Jersey Girl, you're a gem. And thanks for your own take on things, CutienPurg.

I'm inclined not to risk it and just wait until the next trip is over. I would gladly change the plan and go to the UK, except that it's a prepaid vacation package with no chance of refund. We'd be losing about $3,500 if we cancel. I'm somebody who has to have something solid to project ahead to, so at least if I tell myself I'll be in the UK for Christmas I won't feel as bad for having to wait to submit the I-130.

My husband probably wouldn't be able to bring enough documentation with him to "prove" he isn't abandoning the UK when he visits. He lives with his parents right now because his father had a heart attack recently and his mom couldn't care for him alone. His dad is better now, but once we met he continued living with them to save money for our own plans. That lack of a mortgage or lease (and utility contracts) would make his chances of getting in very dicey. We want this process to go as well as it can, and to be turned back at a POE would be beyond traumatic, especially since this trip is basically our honeymoon (he had to return to the UK two days after our wedding).

So it looks like I'll be mostly just lurking here for a while. I'll have nothing new to report, so I won't waste everybody's time with my personal chatter! :thumbs:

Well, it has in fact hit home that my husband and I will simply have to wait to file the I-130 until after he leaves here from his next visit. Oh, man. I know this feeling is probably old news to you guys, but if you can remember what it felt like when you first found out then please accept my apologies for thrashing against it in my last couple of posts. Well, I suppose it gives me that much more time to beef up my savings and get some bills paid down. *Think positive, Jen, think positive*

(Another sobering thought is that) Yahoo Personals is apparently considered a Marriage Broker?! Ha! hey, if I met him during a free 7-day trial, does that still count? :P

I keep telling myself that in a few weeks/months I will be as calm and matter-of-fact as the majority of you here. It sure is hard to imagine that now. At least in the end we'll be approved, right? I mean, provided we have no criminal backgrounds, no serious illnesses, can show we are productive members of society and have the resources to support ourselves ... . Please tell me I'm right about this, at least. I really don't want to move to England (beautiful country, but such high COL and such limited opportunities).

Oh, and JG, congratulations on your approval. That's really wonderful. Gives me hope!

I just read on another thread that it is apparently a bit risky for the immigrant to visit the US spouse while the K3 is in process. We are about to send in our I-130, and this worries me because my husband already bought a rather expensive plane ticket to visit me this autumn. When he came last month for the wedding (a regular tourist visit), he was barely even spoken to at the POE ... how would they ever know if he had a visa in-process or not?

If the ticket he holds is a round-trip fare, is that not good enough "proof" that he intends to return to England ... or at least as good as anything else he could carry with him?

Is this "can he visit?" thing a question that the USCIS call center could address conclusively? I'm surprised that I have been unable to find anything "official" about this topic on a government website, because I'm sure it's a common question. :(

read the instructions for both the I-130 and the I-129F for K3 petioners/applicants. There is No need to send "proof of relationship" with the petition packages. The only "proof of relationship" needed for the petition for a spouse visa is the marriage certificate. Any other proof is only required at the beneficiary's interview much later. Don't confuse the instructions for the fiance visa with the spouse visa.

At the interview they may ask for photographs, passport stamps, travel receipts, etc etc etc...find out from others who have interviewed at the same consulate what they needed and were asked for at their interviews.

Meeting on the internet is no longer a "red flag" to most adjudicators. It happens more often than not these days. However, if either you or your spouse have never met each other's families, this could be a red flag. If you've only met each other once or twice before you got married, this could be a red flag, but not always, it depends on the culture.



A-ha! This is very helpful stuff. Okay, so we don't need "proof of relationship" until the interview. Great! We have at least two visits before then, and on one of them I will be staying first with his parents, and then with his brother and sister-in-law. So that's more mingle/photo time with his family, and we've got lots of wedding photos to show we were married at my parents' house in the presence of my family. There's been lots of correspondence between each of us and the other's family as well. No sweat.

And thank God I just compulsively keep receipts ... .

Kind member Morocco4ever just mentioned in another thread that there are certain "red flags" that might complicate the process, including meeting the SO on the internet or if "sponsor knows family of applicant".

Hmmm. Well, I did meet my husband on the internet. But to help prove it's the real deal, we have letters from both families detailing our meeting(s), photos of us with each other's families, and proof that we got married in my parents' home. We also have correspondence between he and my mother, and me and his mother and sister-in-law.

