Congratulations on the fast approval of your petition! I can't answer the question about your fiancee's daughter, but I can tell you what to expect next.

It will take Juarez a week or longer to get the letter in the mail. You should get one at your address in the States, and she'll get one also. I would be curious to see how long it takes. We called the consulate the middle of May because we had not received anything from them a month after getting the letter from NVC. I got my letter on May 19, post-marked in El Paso on May 17. She received hers a week later in GDL, postmarked the same. But, the letter was dated April 27. We're not sure what happened during all that time.

At any rate, for the K-1, you will not get a fixed interview date. Your letter will say that you have an open appointment to come any day (except weekends, holidays and the last Friday of the month - administrative day the consulate closes every month), between 8 and 10 in the morning. If you click the link on the left of that page called Steps to Obtaining a K Visa, you can walk through that stuff, but ignore most of the information in step 5. It's wrong. Really wrong. The only thing of value on that page is the instruction to not open the sealed visa packet.

I don't want to marry this guy. I can't trust him. I think he is using me. I already sent in all of the K-1 Visa package. I'm not sure, but I don't think it was approved yet. What if he is using me? We have been through hell lately. Manipulation and deceitfulness are included. He has been using vulnerable women in various countries to go and visit. I think he may have a mental problem. Can I cancel the K-1 Visa if it isn't approved yet?

I am not sure , but we spent $455.00 for the K-1 and want to cancel it so we can go the K-3 route and just get married here in the U.S., so we can be together. How do we stop the K-1 review? They have taken 3 months already and we want to be together as soon as we can. We love each other and this time is killing us here! Can we just cancel and get married. How do we cancel the K-1 ?

I was just curious - what's in the package that a K1 holder turns in at the point of entry? Obviously, everything you submitted - USCIS forms, evidence, medical. But what else? Is there something like a letter of recommendation that would be used to determine if you get on AOS interview or not? "Watch out for this couple. I had a sneaky suspicion, but couldn't trip them up at the K1 interview." Or does it contain only everything you saw/submitted, but has the appropriate For Consulate Use check boxes filled in?

It doesn't seem like there is a lot of time for the CO to write commentary, because I know that some consulates must give you the visa the same day.

Anybody know?

Hi and Congratulations. You should have received two I-797s Notice of Action by now. The first one was acknowledging receipt of your I-129F petition by USCIS. The second I-797 Notice of Action is normally a much longer letter that says your I-129F petition has been approved. (You need to keep this - you will need it later for the Adjustment of Status.) The I-797 form looks very official with currency-like scroll lines on it, and a Statue of Liberty hand holding a torch as a watermark. These are infamously referred to by posters on Visa Journey as NOA1 and NOA2 respectively. If you call them that when talking to an immigration official, they probably will tell you they don't know what you are talking about - I saw that on the forums yesterday.

The next document you normally would receive does come from the NVC, and is on a regular sheet of printer paper. It should have your initial INS Receipt number that appears on both I-797 documents. And it will have a Case Number beginning with CDJ2010xxxxxx. This sounds like the letter you are describing.

It's just a single page letter. Read that thread. It should clear up a few of your questions.

Let me address a couple more of your concerns here. The packet 3 letter will be sent to both the USC and the beneficiary. Read the thread, especially where I mention the end game. All the instructions are there. NOTHING gets sent to the consulate. You'll need to send the I-134 and copies of supporting financial documentation to your fiancee so he can take to the interview.

You should also read my (Michael) review of the CDJ consulate in the Embassy Review section.

When you get a chance, you should update your timeline and profile here. It would be easier for folks to help you. Feel free to send me a private message. I'll be happy to help. There are others here that are just ahead of you by days or a couple of weeks. You should be on the lookout for their comments too. Congratulations again. Slow down. Breathe. You have a lot of stuff to do. Read all the instructions. Be methodical. Double and triple check. Then if you still have questions, you know where to come for help. If your 129F petition was already approved, just keep up the same diligence and attitude you had when you prepared for that. I would guess that you'll hear from the CDJ within 6 weeks. If you and your fiance have everything ready by the time you hear from them, he/you could theoretically go to the consulate the very next day. I day for the medical, the next day for the interview, next day (or two) to get the visa from DHL and it's done! You'll be fine and finished before you know it!!!

Although I wasn't asked that question, I did have an answer - I had been asked that by friends already. I basically said that "it is hard enough being apart while we are engaged - but it would be horrible to have to live apart after we are married! If we got married here (in my country) I couldn't go and live with him as his wife until after the spousal paperwork was done, and that isn't the way we want to start our married life together - separated. We want to be able to stay together once we are married so that means a fiancee visa and getting married in the States."

