And then once the assets are intermingled, presumably his, you would be good to go.

This may or may not apply to Canada.

Very Difficult

and then there is Nigeria.

Everything I have ever read about removal under section 265 of the INA indicates that in the abscence of other immigration violations, it has historically been reserved for offenders who were believed to be a risk to national security.

I'm Canadian and am with an American woman. We don't know where we will live after marriage.
We plan to work in Canada for 1 year to save money, and then go to school in USA for 2 years.
Is it possible to have best of both worlds having PR for each of us in each country?


PR has residency requirements that must be met otherwise the permanent residency can be lost. Canada is fairly lax, requiring you live in Canada 2 years out of a 5 year period. The USA is a little more complicated. As a general rule, an extended absence of more than 1 year requires that you obtain a reentry permit ahead of time, but there are a lot more discretionary factors involved. Successive extended trips outside the US increase the chance that USCIS will deny re-entry on the grounds that you have abandoned permanent residence.

Dual citizens of Canada and the USA do not have residency requirements to deal with and are free to remain outside of each country for as long as they like.

Hi everyone,

Now that I'm starting this process, something came up that I thought I would ask. One time when my fiance came out to visit me (I think it was two years ago?) the incompetent desk worker at LAX didn't take out the green tourist visa (I-94?) from his passport. When we got a letter from immigration telling him that he overstayed his visa, we found out it was due to this incident and immigration made it sound like it wasn't a big deal. We wrote a letter which explained what happened, submitted proof that he was indeed back in France (work signatures, pay stubs, receipts, etc.) everything seemed to be behind us. He's come several times since then and never had a problem.

I completely forgot about all that until I started filling out these forms. Since he technically was in the system as having overstayed his visitor's visa, even if it wasn't his fault and it all got cleared up, is there a chance that he will be flagged when I send in his petition?

Any thoughts or advice is helpful, thank you....


It sounds like you followed the correct procedure for documenting departure after the fact. Dated pay stubs are are on the list of evidence that USCIS accepts for this purpose.

It is illegal to enter the US with a tourist visa with the intention of getting married. People do it, but if they judge that you entered with the intent of marrying, it is fraud and they could ban you.

They focus on the Petitioner's Financial capability to support a potential wife and future family and then they focus on the Petitionee's Background to see if there would be Red Flags along the way. And then they focus on the Petitioner and the Petitionee's relationship during the interview process. That's just what I have observed in my case and may not be true for all.

Before or After the period both work but NOT DURING her period. She just have to take note of when was the last time she had her period because they ask this during the physical exam and if she has it regularly. They won't finish the physical exam if she has her period during the medical and they would ask her to go back after her period is over. Like what happened in my case, I was able to go through almost the whole thing when my period suddenly started that day probably because of stress and my being irregular. So the doctor just wrote a note that I should be back after my period is over to finish the rest of the medical exam.

Hello,
I receive good news through my email and it stated my I-129F - Petition for FIANCE visa is approve. So now what? What should I do now or what should my FIANCE in the philippines do?


Congrats to you and your fiance for completing the first step in your K1 visa journey. The next step would need lots of patience as it is the waiting period. Your petition will now be transferred to NVC where it will be processed and assigned a reference number (I don't quite remember but I think this is the MNL number) then sent to the US Embassy in Manila. The US Embassy will then send your fiance a notification advising him to schedule an interview. The letter would have instructions so you need not worry too much about it. Then while waiting for an interview, your fiance should have his medical examination done.

Oh! and don't forget to prepare all the necessary documents for his interview.

Questions that I remembered from my interview that wasn't mentioned on the other post:

1. What is your fiance's job?
2. How long has he been in the company? (I answered an estimate)
3. In what website did you meet? (Since I mentioned that we met in a gaming website's forum)
4. How many times has he visited you?
5. Did he meet your family during his visit?
6. How did your family react to him?

Then some questions were based on the evidence I brought like the pics and e-mail printouts and chat logs. These were trivial questions and is more like just having a friendly conversation with the CO. This was after the "formal" questions.

1. (Pointing at my fiance's picture) Is he the lucky one? :yes:
2. Where was this picture taken?
3. (On the email printout) Who is kitten? (I explained that kitten is one of his terms of endearment for me because of our age gap)

Then right after those questions, the CO said "Well, he should be happy now that you're getting your Visa" and he congratulated me and said Best Wishes. :)

My then-fiance (now husband) filed the I-129f right after his first visit. It got approved. Although, he visited me again for Christmas, USCIS did not learn of the 2nd visit until my interview at the embassy. That said, as long as you send in strong proofs that you met each other during the specified period, then the petition is most likely to be approved.

I also would like to say that the CO was so surprised that my fiance visited me again after a very short period of time and even joked about it. So I guess they do understand the "troubles" that go with travelling (e.g. financial constraints, work schedules, etc.). And for as long as you and your fiancee could show that you have a good relationship despite the distance, you would have a good chance of Visa approval.

As Inky mentioned, the photo is US passport size. When you go to any photo studio (in the Philippines), just say that it is US Passport size and they will know what to do.

As for the pictures together, we put them in a clear plastic and wrote the information about the photo (date taken, where)at the back of each.

NBI did announce a change in the way they are processing NBI Clearance now. In their Press Release, they even mentioned that they would not be processing anything until the new system is up. I think they had just resumed operations early July and may have backlogs that is why it would take them longer to process now.

This is the link to their news NBI news but it did not mention how the new system will cahnge the length of processing.

Bring as much as you can and as organized as you can. There's no such thing as too much. You'd rather have the document/evidence they need than be asked to return to submit additonal documents.

I suggest you use a clearbook where you can group documents together and easily see them. Also it would be a good idea if you can organize your photos (I did mine scrapbook style) so it would be easy for the CO to browse through them.

Hubby and I did ours together during one of his visits. We just read through all the USCIS instruction, discussed what needs to be done, prepared documents and he filed it as soon as he go back home to the US. And it's all good.

As long as you know that there are no complicating issues in your situation, the K-1 process is simple enough to do on your own. And VJ is a very good reference website, not to mention support group.

AOS means Adjustment Of Status and yeah it is for the Green Card. After your fiancee enters US, and you get married within 90 days of entry, you apply for AOS so she can get her conditional Permanent Resident status.

BTW, we also did K-1... our whole process from filing to interview took just 5 months (and we did it all by ourselves)... so even without a lawyer, depending on the Service Center handling your case, the process can take as short as 5 months! :yes: :yes:

Make photocopies of those and bring them and the original during the interview. They wouldn't take the original and even after AOS, I still have all the original documents from USCIS.

You might want to also add Letter of Intent to Marry because sometimes they ask for it during he interview, sometimes they don't. It's better to be prepared though.