And jeez ... "sponsor knows family of applicant" ? I would hope they would want me to know his family if I legitimately married the guy! ;)

Are you better off if you include more information/documents than they need, or does it bog down your file and slow the processing? I would be more likely to give them too much information than not enough, but I am curious to know when that works for me and when it works against.

I saw in another recent thread where Aussiewench made a brief distinction between writing "N/A" or "None" to fill in a blank on a form. On my husband's G-325A forms, he didn't distinguish between the two.

1. Does this distinction necessarily cause a problem/delay?

2. If I correct the form (dry correction tape and a re-write), will they accept it?

Has anybody else here used correction tape/fluid on a form that went through okay? I would hate to have to send it back to England and wait for him to fix it. We are otherwise ready to file this coming week.

From your timeline, it looks like you were married in the US.

It sounds like the "long form" you're describing is a certified copy with an apostille certificate added.

I don't know what the "short form" you're describing is. It might be an ordinary certified copy of the marriage certificate, or it might be a ceremonial copy that has no legal standing.




Thanks, Lucyrich. We did marry in the US, and yes, you've described the long form accurately. The short form is certified/has a raised seal - I went back to NYC from South Carolina last week (where the license was issued) specifically to get additional certified copies and to walk a long form through the system (which by mail would've taken 8-12 weeks!) so there would be no doubt we'd have everything we need and then some. A little excessive, perhaps, but I'm sure I'll save us a heart attack somewhere along the way by being so obsessive-compulsive! Of course, the thing that's gonna reach up and bite us is probably the one thing I haven't prepared for ... .

I also ordered a couple of additional certified copies of my long-form birth certificate, in case somebody wants originals. Beware, native Pennsylvanians, the copy they send when you order online is a bizarrely uninformative short form that doesn't even mention parentage, even if you note that it is for immigrations use. I had to phone them and blow another $17 to get what I need.

I have both a short form and long form (international use) of our marriage certificate. For the I-130 and I-129F, which should I use? The long form has an additional certification page from the State Department stapled to it, as well as two other additions (a stamp with another stapled piece over it) on the back. Copying all of the stuff on the long form would be quite involved. I assume we'll want the long form for the eventual interview(s), but should we be using the long form all along? There's so much to it, it might be confusing/cumbersome for the folks at the Service Center. Opinions?

Still waiting for some of my husband's documentation to come before I can send off the I-130. *taptaptaptaptaptaptap* I can't wait to get this thing in the mail! :clock:

We are filing an I-129F once we get our NOA1 from the I-130, and we plan to let both processes run to completion. He will enter the US on the K-3 so we can be together (provided it does indeed come through first!), and then go back for the CR-1 interview to avoid the pains associated with the AOS process. My questions above are meant to help us make some decisions for the future, such as whether I will accompany him for the CR-1 interview. We have to get a rough budget together for the year that lies ahead, both for time off my job and for $$ needed, since we are arranging for me to fly to the UK every two months until he can join me here in the States. Alas, big bucks take big planning!

So anyway, my original questions stand. Sorry I didn't give enough information.

If my husband opts to come into the US with a K-3 and go back to the UK for the CR-1 interview, how long does he need to plan to be in the UK for that? Is it as simple as going for one interview and coming home, or will he have to wait there for days or more? Since he will be living with me in the States already, can he have his medical exam for the CR-1 interview here in South Carolina?

Also, the I-129F gets sent to the Chicago Lockbox. The example cover letter directs me to include the address of my service center. Does this refer to the Chicago location, or to the "home" Service center used to process the I-130?

I only ask because I figured if everybody sends the form to the same place (Chicago), the example form might have had the address already filled in. Thanks.

From the posts in the IMBRA forum it seems that some are doing nothing in regards to those questions if they dont apply and others have added an attachment. Both ways seem to have gotten approvals. I imagine once a new form comes out (remember this I-129F was an emergency one) that they may perhaps then realise and have both 'yes' & 'no' checked boxes.



Thanks for that last bit of clarification. I'll remember to keep an eye on a couple more forums than I do now, since it does seem that information can be hiding almost anywhere here on VJ!

