a few notarized here in the USA it should be fine? My sister and husband in Mexico are the only 2 in my family who actually know my husband, my family here in the USA do not, the ones from the USA would only be able to say they know we communicate regularly via skype, phone, letters, etc. Also should be included is our affidavits is pretty much our only thing to show we are actually together. I don't have anything else, we don't share bank acc, no proof that I stayed with him(my name wasn't on any bills/lease), I don't have him send me money, etc. we don't share a property. So I am having a hard time with the bonafide part as it is.

I came back to USA in Jan, filed I130 in Feb. I got a temporary job to help out while I was here, not listed on I130 due to me getting job after filing it. Now I plan to go back to Mexico to be with my husband while we wait for interview date. How do I file the I864? I know unemployed, because I will have no job while in Mexico. In the part where it says Unemployed since "date" do I include the temporary job or should I just let it be with what I filed on my I130? I'm worried that they will want me to refile the I130 and G325A because of the other job added.

 

My questions are:

 

Do I need to include the temporary job?

If I do how will that effect the processing?

Will I have to submit some sort of additional papers?

Would they deny for having that job?

I have a very similar story to you, we got married and was only married for about 1 month before I applied for the I130. We had nothing with both of our names on it. I sent pictures, phone cards, phone records, letters, receipt of money he sent(I had him send it just for extra evidence), letters from a few family members saying they knew we are in a real relationship, plane ticket and fmm form(proof I visited), and receipt of a package I sent him. This seemed to suffice and our I130 was approved in 96 days. Good luck to you!

My husband is in Mexico, he doesn't have any type of visa. I am the american citizen and yes I go back and forth with no problem so far. Just because you are in a pending situation they can not take away rights. If one officer shoots you down try again with another one. Normally it is just a matter of being nice and respectful to them and very important, HONEST. They are human too and most of them are not that bad. You just need to explain you miss your other half and you are just visiting.

We have waived the requirement of scheduling the applicant?s visa interview. Once the applicant has all the required documents and completes the medical examination at St. Luke's Extension Clinic, he may come to the Embassy's Immigrant Visa Check-in Counter (Window 38) Monday through Thursday (excluding Oct 1,  U.S. and Philippine holidays, and last business day of the month), between 7:30 a.m. and 10:30 a.m. for the visa interview.

 

Applicants are encouraged to register online at the St. Luke?s website (www.slec.ph) prior to their medical exam.

                       

St. Luke's Extension Clinic is located at 1177 J. Bocobo Street, Ermita, Manila.  The phone numbers are (632) 524-6082, (632) 521-0020, (632) 521-8647, and (632) 526-4327.

 

The applicant should compile all the required documents and complete the medical exam before the visa interview. Please note that the medical examination may take more than one day to complete.

 

 

I'm ready to book a flight this weekend. I'm just nervous that his medical would take longer. Any thoughts?

I tried calling the USCIS , NVC and the US embassy in manila they all advice me that I only have limited time left. I just sent the follow to joint papers to NVC via email. I think I only have a very slim chance here, (I even booked a flight already but this can be cancelled anyway) Will see what the NVC says within Friday if no response yet then I would just cancel the follow to joint and proceed no the I-130 and will let my husband US citizen file for him so this can be process quick. Thanks for all your help I appreciate it a lot. I'll let you know what happened. This is so stressful I haven't eat and just slept for a few hrs bec.of this. Im sure it will be worth it. I got here as a k1 visa and I included him but we didn't have enough time to get him so I only have 1 month to get him which is not possible if we will apply follow to joint or k2. Thanks for the advice. My husband will file for him instead and hoping that we can get him soon but we will be patiently waiting and praying for a smooth process. I will keep you guys updated.

Praying that your son can join you as soon as possible. That is a good idea that your husband will file for his petition as he is his step son now and no need to wait for visa number. By the way, your green card must not be conditional (2-years) it must be 10 years to do F2A

 

Did you mention your kid on your previous immigration processes?

 

I am conditional green card holder and I already filed for my 2 son's petition after I got my conditional green card. Now they are waiting for PD to be in line. It does not matter even you are conditional green card holder. The USCIS allows petition for LPR and CGC.

Update to help others with same question: I had already applied for PCC online 15 days back and today was my appointment. Logically i just had to take my marriage certificate along with my passport and that was it, my logic worked.

No, That's not NEW. NEW means recently issued Passports which has been done with Police Verification.  Anyhow, as you/your wife doesn't have spouse name on Passport, you will have to apply for NEW one (at least in my case it was the case)
 

Why do they need Husband name on her Passport since she can keep her original name with her last name?

 

I have NO IDEA buddy,  I know, to whomsoever I told this process, everyone has shouted at me the same thing.  WHY DO THEY NEED SPOUSE NAME ON THE PASSPORT? I asked the Passport Guy, and he told me that on your PCC application you're married (status) but on your Passport you're not wink.png which is conflicting!!

 

I don't think there is a law to change name after marriage. I apply for her visa with her original name and last name and seems like everything went fine for her so far...

 

It's not about changing spouse name, it's about ADDING spouse name.

 

 

My passport too doesn't have my spouse's  name. How long did it take to reissue the passport?

My PCC appointment is just 2 weeks prior to my interview at the consulate... :(