Hi. For CDJ, packet 3 is nothing more than a letter from them saying they have your file and that you have an open invitation to appear anytime except when they are closed - they list the dates. That letter is sent to the Mexican fiance(e) and the petitioner. I got the letter here in the states before she got hers in Mexico. You need go to their website...

Welcome. :) Your letter of intent is just that. The declaration of intending to marry your fiance/e. Question 18 can be answered in the box or with attachment. You don't need both. If you wrote out an attachment, simply put 'See attachment'. You also don't need to write out an essay of your life story together. They want to know the circumstances of your meeting. You can list all the times you met in person. I did this for the reason being that your evidence is supporting your statement. My evidence covers more than one in person meeting so I made mention of that.


I see. I was asking because we've been dating long-distance dating for over three years and in that time have visited many times in many different countries and have even lived together for one year, so writing it all out with dates and locations is intimidating...

First real post!

So I'm in the middle of gathering everything for the I-129F packet. I'm writing up a letter of intent based on an example from VJ, and I figured I would just personalize mine, copy it, change the info for my fiancee, and have her sign it. However, I've read around that they also like you to put your "how you met" story (Question 18 on the I-129F) in this letter as well. I've already typed out a separate page answering question 18 that I was going to attach to the packet. I also filled in the little box on question 18. This seems a bit much to write out our story three times, so what's the deal? Should I leave question 18's box blank on the form and just write "see attachment" or something?

Also, when they say how you met in the past two years, do they mean just your initial meeting, or do they expect you to describe every time you have seen each other?

Is it cool to post my Question 18 draft here for you guys to check? I'm not sure of the etiquette here...

1. On the G325A it asks for addresses outside of the US "for more than one year". I lived in Spain for about ten months, so I'm guessing I should list this as a residence in the five year history, but in the box where it specifically asks for addresses outside of the US I'll just put "None"?

2. While living in Spain for ten months I was teaching English through a government program in a public school. The visa I obtained to do this was a student visa, not a work visa. The pay I was given every month was officially one "grant" (no income taxes) divided into monthly installments, and the position was considered a "continuation of my studies" although I had already graduated college. This, I imagine, was the Spanish government's little loophole to get people into the country to teach more easily without having to deal with a tricky work visa. My question is: considering the questionable nature of whether this was really a "job" or not, should it be listed in my work history? Or should I put "unemployed" for that period of time? It was the Auxiliares de Conversación / Spanish Cultural Assistants program.

3. I have many gaps in my living history, albeit all of them are less than six months. So on the form I should on put the addresses I lived at, and attach a separate sheet to explain the gaps, right?

4. Is there an easy way to background check myself to see where I've worked in the past five years? There are a lot of places and I don't remember the dates...

I did this because I worked a few jobs about five years ago and I can't remember during which months I worked. Anyone have any experience with how long this takes?

Hey all, I didn't get any responses last time so let's try this again.

I taught English in Spain for about nine months in 2010. It was through a federal program where they give you a STUDENT visa to come teach rather than a work visa. Your "pay" is actually one government grant that is dispersed in monthly increments. Seeing as there are no taxes paid on this money, it doesn't really count as a job, right? Should I list this in my job history?

Also, as far as listing foreign addresses go, how much do you translate? For "rue" and "calle" do I just put "street"? The name of the school I worked at is prefaced with "Instituto de Educacion Secundaria", do I translate that to "Secondary Education Institute" or leave it? The little things...

My question is: Are they really looking for this much evidence in the I-129F, or should we save all of this for her interview?

I know they want evidence of having met in the past two years, so we could mail in a few tickets and pictures from this summer, but what about the rest of this mountain of evidence? I could just make copies of everything, send that in with the I-129F, and mail the originals back to her to use in the interview. What's the consensus on this?

The K-1 visa has a validity of six months, meaning once she receives it after the interview, she has to use it within six months.......but.....many folks have needed to have that six month window extended, for all sorts of reasons and have emailed the Embassy and have been granted the extension....I never have read of an Embassy not granting the extension. You can not delay the petition process short of withdrawing it completely and then needing to do it all over from the beginning including the payment.


Is there a formal process for this extension? A normal path to be taken? Or do I just email them? And would it be wise to alert them of the situation now, or should I wait until the k1 visa is in her hands?

My fiancees I-129f was sent in September 2012, is currently under initial review and is expected to be approved around March if it follows the typical timelines. However we have just hit a hiccup...

Her father has just been diagnosed with cancer. It's not clear yet whether it has metastasized, but it's not looking too good. He might be set up for chemotherapy and surgery around the same time that my fiancee is supposed to go through the embassy interview and fly over here...which obviously she doesn't want to do if her father is dying. I'm currently losing my mind at the thought of having waited four years and having to wait until the very end of this K1 process to determine whether we are going to have to start it AGAIN.