The approach that one should take is to make review of the form as easy as possible - don't invite the reviewer to ask 'why is this not applicable?' and don't write a paragraph when 2-4 words will do.

Regarding the Part C questions, I did insert N/A in question 1, and attached a separate sheet for questions 2 and 3 stating that the questions appeared to require a yes or no answer, so I indicated that both questions were N/A in my case, or as phrased the answer is NO for both. I didn't want to leave this blank. We'll see what happens.

That's a great idea, Michael. It really is unfair that questions that serious would not have a checkbox to indicate "none of the above". I think I'll attach a note as well. Did you write something on the I-129F itself to refer the adjudicator to the attached page, or did you just attach it, assuming they'd see it?

Aussiewench, Yodrak, Simple Male, other veterans, do you think this is a good solution ... or at least preferable to writing "None" directly on the form?

Though the response "never lived together" may be ok I would tend to lean toward N/A, after all thats what the instuctions tell you answer if a question doesn't apply. and i've never heard of anyone getting an RFE from responding N/A to this question.

On anther topic, I see on the back page of the I-129F that there are two questions with checkboxes (#2 and #3) about prior convictions. If they don't apply, do I leave the whole area blank? There is no space provided to write or check "None", but after all I've read about not leaving blanks, it seems risky not to acknowledge that whole section in some way. Should I write something (simple) beside the questions?

I got my husband's G-325A's and all of his documents/photos today, but he left a gap in his employment history so he has to send another set of forms. *sigh* It will be such a relief the day I finally get to mail this @#$% I-130. It seems like it's taking forever just to get this whole thing started! :dead:

I bank with a credit union. Maybe that's the problem. But even if they just wanted two pieces of ID, he can't appear in person to provide it since he really can't visit me here until the visa is in hand. I'd really feel better having his name on some stuff, but it seems like a very tall order. Kinda sucks. :mellow:





Go to the credit union and ask to speak with one of their customer service people, not a teller. It wasn't until I sat in an office with someone that I got the right information.

We followed the same process Yodrak did. They added my husband without a problem, issued him a Master/Debit card for the regular accounts and a pin to access my line of credit.

Make sure that he is active and visible on the account before he gets here and he may be eligible to get a small personal loan upon arrival, to help him establish credit. In my case, my credit union even said that based on my account history, they'd be willing to give him an auto loan at the same low rate I qualify for. Good luck!

Based on the above excerpt I took from your post, I think I read your question(s) differently from the other respondents. Are you asking if you can enter the US with a K-3 and then do the interview for the I-130 process here instead of Indonesia?

Hi, everybody. I finally sent our I-130 today, and I feel really great. It's not anything close to getting an approval, or even an NOA-1, but I'm still thrilled because now the clock finally starts ticking for my husband and I.

Thank you to everybody who answered my zillions of picky, paranoid little questions. I got a lot of excellent advice, and am very confident that our packet will sail through as smoothly as can be due to your kind assistance.

To celebrate, I changed my avatar and screen name (there were a lot of "Jen's" here before me, and I don't want to be confusing).

Now I can finally sit and wait for REAL! (any joy associated with that will get old FAST, I'm sure)

I have a homemade script I follow when calling I have it about memorized but my average hold times are anywhere from 30minutes to an hour.

This is just my process for checking my status since I am unable to get my status using my MSC receipt number through the automated system and online access.

Hi, everyone. Congratulations to those who have been surprised by fast I-129F approvals lately. It's energizing to see so many people moving forward!

I have a question about e-mail notifications. I have seen posts where VJers say they have recieved e-mails about their cases. I didn't see a place on the I-130 form where I could write in my e-mail address, though I did on the I-129F. So for the K-3, there are apparently some things that I will in fact be informed of via e-mail.

1. What exactly will those things be, and who will they be from?

2. Are e-mails always followed up by paper notices, or will there be some things that will only be communicated electronically?

Thanks to those who answered. I have already sent in my form, per my timeline on my post. I was just curious if there was a "busy season" for applications. The graphs here show how long apps are taking to process, but that doesn't necessarily indicate when they were actually sent in. I just thought some of the long-time members might have noticed a pattern.

I do know to be glad that we started this whole business after the new I-129F form came out. My prayers are with those still waiting.

Hi, Kim.