We just need a bit more time to determine how bad the cancer is. To get more tests and chemo and surgery, in order to see if he can beat it or how long he has to live. If the cancer is not advanced and he is ok, she will consider moving here with me. But obviously if the prognosis is bad then we will have to wait...

Is there protocol for deferment of applications once they have been started? Or is my only option to start over? I'm not sure we can make it another year apart, and I don't want her to lose her father and myself at the same time. What are my options?

Fiji is out. Call the NVC and see if you can intcept the case while it is there and have them redirect it to Paris. Email the Paris US Embassy and ask them what to do. They will have to give one local address where the interview forms can be sent. Worst case is they send it to Fiji and you email them and have them redirect it to Paris. Complicated but I'm sure this kind of stuff happens and there is a process for it.


So does the I-824 form have anything to do with this situation?

I called NVC and they said they won't even have the approved petition for another three weeks and as such they can't do anything or give me information =(

I posted a thread about this earlier, but I'm seeking further advice. I am the USC filing for my Tahitian fiancee through VSC. I just received my NOA2 moments ago (excited!). Here's the problem...

About two months ago my fiancees father was diagnosed with cancer in Tahiti. They immediately scheduled surgery in Paris (where they lived for a while years ago, so they trust the doctors more in the big city), and he is now undergoing chemotherapy and expects to be there for many more months recovering. My fiancee has gone with him to Paris and plans to stay until he has recuperated.

This obviously affects the visa process, as she isn't going to leave her fathers side until she is sure that he's okay. As there is no US Embassy in Tahiti we listed the Embassy in Fiji on the I-129F as the closest one at the time, which is now of course a hemisphere away while she sits in Paris.

Now that we have received the NOA2, is there anything we can do to change our selected Embassy to the one in Paris instead of Fiji? I read about the form I-824, is that what we need? If so, I'm assuming that should be filed ASAP? A $400 filing fee is steep but it's better than a $2000+ plane ticket to the Pacific just for an interview...

They no longer have an address in Paris, they are staying with various friends over the months, which might complicate things. Who should I call for help in this situation? The Fiji embassy, the Paris embassy? DHS wasn't much help...

My fiancee, the beneficiary, has temporarily relocated to another country (from French Polynesia to France) just before the NOA2 was received. We believe that we may have succeeded in getting the embassy changed to the one in Paris as she will be in France for several more months, but now that I'm filling out the I-134 should I list her address as the temporary one in Paris or her home in French Polynesia? And for all future address questions until she has her visa?

We've received NOA2 and I have everything assembled to send to my fiancee as per the VJ guide. I'm using my father as a co-sponsor and had him fill out a I-134. I have several paychecks, a letter from my boss and some tax stuff for my evidence, but are these same sorts of things required from the co-sponsor? He is a business owner and won't have any paychecks (and he is the "boss"), what will they want to see from him? Also do they want any proof that he is a USC or anything else?

So I'm slightly confused and I can't find this step among the guides.

 

My fiancee just arrived yesterday in the states (woo!).  At her interview in France she was given a sealed envelope (which I suppose was filled with our i-129 stuff?).  Upon entering immigration at LAX the officer took this packet, hurriedly told her that to get it back she would have to get married and bring a copy of the marriage certificate to a USCIS office in South Carolina where we live, which would then be mailed back to LAX and they would release this packet to us again.  

 

She didn't fully understand and asked him to explain, and apparently the guy hates his job and didn't feel like explaining anything to her and rapidly repeated what he said before (her English isn't perfect).

 

Is this a normal step in the AOS process?  Sorry for the newbie question...

It would be nearly illegible given the small box.

Attach a separate sheet put # of the question and on the form say see attached sheet. I had long address and my husbands work name. It was a full extra sheet.

I enter states on K3 visa from Philippines, I am ready to leave Manila when I got the information that I have my Immigrant visa interview set for February 18, 2009. We process both almost the same times, paid the fees and I was interviewed and granted a K3. So I entered states with my K3. Anybody can tell me what happen next? And we fax the embassy and we cancel my schedule interview there. We talk to embassy visa unit and they tell me, I can have options to use both visa. But now I'm here in the states, could I just apply for adjustments? Please anyone tell me.

It's easier and faster to process in Kuwait if she's your wife already, but since she's fiancee, better to process her K1 in Philippines. If her contract in Kuwait is finish, she doesn't need Police Clearance from Kuwait, only Police Certificates from places she live in Philippines and had live for more than 6 months and NBI clearances in all names she uses. I had a friend who process her Fiancee visa in kuwait and was denied twice.

I just checked my status on USCIS website like I do everyday, and found out that our I-129F got APPROVED!!!!!!!!!!!!!!

It only took us 65 days since NOA1!!!!
This is way earlier than what we expected, but I'm not complaining!!!!!!!!
I knew I had some good feeling about October...
It's 4 a.m. here and I should go back to sleep, but I'm too excited!!!!!