Look up at the blue area on the top of this page, and find "Processing Times" and "Immigration Timelines". Also see the blue tab above these that reads "Guides". You will find a lot of helpful information here, and you can ask additional questions once you have absorbed this basic material.

I can tell you that if you started your process in September this year, your husband will not be with you by January 1st. The first stage of the process alone will likely take you at least 90 days (though we have seen some make it through in about 60 lately), and there's a few months' wait after that to get through the next phase before the visa interview.

Sorry to break the bad news, but meanwhile you can learn everything you can about the process here and make yourself better prepared to navigate the journey to come.

I checked my e-mail today and found the same five e-mails about the Lockbox to CSC/VSC transfer that some of us are reporting. I had checked my online status around noon and saw no change, then checked again after I saw those e-mails (around 5pm) and saw a touch on my I-129F, which I predicted I would probably see. But now, just before 10pm, I was playing around with the new USCIS site and checked my case status again. Now there's a touch on my I-130, too! :thumbs:

In my wildest dreams CSC is efficiently cross-referencing the I-129's to the I-130's, because since they have them both at the same location they see how silly it is to be plodding along with two petitions for the same couple when they can concentrate on just one. But if so, I wonder which one they would choose to accelerate: the prized CR-1, or the K-3 that was supposedly designed to move faster?

Please, CSC, if this is what you're up to then forget that whole K-3 business and push the I-130! :dance: :dance: :dance:

I just wanted to vent this and see what others may have to say. In short - I'm really pissed about our I-129F/K-3.

The K-3 was designed to reunite couples sooner than the more involved CR-1 process would allow, so a lot of us who would naturally prefer the immigrant visa option go ahead and send in our $170 more as a safeguard than a preference.

In our case, our I-130 and I-129F forms apparently met up in California (see my signature) and the I-130 was pushed ahead, while over 30 days later as our CR-1 is rolling along nicely, the I-129F is still sitting untouched at USCIS. Money completely wasted.

It seems to be a full-on racket on the part of USCIS, to squeeze an extra $170 from nearly everybody who applies for a CR-1. If the K-3 isn't fulfilling it's intended purpose, fix the problem or eliminate the visa!

Your I-130 application via Texas Service Center is now automatically forwarded to the CSC. You have to refer to the CSC chart to find out what is going on, however it is not even worth reading because it is truly not accurate anymore.



Hi, Brady/Vicky. Your post showed up while I was writing. When did you find out that your case got moved to CSC? Should new TSC applicants update our profiles to state that our service center is California instead of Texas once we have confirmation that this is what happened?

I hope this is no big deal, and I hope that by mentioning it now I won't freak anybody out unnecessarily, AND I hope I'm not repeating something that somebody else already posted, but I just checked the processing times page for TSC:

...and saw that form I-130 is nowhere to be seen. I checked the other three centers, and saw that Nebraska also has no information for I-130's. What does this mean, exactly? Since I haven't got an NOA-1 yet (too soon), I am of course a little bit concerned. :unsure:

Thanks for the heads up on that. I don't usually check that page! I sent my stuff to TSC only about a week before you did, so it looks like we're in the same boat. It's true, we probably got shifted to CSC, but I'm not going to "freak out" just yet. I try to think of it this way ... if they sent forms elsewhere because our service center was too bogged down, then I'm glad they're trying to stay on top of it. I've noticed several instances here of cases being shifted around, and judging from people's time lines it doesn't always necessarily equal a big delay. I'll keep my fingers crossed with you until our NOA-1's surface!

You are right, I did not answer your question, but rather just commented how the self generated DS 230 would look, if you use color printer Vs black and white printer. The DS 230 forms sent by NVC does not have yellow highlighted area. They are just blank/white/gray. When I did our DS 230 forms, I used a black and white printer to print them out.

On the form DS-230 there are some fields that are highlighted in yellow. Since we're not supposed to make it obvious that we are self-generating, can anyone tell me if the forms the NVC sends have the yellow highlighted fields, or are they just black/white/gray?

I'm pretty sure Aussiewench is saying that the DS-2001 form no longer needs to be completed at all.

I'm a little wary of the forms on the Embassy site. The version of the DS-230 they link to is formatted a little differently than the one on the State Dept pages, and has an expiration date of May 2004. The DS-230 on the State Dept site expires July 2007. Unless someone tells me otherwise, I'm going to go with the form on the State Dept site.
